Abstract

Child marriage is one of the issues that occurred in Indonesia, especially in the Sea Tribe (Suku Laut) community in Lipan Island, Lingga Regency of the Riau Islands Province. Indonesia has a regulation that governs child protection and marriage. This study aimed at, firstly, analyzing the effectiveness of implementing laws on marriage in the Sea Tribe people in Lipan Island. Secondly, it aimed at analysing the impacts of the child marriage practices. The method used in this study was an empirical legal research. The source of data was derived from primary and secondary data. Two (2) legal theories were adopted to analyse the research problems were the Legal Effectiveness Theory by Soerjono Soekanto and the Theory of Legal Protection by Muchsin. The result showed that the implementation of laws on marriage was not effective. The impact caused by a child marriage is the violation of children’s rights in the health and education sectors. Therefore, a revision against Law Number 16 of 2019 concerning Marriage is required, in addition to the improvement of education educational quality for Sea Tribe people in Lipan Island.

Abstract

Negara Indonesia merupakan negara yang menjunjung tinggi hak asasi manusia. Perlindungan terhadap hak asasi manusia merupakan sebuah kewajiban bagi Pemerintah Indonesia. Perlindungan tersebut diberikan juga kepada penyandang disabilitas fisik. Indonesia telah memiliki seperangkat hukum yang memberikan perlindungan mengenai hak bekerja bagi penyandang disabilitas namun pada kenyataannya, Indonesia masih menghadapi problematika dalam pemenuhan hak tersebut termasuk pemerintah Kota Batam menghadapi problematika dalam memenuhi hak bekerja bagi penyandang disabilitas.  Tujuan dari penelitian ini adalah untuk mengetahui pemenuhan hak bekerja bagi penyandang disabilitas dan tantangan yang mereka hadapi. Metode penelitian yang digunakan adalah pendekatan sosiologis yuridis. Teknik penelitian yang dilakukan adalah wawancara. Teori hukum yang digunakan dalam menganalisis penelitian ini adalah Teori Efektivitas Hukum oleh Soejono Soekanto dan Teori Keadilan Hukum oleh Jhon Rawls. Hasil penelitian menyatakan bahwa pemenuhan hak bekerja bagi penyandang disabilitas fisik di Kota Batam belum efektif dengan beberapa tantangan yaitu lemahnya peraturan di daerah Kota Batam dan lemahnya kemampuan yang mereka miliki.

Abstract

In Indonesia various efforts were made to preserve the sovereignity of Rupiah as well as improving national and international trust in Rupiah. One of them is the implementation of regulation that obligates the use of Rupiah in all transactions that occur in Republic of Indonesia. However, there are some exception which allows the use of foreign currency in the country to a certain limit. This study is a normative method based on secondary data collected from literatures (library research) and analytic method of qualitative data. This study will discuss the use of foreign currency as a payment medium in the Republic of Indonesia and their consequences as stated in Undang – Undang Nomor 7 Tahun 2011 tentang Mata Uang and its validity as evidence in the court of justice. Based on this study, we observe results from 2 (two) problem formulations. First, the use of foreign currency as payment medium in transactions that occur in the Republic of Indonesia is allowed but only under certain condition and limited based on exception regulation to the use of Rupiah in the Territory of the Republic of Indonesia and the violations of the use of foreign currency by Undang – Undang Nomor 7 Tahun 2011 tentang Mata Uang have legal consequences on criminal sanctions. Second, invoices or documents of transactions using foreign currency when performed based regulations can be evidence, however, if invoices or documents based from illegal agreement or contract that breaking the law accordingly become void from the start.

Abstract

The Act No. 1 year 1974 concerning Marriage was born as government efforts to do legal unification for resolve legal uncertainty about marriage problems. One of which is indigenous people of Indonesia is Suku Anak Dalam who still implement their customary marriage law and rule out Act No. 1 year 1974 concerning Marriage has been positive law in Indonesia. Research methodology used is law research method juridical normative, the data that used is in the form of secondary data, which consist of both primary and secondary legal materials. The author collecting the data by doing library research. Once all the data is collected, the data then processed and analyzed. The qualitative method was used to group the data point by the studied aspects. Further conclusions drawn related to this study, then describe descriptively. Based on the result of research that has been done, there are some significant differences in Suku Anak Dalam customary marriage law with legal provisions on Act No. 1 year 1974 concerning Marriage. Then, Suku Anak Dalam customary marriage law although recognized based on Indonesia laws, however communities that runned customary law also must implement Act No. 1 year 1974 concerning Marriage. Need a law harmonization between customary law especially Suku Anak Dalam customary law with Act No. 1 year 1974 concerning Marriage.

Abstract

The purpose of this study is to describe clearly about the rights of Indonesia migrant workers who work in Malaysia. Indonesia is the largest migrant-sending countries in ASEAN and the largest migrant-receiving countries of Indonesia in ASEAN is Malaysia. Indonesia itself as a migrant-sending countries already has regulations that governing the protection of the rights of migrant workers working abroad, namely in the Constitution of 1945 set in general on the rights of migrant workers, and more specifically regulates the protection of the rights of Indonesian migrant workers abroad, namely in Law No. 39 of 2004. Malaysia itself also has regulations that governing the protection of migrant workers, namely the 1955 Employment Act. This research is a normative law by using the method of comparative law. The data used in the form of primary and secondary data. Performed with data mining literature (library research). Once all the data is collected both primary data and secondary data, the data is then processed and analyzed, the qualitative analysis was used to group the data point by the studied aspects. Further conclusions drawn related to this study, then described descriptively. Based on the results of this research, Regulations in Indonesia and Malaysia that governs the protection of the rights of migrant workers who work abroad have not been effective in terms of both rules substance and implementation. Memorandum of Understanding (MoU) governing labor migration between the two countries (Malaysia and Indonesia) in 1998 and signed another one on May 10, 2004. MOU made by the two countries also contains many weaknesses in this MOU are not regulated at all about the migrant workers who work at home and have not been effective in protecting the rights of migrant workers.

Abstract

Work agreements has substantial benefits to the parties. This should be realized because a work agreement created and adhered to properly will be able to create a job of peace and guarantee the certainty of rights and obligations for both workers and employers. The problem in this research is that there are still violations committed by the entrepreneur, Lim Siang Huat Group to the workers regarding the provision of certain time work agreement that is not in accordance with Act Number 13 Year 2003 on Manpower. The type of research used by the author is empirical law research, then the type of data used is Primary Data as the main data and Secondary Data as supporting data. Primary data used by the author in the form of observation and interviews at the Disnaker Batam Office, and of course Lim Siang Huat Group which is the focus on this research. Based on the results of this study it can be concluded that there are still violations committed by the entrepreneur, Lim Siang Huat Group against workers regarding the provisions of work agreement for a specified time not in accordance with Article 59 of Act Number 13 Year 2003 on Manpower. Based on that article, if there is any violation, a work agreement for a specified time by law shall be changed into a work agreement for an unspecified time.

Abstract

Batam is rapidly developed nowadays. There are factors that might effect the growth. The effort of promoting tourism and cultural programs, and the envolvement of tourism parties, are made to attract more tourists to visit Batam. However, beside the growth of tourisms itself, the government and responsible parties are laxing to provide and maintain good facilities for tourists. Because, tourist has their own right as a tourist, which is regulated in Undang-Undang Republik Indonesia Number 8 Year 2016 about Person with Disabilities, and it is called the cultural and tourism rights. Therefore, this dissertation is aimed to find out about the tourist visits potency in Batam, and to find out about what’s the real obstacles, faced by both people with disability (phiysically) and the government, due to the effort of fulfilling cultural and tourism rights. The writer is using the empirical method in analyzing the collected data, where the data itself was collected while doing the interview or observation. Then, the writer describe the matters in tie with regulations. By then, it can be seen that the tourism potency of Batam is great, but unfortunately, data lacking toward disabilities show that the government has not yet put the issue in the first place. The problems is now remain unidentified as the data was out of record. So, the government efforts in the future with both tourism business field persons and nearby community is now concerned and hopefully can improve the quality of accessibilities that has been built, in progress, or will be built in the future.

Abstract

This undergraduate final project criticizes about the post nuptial agreement, where before the decision of the Constitutional Court Number 69/PUU-XIII/2015 the marriage agreement can only be made before the marriage takes place. The purpose of this study is to determine the legal consequences of making a marriage agreement after marriage and the legal protection against third parties. This research is legal research with normative method, that is literature study and supported by interview result as supporting data. The data has been collected and then processed and analyzed, then prepared and described descriptively by taking conclusions from the results of data analysis. The results obtained from this study are the post-marriage agreement applicable to the parties making the marriage agreement and related third parties, as a result of the law arising out of the marriage agreement after marriage. Third parties must obtain legal protection in all matters related to the marriage agreement after marriage through preventive and repressive action.

Abstract

Law Number 32 of 2009 concerning Environmental Protection and Management is an important legal instrument in the aspect of environmental protection and management which is then manifested by the Batam City Government and related policy stakeholders in the form of legal products, namely Batam City Regional Regulation Number 4 of 2016 concerning Protection and Management of the Environment and Batam City Regional Regulation Number 4 of 2017 concerning the Implementation of Regional Health which is the commitment of the Batam City Government and related policy makers to protect, protect and preserve the environment so that it can become a good and healthy. For research in this writing, using normative research methods, which are based on written regulations, literature study that examines aspects of theory, as well as legal explanations. And the results of this study indicate that Regional Regulations related to Environmental Protection and Management as well as Health Implementation This community can encourage the achievement of the Suistainable Development Goals (SDGs).
