Abstract

This study examines the influence of the MUI Fatwa Number 83 of 2023 concerning the Legal Ruling on Supporting the Palestinian Struggle on the purchasing interest in Israeli products among the Muslim community in Makassar City, from the perspective of Islamic economic law. The main issue addressed is the low level of public awareness and understanding of the fatwa, amid challenges in identifying products affiliated with Israel and the dominance of global consumer culture. Using a quantitative method within the framework of Islamic economic law, this research involved 156 respondents selected through purposive sampling and analyzed using a Likert scale questionnaire, validation and reliability tests, and regression techniques. The findings indicate that the MUI Fatwa Number 83 of 2023 has a positive and significant effect on purchasing interest (p = 0.000); however, the positive direction of the effect reveals a contradiction between the substance of the fatwa which calls for a boycott and the community’s consumption behavior, which continues to maintain an interest in Israeli-affiliated products. This condition reflects a weak awareness of Islamic economic law among the Muslim community in Makassar City. These findings underscore the need to strengthen education, socialization, and the provision of Sharia-compliant product alternatives to enhance the fatwa’s implementation. Thus, the study concludes that the effectiveness of the fatwa in influencing consumer behavior remains suboptimal and requires ongoing strategic support so that the principles of maslahah, hisbah, and Islamic consumption ethics can be realized in community economic practices.

Abstract

This study examines the conceptual and practical distinctions between corruption, gifts, and grants within Indonesia’s legal framework while analyzing how contemporary Islamic jurisprudence interprets similar practices that may lead to unethical influence. This study's goal is to address the central problem of determining when a gift becomes an illicit benefit, how moral considerations shape decision-making by public officials, and why the convergence of ethical and legal standards is essential for maintaining public trust. Using a normative juridical method, the study reviews legal norms, scholarly opinions, ethical principles, and selected cases to understand how rules and moral reasoning interact. The findings of this study indicate that Indonesian positive law clearly distinguishes corruption, grants, and gifts based on the relationship to public office, conflicts of interest, and transparency obligations as regulated under the Anti-Corruption Law and KPK regulations. In contrast, contemporary Islamic jurisprudence evaluates grants and gifts given to public officials as potentially constituting risywah when they are accompanied by an intention to influence decisions or result in social injustice. Comparative analysis demonstrates that the legal-formal approach of positive law and the moral-transcendental approach of Islamic jurisprudence are not contradictory but complementary. Both legal systems converge on the shared objective of safeguarding public integrity, justice, and the public interest. The integration of normative legal mechanisms with ethical principles derived from maqāṣid al-sharī‘ah produces a more comprehensive framework for corruption prevention. The novelty of this research lies in the formulation of an integrative analytical model that bridges legal certainty with moral consciousness. This model reframes the regulation of gratification not merely as an administrative obligation but as an instrument for cultivating ethical integrity among public officials. Accordingly, the study contributes both theoretically to the development of integrative legal scholarship and practically to the advancement of morally grounded anti-corruption policies in modern society.

Abstract

This paper elaborates in depth on the position of maqasid al-syari'ah towards minority fiqh. This research is a library research, descriptive in nature. This research uses normative (syar'i) and sociological theological approaches. Primary data sources are data obtained through literature studies with primary data taken from the Koran, hadith, jurisprudence books, books that study minority fiqh or others that are related to this research. The results showed that the position of maqasid al-syari ah is the foundation and foundation for the concept of minority fiqh. The format of the rules of maqasid al-syari'ah contained in minority jurisprudence, namely: First: al-taysir waraf' al-haraj (eases and raises difficulties). Second: tagayyur al-fatwa is a change in fatwa. Third: tanzil al-hajah manzilah aL-darurat (Needs occupy an emergency). Fourth: 'Urf or customs in society. Fifth: Annazru ila al-Ma'alat (seeing the legal consequences). Sixth: The congregation as a judge.

Abstract

This study examines the role of wives as family breadwinners from the perspective of normative Islam and contemporary social realities. The study employs a qualitative approach with an interdisciplinary framework that combines normative Islamic legal analysis and sociological perspectives. Primary data were collected through interviews and observations of 12 families in the Pao-Pao Permai Complex, Gowa, South Sulawesi. To date, research in Indonesia has been dominated by normative-doctrinal approaches and has not extensively examined family livelihood practices from an empirical and sociological perspective. The findings reveal four patterns of family breadwinners: (1) both husband and wife work and share financial responsibilities equally; (2) both partners work, but the wife contributes more significantly to household income; (3) the husband acts as the primary breadwinner while the wife focuses on household responsibilities; and (4) the wife becomes the sole breadwinner, particularly in single-parent households or when the husband lacks stable employment. This study demonstrates that the husband’s role as the sole provider is not an absolute theological obligation but rather a sociological phenomenon shaped by historical and social contexts. Thus, women also possess the capacity and legitimacy to assume the role of family breadwinner in accordance with contemporary socioeconomic conditions. This research contributes to the development of Islamic family law by offering a reinterpretation of the concept of maintenance based on maqāṣid al-sharī‘ah, which emphasises the welfare and justice of the family. This study affirms that a flexible division of maintenance can be justified within the framework of Islamic law, thus necessitating a more contextual approach to family law.
