Abstract

Legal protection for doctor's work safety during the Covid 19 pandemic has not received optimal preventive action from the government with the data showing that the death of health workers in Indonesia accounts for the highest in Asia. This study aims to discuss the concept of legal protection for doctors' work safety in handling Covid-19 cases on the basis of Saddu al-Dzari'ah. The main data source for this study's juridical-normative methodology consisted of secondary data from written legal materials quantitatively examined to provide analytical descriptive data. Results show that legal protection for the safety of doctors in dealing with Covid-19 cases cannot be as required and correctly implemented in the legislation; in reality, the rights of doctors are still neglected and not fulfilled. The government's failure to take preventive measures to offer legal protection for doctors means that mafsadat (injury) in managing Covid-19 cases persists, which is also evidenced by the number of doctors who died from Covid-19. Our findings suggest the importance of having the concept of legal protection for doctors in handling Covid-19 cases based on Saddu al-Dzari'ah so that doctors get comprehensive protection.

Abstract

The urgency of Informed Consent is really needed by doctors to be used as a sign of approval for medical action that has the potential for medical disputes or is a legal protection for medical officers who carry out actions. The purpose of this study was to analyze informed consent for the legal protection of doctors in health services. Using a normative juridical method with a statute approach, namely examining all laws and regulations related to the issues to be discussed. The results of the analysis show that absolute informed consent can be a guarantee of a sense of security for both doctors and workers who carry out the health care profession as well as protection for patients so that patients understand the condition of the disease experienced by patients and understand the medical actions that will be carried out so as to avoid malpractice activities.

Abstract

Legally the Hospital has responsibility for the negligence committed by its health workers. The responsibility for criminal acts of malpractice is currently in the spotlight because the legal rules governing it are still unclear. This is because the regulations regarding the qualifications for malpractice are not clearly stated in the legal rules. The purpose of this research is to analyze the responsibility of the hospital for the actions of doctors who commit malpractice. Using a normative juridical method with a statute approach, namely examining all laws and regulations related to the issues to be discussed. The results of the analysis show that based on Law No. 44 of 2009 concerning Hospitals, hospitals have a responsibility if their medical members are proven to have committed negligence. Until now, Indonesia does not have a law that implicitly regulates medical malpractice.

Abstract

Indonesia ratified the Convention on the Rights of Persons with Disabilities (CRPD) and enacted Laws that provide for the right to justice and legal protection for persons with mental disabilities, including the right to own and inherit a legacy. Paradoxically, the same laws legalize actions that undermine their rights. This study examines the legal protection accorded to persons with mental/intellectual disabilities over their inheritance rights as per the Indonesian three-pronged inheritance laws comprising Islamic law, adat law and the civil code. This research is descriptive, using a normative approach with a measure of doctrinal research. Indonesian laws still provide for substituted decision-making for persons with mental disabilities, which legalizes denying their right to legal agency. Ambiguities abound in the laws on important aspects, like how one is declared incapable of making legal decisions. Supported decision-making mechanisms for persons with mental disabilities in Indonesian laws would provide the basis for setting up support centers where persons with mental disabilities can access the necessary support to enable them to make legal decisions. This study can be useful in addressing issues that infringe on the legal rights and protections of people with mental disabilities.

Abstract

A good and healthy living environment is a gift given by God Almighty to all living creatures in this world, therefore the right to enjoy a healthy environment is a right for every human being and all living creatures around him without exception. However, The increasing number of development activities, especially factories, will definitely have an impact on environmental pollution and damage, including water pollution caused by industrial waste, waste produced from activities which are then thrown into rivers or watercourses, causing polluted water and soil pollution. Pondok Village, Grogol District, Sukoharjo Regency is planning to build a factory around community settlements. However, some people do not agree with this plan because it has a negative impact on the environment. On the other hand, residents who reject the plan do not yet know the procedures for rejecting factory construction according to applicable regulations. The method used is to increase knowledge through community-based outreach for Pondok Village residents which aims to increase community and village government awareness of environmental damage disasters by involving Academics, Students, Village Officials and the Pondok Village Community. This service program is able to increase residents' awareness about pollution which is the impact of industrial waste while forming an environmentally conscious community.   Abstrak Sosialisasi Hukum Lingkungan terkait Pembangunan Pabrik kepada Masyarakat Desa Pondok, Grogol – Sukoharjo. Lingkungan hidup yang baik dan sehat merupakan anugerah yang diberikan oleh Tuhan Yang Maha Esa kepada semua mahluk hidup yang ada di dunia ini. Oleh sebab itu hak untuk menikmati lingkungan yang sehat merupakan hak bagi setiap manusia beserta seluruh makluk hidup di sekitarnya tanpa terkecuali.Namun, semakin bertambahnya kegiatan pembangunan terutama pabrik pasti akan berdampak pada pencemaran dan kerusakan lingkungan hidup, diantaranya pencemaran air yang disebabkan oleh limbah industrial limbah yang dihasilkan dari kegiatan yang kemudian dibuang ke sungai atau tempat aliran air sehingga menyebabkan air tercemar, pencemaran tanah. Desa Pondok, Kecamatan Grogol, Kabupaten Sukoharjo dalam rencana akan dibangun pabrik di sekitar pemukiman masyarakat. Namun sebagian masyarakat tidak setuju dengan rencana ini karena berdampak buruk terhadap lingkungan hidup. Disamping itu, warga yang menolak rencana tersebut belum tahu prosedur penolakan pembangunan pabrik sesuai aturan yang berlaku. Metode yang dilakukan adalah dengan melakukan peningkatan pengetahuan melalui sosialisasi berbasis komunitas warga Desa Pondok yang bertujuan untuk meningkatkan kesadaran masyarakat dan pemerintah desa terhadap bencana rusaknya lingkungan dengan melibatkan Akademisi, Mahasiswa, Perangkat Desa serta Masyarakat Desa Pondok. Program pengabdian ini mampu meningkatkan kesadaran warga tentang pencemaran yang merupakan dampak limbah industrial sekaligus membentuk komunitas sadar lingkungan di desa Pondok Grogol.

Abstract

Rape is a despicable act that violates the dignity of a woman. Not only women, even children are often victims of these barbaric acts. And not a few of these legal problems are considered over by marrying the victim to the perpetrator. This research has a goal that focuses on examining and analyzing the legal arrangements that apply in Indonesia to the forced marriage of victims and legal protection efforts and the impact that occurs to victims if married to the perpetrator of rape. The research method used is normative juridical by processing primary, secondary, and tertiary data which are all related to the topic raised. The results of the discussion of this research are based on article 10 paragraph (1) and (2) of Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence, forcing the victim's marriage to the perpetrator is coercion of rape and is punishable by 9 (nine) years imprisonment and / or a fine of Rp. 200,000,000 (two hundred million rupiah).

Abstract

Abstrak: Dalam memberikan pelayanan bantuan hukum harus didasarkan prinsip kesamaan di mata hukum. Bantuan hukum sesuai dengan Undang-Undang Nomor 16 Tahun 2011 tentang Bantuan Hukum merumuskan tentang peran paralegal, paralegal diartikan secara legitimasi yuridis dalam tatanan hukum nasional yang tercantum dalam Pasal 9 dan Pasal 10 Undang-undang Nomor 16 Tahun 2011 tentang Bantuan Hukum. Kegiatan pelatihan paralegal dilakukan untuk mengatasi permasalahan sedikitnya jumlah advokat bersertifikat di Kabupaten Ngawi. Dengan adanya pelatihan paralegal, diharapkan dapat meningkatkan jumlah individu yang memiliki pengetahuan dan keterampilan hukum untuk memberikan bantuan hukum yang memadai kepada masyarakat. Pelaksanaan kegiatan berupa pelatihan dan pendampingan paralegal dengan teknik pemberian informasi atau penyuluhan hak hukum masyarakat tentang cara penyelesaian kasus tindak pidana kekerasan seksual. Waktu kegiatan akan dilaksanakan pada tanggal 14-15 Januari 2023 dan dihadiri oleh 50 peserta, termasuk Pimpinan Cabang Nasyiatul Aisyiyah Se-Kabupaten Ngawi dan perwakilan mahasiswa dari kampus di Kabupaten Ngawi dan Karesidenan Madiun. Pemateri kegiatan ini diisi oleh tim pengabdian, dosen Fakultas Ilmu Hukum Univesitas Muhammadiyah Surakarta (UMS) dan anggota Lembaga Perlindungan Saksi dan Korban (LPSK). Hasil dari kegiatan pelatihan paralegal ini menunjukkan bahwa 62,5% peserta memahami konsep dan materi umum tentang keparalegalan serta aspek di dalamnya sehingga peserta dinilai sudah siap dan mampu memberikan pelayanan hukum serta menumbuhkan kesadaran Hukum kepada masyarakat.Abstract: In providing legal aid services must be based on the principle of equality in the eyes of the law. Legal aid in accordance with Law Number 16 of 2011 concerning Legal Aid formulates the role of paralegals, paralegals are defined legitimately juridically in the national legal order listed in Article 9 and Article 10 of Law Number 16 of 2011 concerning Legal Aid. Paralegal training activities are conducted to overcome the problem of the small number of certified advocates in Ngawi Regency. With the paralegal training, it is expected to increase the number of individuals who have legal knowledge and skills to provide adequate legal assistance to the community. The implementation of activities in the form of paralegal training and mentoring with the technique of providing information or counselling on the legal rights of the community on how to resolve cases of sexual violence. The activity will be held on 14-15 January 2023 and attended by 50 participants, including Nasyiatul Aisyiyah Branch Leaders throughout Ngawi Regency and student representatives from campuses in Ngawi Regency and Madiun Karesidenan. The speakers for this activity were the service team, lecturers from the Faculty of Law, Universitas Muhammadiyah Surakarta (UMS) and members of the Witness and Victim Protection Agency (LPSK). The results of this paralegal training activity showed that 62.5% of participants understood the concept and general material about paralegals and the aspects in it so that participants were considered ready and able to provide legal services and foster legal awareness to the community.

Abstract

Generation Z, born between the mid-1990s and early 2010s, has grown up in a highly connected digital environment. Social media plays a central role in their daily lives, offering a platform for communication, self expression and access to information. However, social media use also poses significant challenges related to mental health. In Indonesia, those with mental health problems are often viewed as ungrateful and unlucky. This research uses empirical juridical research with an activity plan for 3 months and the scope of Gen Z. This research was conducted in Surakarta City. The materials used in this research are primary legal materials and secondary legal materials. Data collection techniques in the form of questionnaires and analysis techniques, namely qualitative analysis. The purpose of this study is to examine and describe the mental health implications of the influence of social media in the view of legal awareness. The results of the discussion of this research are social media offers benefits to Gen Z, such as social support, opportunities for creative expression, and access to education. However, negative impacts are also significant, including increased anxiety, depression, cyberbullying, and sleep disorders. These factors are often trigerred by unrealistic social comparisons, pressure to be perfect, and exposure to negative content. Gen Z’s legal awareness experiences mental health, because it is triggered by criminal acts committed by Gen Z on social media that result in dealing with the law. This is influenced by knowledge of legal rules, awareness, respect and obedience or compliance with legal rules.

Abstract

This study aims to analyse informed consent, legal protection and health workers in the Regional General Hospital of West Papua Province. The research method used is a quantitative approach. The data analysis used was descriptive analysis and verification analysis using multiple linear regression analysis. The descriptive method focuses on describing and analysing the research results and the verification method is used to test the relationship between variables. The sample consisted of 35 respondents who were taken using saturated sampling technique. The results of descriptive analysis showed that in the variables of informed consent, legal protection, and health workers were in the category of very unaware of the insights of health workers in the application of informed consent in emergency medical cases, and there were still some shortcomings that must be considered to be corrected. The results of this study indicate that statistically the results of verification tests with multiple linear regression analysis models show that the informed consent variable has a significant effect on health workers with a coefficient value of 0.542 and a p-value of 0.044. Legal protection also has a significant effect on health workers with a coefficient value of 1.755 and a p-value of 0.000. Meanwhile, informed consent, legal protection showed a significant effect simultaneously on health workers with an F value of 14,079 and a p-value of 0.000.

Abstract

Pasal 28 H ayat (1) Undang-Undang Dasar 1945 secara langsung mengatakan bahwa jaminan sosial menjadi hak setiap manusia. Pada Pasal 34 ayat (1) kembali disebutkan landasan konstitusional diperlukannya sistem jaminan sosial. Landasan konstitusional selanjutnya yaitu Undang-Undang Nomor 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional. Latar belakang demikian berarti negara memiliki tugas untuk membangun sistem jaminan social yang komprehensif dan memberi “rasa aman” (security) yang lebih luas bagi seluruh warga negara Indonesia termasuk ibu hamil dan melahirkan. Jaminan Kesehatan Nasional merupakan Konsep perlindungan kesehatan yang diadopsi dari berbagai konsep perlindungan sosial yaitu upaya perlindungan bagi rakyat Indonesia pada umumnya dan ibu hamil dan melahirkan pada khususnya untuk menghadapi kerentanan dan sakit yang dilengkapi dengan strategi untuk mendapatkan atau melindungi kesehatan secara komprehensif. Jaminan kesehatan bagi ibu hamil dan melahirkan dapat dimaknai sebagai upaya dari negara untuk menolong ibu hamil dan melahirkan dengan memberikan jaminan atau perlindungan berupa pembiayaan proses kelahiran baik normal (pervaginam) maupun caesar. Terdapat beberapa ketentuan agar proses kelahiran tersebut dapat di biayai oleh pemerintah melalui program JKN BPJS (Jaminan Kesehatan Nasional Badan Penyelenggara Jamninan Sosial). Selama ini tidak banyak upaya sosialisasi kebijakan pembiayaan kelahiran melalui JKN BPJS sehingga sering terjadi pembiayaan tidak dapat di tanggung sehingga dapat merugikan Ibu hamil dan melahirkan maupun fasilitas kesehatan baik tingkat pertama maupun tingkat akhir. Upaya sosialisasi kebijakan ini penting dan memiliki beberapa aspek penting terkait pemenuhan hak konstitusi dan perlindungan hukum ibu hamil dan melahirkan melalui program JKN BPJS.
