Abstract

This study aims to analyze the effectiveness of fulfilling children's rights in the judicial system of sexual violence crimes in Batam City, as well as to identify the challenges and realities faced during its implementation. The research method used is an empirical juridical approach, with data collected through in-depth interviews with law enforcement officials, including investigators and police in Batam City. The findings reveal that although comprehensive regulations exist, their implementation remains suboptimal due to limited human resources, insufficient child-friendly facilities, and ineffective inter-agency coordination. These barriers hinder the protection and recovery of child victims of sexual violence. The study also highlights the importance of applying the principles of Best Interests of the Child and the Restorative Justice approach to create a more child-friendly judicial system. Therefore, improvements in law enforcement training, strengthening inter-agency coordination, and developing facilities to support the recovery of child victims of sexual violence are urgently needed.

Abstract

The culture of “reciprocity” remains preserved and continues to serve as the foundation for the implementation of customary/Adat marriages among the indigenous Sea Tribe community in Lingga Regency. This study aims to strengthen cultural norms and regulatory frameworks, while also addressing the enforcement of such cultural practices. Employing an empirical legal approach, the study found that the practice of reciprocity conflicts with the prevailing national marriage law. Specifically, due to imbalances in social obligations, the Sea Tribe community often carries out child marriages based on custom without obtaining a court-issued marriage dispensation, as legally required. Furthermore, the Sea Tribe can no longer be classified as an Adat law community, as it no longer meets the criteria; instead, it should be regarded as a customary community that remains subject to national law. Drawing on Satjipto Rahardjo’s Theory of Legal Compliance, the study identifies three key factors contributing to the community’s non-compliance with marriage law: the lack of proper legal indoctrination, entrenched collective habits, and a limited understanding of the benefits of legal obedience. Consequently, the continued application of the reciprocity culture results in violations of children’s rights to health and education within the community. In light of Mochtar Kusumaatmadja’s Theory of Development Law, this study underscores the need for marriage law to more effectively govern the practices of the Sea Tribe community.

Abstract

Early marriage remains a significant social issue in Indonesia, particularly in Batam City, despite legal regulations setting the minimum marriage age at 19. This study evaluates the effectiveness of the Batam City Government's role in reducing early marriage rates, identifies obstacles, and proposes solutions. Using an empirical legal approach, data were collected through observations at the UPTD for Women and Children Protection (PPA) and the Population and Civil Registration Office, along with secondary sources such as legal documents and reports. Findings reveal that economic pressures, cultural norms, lack of education, and limited reproductive health awareness contribute to persistent early marriages. From 2019 to 2024, Batam recorded 119 early marriage cases, with economic hardship and premarital pregnancies as primary drivers. The government faces challenges, including weak community adherence to legal standards, insufficient coordination among agencies, and resistance from traditional leaders. Proposed solutions include intensifying public education campaigns, integrating reproductive health into school curricula, providing economic support for low-income families, and enhancing parental guidance programs. Strengthening inter-agency collaboration and conducting regular program evaluations are also critical. This study highlights the need for a comprehensive, multi-stakeholder approach to effectively reduce early marriage rates, ensuring better protection of children's rights and long-term societal well-being.

Abstract

Indonesia is a country that has the objective of ensuring the welfare of its citizens. One effective way to achieve prosperity for its citizens is by implementing excellent public services, especially when it comes to the fulfillment of rights concerning the legalization of public documents. Therefore, this study is aimed to analyze the application of the Apostille convention in the legalization of public documents, and to investigate the changes in the law of public services related to the legalization of documents after the Apostille enactment. This legal study is categorized as a type of doctrinal analysis. Specifically, it is descriptive and analytical. Juridical and theoretical foundations were used for data analysis and the theoretical basis employed was the Theory of Legal Reform. The finding is consistent with the principles of the Legal Reform Theory. Legalization of public documents has undergone legal reform because legalization of public documents can be done online and in a short time. This shows that law, as a means of reform, has been realized because it has met the needs of society for the public. Despite the enhancement of public services, several aspects require careful consideration and improvement. This includes establishing effective cooperation with the Regional Office of Law and Human Rights, which acted as a liaison for Apostille services at the regional level. Additionally, the Regional Office of Law and Human Rights assume a pivotal role in overseeing the printing of certificates to ensure accessibility for the public.

Abstract

Geographical Indications play a crucial role as an intellectual property regime that protects unique products originating from specific regions, shaped by both human and natural factors. The presence of natural factors makes Geographical Indications a potential tool for strengthening local economies while simultaneously protecting the environment. This study aims to analyze the potential utilization of the Geographical Indications regime in Indonesia to support sustainable development, particularly in relation to environmental protection. Employing a normative legal research method supported by a statutory approach, this study examines the connection between Geographical Indications and environmental protection. The analysis reveals that despite the conceptual link between Geographical Indications and environmental sustainability, there is no normative legal support within the existing regulatory framework governing Geographical Indications. A normative construction model is proposed to facilitate the integration of environmental protection into the Geographical Indications regime, emphasizing aspects of planning, utilization, supervision, maintenance, control, and law enforcement.

Abstract

Penelitian ini bertujuan untuk mengidentifikasi dan menganalisis kesenjangan antara regulasi dan implementasi hukum dalam memberikan perlindungan terhadap korban kekerasan seksual di lingkungan pondok pesantren. Fenomena kekerasan seksual di pesantren menunjukkan adanya ketidaksesuaian antara norma hukum yang berlaku dengan praktik di lapangan. Meskipun telah tersedia sejumlah regulasi seperti Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual dan Peraturan Menteri Agama Nomor 73 Tahun 2022, pelaksanaannya masih menghadapi banyak kendala. Penelitian ini menggunakan pendekatan yuridis-normatif dan teori legal positivism sebagai dasar analisis. Temuan utama menunjukkan lemahnya pengawasan eksternal, tidak adanya mekanisme pengaduan yang aman, dominasi struktur hierarkis, serta rendahnya literasi hukum sebagai faktor penghambat perlindungan korban. Penelitian ini menawarkan rekomendasi berupa penguatan Standar Operasional Prosedur berbasis korban, pembentukan pengawasan independen, dan pelatihan bagi aparat hukum dan pengelola pesantren. Implikasi dari hasil penelitian ini diharapkan dapat mendorong reformasi kebijakan dan penguatan sistem hukum dalam lembaga pendidikan keagamaan.

Abstract

Public service is a way to realize a prosperous country. Notaries are officials who provide public services in the field of legal services for the community. The role of notaries is very important in providing legal certainty. The purpose of this study is to analyze notary services in the Riau Islands Province and the role of the supervisory board in supervising the performance of notaries. The method in this study is empirical juridical. In answering the problem in this study, the legal basis namely Law Number 2 of 2014 Concerning the Position of Notary and theoretical basis is used, namely the theory of legal certainty by Hans Kelsen and legal protection theory by Philipus M. Hadjon. The results of the study show that notary services still face various problems, especially in the Batam City area. However, there still needs to be synergy between regional and central supervisors in taking firm action against notaries who do not provide good public services. The role of regional supervisors in providing guidance to notaries is expected to provide preventive and repressive protection. The preventive role can be carried out through guidance and repressive can be carried out with the active role of supervisors at the central level in providing sanctions for permanent dismissal based on recommendations from the supervisory board at the regional level.

Abstract

Human trafficking remains a major humanitarian crime problem worldwide. Indonesia has made efforts to combat human trafficking by establishing various regulations that serve as the main foundation in this fight, one of which is Law No. 21 of 2007. The framers of the law used the Palermo Protocol as the foundation for its creation. As a transnational crime, human trafficking has also prompted ASEAN, as a regional organization, to take a stand. Since the 1990s, ASEAN has included human trafficking in its agenda to be collectively eradicated. However, human trafficking practices in Indonesia and ASEAN continue to increase, with various methods of operation. Unfortunately, the majority of the victims of this crime are women and children. This article aims to examine the formalization of national law and ASEAN's role at the regional level in combating human trafficking within the framework of international law. This research employs a normative legal approach. The findings indicate a disconnection between national regulations and the fundamental norms upon which they were based, as well as disharmony with other national regulations. Meanwhile, in the ASEAN context, the formation of hard law has not yet been fully implemented, a situation further compounded by the rigid principle of non-intervention in ASEAN.

Abstract

This research explores the policies of the Batam City Regional Government in the context of protecting and fulfilling rights of children and women against acts of discrimination. Focus on the effectiveness  policy and its implementation barriers, this study uses a qualitative approach to investigate the concrete impact  protected rights. Batam City, as an economic and industrial center, faces complex dynamics in facing the challenges of protecting the rights of children and women.  Research highlights  relevance and urgency of handling issues in regional policies.  Global and national context demonstrates the need for effective and well-implemented policies.  detailing the problem, study raises two key questions: first, this study wants to thoroughly discuss the extent of the effectiveness of policies in protecting children's and women's rights from discrimination, and second, what are the main obstacles that hinder policy implementation This type research uses empirical legal research with an approach to legislation and empirical. The findings study provide in-depth insights into implementation of the policy and impact on desired rights. This analysis highlights the complexity of social and cultural dynamics in Batam City that affect policy effectiveness. The results of this study are expected  provide  better understanding the problem of protecting the rights of children and women, provide concrete recommendations for policy improvement, and stimulate the development of further research in this field.  summarizing the findings and providing recommendations, this study has the potential to make  significant contribution to the understanding and implementation policies to protect the rights of children and women regional level.

Abstract

Penelitian ini mengkaji permasalahan hukum terkait efektivitas penerapan Peraturan Menteri Keuangan (PMK) No. 96 Tahun 2023 jo. PMK No. 111 Tahun 2023 terhadap perkembangan UMKM di Kota Batam yang berstatus sebagai Kawasan Perdagangan Bebas dan Pelabuhan Bebas. Permasalahan utama yang diteliti adalah adanya ketidaksesuaian antara tujuan kebijakan yaitu melindungi industri dalam negeri dan mendorong produk lokal dengan dampak implementasinya yang justru dirasakan memberatkan oleh sebagian pelaku UMKM, khususnya yang mengandalkan barang impor dan bahan baku impor. Penelitian ini bertujuan untuk mengevaluasi sejauh mana regulasi tersebut mendukung keberlangsungan dan daya saing UMKM. Menggunakan metode penelitian hukum empiris, data diperoleh melalui wawancara, observasi, dan dokumentasi, serta dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa meskipun kebijakan ini memberikan keuntungan bagi UMKM berbasis produk lokal, seperti pembebasan bea masuk dan dukungan ekspor, pelaku usaha yang bergantung pada barang impor dan bahan baku impor mengalami penurunan omset dan peningkatan beban administrasi. Efektivitas kebijakan ini masih bersifat parsial dan perlu ditingkatkan melalui penyederhanaan regulasi, peningkatan literasi hukum, serta insentif yang inklusif. Dengan pendekatan yang lebih adaptif dan kolaboratif, kebijakan ini diharapkan dapat menciptakan ekosistem usaha yang adil, kompetitif, dan berkelanjutan di wilayah Batam.
