Abstract

Government administration encompasses, at the very least, the procedures involved in decision-making and/or actions taken by government bodies and/or officials. This is closely related to the legal policy within the Omnibus Law on Job Creation. Therefore, the Omnibus Law on Government Administration is one of the 79 laws amended through the Omnibus Law on Job Creation. Through the Omnibus Law on Job Creation, the requirement for discretion to be "not contrary to the provisions of the legislation" was eliminated. The removal of this requirement renders discretion no longer bound by statutory provisions, potentially violating statutory provisions in the name of discretion. This paper represents normative legal research or library research, using a statute approach and a conceptual approach. This paper concludes that the concept and legal policy behind the change in discretion requirements in the Omnibus Law on Job Creation provide leeway for government officials and/or administrative bodies to address public service issues. However, this is in contradiction with the general theory and purpose of discretion itself.

Abstract

The government has provided legal protection to auction winners who take part in the auction with good intentions and in line with the rules, including those that are specifically regulated in the Regulation of the Minister of Finance Number 27/PMK.06/2016 concerning Auction Implementation Guidelines. The auction winner of Grosse Minutes of Auction Number: 780/44/2019 felt helpless and burdened by not being able to own the tangible object of what he purchased in the auction because the previous owner or mortgage giver objected to emptying the tangible object voluntarily. This problem made the auction winner burdened to forcibly vacate the tangible object from the auction he won and results in new legal actions. This research was conducted through library research to collect secondary data from primary, secondary, and tertiary legal sources. The owner of the Grosse Minutes of Auction number 780/44/2019, who won this auction and had good intentions, should be provided legal protection. This is done to uphold the principles of justice and give the auction winner legal security over his ownership of the tangible auction objects (land and building) that had been purchased. Article 1977, paragraph 1, of the Civil Code (hereafter referred to as the Civil Code) provides legal protection for purchasers who have good intentions. In essence, this article protects purchasers of movable property. Abstract

An auction is a public sale of goods through bidding, requiring the issuance of an auction minutes (auction minutes). These minutes, prepared by an authorized auction official, are authentic deeds with perfect evidentiary strength. The study focuses on the notary's authority to draft auction minutes and their legal validity as authentic evidence in court when acting as an auction official. This research employs a normative juridical method, analyzing the application of legal norms in positive law. Vendu Reglement, PMK No. 213/PMK.06/2020 (updated by PMK No. 122/PMK.06/2023), and PMK No. 189/PMK.06/2017 govern the authority of Class II auction officials. They must meet educational qualifications (minimum bachelor's degree in law or economics), undergo selection, internship, and inauguration. Auction minutes are valid only if prepared by official auction officers, though Article 15(2) of the Notary Law (UUJN) permits notaries to draft them under specific conditions. Article 1868 of the Civil Code mandates that authentic deeds be prepared by authorized officials, granting notaries acting as auction officials the authority to create legally valid auction minutes, provided no evidence disproves their authenticity.

Abstract

This study aims to analyze the legality of establishing the "Koperasi Desa Merah Putih" (Red and White Village Cooperative) through Presidential Instruction Number 9 of 2025 from the perspective of administrative law. The background of this research arises from legal and governance issues, in which the cooperative's establishment is based solely on a presidential instruction, without attribution to a statutory law that carries binding legal authority. The urgency of this study is driven by the potential disharmony between central government policies and village autonomy, as well as the risk of institutional overlap with Village-Owned Enterprises (BUMDes), which are explicitly regulated under Law Number 6 of 2014 on Villages. This research employs a normative juridical method using statutory, conceptual, and historical approaches. The novelty of this study lies in examining presidential authority through the theories of legality, attribution, discretion, and the principles of the General Principles of Good Governance (AUPB) to assess the validity of policies issued through a presidential instruction. This research differs from previous studies by specifically analyzing the legal validity of a presidential instruction as a basis for establishing public legal entities at the village level. The findings indicate that the use of a presidential instruction as the legal foundation for establishing cooperatives does not fulfill the principle of legality and exceeds the limits of lawful administrative discretion, potentially weakening village autonomy and institutional capacity. Therefore, similar policies should be carefully evaluated in light of good governance principles and a sound regulatory framework, and should ideally be supported by a stronger legal basis at minimum, in the form of a presidential regulation, or preferably, through the enactment of a statutory law that explicitly governs the establishment and management of village cooperatives by the central government.   Penelitian ini bertujuan untuk menganalisis legalitas pembentukan Koperasi Desa Merah Putih melalui Instruksi Presiden Nomor 9 Tahun 2025 dalam perspektif hukum administrasi negara. Latar belakang penelitian ini muncul dari problematika hukum dan tata kelola pemerintahan, di mana kebijakan pembentukan koperasi tersebut hanya berlandaskan pada Inpres tanpa dasar hukum atribusi dalam bentuk undang-undang yang memiliki kekuatan mengikat langsung. Urgensi penulisan didorong oleh potensi disharmonisasi antara kebijakan pusat dengan otonomi desa serta risiko tumpang tindih kelembagaan dengan Badan Usaha Milik Desa (BUMDes) yang telah diatur secara eksplisit dalam Undang-Undang Nomor 6 Tahun 2014 tentang Desa. Penelitian ini menggunakan metode normatif yuridis dengan pendekatan perundang-undangan, konseptual, dan historis. Kebaruan dari penelitian ini terletak pada pengujian kewenangan Presiden menggunakan teori legalitas, atribusi, diskresi, dan prinsip Asas-Asas Umum Pemerintahan yang Baik (AUPB) untuk menilai validitas kebijakan berbasis Inpres. Penelitian ini berbeda dengan studi-studi sebelumnya karena secara spesifik menelaah keabsahan hukum Inpres sebagai dasar pembentukan badan hukum publik di tingkat desa. Hasil penelitian menunjukkan bahwa penggunaan Inpres sebagai dasar pendirian koperasi tidak memenuhi asas legalitas dan melampaui batas diskresi yang sah menurut hukum administrasi negara, serta berpotensi melemahkan otonomi dan kapasitas kelembagaan desa. Instrumen kebijakan serupa perlu dievaluasi secara hati-hati dengan mempertimbangkan prinsip good governance dan kerangka regulasi yang sah, serta sebaiknya didukung oleh landasan hukum yang lebih kuat, setidaknya dalam bentuk peraturan presiden, atau idealnya melalui pembentukan undang-undang yang secara eksplisit mengatur pendirian dan tata kelola koperasi desa oleh pemerintah pusat.

Abstract

The purpose of personnel analysis is to achieve professional civil servants in implementing the principles of good governance. To achieve this goal, one of the policies undertaken by the government is to issue a new regulation in the field of personnel as a substitute for the old regulation, namely Government Regulation No. 94 of 2021. The new policy issued by the government should be firmer, better and more effective. so that it will make Civil Servants who commit disciplinary violations become a deterrent. The new regulations have several changes to disciplinary penalties. One of the changes is severe disciplinary punishment. The old regulations set forth in PP No. 53 of 2010, regulated the existence of a penalty for dishonorable dismissal as civil servants, but in the replacement regulation this was omitted. By eliminating the word disrespect, it has an impact on the staffing sector, so that severe disciplinary punishment becomes lighter. The reduction in disciplinary punishment provides an opportunity for civil servants to commit repeated violations, thereby hampering the principles of good governance. In terms of staffing, these changes have an impact on civil servant pension rights. In this way, all civil servants who have been dismissed, both retired and for committing serious disciplinary violations, will receive pension rights. PP for PNS No. 94 of 2021 should carry out the Law's orders, but the new PP is not in line with Article 84 of the ASN Law.

Abstract

This research addresses the critical necessity of reassessing minimum wage policies with a spotlight on their effects on workers’ justice and welfare. Through the examination of existing policy trends and frameworks for setting wages, the study aims to advocate for a more equitable wage formula that strengthens the government’s role in safeguarding worker interests while ensuring business sustainability. A significant aspect of this investigation is the recent change in wage-setting authority brought about by Government Regulation No. 51 of 2023, which shifts wage-setting power back to a centralized position. Current legal wage policies are not benefiting workers sufficiently, calling for a comprehensive review to design a fair and effective wage framework. The results indicate that with the aim of fairness, the existing minimum wage structure does not guarantee adequate welfare for workers. The study also points out the constrained flexibility of the “alpha” parameter, limiting the wage negotiations between employers and unions to a narrow range of 0.1-0.3. By shedding light on the shortcomings of this policy, this research emphasizes the urgent need for a revised wage formula that genuinely reflects workers’ welfare, representing a shift towards reconciling economic goals with social equity within formal wage policies. An equitable wage should align with the value of the work performed, factoring in difficulty levels, responsibilities, and required skills, while not being below the regional minimum wage.

Abstract

The enforcement of political neutrality among contract-based government employees (PPPK) presents complex legal and institutional challenges within Indonesia’s decentralized administrative system. This study critically examines the legal, constitutional, and cultural dimensions of PPPK neutrality during regional elections, with a particular focus on the case of Purbalingga Regency. Using a socio legal methodology, the research combines doctrinal, normative, and empirical approaches to assess the effectiveness of existing legal instruments, primarily Law Number 20 of 2023, and their practical application in local governance settings. The analysis draws on interviews, survey data, and field observations to evaluate the institutional capacity of civil service bodies such as BKD, KASN, and Panwaslu, as well as the role of civil society in oversight. The findings reveal significant enforcement gaps caused by regulatory ambiguity, overlapping institutional mandates, and limited internalization of neutrality as a professional ethic. Although neutrality is legally required, its implementation is constrained by legal uncertainty related to PPPK’s dual identity as both public officials and holders of constitutional rights. The study argues that enforcement must move beyond formal legal provisions to include cultural legitimacy, institutional coordination, and adaptation to digital era challenges. Drawing on the legal doctrine of proportionality and the concept of law as a living institution, the study recommends regulatory reform, structured ethical training, and participatory monitoring mechanisms to promote accountability and safeguard democratic integrity within the civil service.

Abstract

This paper aims to explain and evaluate the safeguarding of housemaids as a human rights issue, the types of legal safeguards available to them, and the establishment of oversight mechanisms governing the interaction between housemaids and their employers. The need for robust protection arises from the current absence of comprehensive legal frameworks in Indonesia to ensure their rights are upheld. In response, a Draft Bill concerning the Protection of Housemaids is under review as part of the 2023 National Legislation Program (Proglenas), and this paper aims to contribute to the legislative process. Using a normative juridical approach, the research finds that protecting housemaids is a critical step in fulfilling human rights, as acts of abuse and physical violence against them are severe violations. Legal safeguards for housemaids encompass preventive measures such as regulating recruitment processes, employment contracts, working hours, rest periods, leave, wages, overtime pay, and participation in health and work accident insurance programs. Additionally, employer-provided housing must meet health and safety standards. A human rights-based approach to managing work conditions is essential for fostering a harmonious relationship between housemaids and employers. Repressive protection includes mechanisms for resolving disputes, both through non-litigation and litigation methods. Effective legal oversight is vital, which can be conducted routinely by labor agencies and supplemented with online supervision tools, such as a complaint application. This application would allow housemaids and employers to submit complaints, integrated with supervisory staff at the labor department. The conclusion emphasizes that the legal protection of housemaids should be firmly rooted in human rights principles to ensure comprehensive and effective safeguards.

Abstract

This article examines the reconstruction of stakeholder confidence in the collaborative governance process for the sustainability of child-friendly cities in new industrial communities. Research problems are due to the implications of the growth of new industrial societies, differences and conflicts of interest between stakeholders, child growth and development problems, high stunting, juvenile delinquency, street children, and parenting patterns that are not by needs. This study aims to analyze the reconstruction of stakeholder trust in creating awareness and shared commitment to collaborative governance processes to realize the sustainability of child-friendly cities. The research method is qualitative, research data is collected through in-depth interviews and focus group discussions (FGD). The results of the study show that collaborative governance processes are faced with different interest gaps that result in a lack of trust and commitment to realizing a child-friendly city. A joint forum among stakeholders in the child-friendliness campaign efforts has been organized but shows no signs of effectiveness. The lack of synergy between local governments and industry players is present, therefore efforts to rebuild trust in realizing the sustainability of a child-friendly environment need to be optimized through communication, openness, social responsibility, and supervision of local governments.

Abstract

Penerapan Asas Freies Ermessen Dalam Pengambilan Kebijakan Oleh Administrasi Negara Berdasarkan Hukum Administrasi Negara  Merupakan  suatu kebebasan yang diberikan kepada tata usaha negara dalam melakukan penyelenggaraan pemerintahan. Sehingga Freies Ermessen merupakan kemerdekaan bertindak atas inisiatif dan kebijakan sendiri dari administrasi negara. Keberadaanya  yang lain karena adanya suatu peningkatan akan  tuntutan pelayanan publik yang harus di berikan tata usaha negara terhadap kehidupan sosial ekonomi pada warga memiliki keberagaman, dan untuk menyelesaikan persoalan-persoalan yang mendesak yang belum ada aturannya  dan harus dapat dipertanggungjawabkan secara hukum dan moral.
