Abstract

Tujuan dari penelitian ini adalah untuk mengetahui skema social funding terbaik dalam koperasi jasa non simpan pinjam yang dapat digunakan untuk memenuhi kebutuhan dana dari anggotanya. Hal ini penting untuk diulas karena selama ini tidak ada skema dalam pemenuhan kebutuhan dana tersebut mengingat koperasi jasa non simpan pinjam tidak mengakomodir transksi peminjaman uang. Selama ini skema simpan pinjam hanya ada pada koperasi jenis simpan pinjam yang berasaskan hutang piutang. Metode yang digunakan dalam penulisan ini adalah metode kualitatif dengan pendekatan deskriptif normative menggunakan sumber primer data transaksi yang diberikan oleh pihak koperasi dan juga sumber sekunder dari jurnal dan Pustaka lainnya. Hasil penelitian ini adalah bahwa skema social funding terbaik yang bisa digunakan oleh koperasi jasa non simpan pinjam untuk memenuhi kebutuhan dana anggotanya adalah dengan mix skema yang merupakan perpaduan antara akad qardhul hasan dan mudharabah. Adapun jumlah maksimal yang bisa dipinjamkan adalah sebesar 50% dari total simpanan hari tua anggota tersebut. Sedangkan waktu pinjaman paling lama adalah selama 5 tahun. Jumlah dan lama waktu pinjama ini telah mempertimbangkan risiko kredit dan risiko operasional yang mungkin timbul. Ditinjau dari aspek teologis maka social funding adalah ajaran islam yang agung yang disampaikan di dalam Al-Quran dan Sunnah. Adapun jika ditinjau dari aspek hukum positif yang berlaku di Indonesia maka social funding merupakan jati diri bangsa Indonesia yang telah ada sejak ratusan tahun sebelum diproklamirkan Negara Indonesia pada 17 Agustus 1945. Dan kemudian dituliskan dalam dasar negara yaitu Pancasila dan UUD 1945 sebagai bagian dari prinsip berbangsa Bangsa Indonesia.

Abstract

This study aims to discuss the description of the implementation process of exchanging forest areas for the relocation of residents and legal certainty of ownership of community land certificates after the relocation of community forest area exchanges in Dusun Ngroto. The research method used in this research is juridical-empirical descriptive by using qualitative data analysis methods to review literature and events that actually occurred through observation and interviews. The research location is in Ngroto Hamlet, Pare Village, Selogiri District, Wonogiri Regency. Abstract

Forest conservation currently attracts the attention of numerous countries in the world, including Indonesia. This is because the world’s forests have experienced terrible damage, including due to deforestation. Principal policies are crucial to prevent the problem of forest deterioration. Thus, many countries apply policies with the paradigm of sustainable forest development. It is based on balancing the sustainability of the economic, ecologic, social, and cultural functions through non-centralistic forest resource management which values the society’s independence. In essence, this paradigm uses local wisdom as its basis. Some requirements must be fulfilled to reach the goals of the forest policies. One of them is society’s active participation in conserving the forests’ natural resources. Society's participation in environmental conservation is crucial, as they act as the determinants (subjects). Apart from that, they simultaneously experience the impact of the determined policies (object).

Abstract

Human rights must be implemented by the rules of community life, where each community group has its view and application of the freedom of human rights. The enforcement of human rights for LGBT people with Islamic law in Aceh is opposed by the international community because it is considered a violation of human rights. So the urgency of this research is to find out how far a person's understanding of human rights freedom is and what is the foundation on which they base human rights to exercise. After that, it will be concluded whether religious values continue to dominate society in acting. This study uses a descriptive-analytical method with a normative juridical approach, where the data and information to be collected both in terms of assessment and in terms of management is carried out interdisciplinary and multidisciplinary as well as cross-sectoral. The data and information are then analyzed in-depth normative juridical so that an overview of human rights in Indonesia is obtained. The results show that the concept of human rights applied in Indonesia uses the concept of cultural relativity and will not be relevant if it uses the concept of human rights in western countries which emphasize individual freedom.

Abstract

Penelitian ini bertujuan untuk mengkaji kebijakan Perum Perhutani KPH Saradan dalam mengadopsi kebijakan Pengelolaan Hutan Bersama Masyarakat (PHBM) sebagai kebijakan kehutanan dengan pendekatan baru, yaitu meningkatkan kesejahteraan masyarakat yang tinggal di sekitar hutan dan sekaligus melestarikan hutan. Penelitian ini merupakan penelitian non-doktrinal dengan pendekatan kualitatif, yaitu sesuatu dilihat dari sudut pandang orang yang diteliti (informan). Lokasi penelitian berada di wilayah kerja Perum Perhutani KPH Saradan. Jenis data dalam penelitian ini terdiri dari data primer dan data sekunder. Data primer diperoleh dari wawancara dengan responden yang diambil dengan metode purposive sampling dan dianalisis dengan analisis kualitatif. Berdasarkan hasil penelitian dan diskusi, dapat disimpulkan bahwa kebijakan PHBM memiliki tujuh tujuan, yaitu: perencanaan dan pelaksanaan kegiatan yang lebih fleksibel, peningkatan tanggung jawab Perum Perhutani (KPH Saradan) terhadap keberlanjutan fungsi dan manfaat hutan, peningkatan peran dan akses masyarakat desa hutan (MDH) dan pemangku kepentingan pengelolaan SDH, penyesuaian PHBM dengan pembangunan daerah, peningkatan sinergi dengan Pemerintah, peningkatan usaha produktif sehingga masyarakat mandiri dan mendukung peningkatan Indeks Pembangunan Manusia (IPM). Implementasi kebijakan PHBM dalam konsepnya adalah pengelolaan hutan bersama masyarakat, yaitu prinsip kerjasama, pengelolaan bersama, dan tanggung jawab bersama. Kebijakan dengan pendekatan kesejahteraan ini juga mengambil jalur kesediaan untuk berbagi hasil hutan kayu dan non-kayu dengan masyarakat Desa Hutan (MDH) yang sebelumnya telah dilakukan dan memiliki konsep pertanian di area hutan sehingga hutan dapat dimanfaatkan untuk kesejahteraan tanpa menyebabkan kerusakan hutan.   Kata Kunci: Kehutanan, Kebijakan, Saradan, Kesejahteraan   This study aims to examine the policies of Perum Perhutani KPH Saradan adopting the Community Forest Management (PHBM) policy as a forestry policy with a new approach, namely increasing the welfare of the people living around the forest and preserving forests on the other hand. This research is a non-doctrinal research with a qualitative approach, that is, something is seen from the point of view of the person being studied (informant). The research location is in the working area of Perum Perhutani KPH Saradan. The type of data in this study consists of primary data and secondary data. Primary data obtained from interviews with respondents from sampled with the purposive sampling method and analyzed with qualitative analysis. BerdaBased on the results of the research and discussion, it can be concluded that the PHBM policy has seven objectives, namely: more flexible planning and implementation of activities, increasing the responsibility of Perum Perhutani (KPH Saradan) for the sustainability of forest functions and benefits, increasing the role and access of forest village communities (MDH) and stakeholders. holders of SDH management, aligning PHBM with regional development, increasing synergy with the Government, increasing productive businesses so that the community is self-sufficient and supporting the improvement of the human development index (IPM). The implementation of the PHBM policy in its concept is community forestry, namely the principles of co-operation, co-management and co-responsibility. The policy with this welfare approach also takes the path of willingness to share timber and non-timber forest products with the Forest Village (MDH) community which was carried out previously and has the concept of agriculture in forest areas so that forests can be utilized for welfare without causing forest damage.   Keywords: Forestry, Policy, Saradan, Welfare.

Abstract

Traditional medicine is a method of treatment or care using traditional procedures. Both rely on knowledge, experience and skills passed down from generation to generation based on local community traditions (custom). The aim of this research is to analyze consumer protection towards traditional medical practices in the city of Surakarta. This research employs empirical legal research method. The results of this research explain consumer protection in the Consumer Protection Act lies in consumer rights which must be fulfilled in the practice of traditional medicine. Apart from that, a clinical practice permit and drug distribution permit from BPOM must be in place. If there is negligence in the implementation of traditional medicine, civil legal action is taken through a lawsuit for unlawful acts or a lawsuit for default and penal legal action through a police report for alleged malpractice. Actions in the form of health services for traditional medicine must prioritize consumer protection in terms of the competence of therapists or doctors, practice permits, production permits and product distribution issued by BPOM and the Indonesian Health Service which aims to maintain patient security and safety.

Abstract

Health Promotion is a process to empower the society through activities to inform, influence and assist the society to play an active role to support behavioral and enviromental changes and maintain and improve health towards optimal health status. The purpose of this study was to analyze the awareness of the implementation of PKRS based on Permenkes No. 44 of 2018 at Hj. Fatimah Sulhan PKU Muhammadiyah Demak Hospital. This research uses empirical research. The results of this study explain that hospitals in the implementation of PKRS based on Permenkes No. 44/2018 focus on 2 aspects, namely PKRS management and fulfillment of PKRS standards. In the preperation carried out, hospitals must consider the rules of the PKRS guidelines that have been regulated in the regulations. These regulations must not contradict but ini making internal rules, hospitals can add according to the technical needs of PKRS. The hospital has adjusted the PKRS guidelines and work program with the guidelines regulated by Permenkes No. 44/2018

Abstract

Medical practice is a series of activities carried out by doctors and dentists on patients as part of their medical practice. When practicing medicine, a doctor who practices medicine or provides medical services must meet the requirements set by the government. All doctors and dentists who practice medicine must have a Practice License. New doctors can practice if they already have STR and SIP. This research aims to analyze the urgency of IDI's role in providing recommendations for registration of medical practice permits and its legal aspects. This research uses normative research. The results of this research explain that there are differences in SIP registration for doctors, namely: In Law no. 29 of 2004 IDI has a role and authority in providing recommendations. Meanwhile, Law No. 17 of 2023 states that registration of a doctor's SIP no longer requires a doctor's recommendation but only an STR and place of practice. The elimination of IDI's authority as a professional organization for doctors means that IDI loses its role in supervising the development and improvement of the quality of doctors to ensure that doctors who have SIP are doctors who are competent in their field

Abstract

This research aims to analyze flexing in marketing from the perspective of Shariah economic law. The phenomenon of flexing, as a common marketing strategy, has recently become prevalent, particularly on social media. However, the current development of flexing presents several issues as it tends to disregard Shariah concepts, thereby potentially harming consumers. This study is a literature review that utilizes primary sources, such as interpretations by Yusuf Qardhawi and economist Reynal Kasali through YouTube channels, as well as secondary sources, including the phenomenon of flexing on social media. The findings of this research indicate that flexing can support marketing activities but tends to have negative impacts on society. Therefore, Islamic business practitioners are advised against employing flexing as a marketing tool, as it violates Shariah principles, such as avoiding defamation, arrogance, ostentation, extravagance, and hypocrisy.
