Abstract

This research analyzes the impact of Indonesian Supreme Court Decision No. 141/Pdt.Sus- PKPU/2020 on the execution of personal guarantees (borgtocht) in bankruptcy proceedings. This decision is significant as it has the potential to alter the practice of borgtocht execution and affect legal certainty for both creditors and debtors. The research employs a normative method with a statutory approach and case studies. Legal sources include legislation, legal literature, and relevant court decisions. The findings indicate that the Supreme Court decision provides clarity regarding the position of borgtocht in bankruptcy, yet also raises some legal uncertainties. This research offers recommendations for legal improvements regarding borgtocht execution to ensure legal certainty and fairness for all parties involved..

Abstract

The inheritance rights of a child who becomes an heir is the main thing to be studied in more depth in this research. Especially when the child who is gifted by God has special needs. As a normal heir or legal subject can be declared legally capable, but how is the legal protection of rights with children with special needs, the question is the first formulation of the two formulations, while the second formulation is how rights and obligations in the perspective of civil law. This research was completed with a normative juridical method, and with a literature review approach, this research method has a descriptive analysis nature, meaning that the two formulations will be explained in detail from the elaboration of primary legal sources and tertiary legal sources. This study concludes that the legal protection of heirs to children with special needs has been regulated in Article 432 of the Civil Code as a fundamental paradigm in the implementation of legal protection. While the rights and obligations obtained need to be facilitated by the concept of guardianship or guardianship, so that the rights and obligations of children with special needs can be accommodated optimally. Abstract

This study examines the legal certainty of using cryptocurrency as an investment instrument in companies in Indonesia. Although cryptocurrency is not recognized as a legal means of payment, it has been acknowledged as a tradable commodity in futures exchanges. This research utilizes a normative legal approach to analyze existing regulations, challenges encountered, and legal protections available for investors. The findings indicate that despite significant profit potential, investors still face high risks due to price volatility, insufficient legal protections, and cybersecurity threats. It is crucial for the government to formulate more comprehensive and supportive regulations to protect investors and prevent misuse and illegal practices. Additionally, an extensive educational program is needed to enhance public understanding of the risks and benefits of investing in cryptocurrency. With adequate regulation and improved public awareness, cryptocurrency is expected to contribute positively to Indonesia’s digital economic growth. This study aims to contribute to the development of policies and regulations related to cryptocurrency in Indonesia and to encourage greater public participation in this investment ecosystem.

Abstract

Employment agreements are a crucial step in establishing the employer-employee relationship. While both the Indonesian Labor Law and the Job Creation Law encourage written agreements, verbal contracts are also legally recognized. Written employment agreements serve as a binding instrument and evidence, yet many labor relationships operate without them. This can lead to legal disputes, particularly regarding workers' rights, as exemplified in the Mamuju District Court Decision No. 2/PDT.SUS-PHI/2018/PN.Mam. This study employs a descriptive-analytical approach, adhering to the normative legal research method. Secondary data is gathered from primary legal materials, secondary legal materials, and tertiary legal materials. The findings reveal that workers' rights under verbal agreements are still protected by the Labor Law and the Job Creation Law. However, the absence of written documentation of agreed-upon terms for termination of employment can pose challenges in proving these terms in court. In the Mamuju District Court Decision No. 2/PDT.SUS-PHI/2018/PN, the court ordered the defendant to pay double the plaintiff's entitlements due to the wrongful termination of employment through coercion. The court found that the plaintiff's termination was unrelated to any company policy violation and could not be substantiated due to the lack of written documentation.

Abstract

Abstract This research compares inheritance practices according to Minangkabau customary law and the Indonesian Civil Code (KUHPerdata) using a normative juridical method. Minangkabau customary law follows a collective system based on the maternal lineage (matrilineal), with an emphasis on preserving wealth within the extended family through collective ownership. In contrast, the Indonesian Civil Code adopts a more individualistic approach, classifying the heirs into four categories and granting inheritance rights based on blood and marriage relations, without gender distinction. This comparison reveals fundamental differences in philosophy, classification, distribution system, and determination of heirs between the two legal frameworks. Despite the differences, both systems strive to provide justice in inheritance distribution according to the cultural and positive law contexts.

Abstract

This research discusses the legal protection of consumers and the responsibility of event organizers for concerts that are canceled, with a case study of the 2022 Berdendang Bergoyang Festival. Canceled concerts often have a negative impact on consumers and challenge the organizers' legal responsibilities. This research aims to analyze the legal aspects involved in concert cancellations, as well as to evaluate the effectiveness of existing consumer protection regulations. The research method used is normative juridical legal research with a case study approach. The research results show that there is a lack of clarity in the legal framework governing concert cancellations, which can lead to conflict between consumers and organisers. In addition, consumer protection does not yet fully cover event cancellation situations that are beyond the organizer's control. Therefore, it is necessary to improve consumer protection regulations and increase legal awareness among event organizers. This research contributes to understanding the legal dynamics related to concert cancellations and formulating recommendations for improving regulations that can increase consumer legal protection and clarify organizers' responsibilities in dealing with canceled concert situations held.

Abstract

This study aims to analyze the fulfillment of National Health Insurance Rights (JKN) for workers who experience Termination of Employment (PHK) at PT. FI and evaluate the regulation of JKN rights after layoffs that provide justice for workers. The method used is normative legal research with a qualitative approach, which includes the selection and classification of legal materials as well as normative analysis of relevant regulations. Based on field findings, this study shows that there are administrative errors in reporting the status of layoffs that cause delays in fulfilling health insurance rights for laid-off workers. In addition, this study also found that even though the post-layoff JKN regulation has been regulated in the law, improper implementation can hinder the granting of rights fairly. This study recommends simplifying reporting procedures, increasing supervision by BPJS Kesehatan, and further education for companies to avoid administrative errors. Thus, this study contributes to the understanding of the importance of social justice in regulating health insurance for laid-off workers.

Abstract

This research aims to analyze the mitigation of the risk of exploitation and violence against women Indonesian migrant workers in the informal sector as well as the responsibilities of the government and migrant employment agencies. Using the normative juridical method, this research examines relevant legal norms, such as the Indonesian Migrant Workers Protection Act, to evaluate the protection of women migrant workers' rights. Data is obtained from documentation of primary and secondary legal sources, analyzed using a feminist perspective to understand vulnerability factors and challenges in the feminization of migration. The results show that mitigating the risk of exploitation and violence against women Indonesian migrant workers in the informal sector includes preventive measures, such as pre-departure education, skills training, recruitment agency supervision, and legal empowerment. During the working period, protection is carried out through standardized work contracts, access to social protection, and bilateral cooperation, while post-work, economic and social reintegration is carried out through mentoring and entrepreneurship training. However, weak implementation of regulations, lack of oversight, and sectoral silos exacerbate the vulnerability of women Indonesian migrant workers in the informal sector to exploitation, discrimination, and rights violations. The responsibilities of the government and migrant employment agencies include legal protection at all stages of migration, from pre-departure recruitment, monitoring of working conditions, and post-employment reintegration programs to ensure that women migrant workers receive comprehensive protection through effective enforcement of employment contracts, legal aid, monitoring, and social reintegration. This research recommends improved regulation, pre-departure education, recruitment agency supervision, legal empowerment, and post-worker reintegration to reduce the risk of exploitation and violence against women migrant workers.

Abstract

The growth of the Indonesian cosmetics industry reached 21.9% with details of 913 companies in 2022 and 1,010 companies in mid-2023. This encourages business actors to compete so that a series of innovations and advertising strategies are carried out in order to attract consumers' attention. However, in the advertising process, business actors sometimes overclaim the contents of their products. On the other hand, the existence of this overclaim is not accompanied by consumer knowledge of the contents of a beauty product. This study examines in more depth the role of law in protecting consumers and the legal responsibility of skincare owners as business actors for overclaiming their beauty products. The research method used is juridical-normative with a statutory regulatory approach and a conceptual approach. The results of this study indicate that the role of law in protecting consumers against overclaims in product marketing has been accommodated in Indonesian national law starting from UUPK to BPOM-level regulations. Regarding legal accountability, it is mandatory for business actors as regulated in the UUPK and BPOM Regulation Number 3 of 2022.

Abstract

Lansia adalah seseorang yang telah memasuki usia 60 tahun ke atas dan merupakan kelompok umur pada manusia yang telah memasuki tahapan akhir dari fase kehidupannya. Kelompok yang dikategorikan lansia ini akan terjadi suatu proses yang disebut aging process atau proses penuaan sehingga muncul berbagai macam masalah kesehatan yang sering terjadi pada lansia, seperti gangguan pendengaran, nyeri pada punggung dan leher, osteoarthritis, jantung, diabetes militus, kolesterol dan hipertensi. Namun, ketika menghadapi masa tua ini banyak dari mereka yang malah diabaikan oleh keluarganya dengan menitipkan orang tuanya ke panti sosial. Tujuan dari penelitian ini adalah untuk untuk menganalisis dan mengkaji permasalahan yang dihadapi lansia serta mengevaluasi prinsip-prinsip lansia guna merumuskan strategi peningkatan kesejahteraan mereka secara holistik. Penelitian ini menggunakan pendekatan deskriptif kualitatif dengan pengumpulan data melalui observasi, wawancara dan juga studi literatur. Hasil penelitian didapatkan bahwa proses penuaan membawa berbagai macam tantangan pada lansia, seperti penurunan Kesehatan fisik, gangguan psikologi keterbatasan aktivitas sosial, dan penurunan ekonomi. Penerpan prinsip-prinsip lansia seperti kemandirian, partisipasi, perawatan, pemenuhan diri dan martabat terbukti dapat membantu meningkatkan kualitas hidup lansia secara menyeluruh. Program pengabdian Masyarakat di Panti Sosial Tresna Werdha Budi Mulia 2 menegaskan pentingnya sinergi antar keluarga, mesyarakat dan pemerintah dalam mendukung kesejahteraan lansia melalui edukasi, dukungan sosial, dan perlindungan hak-hak mereka.
