Abstract

This study aims to determine the concept of guardian justice for the rights of polygamous orphans in the perspective of al-Maṣlaḥah al-Mursalah. This research uses a type of qualitative descriptive research using a normative approach and using a deductive analysis method. The results of the study show that: (1) the urgency of polygamy justice in Islam is preventing tyranny against wives, avoiding the punishment of Allah SWT. the pain on the Day of Judgment, avoiding divisions in the family, not making it easy in Allah's law. and stay away from polygamy if you not be able to do justice to all wives; (2) the concept of guardianship for orphans in Islamic law, namely the guardianship of orphans is the same as the order of guardians in marriage; (3) the concept of guardian justice for the rights of polygamous orphans, namely that there is no difference in justice between polygamous orphans by their guardians and other women in terms of maintenance, clothing, shelter, night distribution and husband's kindness including giving dowry. The concept of guardian justice for the rights of polygamous orphans in the perspective of al-Maṣlaḥah al-Mursalah is carrying out polygamy procedures according to state law, namely the recording of polygamy in the Religious Courts which must be carried out by guardians who want to polygamy orphans under their guardianship for the benefit of personal, family and society.

Abstract

Major depression is one of the serious psychological problems and can affect a person's quality of life significantly and can hinder individuals from carrying out worship optimally. This study aims to analyze the concept of rukhsah and its implications for people with major depression in the perspective of religious jurisprudence. This research is library research using normative and philosophical approach methods. The results showed that in the perspective of religious jurisprudence, people with major depression get rukhsah to carry out worship according to their conditions. In addition, this study also found several examples of rukhsah in worship such as the loss of worship obligations, replacing worship with lighter ones and getting help from others in carrying out worship. This research makes an important contribution in understanding the concept of rukhsah in religious jurisprudence for people with major depression. These findings can be used as a guideline for people with major depression and religious practitioners in facing challenges in carrying out worship. It is hoped that this research can increase public understanding and awareness and provide practical solutions in fulfilling worship obligations for people with major depression.

Abstract

This research aims to find out and understand the rules of mā ḥurrima saddan li al-żarī'ah ubīḥa li al-maṣlaḥah al-rājiḥah and their implementation in the tawaf ifāḍah of Hajj for menstruating women. This researcher used a type of library research using a normative and conceptual approach. The results of the research found that: first, the rules of mā ḥurrima saddan li al-żarī'ah ubīḥa li al-maṣlaḥah al-rājiḥah (something that is forbidden because of the saddan proposition li al-żarī'ah, then it becomes permissible if there is great benefit). What is forbidden to refuse rather than damage is not all that is absolutely permitted for the benefit or greater good, but it is mandatory to pay attention to the level of the benefit and its fulfillment because the greater benefit is permitted. Second, the prohibition of menstruating women from performing tawaf ifāḍah is saddan li al-żarī'ah that menstruating women are not allowed to pass through or linger in the mosque. However, based on the rules of mā ḥurrima saddan li al-żarī'ah ubīḥa li al-maṣlaḥah al-rājiḥah, contemporary ulama provide special space for the permissibility of tawaf ifāḍah for menstruating women when performing the Hajj. This is by looking at the advantages and disadvantages that the opportunity to perform the Hajj nowadays is not an easy thing, both in terms of time, energy, funds, and opportunities for each person in carrying out the Hajj pilgrimage. It is hoped that the research implications will become a reference, literature or consideration, as well as become a positive reference and information for society in general.

Abstract

New or contemporary phenomena are always emerging along with the times. This requires a scientific answer or fatwa related to the problem, This research aims to find out the dawābiṭ fatwa in responding to contemporary fiqh problems. The problems raised by the author in this study are; First, what is the position of fatwa in resolving fiqh problems? Second, How is ḍawābiṭ fatwa in resolving contemporary fiqh problems? This research is a library research using normative and philosophical approach methods. The results of the study were found as follows; First, contemporary jurisprudence has a very important role in determining Islamic laws in the modern era. Second, ḍawābiṭ fatwa in resolving contemporary fiqh problems, namely: 1) Fatwa must be based on a deep understanding. 2) Analysis of complex problems with basic points. 3) The decision of the fatwa should not be hasty. 4) Fatwa decisions must involve experts in certain fields. 5) Fatwas must take into account differences in customs and traditions. 6) Fatwas must be made and based on experience. 7) The right fatwa must be based on the principles of fiqh. 8) Fatwa must be backed up or based on evidence and evidence. 9) The obligation of collective fatwas in the fatwas of the ummah and their priority over individual fatwas. 10) Fatwa must agree and be close to the mind regarding the rules of fiqh.
