Abstract

This increase is very important for a country, especially for a developing country like Indonesia. Along with continuous improvement, progress is characterized as a conscious effort by the state. One of the things that is very important in the progress of a nation is its workers, that in the rapid progress of a country, it is the workers who start. That departing from this, the government is an important part in winning progress in the business sector as well as for the national development program which must be endeavored to open up as many jobs as possible from various layers of trade that are able to balance the increase in quality and increase in security for the workforce which can become a must. Whereas Article 27 Paragraph (2) of the 1945 Constitution of the Republic of Indonesia states that "Every citizen has the right to work and a life worthy of humanity". This research is descriptive in nature which aims to collect data as thoroughly as possible that can accurately describe the legal protection of casual daily workers. The type of research used by the authors uses the type of empirical normative legal research. With library and field research data collection techniques. Problems that arise in the use of legal guarantees for precarious workers/laborers are the factors contained in the components of labor instructions, the labor economy as a result of not partnering with trade unions, and based on variables from employers/companies that have not been maximized in implementing legal security in understanding of the labor inspection in force in Indonesia and elements from the government's point of view that are lacking in providing outreach, supervision and firm action against companies that are naughty in running their business which can harm casual daily workers.

Abstract

In Indonesia, there are many business entities to create jobs in order to reduce the unemployment rate. In general, business entities can be separated into 2, namely business entities in the form of legal entities and business entities that are not in the form of legal entities. Business entities in the form of legal entities, namely limited liability companies, state-owned companies, cooperatives, etc. Meanwhile, business entities that are not in the form of legal entities that are often encountered are firms, CVs, and limited partnerships. In running this business, a business entity requires a workforce that plays an important role in the running of the activities of a business. Labor is someone who does a job to produce goods or services to get wages so that they can fulfill their lives. Law Number 6 of 2023 concerning Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation Becomes an Act which aims to provide protection for every worker so that they are not treated arbitrarily, as well as guarantee certainty in life peace of mind for workers, to find out legal certainty for workers who work in business entities that are not legal entities. Wages that are needed by workers to meet their needs are very important. Therefore employers must pay wages in accordance with the minimum wage regulations set by governors in provincial areas and regents/mayors in urban areas. In addition, employers must guarantee that all workers who work in their company are peaceful, safe, and peaceful in carrying out their work. The purpose of this research is also as a science for readers to know that there is legal certainty that protects a worker in obtaining certainty in obtaining a job. matters and these matters cannot be contested.

Abstract

This research aims to examine the legal protection provided by law to a child who becomes a worker in protecting and maintaining the legal rights and growth and development rights of a child. As well as providing knowledge for a child who will become a worker and for a business owner in employing a child into the workforce so that both parties understand their respective rights and obligations. This research was conducted in order to contribute to the legal protection of a child so that the growth and development of children can be guaranteed and protected properly and is intended to be useful for readers and add insight that is so important in applying special treatment for a child who becomes a worker.

Abstract

The buying and selling process can be established by parties (sellers and buyers) from various countries, this can be referred to as international business. In the implementation of this international business process, an international agreement can be made, which is also known as an export-import agreement. So that it will cause legal consequences that bind the parties involved in the agreement. Legal consequences arise in the form of rights and obligations that must be fulfilled by the parties. As in the import-export agreement between the Ketiara Coffee Traders Cooperative (KOPEPI Ketiara) from Takengon, Central Aceh Regency with Royal Coffee from the United States. However, in its implementation there is a civil dispute in the form of default on the export-import agreement that has been made. The method used in this research report is normative law, with library approach techniques. The theories used in this research are agreement theory and effectiveness theory. The conclusion obtained in this research is that the exporter and importer continue to perform their obligations but not on time and the parties agree to resolve the dispute through non-litigation by negotiation. Abstract

International Civil Agreements are legal relationships designed to facilitate support, business, or trade among the involved parties. These agreements entail elements of foreign involvement. The World Trade Organization (WTO) plays a pivotal role in expanding international trade and safeguarding the interests of its member countries, particularly developing nations. The WTO holds significant responsibility in overseeing and facilitating international trade to promote economic development and poverty reduction. Principles in resolving international trade disputes include: Principle of agreement among parties, freedom to choose dispute resolution methods, choice of law, good faith, and the principle of exhaustion of local remedies. The identified problem formulation revolves around how the application of international civil law influences free trade agreements in resolving international disputes and the efforts made in handling free trade disputes through international legal resolution. This study incorporates the theories of Lex loci solutionis, the proper law of contract, legal protection theory, and international agreement theory. The research adopts a normative approach involving the examination and analysis of applicable legal regulations. The application of international civil law here is highly complex and crucial to resolving potential disputes within the context of free trade agreements. Resolving international disputes through international civil law can support fair and regulated free trade while fostering cooperation among nations and relevant parties, employing principles and theories of international civil law such as lex loci solutionis and the proper law of contract. This approach significantly aids in resolving international disputes within free trade agreements. Utilizing international dispute resolution mechanisms like GATT and WTO, as well as bilateral and multilateral agreements, stands as a critical step in safeguarding free trade and promoting equitable rules in international trade. In situations involving trade disputes, efforts toward resolution must encompass both judicial and non-judicial avenues. Non-judicial avenues involve more flexible diplomatic methods such as negotiation, consultation, mediation, and arbitration. Judicial avenues are formal and binding, involving courts or tribunals in dispute resolution. These efforts represent positive strides towards achieving sustainable goals in free trade.

Abstract

People with disabilities also have the same rights as citizens. In fact, there is still a lot of discrimination of the rights of persons with disabilities in working and looking for work. The usefulness of this research is as a reference for development efforts in the field of law, especially in the field of labor regarding the application of legal protection for persons with disabilities. The purpose of this research is to provide knowledge to readers in understanding the importance of the role of society, government, and companies in respecting the rights of persons with disabilities. This research uses juridical-normative research methods by reviewing the law from various aspects and approaches to the legislation concerned. The nature of this research is descriptive-analytical research, which is a method of taking existing data so that it can be described more fully. Persons with disabilities have the right to obtain guarantees of legal protection through guarantees of rights that are expressly stated in laws and regulations regarding persons with disabilities, including having guarantees of freedom from neglect, exclusion, discrimination, threats to respect for integrity. Persons with disabilities have the right to get a job according to the level of disability as well as employers guarantee the protection of workers with disabilities according to the level of disability of these workers.

Abstract

Pencemaran laut adalah salah satu masalah yang sangat serius karena dapat merusak lingkungan, alam dan kualitas air. Hal ini dapat terjadi karena masuknya material seperti limbah, bahan kimia, tumpahan minyak, dan lain sebagainya. Jumlah minyak montara yang tumpah per hari diperkirakan sekitar 500.000 barel minyak selama 74 hari Hal ini sangat merugikan negara Indonesia khususnya masyarakat Nusa Tenggara Timur. Permasalahan yang akan diteliti dalam penelitian ini adalah seberapa besar pertanggungjawaban Australia terhadap Laut Timor akibat kebocoran minyak Montara dan bagaimana menyelesaikan sengketa antara Indonesia dan Australia mengenai pencemaran di Laut Timor. Metode penelitian normatif merupakan metode yang digunakan dalam penelitian ini. Hasil penelitian ini adalah bentuk tanggung jawab negara Australia atas pencemaran Laut Timor akibat tumpahan minyak Montara bersifat mutlak atau tanggung jawab mutlak, penyelesaian sengketa saat ini sedang berada di tahap negosiasi yang dilakukan antara Indonesia dan Australia.

Abstract

Berawal dari gugatan IKEA Swedia kepada IKEA PT. Ratania Khatulistiwa Indonesia, dimana gugatan tersebut atas dasar bahwa terdapat kesamaan nama merek, selain itu penggugat beralasan bahwa tergugat dipandang tidak beritikad baik karena terdapat motif tergugat meniru dan mengambil keuntungan dari popularitas merek “IKEA”. Namun dalam perlawanan tergugat membuktikan bahwa merek IKEA Swedia sudah 3 tahun tidak digunakan, dalam hal ini sesuai dengan ketentuan Pasal 61 ayat (2) huruf a Undang-Undang Nomor 15 Tahun 2001 tentang Merek. Penelitian ini bertujuan mengetahui alasan penyelesaian sengketa ini dilakukan di Indonesia dan kompetensi hakim dalam menentukan hukum yang digunakan dalam penyelesaian sengketa melalui pendekatan Hukum Perdata Internasional. Metode pendekatan penelitian yang digunakan adalah metode pendekatan normatif dan yuridis yang berdasarkan kajian pustaka. Hasil dari penelitian ini ialah bahwa dalam perdagangan harus memperhatikan perkembangan mereknya sendiri baik masih digunakan atau tidak agar tidak terjadi perebutan merek karena ada undang-undang yang mengatur bahwa jika merek tersebut tidak digunakan selama 3 tahun berturut-turut maka dapat dihapuskan secara hukum dari badan pendaftaran merek umum.

Abstract

Law Number 1 of 1974 concerning Marriage contains a section on religiosity. A man and a woman become husband and wife with the aim of realizing a happy and eternal family based on the One Almighty God. This is the definition of marriage itself. The Civil Code and the Marriage Law have different definitions of marriage: in Article 26 of the Law "The Law views the issue of marriage only in civil relations". The research method used in this study is descriptive normative legal research. With the technique of statutory regulations, as well as other related documents that are related to science, the development of its theory. Primary legal materials are obtained from Law Number 1 of 1974 concerning marriage, while secondary legal materials, namely the Civil Code, textbooks, legal journals, expert opinions and legal experts. The data obtained are both secondary and primary. Because there are foreign components in legal relations, international civil law applies. Algemene Bepalingen are general regulations that regulate international civil norms in Indonesia. In the concept of international civil law, there are 2 types of schools, namely: 1) Internationality which requires international or multilateral civil law. 2) Nationality because each country has different procedures for International Civil Law for Inter-National Marriage. Marriage between two people from different countries is defined as a mixed marriage based on Article 57 of the Indonesian International Civil Law Marriage Law. However, the third factor, not differences in religion, ethnicity, or social class in Indonesia, is the cause of this gap.

Abstract

AbstractThe ease of filing a bankruptcy petition in Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations (Bankruptcy Law PKPU) creates vulnerabilities for public companies, even though the public companies have good intentions and healthy financial conditions. The absence of insolvency test regulations creates a legal vacuum that has the potential to be misused by creditors. This study aims to examine the urgency of implementing an insolvency test in Indonesian bankruptcy law and to analyze the need for legal protection for public companies that are still solvent from the potential misuse of bankruptcy petitions through the application of an insolvency test. The research method used is normative law, which uses a legal norm system, which includes research on legal principles and legal rules, in addition this study uses a descriptive inductive approach. Public companies whose shares are owned by many investors need legal protection so that the shareholder community is also protected. The use of insolvency tests such as the balance sheet insolvency and cash flow insolvency methods can be an objective basis for the court in deciding on bankruptcy petitions against public companies. The absence of regulation on insolvency test in Bankruptcy Law PKPU is the impetus to reform bankruptcy law in Indonesia. Therefore, there needs to be a provision that requires bankruptcy test before a public company can be filed for bankruptcy, to ensure that its financial condition is truly insolvent. Keywords: Public Company; Bankruptcy; Insolvency Test.
