Abstract

This article aims to explain how the law of music is in the perspective of saddu dzara'i. The issue of whether music is haram or not is still an interesting discussion at this time. The Salafis consider that music is absolutely haram, while Ibn Hazm allows music to be used to invite goodness. This research is qualitative research which is carried out by collecting, analyzing, and interpreting the narrative comprehensively on visual data to obtain a complete, comprehensive, and holistic insight into the law of music in the perspective of saddu dzara'i. The results of this study show that a music has two law, there are halal and haram based on their respective reasons. Music becomes halal when it is used for good purposes and is not mixed with disobedience and Music becomes haram if it is used for a bad purpose and contains inadversity such as the designation of pornography.

Abstract

Interfaith marriages are in the news on TV and social media, with both pros and cons. Those who are pro argue that such actions are based on humanity and human rights and do not care about religious differences as long as the family is harmonious and happy. On the other hand, the cons argue from the perspective of positive law, which prohibits it in Indonesia, and according to fiqh, the marriage is invalid. The purpose of this study is to understand how Maqashid al-Syariah Syatibhi views interfaith marriage and what its impact is. The method used is descriptive-analytical, examining Indonesian normative or positive law, conceptually comparing it with the Compilation of Islamic Law (KHI), and investigating arising issues. The results of this study indicate that interfaith marriage has more adverse effects than benefits. The data collection technique uses a comparative analysis of interfaith marriage and Maqasid Sharia. The results of this study indicate that interfaith marriage is not allowed in Islam because it contradicts five maqasid sharia concepts: (1) Maintaining Religion, suggesting religion as a life guide; (2) preserving the soul, as different teachings may cause internal conflict; (3) preserving the mind, as one might be led astray by improper use of reason; (4) preserving offspring, as different religions could hinder the fulfillment of their duties as Allah’s caliphs; (5) maintenance of property, as different religions prevent mutual inheritance. Marriages meant to foster household harmony often end in divorce due to disputes over children’s religious choices and inheritance issues. The conclusion of this research is that interfaith marriage is prohibited by Indonesian positive law and haram according to fiqh. Meanwhile, Maqashid al Sharia views the number of evils as outweighing the good.

Abstract

Moving on from the near extinction of syar'u man qablana in Islamic legal methodology because it was deemed not to have contributed much to the discourse of Islamic legal thought, this article attempts to examine and reposition the existence of syar'u man qablana in the present era. Syar'u man Qablana is the shari'ah of the previous prophets before the Islamic shari'ah brought by the Prophet Muhammad. There are several views on understanding. Syar'u man qablana, both as a barrier (takhsis), nasikh and even as a method, is primarily related to the application of previous shari'ah in the present. Syar'u man qablana can contribute to the exploration of Islamic law, if it is contextualized with the development of contemporary thought, of course all of this stands on the benefit of the Muslim community as a whole and is supported by an understanding of maqashid al-syai'ah. The application of contextualizing syar'u man qablana is by repositioning syar'u man qablana as a method with the technique that Islamic law at the time of the Prophet Muhammad is seen as syar'u man qablana for Muslims living today. Among the provisions of the sharia, some are still valid, some are not valid. This effort is carried out not by replacing normative texts, but rather by contextualizing the laws contained in these normative texts to current conditions.

Abstract

Islam Nusantara is recognized as an ideology that advocates the application of fiqh law while accommodating cultural and traditional values. In the contemporary evolution of religious comprehension, particularly in Aceh, the local community perceives cultural manifestations in worship as misguided. Therefore, the introduction of Islam Nusantara concept aims to rectify these misconceptions through cultural adjustment with Sharia, commonly referred to as Islamization. Considering these challenges, the role of ulemas should be examined by implementing and practicing fiqh law in the Aceh community. Furthermore, this study adopts qualitative and descriptive normative methods. Data are derived from a comprehensive literature review, interviews, and observations, and subjected to qualitative data analysis methods. The results show that fiqh practices in Aceh are always based on the fatwa of ulemas to provide legality of carrying out these practices. The inclusion of ulemas is indispensable to ensure the conformity of new cultural teachings with the established legal framework.

Abstract

Transformasi hukum Islam dalam bidang zakat cukup kompleks berbanding lurus dengan problematika masyarakat Islam kontemporer khususnya dalam hal mu’amalah. Zakat dalam Islam awalnya terbagi hanya kepada dua bagian, yakni zakat fitrah dan zakat maal, namun kedua jenis zakat di jaman kiwari berkembang. Dalam wacana zakat, zakat profesi muncul sebagai ide yang mengusung adanya keadilan dalam profesi yang saat ini cukup beragam. Pergeseran dari era agraris ke era industrulisasi dan telekomonikasi melahirkan profesi-profesi yang tidak ditemukan dalam era agraris tradisional. Meskipun sebagai hukum Islam yang muncul di era industri, zakat profesi tetap memiliki syarat-syarat yang sesuai dengan hukum mu’amalah, seperti pencapaian nisab yang ditentukan, pendapatan yang harus halal, pendapatan yang terakumulasi dan adanya kepemilikan yang sah. Namun demikian terdapat berbagai pro dan kontra dalam pelaksanaan zakat profesi, yang dalam praktiknya seringkali menjumpai masalah-masalah seperti efiseinsi dan transparansi pengumpulan dana zakat profesi, potensi penyalahgunaan dan kesulitan dalam melakukan perhitungan yang cenderung rumit dan melibatkan berbagai analisa persentase perhitungan dari pendapatan yang tidak seragam. Penelitian ini berfokus dalam membaca alur dari zakat profesi pada ranah teoritis dan praktis dengan menggunakan pendekatan studi kepustakaan yang dijabarkan dengan metode kualitatif. Penelitian ini diharapkan mampu memberikan  kontribusi pemikiran hukum Islam yang komprehensif dan sebagai petimbangan dalam analisa mu’amalah pada lembaga terkait.

Abstract

The determination of the time of dawn is highly dependent on the position of the sun. The government, through the Ministry of Religious Affairs, has long used a sun depression angle of -20° as a marker of the beginning of dawn. However, the latest decision of the XXXI Tarjih National Conference revised this criterion to -18°. This change directly leads to a shift in the calculation of the time of Fajr, becoming backward in time by 8 minutes. This study was conducted to analyze more deeply the implications of the change in the criteria for determining the time of dawn, which resulted from the national deliberation of Islamic religious experts. Internal and external factors of the implementation of the Muhammadiyah Tarjih decision on the criteria for the beginning of Fajr time in the Muhammadiyah mosque in Medan City. In this case, it is necessary to conduct research that uses clear data analysis, and descriptive-analytical methods to provide answers to existing problems and find conclusions, namely the research conducted produces and that the efforts of the Tarjih and Tajdid Council of Muhammadiyah Medan City to try to implement and socialize to the congregation, Muhammadiyah sympathizers and the surrounding community regarding the Tarjih Decision on the beginning of dawn time have accurate data and can be accounted for.

Abstract

Although parental responsibility in providing child support was determined by a religious court, many parents have simply ignored the specific level of obligation until such time that any debt had been declared satisfied on behalf of indebtedness once accrued — i.e., when they are no longer able to fulfill weekly financial 'honey-do lists'. Religious courts have no binding force, and cannot enforce him fulfill his obligations as a parent. This is largely because religious court decisions do not carry the force of law and cannot be enforced against those who disregard them. But the fact that one can bear to pay child support after a court decision should not be neglected and effective mechanisms must help each kid, especially those divorced. This research aims to evaluate how well the 'Whole of Government Response' strategy works in securing post-divorce child support, using a qualitative, normative juridical approach based on secondary data. The study results conclude that a "Whole of Government" approach is feasible and may offer substantial potential to address problems associated with neglected child support post-divorce. Co-responsibility of ministries and agencies to carry out child support. This is a very important thing, considering that the life of children has now become more popular by government attention also in RPJMN 2020-2024 there are policies on improvements for unsurpassed quality of living for good to implement based multi dimensional multicultural sustainability and natural geography. This research aims to evaluate how well the 'Whole of Government Response' strategy works in securing post-divorce child support.

Abstract

This paper aims to analyze the impact and legal consequences of extraordinary legal efforts for judicial review in the religious courts of divorce cases from the perspective of mashlahat al-mursalah. The method used is normative legal research using multiple approaches including legislation, cases, and a comparative approach with data analysis techniques using descriptive analysis methods. The conclusion of this study shows that legal remedies for judicial review of divorce cases that have permanent legal force (inkracht van gewijsde) create new problems (mafsadat) in society, so for the sake of legal certainty, it is better if legal remedies taken against divorce cases are sufficient to the level of appeal. or just appeal. The Compilation of Islamic Law (KHI) has a strategic position to regulate the provisions of the procedural law, considering that the position of KHI so far has not only played a role in regulating material law, it also regulates formal law against Muslim divorces in Indonesia.

Abstract

Penelitian ini bertujuan untuk mengetahui zakat profesi (zakat penghasilan) dalam pandangan Islam (hukum Islam). Penelitian ini bersifat deskriptif kualitatif. Penelitian ini termasuk penelitian kepustakaan dengan menelaah sumber-sumber tertulis seperti jurnal ilmiah, buku-buku referensi, literatur, ensiklopedia, artikel ilmiah, karya tulis ilmiah dan sumber-sumber lain yang relevan dan berkaitan dengan objek yang dikaji. Adapun yang menjadi objek kajian dari penelitian ini adalah berupa teks-teks atau tulisan-tulisan yang menguraikan dan menjelaskan tentang zakat profesi (zakat penghasilan). Hasil dari penelitian ini adalah wajibnya zakat profesi disamakan dengan zakat perniagaan dan zakat penghasilan lainnya seperti pertanian, peternakan dan perdagangan. Batas nisab harta yang berasal dari profesi bisnis dapat disamakan dengan nisab zakat hasil pertanian yaitu 5 wasaq (sekitar 750 kg beras), dengan kewajiban zakat sebesar 5% atau 10%, dan dikeluarkan ketika mendapatkan prestasi, imbalan atau upah dari profesi tersebut. Untuk jenis profesi seperti dokter di rumah sakit, guru atau dosen yang hanya menerima gaji tetap dari hasil kerja instansi pemerintah, disamakan nisabnya dengan emas dan perak, yaitu 93,6 gram, dengan kewajiban zakat 2,5 persen, yang dikeluarkan setiap satu tahun sekali, dan telah mengeluarkan biaya kebutuhan pokok.

Abstract

Artikel ini mengkaji pengertian dan perbedaan antara qawaid fiqhiyah dengan dhawabit fiqhiyah, nazariyah fiqhiyah, dan kaidah ushuliyah. Qawaid fiqhiyah merujuk pada prinsip-prinsip umum dalam fiqh yang digunakan untuk menyelesaikan masalah-masalah hukum Islam secara praktis, sementara dhawabit fiqhiyah berkaitan dengan kaidah-kaidah yang lebih spesifik dan memiliki ruang lingkup yang lebih terbatas dalam konteks fiqh. Nazariyah fiqhiyah adalah teori-teori fiqh yang bersifat lebih konseptual dan bersifat dasar dalam memahami hukum Islam, sedangkan kaidah ushuliyah merujuk pada prinsip-prinsip dalam ushul fiqh yang menjadi dasar dalam proses ijtihad dan penalaran hukum. Dalam artikel ini, penulis membahas secara rinci perbedaan karakteristik dan aplikasi dari masing-masing kaidah tersebut, serta relevansinya dalam memahami dan mengembangkan hukum Islam. Dengan analisis ini, artikel ini bertujuan untuk memberikan pemahaman yang lebih mendalam mengenai struktur pemikiran fiqh dan kontribusinya dalam pengembangan hukum Islam yang lebih aplikatif dan kontekstual.
