Abstract

Basically, ulayat land is a ulayat right for customary law communities,which according to customary law ulayat rights can only be owned together, usedtogether and used together. ulayat land may not be owned individually, becausebasically ulayat land cannot be sold, given, or pawned to anyone. However, inreality there are cases of selling ulayat land of the Malay Datuk Mudo by thenephew of the Malay tribe of Datuk Mudo. The purpose of writing: first : to findout the regulation regarding the transfer of ulayat rights of the Malay DatukMudo indigenous peoples according to customary law. Second : knowing how toresolve disputes over customary land of the Malay Datuk Mudo tribe according tocustomary law. This type of research can be classified in the type of sociologicalresearch. This research was conducted in Sei Jernih Hamlet, Pasir SialangVillage, Bangkinang District, Kampar Regency. The population and sample arethe parties related to the problems studied by the authors in this study. Collectingdata by interview method and library study.From the results of the research problem there are two main things thatcan be concluded. First: The ownership of customary land rights for the MalayDatuk Mudo indigenous peoples basically cannot be transferred or traded, ormortgaged, which has been explained by ninik mamak based on existingcustomary law regulations or based on national regulations that have been set. bythe Kampar Regency Government. Except based on the conditions and coercion ofthe customary leader through consultation with traditional officials, religiousscholars, and ninik mamak. Second: The dispute resolution carried out in thisstudy has reached the point of deliberation and consensus. In which thisdeliberation was carried out with traditional officials, ninik mamak, religiousscholars, government and the indigenous Malay tribal community, Datuk Mudo.However, the dispute over the customary land of the Datuk Mudo Malay tribe inKampar Regency has not been resolved.Key words: Transfer of ulayat rights- ulayat land

Abstract

Auction activities are sales that of er lower or lower prices. The definitionof auction in Article 1 point 1 PMK Number 213/PMK.06/2020 concerningAuction Implementation Instructions: “An auction is a sale of goods that are opento the public with a written and/or verbal price of er that is increasing ordecreasing to reach the highest price, preceded by the announcement of theauction”. This study aims to find out how the procedure for implementingmortgage auctions is carried out and to find out the obstacles in the process ofimplementing mortgage auctions at the Pekanbaru State Property and AuctionService Of ice. The type of research used is Sociological Law research, Sociologicalresearch with primary and secondary data types using qualitative data analysistechniques. The results of this study are first to find out the auction procedure formaterial guarantees that have been tied with mortgages as part of the executionof debt guarantees by a creditor who has been guaranteed by the debtor andinstalled Mortgage by the creditor. Second, to find out and analyze the Obstaclesin the Implementation of the Auction of Mortgage Objects Based on PMK Number213/PMK.06/2020 concerning Instructions for the Implementation of Auctions. Suggestions that the author can give in this research: Firstly, PekanbaruKPKNL and Auction Of icials in carrying out auctions can verify more carefullythe object to be executed. Comprehensive initial verification in terms of theprocess that has carried out the imposition of mortgage rights by creditors canminimize pre-auction and post-auction problems. The two Parties to thePekanbaru State Property and Auction Service Of ice suggest that the bankingsector be more careful in making mortgage auction announcements in order toanticipate unwanted events that can cause losses to the banking sector

Abstract

Pekanbaru City Regional Regulation Number 10 of 2006 concerning Water Resourcesand Infiltration Wells Article 19 paragraph (1) stipulates "Every applicant for a Building Permitis required to plan and construct infiltration wells. Making infiltration wells is the developer'sobligation in housing areas in Tangkerang Labuai Village, but based on facts on the ground, 20housing estates in Tangkerang Labuai Village do not build infiltration wells. The purpose of thisresearch is to find out; first, Implementation of Infiltration Well Development Based onPekanbaru City Regional Regulation Number 10 of 2006 concerning Water Resources andInfiltration Wells in Tangkerang Labuai Village, Pekanbaru City, second, inhibiting factors forImplementation of Infiltration Well Development Based on Pekanbaru City Regional RegulationNumber 10 of 2006 concerning Water Resources and Infiltration Wells in Tangkerang LabuaiVillage, Pekanbaru City, thirdly, efforts to maximize the implementation of making infiltrationwells based on Pekanbaru City Regulation Number 10 of 2006 concerning Water Resources andInfiltration Wells in Tangkerang Labuai Village, Pekanbaru City.The type of legal research used by the author is sociological legal research. In thissociological study the authors took primary data and secondary data with the population andsamples, namely the Office of Investment and One Stop Integrated Services (DPMPTSP)Pekanbaru City, Public Works and Spatial Planning (PUPR) Pekanbaru City, HousingDevelopers in Tangkerang Labuai Village, Practitioners Pekanbaru City Planning, Secretary ofthe Lurah of Tangkerang Labuai Village, Head of RW in Tangkerang Labuai Village andresidents of housing in Tangkerang Labuai Village.Based on the results of this study, it can be concluded that the Implementation of MakingInfiltration Wells Based on Pekanbaru City Regulation Number 10 of 2006 concerning WaterResources and Infiltration Wells in Tangkerang Labuai Village, Pekanbaru City does not work atall. Abstract

This study aims to determine the implementation of the Lend-UseAgreement between the first party and the second party, and efforts to resolvedisputes in the Lend-Use Agreement between the first party and the second partybased on civil law. This research is useful theoretically and practically. The typeof research is sociological juridical law research. Based on the results of the study,it was shown that the implementation of the Lend-Use Agreement between theFirst Party and the Second Party was carried out verbally with the object of theagreement being foodcrop land. In the agreement, it was agreed that the mainprovisions were that the Second Party was only allowed to plant foodcrops. Theagreement that has been made above has explained the existence of the partiesrelated to the rights and obligations of each party, on that basis the agreement thathas been made between the two parties has fulfilled the legal requirements of theagreement as stipulated in Article 1320 of the Indonesian Civil Code. However, inits implementation, the Second Party does not follow the agreement that has beenmade, resulting in a default. The settlement of disputes between the first party andthe second party in the Lend-Use Agreement in Berumbung Baru Village, DayunDistrict, Siak Regency has been carried out through non-litigation and litigation.However, these efforts could not solve the problem. The inhibiting factors forresolving land-borrowing disputes through mediation and litigation are notresolved because there is no goodwill from the Second Party, and this causes theproblems that have occurred to date have not been resolved.Keywords: Dispute - Agreement - Lend Use Agreement - Private Law

Abstract

Dispute resolution as mediationhas been known since the first inIndonesia because of the customssystem in resolving a case alwaysuphold discussion and consensusthrough traditional forums ofeach region in Indonesia. As itgrows by time, this is enforced inthe court (Court ConnectedMediation) as form of justice law.However, mediation process incourt has to be enforced throughthe civil dispute resolution. Ifmediation as set forth in SupremeCourt Rule No. 1 of 2008, ifmediation is not implemented, thejudgment will be omitted for lawpurpose.

Abstract

This research related to the analysis of the decision of the judge of the Siak District court incivil case number 37/Pdt.G/2018/PN.Sak regarding the determination of compensation fordevelopment in the public interest. Based on this decision, there are many things that need to bestudied because they are not in accordance with the provisions of existing laws an regulations.Therefore, it is necessary to study stimulatively the first consideration of the judge in the decision ofthe Siak District court in civil case number 37/Pdt.G/2018/PN.Sak regarding the determination ofcompensation for development for the public interest.. Second, the suitability of the judge’s decisionto the theory of justice according to the Siak district court in civil case number 37/Pdt.G/2018/PN.Sakregarding the determination of compensation for development in the public interest.

Abstract

Ninik mamak bertanggung jawab terhadap permasalahan yang terjadi dalam masyarakat. Termasuk juga harta pusaka yang dimiliki oleh kaumnya (tanah) Dalam hal ini dikatakan sebagai kewajiban penghulu, seperti kata pepatah: “kusuik manyalasaikan, karuah mampajaniah. Dalam adat Minangkabau dengan menempatkan pemangku adat sebagai pelaksana dari kebenaran yang memposisikan musyawarah mufakat. Keadaan sekarang peran dan tanggung jawab ninik mamak dan peradilan adat sudah mulai di abaikan dan mengandalkan hukum nasional, hal ini dilakukan beberapa pihak untuk mendapat kekuatan hukum. Adapun tujuan pertama Untuk mengetahui peran ninik mamak dalam menyelesaikan sengketa tanah ulayat menurut hukum adat, kedua Untuk mengetahui faktor penyebab terjadinya pergeseran peran ninik mamak dalam menyelesaikan sengketa tanah ulayat di Nagari Koto Tangah Kecamatan Tilatang Kamang Kabupaten Agam, ketiga Untuk mengetahui upaya agar peran ninik mamak hidup kembali dalam menyelesaikan sengketa tanah ulayat berdasarkan hukum adat yang berlaku di Nagari Koto Tangah Kecamatan Tilatang Kamang Kabupaten Agam. Metode   yang   digunakan   pada penelitian   ini   adalah   metode   kualitatif   dengan   pendekatan deskriptif. Hasil  dari  penelitian  yaitu Peran Ninik Mamak dalam Menyelesaikan Sengketa Tanah Ulayat berdasarkan Hukum Adat telah bergeser karena salah satu pihak tidak mengikuti adat Minangkabau sesuai dengan azas bajanjang naiak batanggo turun dan menggugat ke pengadilan untuk mendapatkan ketetapan hukum sehingga peran ninik mamak di sini diabaikan.

Abstract

Same-ethnic marriage is a ban on marriage in the indigenous people of Tambak Village,Langgam District. This is because the customary law system views same-ethnic marriages asmarriages that occur within one family or one breastfeeding. The indigenous people of Tambak,Langgam District, are still guided by the fatwas from their ancestors. So in this case the indigenouspeople in Tambak Village, Langgam District, still prohibit same-tribe marriage. The purpose of thisthesis research is first, the factors that cause same-tribal marriage in indigenous peoples in TambakVillage, Langgam District, Pelalawan Regency. Second, settlement of violations of the prohibitionon same-tribal marriages committed by traditional leaders in the indigenous people of TambakVillage, Langgam District, Pelalawan Regency.This type of research can be classified into the type of sociological juridical research. Withthe research location in Tambak Village, Langgam District, Pelalawan Regency. While thepopulation and sample are parties related to the problem under study. This study used primary datasources and secondary data and data collection techniques were carried out by means of interviewsand literature review.The results of the research conducted by the author are, First, the causes of one-tribemarriage in indigenous peoples in Tambak Village, Langgam District, Pelalawan Regency arecaused by a lack of understanding of customs and tribes in Tambak Village, Langgam District,Pelalawan Regency; decreased public compliance; Affection and mutual love; law is defeated bytime; Because in Islamic law there are no rules governing the prohibition of same-ethnic marriages.Second, the settlement of violations of the prohibition on same-tribal marriages perpetrated bytraditional leaders in the indigenous people of Tambak Village, Langgam District, PelalawanRegency can be carried out by means of the customary leader (datuk shoot inner/penghulu) carryingout clarification of couples who violate customary same-tribal marriages; listen to explanations orclarifications by perpetrators of ethnic marriage offenders; customary leaders will deliberate toreach a consensus/decision; after finding a consensus, the traditional leader conveys the customarysayings and inner shoots conveys their attitudes and decisions; sanctions for violators of sameethnic marriages, namely expulsion from the village; if the violator asks for forgiveness, he must pay1 (one) buffalo along with other equipment; paying customary fines by feeding 1 (one) Nagari; ifthe customary fine has been paid, the offender of the same ethnic marriage has been reinstated. Abstract

Indigenous peoples still use their customary laws in resolving crimes andviolations that occur in customary areas, especially crimes in theft that occur incustomary forbidden forests. The purpose of writing this thesis is first, to find outthe role of the tribal chief in maintaining the existence of customary law againstcrimes of theft in the imbo putui customary forest, Petapahan Village, TapungDistrict, Kampar Regency. Second, how is the application of customary sanctionsagainst crimes of theft in the customary forest of Imbo Putui, Petapahan Village,Tapung District, Kampar Regency.This type of research uses sociological or empirical legal researchmethods. This research was conducted in Petapahan Village, Tapung District,Kampar Regency, Riau Province. While the population and sample are all partiesrelated to the problems studied in this study, the data sources used are primarydata, secondary data and tertiary data, data collection techniques in this studyare interviews and document studies.The results of this study indicate that the important role of the tribal chiefis in maintaining the existence of customary law against crimes of theft incustomary forests and the application of customary sanctions against crimes oftheft in Imbo Putui customary forests because the perpetrators of theft assumethat the forest belongs to all people who know the forest, so the perpetrators donot know the customary law that applies in the area of the indigenous people ofPetapahan Village. The author's suggestion is for the nagari government and itsinstruments to improve oversight of the customary prohibition forest and makenagari regulations that regulate all categories of theft, so that not only timbertheft but everything that can be said to be theft is regulated in the nagariregulations and work together with local government authorities to conductoutreach to the community, so that the community knows that customary law inPetapahan Village still exists today and will not fade with the times.Keywords: The Role of the Head of the Tribe - Customary Law - ForestProhibition of Customs - Theft

Abstract

Geographical Indications are part of Intellectual Property which is the main drivingfactor for a country's economic development. This Geographical Indication Protection Objectincludes Natural Resources, handicraft products, industrial products owned by an area but notowned by other regions in the Territory of the Unitary State of the Republic of Indonesia. Thistype of protection for Geographical Indications has the peculiarity of other IntellectualProperty Rights Protection, which is characterized by communal ownership and usuallyidentifies the area as its trademark. In writing this thesis, the author tries to examine the Socio-Economic Influence on the Protection of the Rights of Geographical Indications of SumatraLintong Arabica Coffee.The objectives of writing this thesis are: first, to find out the Socio-Economic Effects inProtecting the Rights of Geographical Indications of Sumatra Lintong Arabica Coffee inHumbang Hasundutan Regency. Second, to find out the Efforts That Can Be Taken in Obtainingthe Protection of the Rights of Geographical Indications. The research method in this thesisuses a type of sociological legal research, namely research on the effectiveness of laws that livein society. The nature of this thesis research is research descriptive which describessystematically, the facts and characteristics of the object studied appropriately. The data sourceused is the data source first, seconds and tertiary, the data collection technique in this studywas by interview method, and literature review, then after the data was collected, it was thenanalysed to draw conclusions.Based on the results of the research, the first conclusion can be drawn. The socio-economic impact that occurred on the coffee farmers of the Sumatran Lintong Arabica CoffeeObserver Community (maspekal) as the owner of the right to the geographical indication ofSumatera Lintong arabica coffee is a change in people's lives from previously woodendwellings to semi-permanent and permanent, changes to agricultural management frompreviously only simple tools and using machine tools to help improve farming care and yields,especially coffee. Second, violations committed intentionally and unintentionally must bepursued by legal remedies to prevent further losses to the Sumatra Lintong Arabica CoffeeObserver Community in accordance with Law Number 20 of 2016 concerning Marks andGeographical Indications.Keywords: Geographical Indication-Legal Protection-Legal Remedies.
