Abstract

Crimes regarding forgery or falsification is a crime abbreviated form of the crime in which an element of untruth or false state of something (an object), the things it looks from the outside as if true when in fact contrary to the truth. Regarding the rule of law and brand protection stipulated in Law No. 15 of 2001 on Marks. The author chose the study with Snowman marker object as a brand name items are forged with Snowmay markers, because this Snowman markers forgery case the most recent case handled by the Riau Police. Currently the case has SP3, or the forgery case does not proceed, because the parties have to take the path of peace. In this study the authors used a qualitative analysis, in drawing conclusions using inductive method of thinking. Abstract

Water is a basic need that is required by every human being. and function for life. The rapid advancement of technology today raises a variety of new products that can meet consumer needs. Use of technology on the one hand allows manufacturers are able to make a wide range of products. But on the other hand the use of technology allows it produces products that do not conform to cause harm to consumers. One product is a product refill drinking water. depot refill drinking water are industrial enterprises that perform processing of raw water into drinking water and sell directly to consumers. The amount of water depot in the city of Pekanbaru, make it easy for the public also would have a negative impact on people's lives when the review of the relationship between businesses and consumers. In Article 7 letter d BFL No. 8 of 1999 says that the obligation of business is to ensure the quality of goods and / or services produced and / or traded under the provisions of the quality standards of goods and / or services are applicable. One District in the city of Pekanbaru contained drinking water depots Refill adalahKcamatan Bukitraya as much as 37 Depot Water.The issues examined in this research are: First, whether the application of product quality standards refill drinking water in Sub Bukitraya in accordance with the Consumer Protection Act? Second. the impact of product quality standards refill drinking water in Bukitraya is the fulfillment of Consumer Rights. Third, efforts undertaken Pekanbaru City Health Office in the application of product quality standards refill drinking water in Sub Bukitraya is to conduct regular senitation. Abstract

Senam adalah latihan tubuh yang dipilih dan diciptakan dengan sengaja dan berencana, disusun secara sistematik dengan tujuan membentuk dan mengembangkan keseluruhan yang harmonis. Senam merupakan salah satu olahraga populer di masyarakat. Hasil dari kegiatan senam pagi pada bidang kesehatan masyarakat yang dilakukan mahasiswa KKN-DR Kelompok 99 yang telah dilaksanakan pada hari minggu tanggal 25 juli 2021 di Desa Cinta Makmur, Kecamatan Panai hulu, Kabupaten Labuhan Batu. Menjaga kesehatan jasmani sangatlah penting bagi manusia, terlebih lagi dimasa pandemi covid-19 ini. Dengan melakukan kegiatan senam pagi dapat memberikan manfaat yang baik bagi tubuh manusia dan merupakan salah satu cara kita menjaga daya imun agar tetap kuat dan terhindar dari berbagai virus termasuk virus covid-19 . Seperti yang sudah di lakukan masyarakat di Desa Cinta Makmur yang mengikuti kegiatan senam pagidan merasa lebih baik setelah melakukan senam pagi.

Abstract

The impact of global warming in Indonesia are felt by all people, including the adat law community. Because the community is live from nature who manage natural resources for daily needs. It also happens in Riau Province. The purpose of this study is to determine the protection of adat law community to the impact of global warming in Riau Province. This is socio-legal research by using primary and secondary data. The results show that the impact of global warming on the adat law community in Riau Province is real and widespread in various aspects of life, such as prolonged ecological disasters, floods, land fires, and droughts; Climate change causes unpredictable seasons, the community is unable to predict planting times according to the seasonal calendar has been passed down for generations, causing crop failure; Community needs additional capital to manage agricultural land to adapt the climate change, they need synthetic fertilizers, pesticides, herbicides, and others. Even though formerly, additional treatments are not necessary; Forest and land fires cause a smog disaster, the haze impact make the loss of honey bees from the sialang trees, so reduced honey production. the conclusion is that the impact of global warming decreases standard life, economic, health, and environmental. Therefore, the government have to control the impact of global warming which is extracted from the values of local wisdom that live and develop in the adat law community, especially in Riau Province in terms of managing existing natural resources. Keywords: Dampak, Global Warming, Masyarakat Hukum Adat, Provinsi Riau

Abstract

Perceraian adalah putusnya ikatan perkawinan antara seorang pria dan seorang wanita yang mengakibatkan putusnya hubungan antara suami dan istri. Adanya perceraian mempunyai akibat yang diatur dalam Pasal 41 UU Perkawinan. Dari akibat perceraian tersebut, maka kewajiban orang tua untuk memenuhi hak-hak anak dari perceraian tersebut adalah kewajiban orang tua. Penelitian ini bertujuan untuk mengetahui bagaimana pemenuhan hak anak dari perkawinan di bawah umur menurut hukum positif dan hukum Islam di Desa Muara Bahan Kecamatan Singingi Hilir Kabupaten Kuantan Singing dan untuk mengetahui hambatan pemenuhan hak anak akibat perceraian perkawinan di bawah umur. Jenis penelitian yang digunakan adalah penelitian sosiologis. Jenis data penelitian adalah data primer dan data sekunder. Teknik analisis data yang digunakan adalah analisis data kualitatif. Hasil penelitian ini adalah kewajiban orang tua untuk memenuhi hak anak pasca perceraian sesuai dengan yang diatur dalam undang-undang meningkatkan kesadaran orang tua terhadap hukum agar tidak ada lagi hak anak yang tidak terpenuhi setelah terjadi perceraian dan juga peran kelembagaan desa dan pelayanan pengendalian kependudukan, KB, pemberdayaan perempuan dan perlindungan anak dalam membantu pemenuhan hak anak. Hambatan yang menyebabkan tidak terpenuhinya hak anak akibat perceraian adalah kurangnya kesadaran hukum masyarakat, tidak digugat di pengadilan, faktor ekonomi, dan faktor orang tua menikah lagi.

Abstract

PayLater is a form of P2P agreement which is a loan agreement from oneparty to another through a provider other than a bank, so there are other partiesinvolved in using the PayLater payment method. With the existence of otherparties, it is also possible to have various agreements in the use of the PayLatermethod, with the formation of an agreement between the parties, it can also beseen that the parties have an obligation to fulfill the achievements of other parties.In this case, the parties mentioned are consumers who also use PayLater on theirTraveloka account. So it can be said that the legal relationship that arisesbetween PayLater and consumers is when consumers use the payment methodowned by PayLater.This type of research can be classified in the type of normative legalresearch, which discloses laws and regulations relating to legal theories that arethe object of research. The approach taken is using a qualitative analysisapproach by searching for data in books, journals and other scientific worksrelated to this research. The data sources used are primary and secondary legalmaterials.The conclusions that can be drawn from the results of the research are:First, the regulation regarding the practice of using paylaters based on theprevailing laws and regulations in Indonesia is regulated in: Law Number 11 of2008 concerning Information and Electronic Transactions and PBI Number16/8/PBI/2014 concerning Amendment to Bank Indonesia Regulation Number11/12/PBI/2009 concerning Electronic Money (paylater position as electronicmoney or as a transaction tool at Traveloka) Second, Traveloka's liability ifconsumers are harmed by using paylaters, namely Traveloka is responsible forproviding protection to consumers, as regulated in the provisions of article 4 jo.Article 62 of Law Number 8 of 1999 concerning Consumer Protection and POJKNumber 1/POJK.07/2013 concerning Consumer Protection of the FinancialServices Sector.Keywords: Consumer Protection, PayLater, Traveloka, Legal Responsibility,Consumers.

Abstract

Build-Use-Transfer is the utilization of State/Regional Property in the form of land by another party byconstructing buildings and/or facilities along with their facilities, then utilized by the other party within a certainagreed period of time, to be subsequently handed back the land along with the building and/or facilities and facilitiesafter the expiry of the term. PT. Agung Rafa Bonai (PT. ARB) was unable to fulfill his achievement, namelycompleting the construction of the Pekanbaru City main market within 24 months according to the contract agreedwith the Pekanbaru City Government. The purpose of writing this thesis First is to find out the implementation of thecooperation agreement for the use of regional property owned by the Pekanbaru City Government and PT. ARB,Third, to find out the legal consequences of default in the implementation of the cooperation agreement for the use ofregional property, the Pekanbaru City Government and PT. ARB.This research is classified in the type of empirical juridical research, namely research on the effectivenessof the law, how the law operates in society. This research was conducted at the Office of Industry and Trade ofPekanbaru City and PT. ARB, while the sample population is the Head of the Pekanbaru City Industry and TradeOffice and the Director of PT. ARB with the problems studied in this study, the data sources used, primary data andsecondary data, data collection techniques in this study with interviews, literature review, and data analysis.The conclusion of this study. First, the implementation of the cooperation agreement for the use of regionalproperty, the Pekanbaru City Government and PT. ARB, namely the PT. ARB was unable to fulfill its achievements,namely completing the construction of the Pekanbaru City main market within 24 months, paying annualcontributions for 3 consecutive years and not ensuring cleanliness in the main market project development area. Thetwo obstacles in the implementation of the cooperation agreement for the use of regional property, the PekanbaruCity Government and PT. ARB is the Covid-19 pandemic which has an impact on the company so that the company'sactivities are not smooth, especially related to development and this has an impact on the budgeting of funds thathave been prepared previously. PT. ARB selling assets to continue the development of the main market has not beenimplemented. Third, the legal consequences of default in the implementation of the cooperation agreement for the useof regional property owned by the Pekanbaru City Government and PT. ARB means that the Pekanbaru CityGovernment has not carried out the legal consequences in accordance with Article 19 concerning the termination ofthe contract. The Pekanbaru City Government may terminate the BGS unilaterally in accordance with Article 19 ofthe cooperation contract. However, the Pekanbaru City Government still provides opportunities for PT. ARB to fulfillits obligations in completing the Pekanbaru City main market.

Abstract

This study aimed to analyze the management of Imbo Putui Customary Forest and as well as the model for using customary forest that can improve the community’s economy in Kenegerian Petapahan. The Imbo Putui Customary Forest managed by adat law communities based on adat law and local wisdom of society in Kampar Regency. The challenge is that there are still individuals who carry out illegal logging of trees without permission of the tribal chief for commercial purposes. This research is useful theoretically and practically. The type of research is sociological or empirical legal research. The results of the study show that customary forest management is carried out based on adat law in the form of rules, prohibitions, and sanctions such as; take medicinal plants only for daily needs, not selling wood commercially, maintaining etiquette in words and actions while in the Imbo Putui Customary Forest. People who break the rules will be penalized. The model for using Imbo Putui customary forest that can improve the community's economy, such as making the customary forest a center of study, developing natural tourism, and cultivating kelulut bees. In addition, the community need to expand cooperation networks with the government and non-governmental, also promote customary forests both domestic and foreign. Penelitian ini bertujuan untuk mengetahui pengelolaan Hutan Adat Imbo Putui, dan model pemanfaatan Hutan Adat agar dapat meningkatkan ekonomi masyarakat hukum adat di Kenegerian Petapahan. Hutan Adat Imbo Putui dikelola masyarakat hukum adat berdasarkan hukum adat dan kearifan lokal masyarakat di Kabupaten Kampar. Tantangannya masih ada oknum yang melakukan penebangan liar pohon tanpa ijin kepala suku untuk kepentingan komersial. Penelitian ini bermanfaat secara teoritis dan praktis. Jenis penelitian adalah penelitian hukum sosiologis atau empiris. Hasil penelitian menujukkan bahwa pengelolaan hutan adat dilakukan berdasarkan hukum adat berupa Aturan, larangan dan sanksi seperti: boleh mengambil tanaman obat-obatan hanya untuk keperluan sehari-hari, tidak boleh menjual kayu secara komersial, menjaga adab perkataan dan perbuatan saat berada di Hutan Adat Imbo Putui, jika melanggar aturan-aturan tersebut maka akan dikenakan sanksi adat. Model pemanfaatan hutan adat imbo putui agar dapat meningkatkan perekonomian masyarakat seperti menjadikan hutan adat sebagai pusat studi, pengembangan wisata alam dan budidaya lebah kelulut. Perlu dilakukan upaya perluasan jejaring kerjasama baik dengan pemerintah maupun lembaga swadaya masyarakat dan promosi hutan adat baik di dalam negeri maupun di luar negeri.

Abstract

Business conspiracy or conspiracy is a form of cooperation carried out by businessactors with other business actors with the intention of controlling the relevant market forthe interests of the conspiring business actors. The Business Competition SupervisionCommission (KPPU) is tasked with examining alleged violations of Law Number 5 of1999 concerning the Prohibition of Monopolistic Practices and Unfair BusinessCompetition, and each decision uses a Per Se Illegal approach and a Rule of Reasonapproach. In the case of tender conspiracy, the Commission Council must apply the Ruleof Reason approach in its decision to analyze the case. However, the KPPU's decisionhas not been consistent in applying the Rule of Reason approach to the case of tenderconspiracy by the government. Therefore, the research objectives of this thesis are,firstly, to determine the variation of the application of the Rule of Reason approach to theKPPU's decision on the procurement of goods/services by the government. Second, tofind out the ideal indicators in the application of the Rule of Reason approach to theKPPU's decision. This study uses normative/legal research methods to analyze casestudies. This study uses secondary data sources by using primary legal materials,secondary legal materials, and tertiary legal materials. From the results of the studythere are 2 main things that can be concluded. First, the variation of the application ofthe Rule of Reason approach to the KPPU's decision on the procurement ofgoods/services by the government is contained in Decision Number 04/KPPU-L/2020,Decision Number 05/KPPU-I/2020 and Decision Number 35/KPPU-I/2020. Where in thedecision Number 04/KPPU-L/2020 and Decision No.05/KPPU-I/2020 the Rule of Reasonapproach has not been implemented perfectly, and in Decision Number 35/KPPU-I/2020the Rule of Reason approach has been implemented perfectly. Second, the ideal indicatorto apply the Rule of Reason approach is regulated in Article 22 of the 1999 Law on theProhibition of Conspiracy, which regulates indications of conspiracy in tenders. Indecision Number 04/KPPU-L/2020 the Commission Council did not apply the Rule ofReason approach perfectly. In decision Number 05/KPPU-I/2020 the CommissionCouncil has not implemented the Rule of Reason approach perfectly. Abstract

The basis for implementing land use in Indonesia is regulated in Article 33 Paragraph (3) of the 1945 Law, the article explains that everything regarding natural resources including land. Therefore, no one can interfere with someone's land ownership rights, where land tenure rights are a concrete legal relationship. Based on the author's observations, the problem regarding land disputes between PT RAPP and oil palm farmers in Dayun Village is that long-standing mutual claims to land rights have led to even greater conflicts. The purpose of this study was to obtain an overview of the factors causing the dispute between PT RAPP and the oil palm farmers of Dayun Village. And how to resolve land disputes between PT RAPP and oil palm farmers in Dayun Village. It is hoped that the disputing parties should pay attention to and also consider mediation efforts and also other solutions that can reconcile the two parties.
