Abstract

This research is entitled “Binding Force of Non-Disclosure Agreement as Means of Trade Secret Protection in Decision No. 832/Pdt.G/2023/PN.Jkt.Brt” The object of this study is the regulation and implementation of NDAs within the framework of Indonesia’s positive legal system. The purpose of this research is to explain the form of overlap between civil law and intellectual property law, which results in weak legal certainty in the protection of trade secrets. The research method applied is normative juridical research with a statutory and case study approach, focusing on Decision No. 832/Pdt.G/2023/PN.Jkt.Brt. The results show that NDAs are legally recognized as innominate agreements under Article 1338 of the Indonesian Civil Code. However, their application in the context of trade secret protection remains ineffective due to differences in legal regimes and institutional arrangements under Law No. 30 of 2000. The case analysis demonstrates that the court still interprets NDA violations narrowly as contractual breaches rather than as infringements of intellectual property rights. This condition reflects that the function of NDAs as instruments for trade secret protection has not yet been fully optimized. The findings of this research illustrate the need to strengthen the synergy between civil law and intellectual property law in the practice of trade secret protection in Indonesia.

Abstract

The increasing public interest in fast food restaurants demands the implementation of food safety standards to protect consumers. This study examines the application of consumer security and safety principles in food production processes at fast food restaurants and the role of the Health Department. This study utilizes normative juridical methods complemented by a statutory approach and data sources through literature studies and interviews with the DKI Jakarta Provincial Health Office, which is responsible for guidance and supervision of ready-to-eat processed foods. The findings show that Indonesian legal regulations have adequately regulated the standardization of food production processes by applying consumer security and safety principles. The Health Office plays an active role in maintaining consistent application of these principles through guidance programs, including Ready-to-Eat Food Safety Training and educational material dissemination, as well as supervision through Environmental Health Inspections and mandatory Hygiene Sanitation Eligibility Certificates, accompanied by administrative sanctions for businesses violating food safety standards.

Abstract

A legal tool known as halal certification attests to a product's halal status and ensures compliance with Islamic law. Implementing halal certification involves more than inspection and testing; it also requires certifying bodies to ensure that business actors comply with product-naming rules during the certification process. The purpose of this study is to investigate human resource development in the halal certification process via the regular and self-declaration pathways established by BPJPH, MUI, and LPH, and to analyse the monitoring of the halal certification mechanism through these two channels. With a statute-based and case-based methodology, this study employs a normative juridical approach. Primary, secondary, and tertiary legal literature found through library research are the sources of the data used. The study's findings indicate that BPJPH, MUI, and LPH conduct more stringent oversight of the halal certification procedure through standard channels, involving Halal Auditors and Halal Supervisors who possess competency certifications in compliance with legal requirements. However, because the self-declaration pathway depends on the business owner's self-declaration and PPH Assistants' confirmation, it is typically more vulnerable to exploitation.

Abstract

Low financial literacy amidst high digital service access leaves society, particularly university students, vulnerable to detrimental financial practices such as online loan traps and hidden costs. Universitas Pembangunan Nasional Veteran Jakarta was selected as the partner location based on the strategic demographic of students as the younger generation and the institution's commitment to national defense and sustainability values. This activity was implemented using the Plan-Do-Check-Action (PDCA) framework, which integrates a pentahelix collaborative approach to ensure systematic program execution and measurable impacts. The community service results demonstrated a significant 25.7% increase in participants' financial literacy and consumer rights awareness, with the average score rising from 3.35 to 4.14. Furthermore, the program successfully fostered critical awareness among students regarding the connection between financial systems and the climate crisis while initiating the formation of the Consumer Sustainability Community as an advocacy platform. This cross-sector synergy proved effective in establishing an educational ecosystem that empowers students to become responsible and legally literate consumers in the digital financial era.

Abstract

This study examines the causal relationship between asset–liability imbalance, the failure of the Postponement of Debt Payment Obligations (PKPU) mechanism, and the resulting director liability in the bankruptcy of PT Sri Rejeki Isman Tbk (Sritex). The research is motivated by a normative gap in Indonesia’s Bankruptcy and PKPU Law, which does not require an insolvency test, thereby allowing corporations in a state of absolute insolvency to access PKPU despite lacking any realistic prospect of going concern. This study employs a normative juridical method using statutory and case approaches, with particular reference to the Commercial Court of Semarang Decision Number 2/Pdt.Sus-Homologation/2024/PN Niaga Smg. The findings reveal that the extreme disparity between Sritex’s assets and liabilities rendered its restructuring plan legally and economically unfeasible, making creditor rejection a rational outcome that normatively necessitated a bankruptcy ruling. Furthermore, the board of directors’ failure to fulfil fiduciary duties, especially the duty of care and transparency, invalidated the protection of the Business Judgment Rule and triggered potential personal liability. The novelty of this research lies in its integrated analytical framework that conceptualizes asset–liability imbalance as both a determinant of PKPU infeasibility and an indicator of fiduciary breach leading to director liability, thereby providing a normative basis for insolvency law reform in Indonesia.     Penelitian ini mengkaji hubungan kausal antara ketidakseimbangan aset dan utang, kegagalan mekanisme Penundaan Kewajiban Pembayaran Utang (PKPU), serta implikasi pertanggungjawaban direksi dalam kepailitan PT Sri Rejeki Isman Tbk (Sritex). Kajian ini dilatarbelakangi oleh kekosongan norma dalam Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan PKPU yang tidak mewajibkan penerapan insolvency test, sehingga perusahaan dalam kondisi insolvensi absolut tetap dapat mengakses PKPU meskipun tidak lagi memiliki prospek going concern. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus, khususnya melalui analisis Putusan Pengadilan Niaga Semarang Nomor 2/Pdt.Sus-Homologasi/2024/PN Niaga Smg. Hasil penelitian menunjukkan bahwa disparitas ekstrem antara nilai aset dan liabilitas Sritex menjadikan rencana perdamaian tidak layak secara hukum dan ekonomi, sehingga penolakan kreditur merupakan konsekuensi rasional yang berujung pada putusan pailit. Selain itu, kegagalan direksi dalam memenuhi kewajiban fidusia, terutama duty of care dan prinsip transparansi, menggugurkan perlindungan business judgment rule dan membuka ruang pertanggungjawaban pribadi. Kebaruan penelitian ini terletak pada konstruksi analitis yang menempatkan ketidakseimbangan aset dan utang sebagai parameter kelayakan PKPU sekaligus indikator pelanggaran fiduciary duty yang menimbulkan personal liability, serta memberikan justifikasi normatif atas urgensi reformasi hukum insolvensi di Indonesia.

Abstract

This study examines the legal protection afforded to good-faith housing buyers when objects of a Binding Sale and Purchase Agreement (PPJB) are included in a developer's bankruptcy estate, focusing on Supreme Court Decision No. 24 K/Pdt.Sus-Pailit/2025. The research employs a normative juridical method, using statutory, conceptual, and case approaches to analyze bankruptcy law, consumer protection norms, PPJB regulations, and judicial reasoning. The study finds that although the PPJB in the case was privately executed and did not comply with the formal requirements of Ministerial Regulation ATR/BPN No. 16 of 2021, the Supreme Court affirmed that buyers who had fully paid and taken possession before bankruptcy qualify as good-faith third parties entitled to protection. The Court emphasized the asset separation principle, holding that only assets legally owned by the debtor at the time of bankruptcy may form part of the bankruptcy estate, thereby limiting the universality principle and prioritizing substantive justice. By annulling the curator’s action, the decision strengthens consumer protection in developer bankruptcy cases. This study concludes that buyers require both preventive and repressive legal protection, and that PPJBs should be executed as authentic deeds with a power of sale clause to prevent future disputes.

Abstract

Abstract Excessive consumption of trans fats can increase LDL and triglyceride levels and decrease HDL levels. Therefore, an instrument is needed to protect consumers when consuming processed foods by including information about trans fat content on processed food packaging. The main topic of this research examines the regulations regarding the inclusion of trans fat information on processed food packaging in Indonesia and Singapore and the government's responsibility to consumers to provide accurate information. The research methods applied are the normative juridical method with a legislative approach, a comparative approach, and a case approach. Library research was applied as a data collection technique. This study shows that regulations regarding the inclusion of trans fat information in Indonesia and Singapore already exist, but there are several differences regarding the limits of trans fat content that can be contained in food and provisions regarding sanctions. Therefore, Indonesia can immediately create regulations regarding sanctions for violations of the inclusion of trans fat information on processed food packaging and consider the implementation of front-of-pack labeling. Keywords : Trans fat, Indonesia, Singapore.

Abstract

Abstract  This study aims to analyze corporate responsibility in ensuring the compliance of the pharmaceutical industry with regulations governing the use of laboratory animals in Indonesia, emphasizing aspects of legal, ethical, and technical adherence to animal welfare principles. This study adopts normative juridical research method employing both statuory and conceptual approaches. The data were gathered through library research, comprising primary legal materials for instance like laws and regulations, additionally secondary legal materials including books, journal articles, as well as online references. The findings indicate that although Indonesia has established several regulations such as Law No. 18 of 2009 jo. No. 41 of 2014, Government Regulation No. 95 of 2012, Minister of Health Regulation No. 75 of 2020, and BPOM Regulations No. 10 of 2022 and No. 20 of 2023, their implementation within the pharmaceutical industry remains suboptimal due to weak enforcement and monitoring mechanisms. Therefore, the establishment of an integrated compliance system combined with ethical and technical oversight is essential to ensure that the use of laboratory animals is conducted transparently, responsibly, and in accordance with the 3R and 5F principles. Keywords: laboratory animals, legal compliance, animal welfare.

Abstract

 AbstractProtection of industrial designs for food packaging is vital to preserve originality and legal certainty. In Indonesia, substantive examination remains reactive triggered only by third-party objections during the publication period creating potential uncertainty, as seen in the red ginger drink packaging dispute between PT Aneka Boga Citra and PT Total Asri Sumber Alam. In contrast, Japan applies a full examination from the outset to assess novelty and originality. Using a normative juridical method (comparative approach and case studies), this study finds that full examination effectively strengthens protection and prevents disputes. This research recommends that Indonesia must  adopt a Hybrid Substantive Examination Model combining rigorous expert review with AI technology. Keywords : Industrial Design, substantive examination, comparative law.

Abstract

This study analyzes unfair business competition practices in the telecommunications sector in Indonesia, which analyzes in more depth the case study of blocking carried out by PT Telekomunikasi Selular and PT Telekomunikasi Indonesia under the auspices of the Telkom Group against the Over The Top (OTT) service Netflix. The author uses a normative method with a case and legislative approach, this study found that the unilateral blocking carried out by the Telkom Group has fulfilled the elements of discrimination regulated in Article 19 letter (d) of Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition because the Telkom Group only blocked Netflix, while other OTT services that have done the same thing were not subjected to the same blocking, in this case the Telkom Group's policy as a dominant business actor in the telecommunications sector also has a negative impact on consumer internet access. However, despite the discovery of discriminatory acts that are strong indications, the KPPU decision in Case No. 08 / KPPU-I / 2020 stated that the Telkom Group was not indicated in unfair business competition practices, this indicates a legal weakness. This legal weakness is caused by the non-implementation of the Network Neutrality principle in regulations governing the flow of telecommunications services and the limitations of business competition test indicators that cannot analyze the long-term impact (Network Effects) in the digital telecommunications market. Therefore, this study concludes that regulators must harmonize by improving regulations on cooperation between telecommunications services and OTT services through fair and transparent Business to Business principles, as well as adding long-term impact (Network Effects) test criteria to the KPPU Commission Regulation to ensure healthy competition in the future.
