Abstract

Life always evolves with the times, including the country. Indonesia is developing by shifting from an agrarian to an industrial sector that is growing rapidly. The existence and development of the industry are instrumental in economic growth in Indonesia, but as the industry develops, the greenhouse gas emissions produced by Indonesia are also increasing. Therefore, a solution is needed to lower greenhouse gas emissions, and one of the solutions is carbon trading. Besides reducing carbon gas emissions, carbon trading can also encourage the domestic carbon market through its buying and selling system, opening up investment opportunities. In relation to investment, since the inauguration of the Job Creation Law, there has been an institution specifically regulating investment, namely the Investment Management Institution, representing the central government with significant authority and privileges. This study aims to analyze how the regulation of carbon trading has changed after the inauguration of the Job Creation regulation as a law and the position of the Indonesia Investment Authority in carbon trading within the industrial sector in Indonesia.

Abstract

This research aims to determine the effectiveness of consumer protection efforts in purchasing houses near riverbanks, focusing on legal aspects, consumer rights, and dispute resolution. This research is urgent to conduct considering the increasing vulnerability of consumers in property transactions that can potentially increase the risk of violations of consumer rights, economic stability, and public security. The research method used is normative legal research, which allows for an in-depth review of existing laws and regulations governing consumer protection in property transactions, with a thorough analytical approach to the role of regulation and government involvement in responding to developers' failure to comply with rules when constructing buildings, resulting in harm to consumers. The outcome of this research is to propose solutions for regulatory evaluation to enhance consumer protection and ensure fairness and balance in housing transactions, emphasizing the critical role of the legal framework in protecting consumer rights.

Abstract

The enactment of Law Number 17 of 2023 concerning Health marks a new era in Indonesia’s legal framework through an omnibus approach aimed at harmonizing and consolidating overlapping health regulations. This study examines the legal protection of medical and health personnel in performing their professional duties as stipulated in the new Health Law and its implementing regulation, Government Regulation Number 28 of 2024. Using a normative juridical research method, the study relies on secondary legal materials, including legislation, legal doctrines, and scholarly literature. The findings indicate that Law No. 17/2023 repeals eleven previous health-related statutes and introduces a more comprehensive legal framework to strengthen healthcare governance and ensure professional accountability. The law expands the scope of legal protection for medical personnel by including standards of professional ethics, service quality, and patient health needs, which were not explicitly covered in earlier laws. Moreover, the regulation outlines the responsibilities of central and local governments, as well as healthcare facility administrators, in providing preventive and responsive legal protection. The study concludes that the 2023 Health Law represents a significant legal reform that reinforces the state’s constitutional duty to ensure fairness, legal certainty, and the protection of both healthcare providers and patients, thereby promoting a just, ethical, and sustainable health system in Indonesia.

Abstract

Indonesia’s coastal governance is characterized by jurisdictional overlaps and normative inconsistencies, which undermine the legal framework sustaining the seaweed sector within the Blue Economy paradigm. Employing a normative-doctrinal method, this study adopts the principle of legal certainty in coastal spatial planning and evaluates the scope of regional governments’ competence in integrating local wisdom into marine resource regulation. The analysis reveals that the centralization of authority under Law No. 6 of 2023 generates normative disharmony with Law No. 23 of 2014, thereby restricting provincial administrative jurisdiction over maritime affairs. This recentralization engenders regulatory dualism, overlapping licensing regimes, and weakens legal safeguards for coastal communities. In contrast, regional governments advance sustainable governance by institutionalizing local wisdom through participatory and empowerment-based mechanisms, which reconcile ecological imperatives with economic objectives. The study concludes that regulatory harmonization and juridical recognition of local wisdom are essential for equitable and sustainable marine development.

Abstract

The accuracy of fuel pumps at public fuel filling stations (SPBU) is an essential factor in ensuring fair transactions and consumer protection. This study aims to analyze the level of compliance of SPBUs with fuel pump accuracy standards and examine the role of the Ministry of Trade in monitoring potential measurement discrepancies. The research method used is a normative juridical approach supported by empirical data from several cases of measurement manipulation, such as the installation of printed circuit boards (PCBs) in Sukabumi, measurement reduction in Serdang Bedagai, and the use of remote control devices in Bogor. The study’s results show that gas station compliance remains partial. Formally, some gas stations have carried out calibration and recalibration. However, substantively, there are still practices of manipulation that violate Law Number 2 of 1981 concerning Legal Metrology and Law Number 8 of 1999 concerning Consumer Protection. The Ministry of Trade conducts supervision through calibration/recalibration, field inspections, and the enforcement of sanctions, supported by internal oversight from Pertamina, a state-owned enterprise. However, the effectiveness of supervision is still hampered by limited resources, the development of technical manipulation methods, and low legal awareness among business actors. This study emphasizes the need for intensive, multi-layered supervision, the digitization of metrology, and strict law enforcement to ensure accurate fuel measurements and optimal consumer protection.

Abstract

This research is entitled “Binding Force of Non-Disclosure Agreement as Means of Trade Secret Protection in Decision No. 832/Pdt.G/2023/PN.Jkt.Brt” The object of this study is the regulation and implementation of NDAs within the framework of Indonesia’s positive legal system. The purpose of this research is to explain the form of overlap between civil law and intellectual property law, which results in weak legal certainty in the protection of trade secrets. The research method applied is normative juridical research with a statutory and case study approach, focusing on Decision No. 832/Pdt.G/2023/PN.Jkt.Brt. The results show that NDAs are legally recognized as innominate agreements under Article 1338 of the Indonesian Civil Code. However, their application in the context of trade secret protection remains ineffective due to differences in legal regimes and institutional arrangements under Law No. 30 of 2000. The case analysis demonstrates that the court still interprets NDA violations narrowly as contractual breaches rather than as infringements of intellectual property rights. This condition reflects that the function of NDAs as instruments for trade secret protection has not yet been fully optimized. The findings of this research illustrate the need to strengthen the synergy between civil law and intellectual property law in the practice of trade secret protection in Indonesia.

Abstract

The increasing public interest in fast food restaurants demands the implementation of food safety standards to protect consumers. This study examines the application of consumer security and safety principles in food production processes at fast food restaurants and the role of the Health Department. This study utilizes normative juridical methods complemented by a statutory approach and data sources through literature studies and interviews with the DKI Jakarta Provincial Health Office, which is responsible for guidance and supervision of ready-to-eat processed foods. The findings show that Indonesian legal regulations have adequately regulated the standardization of food production processes by applying consumer security and safety principles. The Health Office plays an active role in maintaining consistent application of these principles through guidance programs, including Ready-to-Eat Food Safety Training and educational material dissemination, as well as supervision through Environmental Health Inspections and mandatory Hygiene Sanitation Eligibility Certificates, accompanied by administrative sanctions for businesses violating food safety standards.

Abstract

A legal tool known as halal certification attests to a product's halal status and ensures compliance with Islamic law. Implementing halal certification involves more than inspection and testing; it also requires certifying bodies to ensure that business actors comply with product-naming rules during the certification process. The purpose of this study is to investigate human resource development in the halal certification process via the regular and self-declaration pathways established by BPJPH, MUI, and LPH, and to analyse the monitoring of the halal certification mechanism through these two channels. With a statute-based and case-based methodology, this study employs a normative juridical approach. Primary, secondary, and tertiary legal literature found through library research are the sources of the data used. The study's findings indicate that BPJPH, MUI, and LPH conduct more stringent oversight of the halal certification procedure through standard channels, involving Halal Auditors and Halal Supervisors who possess competency certifications in compliance with legal requirements. However, because the self-declaration pathway depends on the business owner's self-declaration and PPH Assistants' confirmation, it is typically more vulnerable to exploitation.

Abstract

Low financial literacy amidst high digital service access leaves society, particularly university students, vulnerable to detrimental financial practices such as online loan traps and hidden costs. Universitas Pembangunan Nasional Veteran Jakarta was selected as the partner location based on the strategic demographic of students as the younger generation and the institution's commitment to national defense and sustainability values. This activity was implemented using the Plan-Do-Check-Action (PDCA) framework, which integrates a pentahelix collaborative approach to ensure systematic program execution and measurable impacts. The community service results demonstrated a significant 25.7% increase in participants' financial literacy and consumer rights awareness, with the average score rising from 3.35 to 4.14. Furthermore, the program successfully fostered critical awareness among students regarding the connection between financial systems and the climate crisis while initiating the formation of the Consumer Sustainability Community as an advocacy platform. This cross-sector synergy proved effective in establishing an educational ecosystem that empowers students to become responsible and legally literate consumers in the digital financial era.

Abstract

This study examines the causal relationship between asset–liability imbalance, the failure of the Postponement of Debt Payment Obligations (PKPU) mechanism, and the resulting director liability in the bankruptcy of PT Sri Rejeki Isman Tbk (Sritex). The research is motivated by a normative gap in Indonesia’s Bankruptcy and PKPU Law, which does not require an insolvency test, thereby allowing corporations in a state of absolute insolvency to access PKPU despite lacking any realistic prospect of going concern. This study employs a normative juridical method using statutory and case approaches, with particular reference to the Commercial Court of Semarang Decision Number 2/Pdt.Sus-Homologation/2024/PN Niaga Smg. The findings reveal that the extreme disparity between Sritex’s assets and liabilities rendered its restructuring plan legally and economically unfeasible, making creditor rejection a rational outcome that normatively necessitated a bankruptcy ruling. Furthermore, the board of directors’ failure to fulfil fiduciary duties, especially the duty of care and transparency, invalidated the protection of the Business Judgment Rule and triggered potential personal liability. The novelty of this research lies in its integrated analytical framework that conceptualizes asset–liability imbalance as both a determinant of PKPU infeasibility and an indicator of fiduciary breach leading to director liability, thereby providing a normative basis for insolvency law reform in Indonesia.     Penelitian ini mengkaji hubungan kausal antara ketidakseimbangan aset dan utang, kegagalan mekanisme Penundaan Kewajiban Pembayaran Utang (PKPU), serta implikasi pertanggungjawaban direksi dalam kepailitan PT Sri Rejeki Isman Tbk (Sritex). Kajian ini dilatarbelakangi oleh kekosongan norma dalam Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan PKPU yang tidak mewajibkan penerapan insolvency test, sehingga perusahaan dalam kondisi insolvensi absolut tetap dapat mengakses PKPU meskipun tidak lagi memiliki prospek going concern. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus, khususnya melalui analisis Putusan Pengadilan Niaga Semarang Nomor 2/Pdt.Sus-Homologasi/2024/PN Niaga Smg. Hasil penelitian menunjukkan bahwa disparitas ekstrem antara nilai aset dan liabilitas Sritex menjadikan rencana perdamaian tidak layak secara hukum dan ekonomi, sehingga penolakan kreditur merupakan konsekuensi rasional yang berujung pada putusan pailit. Selain itu, kegagalan direksi dalam memenuhi kewajiban fidusia, terutama duty of care dan prinsip transparansi, menggugurkan perlindungan business judgment rule dan membuka ruang pertanggungjawaban pribadi. Kebaruan penelitian ini terletak pada konstruksi analitis yang menempatkan ketidakseimbangan aset dan utang sebagai parameter kelayakan PKPU sekaligus indikator pelanggaran fiduciary duty yang menimbulkan personal liability, serta memberikan justifikasi normatif atas urgensi reformasi hukum insolvensi di Indonesia.
