Abstract

In a country, territory is one of the mandatory elements for the establishment of the country. The potential owned by a region will not be utilized optimally if there is no development of the region. This study aims to determine how the construction of regulations in the development of coastal areas by Pandeglang Regency, to determine the effectiveness of the construction of regulations that have been owned by Pandeglang Regency and what problems arise, as well as solutions that can be applied as a solution to these problems. The normative legal research method is carried out by means of a literature study in the form of secondary data as a basic material for research and also by carrying out a qualitative approach. Pandeglang Regency has great potential for the development of coastal tourism. However, to maintain the sustainability of the local environment and culture, regulations are needed that integrate local wisdom in every aspect of tourism development. The results of the study indicate the need for regulations based on local wisdom to ensure sustainable coastal tourism development and provide adequate legal protection for the local community and environment. Abstract

This study aims to examine the legal responsibilities of PT. Pos Indonesia Central Jakarta Branch in protecting consumers, with a specific focus on cases of lost, damaged, and delayed deliveries. The research adopts a normative legal methodology to analyze customer complaints and return data from 2023, as well as to review relevant legal frameworks under the Consumer Protection Law and the Postal Services Law. Special attention is given to the case of YouTuber Artodipro, whose import of non-nicotine cigarettes in excess of legal limits resulted in customs seizure, highlighting the intersection of postal services and import regulations. The scope of this study encompasses the legal obligations of PT. Pos Indonesia Central Jakarta in handling consumer complaints, the effectiveness of existing complaint resolution mechanisms, and the regulatory environment governing import restrictions for non-nicotine products. The findings reveal that the top five customer complaints relate to shipment information issues, misdelivery, pre-collecting, pickup requests, and item returns. The study concludes that PT. Pos Indonesia Central Jakarta is legally liable for ensuring compliance with delivery agreements and for providing compensation in cases of delay, loss, or damage. However, current complaint resolution processes are underutilized, and there is a lack of regulatory clarity and consumer awareness regarding import restrictions. In conclusion, PT. Pos Indonesia Central Jakarta is recommended to enhance its tracking systems, increase transparency in complaint handling, and streamline return processes. The study also suggests updating importation regulations for non-nicotine products and improving consumer education on customs procedures to strengthen consumer protection and regulatory compliance.

Abstract

All micro and small enterprises must register their products under the Halal Product Guarantee Organising Agency's (BPJPH) halal certification program in order to obtain halal certification. BPJPH streamlines the process by offering a more straightforward method for halal certification registration, which involves utilizing the self-declaration scheme. However, this certainly does not excuse violations committed by business actors or other parties. Therefore, the purpose of this research is to shed light on BPJPH's monitoring role in the halal certification process via the self-declare scheme, and to outline the legal repercussions for those who violate these stages. We conducted the research using a normative juridical approach, collecting primary data from statutory regulations and supplementing it with interviews. The research findings show that BPJPH carries out a supervisory function over the halal certification process through a self-declare scheme. This research also reveals that the self-declare scheme will impose administrative sanctions on violators at the halal certification stages. However, the imposition of administrative fines is not yet feasible. We are still studying the limits of fines and the types of violations committed.

Abstract

Two-wheeled vehicles are one of the primary modes of transportation for the majority of the population today. Honda, a leading manufacturer of two-wheeled vehicles, dominates the market in Indonesia by continually introducing innovations that meet consumer needs. Honda's latest innovation is the Enhanced Smart Architecture Frame (e-SAF). However, in some cases, this frame has experienced damage due to corrosion, which can be detrimental and even dangerous to consumers. This research used a normative legal research method, utilizing a literature review of positive law, data, and other legal materials, supplemented by interviews. The objective of this study is to analyze the aspects of legal protection for consumers using Honda vehicles with eSAF frame damage based on the principles of consumer safety and security. The research results indicated that in this case, Honda did not apply the principles of consumer safety and security, which should be an obligation for businesses to ensure the safety and security of their consumers. Legal protection for eSAF frame users is also assured by Law No. 8 of 1999 regarding Consumer Protection, which offers a robust basis for safeguarding consumer rights, especially their right to safety and security.

Abstract

To understand and analyze the legality concerning the use of artificial intelligence in commercial activities. To explore and analyze the legal certainty of advertising generated by artificial intelligence. This research also helps the author gain insight and firsthand knowledge on how AI-generated advertising is regulated under Indonesian law. Through this normative legal method, results will be obtained that align with practical applications. This will make the research more concrete and accountable for its authenticity and validity. Artificial intelligence technology is fundamentally developed by generating results through the input of big data or pre-existing data, which is then trained to produce the desired outcomes. Although the technology is created to ease human life, its development has led to complexities, particularly in relation to the law. One current debate centers on the copyright of works created by artificial intelligence (AI). This has become a polemic due to the illegal use of data for training purposes

Abstract

Pemberdayaan kelompok tani mangrove adalah upaya yang dilakukan untuk meningkatkan kualitas hidup dan kemampuan masyarakat setempat dalam meningkatkan kesadaran mereka terhadap hukum ketenagakerjaan. Tujuan dari kegiatan pengabdian kepada masyarakat ini adalah memberikan penyuluhan kepada kelompok tani terkait ketenagakerjaan dengan petani mangrove di Ekowisata PIK dan peran tanaman mangrove untuk menjaga iklim. Metode pengabdian kepada masyarakat yang dilakukan di Ekowisata PIK yaitu dengan melakukan penyuluhan kepada kelompok tani tentang ketenagakerjaan. Pada penulisan ini dapat diketahui bahwa para petani memiliki hak dan kewajiban yang melekat pada dirinya dan diatur dalam Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan,dan mengetahui bahwa peran mangrove sangat besar dalam menyerap dan menyimpan karbon dalam jumlah besar guna menjaga perubahan iklim

Abstract

The development of Artificial Intelligence (AI) technology has led to the creation of various works, including images generated without direct human involvement. One of the platforms that facilitates the buying and selling of AI-generated images is Adobe Stock. However, this raises legal issues regarding ownership status and copyright protection of such images, considering that Indonesia's positive law has not explicitly regulated ownership of works produced by non-human entities. This research aims to examine the legality of ownership over images generated by Generative AI in transactions through Adobe Stock and to analyze its compatibility with the Indonesian legal system. This study uses a normative juridical method with statutory, case, comparative, and conceptual approaches, as well as a literature study relevant to the issues discussed. The results show that under the Indonesian legal system, a work must have a creator who is a legal subject. Therefore, images generated by AI cannot automatically be granted copyright status unless there is significant human intervention in the creation process. In transactions through Adobe Stock, the platform's policy serves as the main reference in determining ownership and legal responsibility over AI-generated images. The legality of AI-generated image ownership in Indonesia remains a gray area and requires regulatory updates to accommodate technological developments. Legal clarity is needed to protect parties involved in AI-based digital transactions and to ensure legal certainty in the protection of creative works.

Abstract

This study examines the legal conflict between workers' wage claims and state tax obligations in bankruptcy proceedings under Indonesian law, focusing on the constitutional imperative to prioritize workers' rights. The Introduction contextualizes the tension between Article 95(4) of the Labor Law, which mandates wage prioritization, and tax legislation granting precedence to state claims, highlighting the landmark Constitutional Court Decision No. 67/PUU-XI/2013 that affirmed workers' constitutional rights to timely wages. Employing a Method of normative legal research, the analysis integrates statutory and case approaches, reviewing laws on bankruptcy (UU No. 37/2004), labor rights, and taxation, alongside judicial decisions and international frameworks like ILO Conventions No. 100 and 111. Results reveal that while the Constitutional Court’s decision established workers’ absolute priority over tax claims, regulatory disharmony persists due to conflicting provisions in the Tax Law (UU KUP) and the 2020 Job Creation Law (UU Cipta Kerja), which ambiguously subordinates tax claims only to secured creditors. Discussion underscores the necessity for legal synchronization to align labor and tax regulations, ensuring compliance with Gustav Radbruch’s principles of legal certainty and Hans Kelsen’s normative hierarchy. The study advocates legislative reforms to codify workers’ priority in bankruptcy, drawing parallels with Malaysia’s Employment Act 1955 and France’s AGS system, which institutionalize wage protection. By addressing regulatory contradictions, Indonesia can harmonize constitutional mandates with fiscal policies, balancing social justice and economic stability.

Abstract

This study examines the transfer of trademark rights as a means of debt settlement in corporate bankruptcy proceedings, using the bankruptcy case of PT Nyonya Meneer as a case study. The main issue addressed is how trademarks, as intangible intellectual property with high economic value, can be used as debt settlement assets during bankruptcy. This research employs a normative legal method with statutory and conceptual approaches, supported by a review of relevant court decisions. The analysis focuses on the relationship between the provisions of Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations and Law No. 20 of 2016 on Trademarks. Trademarks may be transferred or sold to fulfill the debtor's obligations. Theoretical foundations include the Creditors’ Bargain Theory (Thomas H. Jackson) and the principle of wealth maximization (Richard A. Posner), emphasizing collective settlement and asset value optimization. The findings reveal that trademark transfer in bankruptcy is not explicitly regulated, creating a legal gap that affects the effectiveness of debt settlement and the protection of creditors’ rights. In the PT Nyonya Meneer case, the trademark despite its potential as a debt settlement instrument was not utilized optimally. Therefore, direct transfer of trademarks to creditors as a form of debt payment can be seen as an alternative solution, provided it is conducted under the principles of justice, legal certainty, and efficiency. This study recommends further regulation on the management and transfer of intellectual property within the bankruptcy regime to address the challenges of modern business practices.

Abstract

This research examines the legal responsibility of corporate guarantors declared bankrupt for their obligations to creditors in loan agreements, analyzing Court Decision No. 318/Pdt.Sus-PKPU/2022/PN Commercial Court Jakarta Central. The study addresses the legal complexities arising when a corporate guarantee becomes insolvent before the principal debtor defaults, creating jurisdictional conflicts between bankruptcy law and guarantee obligations. Using normative legal research methodology with a juridical normative approach, this study analyzes the application of Article 229(2) in conjunction with Article 278(6) of Law No. 37/2004 on Bankruptcy and Suspension of Debt Payment Obligations (K-PKPU) and Article 1381 of the Civil Code. The research reveals that the curator's action in obstructing and rejecting PT KawanCicil Teknologi Utama's claim registration against the bankrupt guarantor without proper judicial determination constitutes conduct not based on applicable laws and regulations. The findings demonstrate that when a guarantor is declared bankrupt and the debtor is in default, the Supervisory Judge and Curator must accept PT KawanCicil Teknologi Utama as a creditor with rights to the debtor's assets during asset liquidation proceedings. The study concludes that bankruptcy declaration of a guarantor does not automatically terminate guarantee obligations under Article 1381 of the Civil Code, as bankruptcy is not enumerated among the causes of contract termination. This research contributes to legal certainty in corporate guarantee enforcement within Indonesia's bankruptcy framework and provides recommendations for legislative harmonization between conflicting provisions in bankruptcy law.
