Abstract

This service aims to increase employment opportunities for diasporas who take further education abroad, such as in Malaysia, Hong Kong, and Sweden, with manufacturing abroad, such as in Malaysia, Hong Kong, and Sweden, by creating and submitting articles to reputable journals. Abstract

This study aims to analyse the role of informed consent, legal protection and health workers in the Regional General Hospital of West Papua Province. The research method used is a quantitative approach. The data analysis used was verification analysis using linear regression analysis. The verification method is used to test the relationship between variables. The sample consisted of 35 respondents who were taken using saturated sampling technique. The results of this study indicate that there is a significant influence between the variables of informed consent and legal protection of health workers in medical practice, especially in the context of health services in emergency situations. The results of hypothesis testing show that the application of informed consent serves as a guarantee for patients to understand the medical procedures to be carried out, while protecting health workers from potential lawsuits. Law No. 17 of 2023 provides a clear legal framework regarding the obligation of health workers to obtain consent for medical actions, with the exception of emergencies. This study confirms the importance of effective communication between health workers and patients. Although health workers do not fully understand the principles of informed consent.

Abstract

This article offers a discussion on the law on medical cannabis utilization in the health sector from the perspective of the fatwas (official statement from an Islamic religious leader) of the Indonesian Islamic Scholar Assembly (MUI) and the Tarjih Council of Muhammadiyah (Muhammadiyah Organizational Ijtihad Institution). This paper aims to provide insight into the legalization of medical cannabis in Indonesia and review the policies of other countries that have legalized cannabis for medical purposes. There needs to be a firm statement of MUI and Islamic organizations such as Muhammadiyah on this issue. This paper employed the normative research method. It used the statute approach to profoundly analyze the available legal materials. The data were sourced from secondary legal materials. The data were collected by reading, studying, and understanding the materials related to the legal issue. The data were analyzed using the qualitative technique. Research results showed the findings that the fatwas of MUI and Tarjih Council of Muhammadiyah permit the usage of medical cannabis for treatment under emergency reasons and with strict supervision from doctors. It is crucial to have a fatwa in determining the legalization of medical cannabis, considering that Indonesia has the largest Muslim population in the world, and up to now, there has not been a firm legal policy that regulates the use of medical cannabis. The existence of a fatwa in determining the law benefits human beings both in the world and in the Hereafter. Apart from that, it brings tranquility in resolving the issue of the Muslim community. This paper brings novelty as it provides information on how other Muslim countries view the legalization of cannabis as well as the perspectives of MUI and the Tarjih Council of Muhammadiyah on this issue.

Abstract

Lingkungan hidup yang baik dan sehat merupakan anugerah yang diberikan oleh Tuhan Yang Maha Esa kepada semua mahluk hidup yang ada di dunia ini, oleh sebab itu hak untuk menikmati lingkungan yang sehat merupakan hak bagi setiap manusia beserta seluruh makluk hidup di sekitarnya tanpa terkecuali.Namun, semakin bertambahnya kegiatan pembangunan terutama pabrik pasti akan berdampak pada pencemaran dan kerusakan lingkungan hidup, diantaranya pencemaran air yang disebabkan oleh limbah industrial limbah yang dihasilkan dari kegiatan yang kemudian dibuang ke sungai atau tempat aliran air sehingga menyebabkan air tercemar, pencemaran tanah. Desa Pondok, Kecamatan Grogol, Kabupaten Sukoharjo dalam rencana akan dibangun pabrik di sekitar pemukiman masyarakat. Namun sebagian masyarakat tidak setuju dengan rencana ini karena berdampak buruk terhadap lingkungan hidup. Di sisi lain, warga yang menolak rencana tersebut belum tahu prosedur penolakan pembangunan pabrik sesuai aturan yang berlaku. Metode yang dilakukan adalah dengan melakukan peningkatan pengetahuan melalui sosialisasi berbasis komunitas warga Desa Pondok yang bertujuan untuk meningkatkan kesadaran masyarakat dan pemerintah desa terhadap bencana rusaknya lingkungan dengan melibatkan Akademisi, Mahasiswa, Perangkat Desa serta Masyarakat Desa Pondok. Program pengabdian ini mampu meningkatkan kesadaran warga tentang pencemaran yang merupakan dampak limbah industrial sekaligus membentuk komunitas sadar lingkungan di desa Pondok Grogol.

Abstract

This writing aims to find out the form of legal protection against misuse of the logo without permission and to find out the legal consequences for content creators on TikTok social media who misuse the logo. This research can provide information to content creators and the public to protect logos and to find out the legal consequences for parties who misuse logos. In this writing, normative legal research methods are used. This article has a novelty, namely a more specific discussion of logo misuse in terms of Law No. 20 of 2016 and the consequences of misuse of logos on social media. The result of this writing is to find out the form of legal protection for the owner of the rights to the logo, if the logo owner experiences a loss caused by another party then the party who caused the loss can be given sanctions in accordance with Law No. 20 of 2016 and to find out the legal consequences for content creators who misuse the logo without permission on TikTok social media are subject to imprisonment and/or fines as regulated in Law No. 20 of 2016, and can also file a civil suit for compensation and/or to stop misuse of the logo. If the violation is committed on social media, you can be sentenced to imprisonment for a maximum of 4 years and/or a fine of a maximum of IDR. 750,000,000,- (seven hundred and fifty million rupiah) as regulated in article 45 paragraph 3 of the ITE Law.

Abstract

This research aims to analyze flexing in marketing from the perspective of Shariah economic law. The phenomenon of flexing, as a common marketing strategy, has recently become prevalent, particularly on social media. However, the current development of flexing presents several issues as it tends to disregard Shariah concepts, thereby potentially harming consumers. This study is a literature review that utilizes primary sources, such as interpretations by Yusuf Qardhawi and economist Reynal Kasali through YouTube channels, as well as secondary sources, including the phenomenon of flexing on social media. The findings of this research indicate that flexing can support marketing activities but tends to have negative impacts on society. Therefore, Islamic business practitioners are advised against employing flexing as a marketing tool, as it violates Shariah principles, such as avoiding defamation, arrogance, ostentation, extravagance, and hypocrisy.

Abstract

Traditional medicine is a method of treatment or care using traditional procedures. Both rely on knowledge, experience and skills passed down from generation to generation based on local community traditions (custom). The aim of this research is to analyze consumer protection towards traditional medical practices in the city of Surakarta. This research employs empirical legal research method. The results of this research explain consumer protection in the Consumer Protection Act lies in consumer rights which must be fulfilled in the practice of traditional medicine. Apart from that, a clinical practice permit and drug distribution permit from BPOM must be in place. If there is negligence in the implementation of traditional medicine, civil legal action is taken through a lawsuit for unlawful acts or a lawsuit for default and penal legal action through a police report for alleged malpractice. Actions in the form of health services for traditional medicine must prioritize consumer protection in terms of the competence of therapists or doctors, practice permits, production permits and product distribution issued by BPOM and the Indonesian Health Service which aims to maintain patient security and safety.

Abstract

Health Promotion is a process to empower the society through activities to inform, influence and assist the society to play an active role to support behavioral and enviromental changes and maintain and improve health towards optimal health status. The purpose of this study was to analyze the awareness of the implementation of PKRS based on Permenkes No. 44 of 2018 at Hj. Fatimah Sulhan PKU Muhammadiyah Demak Hospital. This research uses empirical research. The results of this study explain that hospitals in the implementation of PKRS based on Permenkes No. 44/2018 focus on 2 aspects, namely PKRS management and fulfillment of PKRS standards. In the preperation carried out, hospitals must consider the rules of the PKRS guidelines that have been regulated in the regulations. These regulations must not contradict but ini making internal rules, hospitals can add according to the technical needs of PKRS. The hospital has adjusted the PKRS guidelines and work program with the guidelines regulated by Permenkes No. 44/2018

Abstract

Medical practice is a series of activities carried out by doctors and dentists on patients as part of their medical practice. When practicing medicine, a doctor who practices medicine or provides medical services must meet the requirements set by the government. All doctors and dentists who practice medicine must have a Practice License. New doctors can practice if they already have STR and SIP. This research aims to analyze the urgency of IDI's role in providing recommendations for registration of medical practice permits and its legal aspects. This research uses normative research. The results of this research explain that there are differences in SIP registration for doctors, namely: In Law no. 29 of 2004 IDI has a role and authority in providing recommendations. Meanwhile, Law No. 17 of 2023 states that registration of a doctor's SIP no longer requires a doctor's recommendation but only an STR and place of practice. The elimination of IDI's authority as a professional organization for doctors means that IDI loses its role in supervising the development and improvement of the quality of doctors to ensure that doctors who have SIP are doctors who are competent in their field

Abstract

The development of information and communication technology has given birth to innovations in various fields, including the financial sector. One of the rapidly developing innovations is the emergence of online loans (pinjol). However, this pinjol has the potential for problems, one of which is the rise of illegal pinjol. This study aims to determine the process of agreements between online loan platforms and consumers, regulations and rights and obligations in agreements between online loan platforms and consumers according to civil law and Islamic law, and legal liability if one party defaults or violates the law. This research is a descriptive study with a normative research approach. The data sources for this study are secondary data and primary data. Data collection was carried out using literature studies and field studies (interviews). Furthermore, the data was analyzed using a qualitative approach. The results of this study show that the agreement process between illegal online loan platforms and consumers in Indonesia often does not meet the requirements for a valid contract regulated in the Civil Code, and violates the principles of consumer protection regulated in Law No. 8 of 1999. Agreements in online loan platforms, both according to civil law and Islamic law, must meet the requirements for a valid agreement which include agreement, capacity, clear objects, and lawful causes. In Islam, lending and borrowing must be done based on the principle of qardh which upholds mutual assistance and compliance with sharia. In the event of a default or violation of the law, especially in the context of illegal online loans, the agreement is invalid and null and void because it does not meet the requirements set out in Article 1320 of the Civil Code and does not comply with the principles of sharia law
