Abstract

Acquisition of land rights can only be obtained through registration of land rights with the BPN, as the state institution authorized to issue land rights certificates. Then based on the provisions in the UUPA, for foreign companies that have representatives in Indonesia can only have the Right of Use as a form of ownership of land rights. Thus, the research objectives of this Researcher's thesis are first how the status of land rights along Jalan Gatot Subroto Dumai City and second how the settlement of land rights disputes between the government and the community along Jalan Gatot Subroto Dumai City. The type of legal research used is sociological juridical legal research, with research locations in Bangsal Aceh Village and Mekar Sari Village. The population and samples in this study are the parties related to the problem under study. This research uses primary data sources and secondary data and data collection techniques are carried out by means of interviews and studies. From the results of the research, the status of the land/land concession of PT. CPI is still unclear because the maintenance of land registration data cannot be carried out. Therefore, whatever dispute resolution efforts the parties choose in resolving land disputes, in this case mediation, the mediator must be neutral to be able to produce fair agreements for the parties.

Abstract

The confiscation of a fiduciary object by the state due to an unlawful act is considered negligence by the fiduciary and the fiduciary must be held responsible. As happened in the Civil Lawsuit Decision Number 142/Pdt.G/2021/PN Pbr, where the party receiving the fiduciary tried to defend his rights because the object which was the object of the fiduciary guarantee was confiscated by the state due to the negligence of the fiduciary giver. The preferential right of the fiduciary recipient here becomes questionable when the object that is the object of the fiduciary guarantee is no longer in the hands of the debtor because the object is confiscated by the state. However, the confiscation of the object that is the object of the fiduciary guarantee here does not make the fiduciary guarantee invalid/destroyed, the fiduciary giver still has to resolve the default against the party receiving the fiduciary. The author aims to analyze how the position of the fiduciary recipient, namely as a preferred creditor, and the material rights owned by the fiduciary recipient are linked when the object that is the object of the fiduciary guarantee is confiscated by the state. Apart from that, the author also examines the process of resolving defaults when objects that are the object of collateral are confiscated by the state. The conclusions obtained from the results of this research are first, the creditor, in this case PT MCF, has material rights so it is classified as a preferred creditor. The priority right in question is the right of the fiduciary recipient to collect the receivables for the proceeds from the execution of the object that is the object of the fiduciary guarantee. The preferred position of creditors is obtained, among other things, if they have material rights. Second, negligence regarding collateral objects is the debtor's responsibility. The creditor, namely PT MCF, who felt aggrieved as a result of the debtor's actions, submitted a request to the presiding judge at the trial examining the criminal case. Then, of course, the person being sued is the debtor as the provider of the fiduciary guarantee. The PT finally filed a lawsuit at the Bangkinang District Court which ended with a deed of peace stating that the collateral object would be returned to the creditor and auctioned off as repayment of the debtor's debt.

Abstract

CV. Raphita Muda Berkarya, where there are four of its twelve workers, is known to have not been registered in the BPJS Employment program. The non-registration of each worker as a participant in the BPJS Employment program has harmed each individual worker because they do not get what they are entitled to as workers if in the future there is a work accident or unwanted things. This makes labor rights not fulfilled to the maximum. This situation is further exacerbated by the outbreak of the Covid-19 pandemic which has a major impact on Furthermore, this study aims to determine the fulfillment of BPJS Employment rights to workers and the efforts taken by workers. This research will be structured using the type of empirical juridical research, namely analyzing a problem that is correlated or connected with the current laws and regulations. This research is descriptive in nature to provide symptoms, facts or events in a systematic and accurate manner, regarding the nature of a particular population. The data sources used consist of primary legal materials, secondary legal materials and tertiary legal materials. Data collection techniques in this study were carried out by interviews and literature review by taking quotations from the literature that are related to the problem being studied. The results of this study are first, it is known that the implementation of salary or wage subsidy assistance for CV workers. Raphita Muda Berkarya has not run according to the regulations stipulated in Law Number 24 of 2011 concerning the Social Security Organizing Agency, so that some workers do not get their rights to get COVID-19 wage / salary subsidy assistance, both workers can take several efforts such as, carrying out the obligation to register personal data with the company and asking for responsibility in the form of losses to their workers due to companies that do not register workers as BPJS Employment participants.

Abstract

Humans in fulfilling their needs are inseparable from the assistance and cooperation carried out, often in which an agreement has been made. The Cooperation Agreement for the Sale of Land Lots between PT Kawasan Kurma Indonesia, which is engaged in property along with gardens, complete with a Sharia-based Muslim area with landowners, however, there are rights from landowners that are not paid. The formulation of the problem in this thesis is how efforts to resolve disputes in the land kaflingan sales cooperation agreement in Ranah Sungkai Village, XIII Koto Kampar District, Kampar Regency and what are the inhibiting factors in dispute resolution efforts in the land kaflingan sales cooperation agreement in Ranah Sungkai Village, XIII Koto Kampar District, Kampar Regency. This type of research is sociological research because with this research the author directly conducts research at the location or place under study, namely to provide a complete and clear picture, while the population and samples are the Head of Ranah Sungkai Village, the landowner community and the Manager of Corporate Aaffairs / Legal / HRIR PT Kawasan Kurma Indonesia. The purpose of this research is to find out the Dispute Resolution in the Cooperation Agreement for the Sale of Land Plots in Ranah Sungkai Village, XIII Koto Kampar District, Kampar Regency and the obstacles to Dispute Resolution in the Cooperation Agreement for the Sale of Land Plots in Ranah Sungkai Village, XIII Koto Kampar District, Kampar Regency.The results of this study are efforts to resolve disputes in the land kaflingan sales cooperation agreement in Ranah Sungkai Village, XIII Koto Kampar District, Kampar Regency have been carried out and the result is an agreement to disagree, because the mediation process does not get an agreement as well as the consensus deliberation process and inhibiting factors Both parties maintain their arguments and insist on their respective opinions There is no good faith from each party to the dispute. The parties do not understand the mediation process and the selfishness of the parties. The author's suggestion for the parties involved in resolving disputes in the land kaflingan sales cooperation agreement in Ranah Sungkai Village, XIII Koto Kampar District, Kampar Regency is to carry out a subpoena, if the subpoena has been taken also does not get results, proceed to the district court which is mutually agreed upon according to the agreement.

Abstract

Jurnal ini membahas konsep progresivisme dan implikasinya bagi pendidikan Islam. Progresivisme menekankan pengalaman belajar yang aktif, kolaboratif, dan relevan dengan kehidupan nyata siswa. Melalui pendekatan kualitatif library research ini, pendidikan tidak hanya bertujuan untuk mentransfer pengetahuan, tetapi juga untuk mengembangkan keterampilan kritis dan kemampuan beradaptasi di dunia yang terus berubah. Dalam konteks pendidikan Islam, progresivisme menawarkan cara untuk mengintegrasikan nilai-nilai spiritual dengan praktik pendidikan modern, sehingga mendorong siswa untuk berpikir kritis terhadap ajaran agama dan menerapkannya dalam konteks sosial. Artikel ini mengeksplorasi berbagai strategi implementasi progresivisme dalam kurikulum pendidikan Islam, serta tantangan dan peluang yang dihadapi. Dengan mengadopsi pendekatan progresivis, pendidikan Islam diharapkan dapat lebih responsif terhadap kebutuhan masyarakat dan menciptakan generasi yang tidak hanya berpengetahuan, tetapi juga berkarakter dan berdaya saing.

Abstract

Penelitian ini mengkaji tentang pelaksanaan perlindungan konsumen dalam jual beli mobil bekas di Showroom Syahran Motor Kabupaten Padang Lawas Sumatera Utara yang berfokus tentang pemenuhan hak-hak konsumen berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK). Penelitian ini menggunakan Hukum Sosiologis, data diperoleh melalui hasil wawancara dan hasil observasi. Pelaku usaha belum sepenuhnya memenuhi ketentuan UUPK, terbukti dari hak-hak konsumen yang diabaikan, seperti informasi yang tidak jelas terkait kondisi mobil, serta adanya kerugian yang dialami konsumen akibat kondisi mobil yang cacat. Kemudian, adanya klausula eksonerasi dalam perjanjian jual beli yang menimbulkan ketidakseimbangan posisi hukum antara konsumen dan pelaku usaha. Beberapa konsumen juga tidak mendapatkan ganti rugi atas kerusakan mobil, karena terikat perjanjian sepihak yang melanggar prinsip perlindungan konsumen. Dalam penelitian ini pentingnya pengetahuan  hukum baik konsumen maupun pelaku usaha agar lebih memahami  hak dan  kewajibannya, dan  seharusnya    konsumen   perlu melakukan upaya lanjutan untuk memperjuangkan haknya melalui Badan Penyelesaian Sengketa Konsumen.

Abstract

Pengguna media internet saat ini mempunyai pengaruh besar dalam upaya menyediakan informasi. Dengan media internet informasi dapat di akses dengan cepat yang mudah diperolah dan disebarluaskan, begitu juga dengan TB Shuta. Bahan bangunan adalah material yang digunakan dalam proses konstruksi untuk membangun berbagai struktur, mulai dari rumah hingga gedung, jembatan dan lainnya. TB Shuta adalah industri yang bergerak dibidang penjualan bahan bangunan seperti pembutan Conblock, Batako, Vaping dan sebagainya sehingga dalam proses penjualnnya membutuhkan pemasaran dimedia sosial yang sangat membantu penjualan. Saat ini TB Shuta dalam penjualannya masih secara oflline dan juga sering melakukan transaksi penjualan ditempat. Untuk menghemat waktu dan memberikan pelayanan terbaik pada pelanggan, penulis ingin membuat aplikasi E-commerce berbasis website. Perancangan Sistem Informasi Penjualan Pada TB Shuta Prabumulih Berbasis Web ini menggunakan Metode UCD (User Centered Design) yang akan membantu penjualan yang dapat memberi kemudahan dalam pemesanan bahan bangunan.

Abstract

Consumer protection is an important part of creating a balance between the rights and obligations between consumers and business actors. In practice, there are still many consumers who have not received optimal protection, especially in terms of fulfilling their rights to information, services, and product guarantees. One form of protection that often becomes a problem is product warranty. This study aims to determine the implementation of consumer protection for the provision of product warranty for mattresses in the box at Atria Furniture and the responsibility of business actors for this. This research uses a sociological legal approach, namely by looking at the law as a social symptom that can be documentation in the interaction between consumers and business actors. Data were obtained through interviews with six consumers who submitted warranty claims, as well as managers and employees of Atria Furniture in Pekanbaru. The data was analyzed using a descriptive method with a qualitative data analysis approach that aims to systematically describe the facts in the field. The results showed that the implementation of the mattress in the box product warranty by Atria Furniture has not fully reflected the principles of consumer protection as stipulated in Law Number 8 of 1999 concerning Consumer Protection. Consumers experience difficulties in claim procedures, lack of information transparency, and slow and unsatisfactory responses from business actors. Based on these findings, it is necessary to evaluate the warranty service mechanism and increase the responsibility of business actors so that legal protection for consumers can be realized optimally.

Abstract

This article examines the fulfillment of moral and economic rights in the commercial use of personal portraits on Instagram, where the rapid growth of digital business has intensified the unauthorized exploitation of visual content. This study aims to analyze the extent to which these rights are fulfilled and to identify commonly used dispute resolution mechanisms. The research employs a sociological legal method with a case approach, utilizing primary data obtained from 50 portrait owners and 15 business actors, supported by relevant literature. The findings reveal that the fulfillment of these rights remains inadequate, as many individuals receive only attribution without economic compensation and demonstrate limited awareness of their legal rights. Dispute resolution is predominantly conducted through informal and non-litigation mechanisms, such as direct communication and platform-based reporting, rather than formal legal processes. The novelty of this study lies in its focus on non-commercial individuals within a single social media platform, integrating empirical analysis with reward theory and principled negotiation theory. These findings underscore the urgency of strengthening legal awareness, improving enforcement, and enhancing the effectiveness of dispute resolution mechanisms to ensure more comprehensive protection of creators in the digital environment.

Abstract

Agrarian conflicts in Indonesia show the limitations of formal legal approaches in accommodating the rights of indigenous peoples, especially in the context of land-based investment expansion. This article analyzes the interaction between customary norms and investment-based governance of natural wealth through a case study of Jelutih Village, Jambi Province. This study aims to identify the gap between normative recognition and implementive practice, as well as to formulate a more inclusive governance model. This study uses a qualitative approach, with normative juridical methods, strengthened by conceptual analysis and a literature review. The findings show that legal recognition of indigenous peoples remains partial and has not been integrated into resource management operational mechanisms, thereby triggering tenure conflicts and weakening the bargaining position of local communities in the face of investment actors. The novelty of this article lies in the development of an operational legal pluralism framework through three key dimensions, namely: first, the recognition of the collective rights of indigenous peoples; second, the application of the principle of Free, Prior and Informed Consent (FPIC) in the investment process; and third, fair and sustainable distribution of benefits. This framework shifts the position of indigenous peoples from policy objects to major actors in natural resource governance. This article contributes to strengthening the discourse of legal pluralism by offering an integrative model relevant to agrarian policy reform and resource governance at the local and national levels.
