Abstract

 Tanah mempunyai arti penting dalam kehidupan dan penghidupan manusia, bahkan dapat dikatakan manusia tidak dapat terpisahkan dengan tanah karena dari tempat manusia berpijak di atas tanah, tempat manusia mengambil semua kebutuhan sehari-hari untuk sandang, pandang dan papan semua berawal dari tanah bahkan sampai dengan manusia meninggal masih membutuhkan tanah. Dari waktu ke waktu seiring dengan perkembangan zaman, jumlah permintaan akan tanah terus meningkat. Ada tiga faktor yang mempengaruhinya, yaitu pertumbuhan penduduk, kemajuan teknologi dan pergeseran industri dan budaya. Secara geografis, DKI Jakarta merupakan Provinsi yang padat penduduk. Dengan melunjaknya jumlah kelahiran atau peledakan perkembangan penduduk di Ibu Kota Jakarta, maka banyak masyarakat yang mendirikan pemukiman di wilayah garis sempadan Sungai Ciliwung. Hal tersebut didukung dengan harga tanah yang lebih murah dibandingkan dengan harga tanah pemukiman di tengah kota. Namun dengan adanya pemukiman di wilayah garis sempadan Sempadan Sungai Ciliwung, membawa dampak negatif terhadap perkembangan ekosistem sungai dan juga memberikan dampak buruk pada kehidupan masyarakat sekitar pemukiman karena merusak sistem penyerapan air. Salah satu dampaknya adalah sering terjadi banjir. Dalam pemanfaatan tanah di perbatasan sungai menurut Undang-Undang Agraria dalam pemanfaatannya harus mengutamakan fungsi sosial yaitu prinsip yang menyatakan bahwa penggunaan tanah tidak boleh bertentangan dengan hak orang lain dan kepentingan umum serta agama.Kata-Kunci: Kebijakan, Sempadan Sungai, Lingkungan. Land has an important meaning in human life and livelihood, it can even be said that humans cannot be separated from land because from where humans stand on the ground, where humans take all their daily needs for clothing, views and boards, everything starts from the ground and even reaches humans. dead still need land. From time to time along with the times, the amount of demand for land continues to increase. There are three factors that influence it, namely population growth, technological progress and industrial and cultural shifts. Geographically, DKI Jakarta is a densely populated province. With the increasing number of births or the explosive population development in the capital city of Jakarta, many people have set up settlements in the Ciliwung River border area. This is supported by the cheaper land prices compared to residential land prices in the middle of the city. However, the presence of settlements in the Ciliwung River border area has a negative impact on the development of river ecosystems and also has a negative impact on the lives of communities around the settlements because it damages the water absorption system. One of the effects is frequent flooding. In the use of land on the river border, according to the Agrarian Law, in its use, it must prioritize social functions, namely the principle that land use must not conflict with the rights of others and public and religious interests.Keywords: Policy, River Border, Environment.

Abstract

Disputes involving losses or defaults suffered Prolong the process and create uncertainty for the company or the disputing parties. Consequently, alternative dispute resolution facilitates the dispute resolution process for online transactions. One is to provide alternative dispute resolution via Online Dispute Resolution (ODR). The Method study employs the descriptive-analytic approach to acquire in-depth data that will be meaningful. This study intends to examine the opportunities and challenges faced by buyers in using Online Dispute Resolution. Concluded Although juridically, the Arbitration and Alternative Dispute Resolution Law do not regulate ODR, Some forms of legal discovery that can be done are interpretation and analogy to explain the provisions of the articles in the Arbitration Law and Alternative Dispute Resolution.

Abstract

The development of the Indonesian economy is aimed at improving the lives of people who are just and prosperous. This is an ideal that has been mandated in the 1945 Constitution and Pancasila. One of the obstacles in the Indonesian economy is the existence of monopolistic practices and unfair business competition in business or business in Indonesia. Tender conspiracy is one of the forms of action prohibited in the Anti-Monopoly Law because tender conspiracy is fraudulent and detrimental, especially to other tender participants who do not conspire, because automatically in the tender, the winner cannot be regulated, but rather who does it. the best bid is the winner and apart from that bid rigging is an anti-competitive act. Regarding the conspiracy, there is a KPPU Decision relating to this matter, namely the KPPU Decision Case Number 6 / KPPU-L / 2015 regarding the construction of the Barito Kuala Regency DPRD building and its Land Development, in its decision the KPPU Commission Council stated that Reported Party I (PT. Citra Kharisma Persada), reported II (PT. Cempaka Mulia Perkasa), reported III (PT Sumber Nor Abadi), reported IV (Pokja I in the Human Settlements Division of the Public Works Office of Barito Kuala Regency Fiscal Year 2013) was proven legally and convincingly violating Article 22 of the Law Number 5 of 1999. This research will discuss legal protections for business actors participating in tenders who suffer losses due to conspiracy in the KPPU's decision.

Abstract

AbstrakPenelitian ini bertujuan untuk menganalisis regulasi yang ada mengenai energi baru terbarukan di Indonesia berdasarkan analisis ekonomi. Indonesia memiliki potensi untuk memproduksi listrik tenaga surya dalam jumlah yang sangat besar. Hal ini sejatinya telah disadari oleh pemerintah sebagai badan struktural yang telah menyusun strategi lewat regulasi untuk mengembangkan PLTS. Namun masih terdapat banyak celah substansial yang menyebabkan investor, IPP, dan masyarakat luas pada umumnya enggan melirik PLTS. Dengan menggunakan metode hukum normatif yang mendekatkan pada peraturan perundang-undangan yang berlaku ditambah dengan metode komparatif-deskriptif untuk melihat cerminan perbandingan regulasi di negara lain, penulis mendapati bahwa celah substansial tersebut di antaranya meliputi belum tersedia kemudahan serta penetapan harga yang masuk akal dengan kewajiban membeli tanah untuk pengadaan proyek, syarat TKDN yang tinggi padahal eksternalitas yang tinggi juga dibutuhkan untuk mengembangkan PLTS di Indonesia, serta adanya kekosongan hukum secara umum mengenai EBT dan insentif fiskal khusus. Untuk itu, perlu adanya rekonstruksi yang menyeluruh dan gamblang, yang menyiasati ketiga komponen utama sistem hukum yakni struktur, substansi, dan budaya.Kata kunci: energi terbarukan; PLTS; investasi. AbstractThis study aims to analyze the existing regulations regarding renewable energy in Indonesia based on economic analysis. Indonesia has the potential to produce a very large amount of solar power. This has been realized by the government that has developed a strategy through regulations to develop PLTS. However, there are still many substantial gaps that cause investors, IPPs, and the general public to be reluctant to look at PLTS. By using other normative legal methods in the applicable laws and regulations plus a comparative-descriptive method to reflect regulatory regulations in the country, the authors find that these substantial gaps include the unavailability of facilities and reasonable pricing by purchasing land for project procurement, high local content requirements despite high externalities are also needed to develop PV mini-grid in Indonesia, as well as the availability of general laws regarding NRE and special fiscal incentives. For this reason, there is a need for a thorough and clear reconstruction, which takes into account the three main components of the legal system, namely structure, substance, and culture.Keywords: renewable energy; solar power plant; investment.

Abstract

Buying and selling transactions, both services and goods, are growing rapidly along with technological developments. The profession of financial planning has been in great demand by the public in recent times, but this is inseparable from the existence of disputes which result in losses for consumers. Misappropriation of authority and violations committed by financial planning companies violate consumer rights. The Financial Services Authority has also yet to supervise because financial planners are not included in the financial sector. This research examined legal protection for financial planning consumers through supervision based on safety, certainty, and benefit principles. A statutory approach supports the normative juridical method and uses secondary data. The results of the study show that legal protection for consumers of financial planning companies is based on Article 10 letter c of Law Number 8 of 1999 on Consumer Protection, Articles 103 and Article 104 of Law Number 8 of 1995 on Capital Markets, Article 28 of Law Number 19 of 2016 on ITE, Article 378 and Article 372 of the Criminal Code and Article 1365 of the Civil Code.

Abstract

The practice of predatory pricing is a sales strategy that sets very low prices with the aim of removing competitors from the market and attracting buyers at low prices. Article 20 of the Law of the Republic of Indonesia No. 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition states that business actors are prohibited from supplying goods and or services by selling at a loss or setting meagre prices with the intent to eliminate or terminate the business of its competitors in the relevant market to result in monopolistic practices and or unfair business competition. The type of research that will be used to analyse problems related to the alleged practice of selling at a loss on the Shopee e-commerce site is normative juridical. The legal approach that the author will use is the statutory approach. The development of the e-commerce industry can benefit consumers and businesses. In searching for a case, 2 sources can be found by KPPU, namely based on reports and initiatives from KPPU itself. Not only that, an in-depth examination process and sufficient evidence are needed so that the case can be followed up to the next stage. Regarding preventive measures, KPPU has continued to conduct in-depth research since 2017 to be able to map the digital economic ecosystem and the potential for anti-competitive behaviour that might occur in the future in the digital era. This matter is also stated in the KPPU's Strategic Plan for 2020-2024.

Abstract

Abstract: This study aims to analyze the consideration of the supreme court regarding the judex factie error in deciding that corruption was acquitted (Study of Supreme Court Decision Number 2407/K/Pid.Sus/2020). This type of normative research is prescriptive with a case approach. The research legal materials used are primary and secondary legal materials with library research collection techniques. This research shows that the consideration of the Supreme Court in decision Number 2407K/Pid.Sus/2020 is in accordance with Article 253 paragraph (1) of the Criminal Procedure Code because judex factie in this case the Decision of the Makassar High Court does not apply the law as it should. Abstract

Prevalensi perokok anak yang tinggi salah satunya disebabkan oleh iklan produk rokok yang beredar secara masif di berbagai media, baik itu secara cetak, penyiaran, teknologi informasi, dan/atau luar ruang memberi paparan terhadap anak yang melihatnya. Penelitian ini bertujuan untuk mengetahui pandangan Peraturan Perundang-Undangan di Indonesia terhadap iklan rokok dan mengenai upaya perlindungan konsumen atas iklan produk rokok dalam upaya menekan prevalensi perokok anak. Penelitian ini menerapkan metode yuridis normatif dengan data sekunder yang didapat melalui studi pustaka dengan bahan hukum primer berupa UUPK, UU Penyiaran, UU Kesehatan, dan PP No. 109/2012, bahan hukum sekunder berupa rancangan undang-undang, hasil penelitian, buku, artikel ilmiah, dan jurnal ilmiah, serta bahan hukum tersier.berupa kamus, data yang terkumpul dianalisis menggunakan teknik analisis deskriptif. Perlindungan hukum terhadap perokok anak selaku konsumen dalam rangka menekan prevalensi perokok anak telah diatur dalam regulasi yang memuat pengendalian iklan produk rokok, namun hasil penelitian menyatakan bahwa anak-anak masih dapat mengakses iklan rokok yang tersebar di media sosial, khususnya iklan rokok elektrik, sedangkan pengendalian mengenai rokok elektrik belum diatur dalam PP No.109/2012. Agar perlindungan anak dari iklan rokok dapat berjalan secara maksimal maka diperlukan pengawasan yang ketat oleh pemerintah, pihak yang berwajib, dan masyarakat untuk melarang anak di bawah umur mengakses iklan rokok, melakukan sosialisasi di setiap sekolah, serta mempercepat revisi PP No. 109/2012.

Abstract

This study aims to analyze legal protection related to technology-based lending and borrowing services. The research method used is normative legal research, with a statutory approach, namely an approach using legislation and regulations, and a conceptual approach that refers to existing legal doctrines. The data collection technique used was a literature study. The results show that legal protection for debtors as consumers has not been realized because the consumer dispute resolution mechanism for non-PUJK activities has not been regulated, there is no regulation regarding the interest rate ceiling and mechanisms related to the collection process, and because of the lack of strict sanctions against online loan administrators who commit violations.

Abstract

Penelitian ini bertujuan untuk menganalisa perlindungan konsumen terkait dengan penamaan menu kopi. Sertifikasi halal dalam sistem hukum di Indonesia mempunyai kedudukan yang sentral, karena termaktub dalam Undang-Undang No. 33 tahun 2014 tentang Jaminan Produk Halal. Perkembangan industri kopi dewasa ini erat dengan style anak muda. Tren tersebut berdampak pada menjamurnya usaha-usaha yang menyajikan beragam jenis kopi di masyarakat. Dalam penamaannya, pelaku usaha kopi kekinian banyak yang mencantumkan nama varian khamr. Kenyataanya, sebagian besar penamaan varian khamr justru hanya sebatas strategi pemasaran. Pelaku usaha kopi banyak menggunakan penamaan menu kopi menggunakan nama varian khamr lalu menyatakan atau mengklaim bahwa produknya halal. Dengan menggunakan metode penelitian empiris normatif, maka diketahui bahwa Majelis Ulama Indonesia telah memberlakukan regulasi mengenai sertifikasi halal yang didalamnya mengatur menge-nai penamaan sebuah produk. Penamaan tersebut meliputi menu kopi kekinian yang mencantumkan nama varian khamr yang bersebrangan dengan Fatwa DSN MUI No. 4 Tahun 2003 tentang Sertifikasi Fatwa Halal. Dampak dari penggunaan nama varian khamr pada menu kopi salah satunya adalah pelaku usaha tidak dapat melakukan sertifikasi halal produknya untuk mendapatkan sertifikat halal. Consumers Protection of Labeling Coffee That Uses A Variant of Khamr  This study aims to analyze consumer protection related to the naming of coffee menus. Halal certification in Indonesia's legal system is important as stipulated in Law Number 33 of 2014 concerning Guarantee of Halal Products. Nowadays, the progressive development of coffee industry is closely related to the style of the youth. It’s give an impact on the increasing number of businesses that serve various kind of coffee. Some of modern coffee shops use the name of the khamr variant. ‘Labeling khamr variant is just for marketing strategy, but its claimedas halal product. This is a normative and empirical researchs.  It shows that the Indonesian Ulama Council (MUI) has enacted a regulation regarding halal certification.  This regulation also explained about the labeling of any kind of coffee which any vanriants of khamr, that is contradicetive ro Fatwa DSN MUI nomor 4/2003 On Halal Fatwa Certificarion. So, its is impossible to get halal certificate for any kind of coffe with labeling the khamr variant.
