Abstract

Abstrak: Adanya stigma negatif dan sulitnya akses informasi bagi penyandang disabilitas menyulitkan mereka untuk memperoleh pekerjaan ataupun membuat usaha sendiri. Untuk mengatasi masalah ini, pengabdian kepada masyarakat ini bertujuan untuk memberikan solusi agi penyandang disabilitas yang kurang mendapatkan informasi terkait pendaftaran perseroan perorangan sehingga mereka cinderung kesulitan untuk memperoleh izin atas usaha yang mereka miliki adanya pengabdian ini tentu dapat meningkatkan taraf hidup mereka terutama dalam aspek ekonomi dengan adanya izin yang jelas terkait usaha mereka sehingga mereka dapat menjalankan usahanya dengan lancar. yang dapat meningkatkan taraf hidup mereka terutama dalam aspek ekonomi . Pada kegiatan ini, menggunakan metode survei yaitu suatu penelitian yang dilakukan untuk memperoleh data-data dari fenomena yang berlangsung dan mencari keterangan-keterangan secara factual dari suatu kelompok. Kemudian dilanjutkan dengan analisis pendampingan pendaftaran perseroan perorangan bagi penyandang disabilitas. Hasil pengabdian kepada masyarakat menunjukkan bahwa adanya pendampingan dan pelatihan terkait pendaftaran perseroan perorangan memberikan pengetahuan dan juga keterampilan yang diperlukan untuk memberikan perlindungan dan kepastian hukum dalam menjalankan usaha. Kegiatan pendaftaran perseroan perorangan ini menghasilkan 3 (tiga) buah Sertifikat Nomor Induk Berusaha dan 9 (Sembilan) Sertifikat Pendaftaran Pendirian Perseroan.Abstract: The existence of negative stigma and difficult access to information for people with disabilities makes it difficult for them to get a job or create their own business. To overcome this problem, this community service aims to provide solutions for people with disabilities who lack information related to individual company registration so that they have difficulty obtaining permits for their businesses the existence of this service can certainly improve their living standards, especially in the economic aspect with a clear permit related to their business so that they can run their business smoothly. In this activity, using the survey method is a study conducted to obtain data from ongoing phenomena and seek factual information from a group. Then followed by the analysis of assistance for individual company registration for persons with disabilities as many as 13 people. The results of community service show that assistance and training related to the registration of individual companies provide the knowledge and skills needed to provide protection and legal certainty in running a business. This individual company registration activity resulted in 3 (three) certificates of business Identification Number and 9 (nine) certificates of registration of Company establishment. Abstract

This research endeavors to assess the imperative need for global halal standards in product certification within the regulatory frameworks of diverse countries. Employing normative juridical research methods alongside statutory, comparative, and conceptual approaches, the study seeks a comprehensive understanding of the existing landscape. The findings underscore significant disparities among halal certification bodies across various countries, attributable to variations in regulations, diverse schools of thought, cultural influences, and nuanced considerations of maslahah (public interest). These divergences necessitate urgent attention and intervention. It becomes apparent that the Standards and Metrology Institute for the Islamic Countries (SMIIC) holds a pivotal role in harmonizing global halal standards. Such harmonization is critical not only to safeguard the interests of Muslim consumers on a global scale but also to mitigate potential international trade disputes arising from the export and import of halal products. This research underscores the pressing need for concerted efforts to establish unified global standards, ensuring the integrity of halal certification processes and fostering a more transparent and equitable global trade environment for halal products. The study contributes to the ongoing discourse on harmonization and standardization within the halal industry, emphasizing the potential for enhanced consumer protection and international trade facilitation.

Abstract

The inheritance rights of a child who becomes an heir is the main thing to be studied in more depth in this research. Especially when the child who is gifted by God has special needs. As a normal heir or legal subject can be declared legally capable, but how is the legal protection of rights with children with special needs, the question is the first formulation of the two formulations, while the second formulation is how rights and obligations in the perspective of civil law. This research was completed with a normative juridical method, and with a literature review approach, this research method has a descriptive analysis nature, meaning that the two formulations will be explained in detail from the elaboration of primary legal sources and tertiary legal sources. This study concludes that the legal protection of heirs to children with special needs has been regulated in Article 432 of the Civil Code as a fundamental paradigm in the implementation of legal protection. While the rights and obligations obtained need to be facilitated by the concept of guardianship or guardianship, so that the rights and obligations of children with special needs can be accommodated optimally. Abstract

Law Number 16 of 2019, concerning Amendments to Law Number 1 of 1974 concerning Marriage, has substantially renewed the age of Marriage to 19 years for boys and girls as a form of government effort to reduce the number of child marriages. However, Article 7 Paragraph (2) provides opportunities for child marriages under the age of 19 years. The Court gives this opportunity through the provision of marriage dispensation. Marriage dispensation is also found in Bangladeshi marriage law. Article 19 of Bangladesh's Child Marriage Restriction Act states that girls under 18 and boys under 21 can enter into Marriage if parental or court approval can be obtained in exceptional circumstances. The prevailing marriage dispensation breaks the expectation of a decline in child marriages. This study aims to explain the provision of dispensation for Marriage to minors, which compares the arrangements in Indonesia and Bangladesh. This research is qualitative research with a normative juridical approach. Solve problems using a statutory approach and a comparative approach with data obtained through a literature study, which is described in an analytical descriptive manner. The results of the study show that there is a difference in regulating the dispensation of Marriage for minors in Indonesia and Bangladesh. The conclusion of this study shows that regulations in both countries granting dispensation for Marriage to minors are contradictory to changes in the rules for the age limit for Marriage.

Abstract

Penelitian berusaha untuk menganalisis praktik greenwashing dengan kerangka hukum yang ada di Indonesia, baik dalam perlindungan hukum terhadap praktik greenwashing, maupun tanggung jawab korporasi dalam mengimplementasikan praktik greenwashing sebagai pelaku usaha. Metode penulisan yang digunakan adalah metode hukum normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan perbandingan. Hasil dari studi ini menunjukan bahwa terdapat beberapa regulasi yang dapat menjadi payung hukum terhadap praktik greenwashing serta dapat mengakomodasi kepentingan konsumen dan lingkungan. Selain itu penulis juga mendapati bahwa prinsip product liability atau pertanggungjawaban produk merupakan tanggung jawab yang harus dilakukan korporasi ketika melakukan praktik greenwashing. Penulis juga menggarisbawahi tentang e-commerce dapat menjadi salah satu ancaman adanya praktik greenwashing. Maka dari itu perlu peran pemerintah dalam pembaharuan regulasi terkhusus terhadap praktik greenwashing, dan kesadaran konsumen dalam menilai dan menelaah sebelum membeli produk dapat dikategorikan sebagai produk ramah lingkungan.

Abstract

Open banking with Open Application Programming Interface (open API) technology is an initiative aimed at streamlining the payment system in Indonesia. The open API allows banks to integrate their systems with digital financial service providers (fintech) and bold trade (e-commerce) providers by disclosing customer transaction data. This study investigates the urgency of open API standardization in implementing open banking in Indonesia. This study uses a normative juridical approach to secondary data. The data includes primary, secondary, and tertiary legal materials. In addition, it also uses qualitative normative data analysis methods. It was concluded that before the National Open API Payment Standard (SNAP) stipulation, the process of sharing data between banks and fintech and/or e-commerce still needed to be standardized but was only based on an agreement between the parties. Banking in Indonesia has various open API standards that can affect the protection of customer data. According to the Financial Services Authority Regulation Number 12/POJK.03/2018, the relationship between banks, fintech, and/or e-commerce in providing digital banking services based on agreements between parties needs to be stronger. OJK is indeed present as a supervisory agency. However, the parties will eventually come back to a deal between themselves. Unlike the Regulations of the Financial Services Authority, the Regulations of the Members of the Board of Governors, which form the legal basis for SNAP, provide standards that must be complied with by both service providers and service users. However, implementing SNAP-based open APIs still requires personal data protection regulations.

Abstract

This paper explores the transformative potential of class action lawsuits in redefining justice for insurance policyholders in Indonesia. Through an in-depth examination of the legal landscape and specific cases, the study delves into the mechanisms and implications of leveraging class actions as a means of seeking justice within the insurance sector. By analyzing notable instances, such as the class action lawsuit initiated by insurance policyholders of PT Asuransi Jiwasraya and PT Asuransi Jiwa Adisarana WanaArtha, the paper scrutinizes the impact of collective legal action in addressing grievances and restoring violated rights. The research also navigates the legal provisions surrounding class actions in Indonesia, shedding light on their relevance and effectiveness in the pursuit of justice for insurance policyholders. Ultimately, this paper contributes to the ongoing discourse on legal remedies within the insurance industry, offering insights into the potential of class action lawsuits as a powerful tool for policyholders to assert their rights and demand justice in the Indonesian legal context.

Abstract

Indonesia, the largest Muslim-majority country, requires a substantial amount of food to meet the needs of its population. This research examines efforts to protect consumers through the inclusion of non-halal information on food products. The study focuses on the regulatory framework, including the Consumer Protection Law, Law No. 33 of 2014 on Halal Product Assurance, and relevant regulations in Indonesia. It aims to analyze how including non-halal information contributes to protecting consumer rights concerning food products. Employing a juridical-normative approach, the research utilizes literature review and interviews. The findings underscore the importance of transparency regarding the halal status of products for consumers, with the inclusion of non-halal information serving as a protective measure for consumer rights. It reaffirms the business actor’s responsibility to provide such information on products not meeting halal standards. The study reveals that regulations mandating the inclusion of non-halal information can uphold the right to information for Muslim consumers. Should consumer rights remain unmet, individuals retain the option to seek legal recourse through civil, criminal, and administrative avenues. This research contributes to comprehending consumer protection practices concerning the halal status of food products in Indonesia. It lays the groundwork for policy enhancements and raising producer awareness of consumer rights in the context of halal food products.

Abstract

This article intends to describe the function of new and renewable energy in assisting the halal sector in Indonesia by using descriptive and comparative analytical studies on initiatives carried out by Germany about new and renewable energy. Indonesia has a very high potential to develop into a global powerhouse for halal food because its population is predominately Muslim. To accomplish this goal, the halal industry needs cooperation from various areas, one of which is innovative and renewable energy. However, Indonesia's inconsistent rules, particularly those governing investment, impede the development of new renewable energy sources. Investors must grow the initial business of renewable energy because it has high costs but can reduce the consumption of electricity or fossil fuels. Following that, this new renewable energy will be applied to various other industries, including halal food and beverages, pharmaceuticals and cosmetics, fashion, and tourism. The geographic position of Indonesia is another aspect that encourages the development of new renewable energy sources.

Abstract

This research aims to explain the types and forms of liability held by e-commerce platforms in cases of fraud by verified business actors. This includes a legal analysis of the platform's liability towards aggrieved consumers. This can improve the liability mechanism, e-commerce platforms can build consumer trust. Consumers who feel protected are more likely to shop online, which in turn can increase transaction volume and profits for e-commerce platforms. The method used in this research is Juridical-Normative by conducting research sourced from literature and from the results of decisions related to the Law or commonly referred to as library legal research conducted by examining secondary materials only. The results of this study are that consumer protection in digital transactions in Indonesia is regulated by the GCPL and ITE Law. In the case of fraud in ordering roof tiles on Tokopedia, there is negligence on the part of Tokopedia and vendors that violate the law. Consumer rights according to the GCPL have been violated, so the responsibility is not only on the deceptive seller but also on Tokopedia as a platform provider. However, Tokopedia does not support its consumers in resolving this dispute.
