Abstract

This study aims to (1) find out the provisions of the punishment of husbands who marry without the wife's permission in the Criminal Code (2) find out the views of the Indonesian Ulema Council of North Sumatra Province on the punishment of husbands who marry without the wife's permission in the Criminal Code (3) the author's analysis of the views of the Indonesian Ulema Council of North Sumatra Province on the punishment of husbands who marry without the wife's permission in the Criminal Code. This research is designed with a qualitative method with the type of research of this thesis is field research. The result of the research is that a husband who marries without his wife's permission is a crime in the Criminal Code. In addition to being a crime, it is considered an unlawful act (wederrechtelijk) in the context of Criminal Law. The MUI of North Sumatra Province is of the view that the criminalization of husbands who marry without the wife's permission is permissible even though in Islam there is no sanction/punishment for husbands who marry siri (secretly) and without the knowledge of the wife. A husband who remarries without his wife's permission can cause more harm than good. The imposition of sanctions (punishment) is also permitted because it can be classified as Ta'zir and contains benefits because it is a policy to protect wives who feel harmed.

Abstract

This research examines the concept of legal reasoning of judges in Islamic law related to legal decisions for drug addicts in the Mandailing Natal District Court. Legal reasoning in Islamic law involves interpreting the Quran, Hadith, Ijma, and Qiyas to reach a just decision. This research uses a qualitative approach with a case study method, analysis of decision documents, interviews with judges, and trial observation. The results showed that the judge combined the principles of Islamic law with Indonesian positive law. In the case of drug addicts, judges consider: Justice and Public Welfare: A verdict that not only punishes but also provides opportunities for rehabilitation. Interpretation of Islamic Law Sources: Referring to the Quran, Hadith, and scholarly opinions on punishment for drug addicts. Social Context and Positive Law: Ensuring the verdict is in line with national laws and local conditions. Rehabilitation and Protection of Human Rights: Support for the rehabilitation and recovery of addicts. In conclusion, the concept of judges' legal reasoning in Islamic law plays an important role in determining decisions that are fair, humane, and support the recovery and welfare of society. Practical implications include improving judges' understanding of Islamic legal reasoning and the integration of rehabilitative approaches in court decisions.

Abstract

This study aims to assess the essence of zakat on business results as an instrument in improving the welfare of the community and describe the implementation of zakat on business results as a strategic effort in building the economy of the people of Medan city. This research uses descriptive qualitative method to provide as much detail as possible about the implementation of business zakat. This research is a normative-empirical research with the research subjects of businesses in Medan city whose profits have reached nisab and haul. The object of this research is business zakat based on the Qur'an and hadith. The data collection technique used in this research is by collecting data from related literature such as the Qur'an, journals, books and other sources that support this research, then using reading and recording techniques. Data analysis techniques using descriptive techniques. The results of this study show: (1) Definition of Zakat on Business Results; (2) Businesses in Medan City that can be charged with Zakat on Business Results; (3) Application of Zakat on Business Results in the View of Islamic Law.

Abstract

This study aims to examine the determination of inheritance for the youngest child in the Central Barumun customary society from the perspective of Islamic law. The customary tradition of Central Barumun has its own rules and customs in the distribution of inheritance which is sometimes different from the provisions of Islamic law. This research uses field research (filed research) with a case study approach, collecting data through interviews with traditional leaders, indigenous people, naposo bulung adat and local religious leaders, then using data collection methods that are reviewed by observation, and related documents. The results showed that in the customary society of Central Barumun adheres to the inheritance distribution system with the descent system by giving automatically given to adult sons, and for the youngest child often gets special treatment in the distribution of inheritance and done by parents during life. If there is any remaining inheritance, it will be distributed after the parents die. Girls will not get the inheritance if it is not given by their brothers. Although in the view of Islamic Law the division carried out by the system cannot be called the division of inheritance, as stated in the Koran as the main guide to inheritance law in Islam which has determined the portion of each heir in accordance with the provisions that have been determined from Allah SWT, with a predetermined size based on the small and large age and has been confirmed by Islamic inheritance law stipulates that every time there is a death, the determination of the share of each heir must be done.

Abstract

This study examines the economic implications of wives’ fulfillment of family support, analyzed through the perspectives of the Syafi'i and Hambali Islamic legal schools. The purpose is to understand how these jurisprudential views influence family economic dynamics and the role of wives in sustaining family welfare. The study employs a qualitative literature review methodology, analyzing classical and contemporary fiqh texts and scholarly interpretations related to women’s financial contributions within the household. The findings indicate that both the Syafi'i and Hambali schools provide nuanced frameworks recognizing wives’ involvement in family economic matters while emphasizing responsibilities aligned with social and religious norms. This review highlights the importance of integrating religious jurisprudence with socio-economic realities to foster family sustainability.

Abstract

This study aims to examine the practice of two marriage contracts for illegitimate daughters in Deli Serdang Regency from the perspective of mashlahah. This study uses a qualitative approach with a descriptive analytical method through interviews, observations, and documentation. The study results indicate that the first contract carried out by the guardian judge is legally valid under Islamic law because it fulfills the pillars and requirements of marriage. In contrast, the second contract carried out by the biological father is only symbolic and has no legal force. Implementing the second contract is intended to maintain the honor of the family and cover up past disgrace, so it is seen as a form of mashlahah mursalah that is tolerated as long as it does not conflict with the basic principles of sharia. Therefore, this phenomenon reflects a social need that demands a wise, contextual, and community-oriented Islamic legal approach

Abstract

Fenomena penggunaan akal yang terkadang melampaui batas dalam istinbat hukum Islam menjadi kegelisahan Ramadhan al-Buthi. Mashlahah dalam pandangan Ramadhan al-Buthi bukan merupakan dalil yang sifatnya independen, melainkan harus didukung dengan dalil lainnya. Oleh karenanya, menanggapi fenomena tersebut Ramadhan al-Buthi membuat batasan dalam konsep maslahah. Menurut Ramadhan al-Buthi dalam bukunya Dhawabith al-Mashlahah fi as-Syari’ah al-Islamiyyah, mashlahah dapat diakomodir menjadi hukum syara’ apabila memenuhi beberapa kriteria sebagai berikut: Pertama, bahwa mashlahah masih dalam ruang lingkup tujuan syari’ (maqashid as-syar’iyyah). Kedua, tidak bertentangan dengan al-Qur’an. Ketiga, tidak bertentangan dengan sunnah. Keempat, tidak bertentangan qiyas, dan kelima tidak bertentangan dengan kemashlahatan yang lebih tinggi. Dalam pandangan Ramadhan al-Buthi konsep mashlahah meliputi hifdz addin, hifdz an-nafs, hifdz al-aql, hifdz an-nasl, hifdz al-mal. Implementasinya tentunya berdasarkan urutannya. Kemaslahatan yang lebih tinggi harus didahulukan terhadap kemaslahatan yang lebih rendah. Sedangkan pandangan at-Thufi tentang mashlahah merupakan dalil tersendiri dan mandiri di luar teks, sehingga akal bebas menentukan kemaslahatan dan kemafsadatan. Dengan demikian secara epistemologis, at-Thufi lebih menempatkan posisi akal dari pada wahyu dalam menentukan kemashlahatan dan kemafsadatan hukum.

Abstract

Banyaknya jumlah penduduk muslim di Indonesia yakni sekitar 207 jiwa sangat berpeluang bagi perusahaan yang akan melakukan go public dengan menjual saham syariah di Pasar Modal. Karena umat muslim selalu dalam segala aktifitasnya selain ingin memperoleh keuntungan duniawi, acapkali juga mempertimbangkan aspek akhirat sebagai tujuan dalam aktifitas bisnisnya sehingga perusahaan-perusahaan yang mencari pendanaan melalui mekanisme go public dapat mempertimbangkan untuk menerbitkan saham syariah daripada saham konvensional. Faktanya banyak perusahaan-perusahaan yang diklasifikasikan sahamnya kedalam saham syariah oleh OJK, padahal telah diketahui perusahaan tersebut tidak memiliki nama syariah atau dalam melakukan kegiatan tidak memiliki platform syariah sehingga apa yang mendasari OJK memutuskan untuk menyatakan sebagai saham syariah. Penelitian ini menggunakan jenis penelitian yuridis normatif yang penguraiannya bersifat deskriptif dengan pendekatan peraturan perundang-undangan dengan data-data sekunder dan bahan hukum primer dan sekunder berupa peraturan perundang-undangan dan fatwa Majelis Ulama serta pendapat para ahli dalam buku-buku. Hasil dari penelitian ini menunjukkan bahwa ternyata tidak harus menjadi perusahaan yang berlabelkan syariah untuk menerbitkan saham syariah, namun perusahaan konvensional yang sama sekali tidak berlabelkan Islam tetap dapat mengeluarkan saham syariah atau sahamnya dapat dikelompokan sebagai saham syariah asalkan memenuhi persyaratan OJK yang terdapat dalam POJK Nomor 35/2017 yang mengatur pada dua aspek utama yaitu aspek kegiatan usaha tidak boleh melanggar hukum Islam seperti memiliki kegiatan usaha minuman keras, judi, prostitusi, melanggar lingkungan hidup dan lain sebagainya yang sifatnya merusak dan aspek keuangan yaitu tidak memiliki hutang riba diatas 45 % serta tidak memiliki pendapat riba ditas 10 % sehingga walaupun bukan perusahaan syariah tetap sahamnya dapat dikelompokkan sebagai saham syariah.

Abstract

Law No. 23 of 2011 concerning Zakat Management as a complement to the previous Law, namely Law No. 38 of 1999. This law provides institutional strengthening in the management of integrated zakat into a unified system. In turn, the National Amil Zakat Agency is the only institution that holds the authority of zakat, and the Amil Zakat Institution is a partner in assisting the National Amil Zakat Agency, as well as government supervision as a regulator. This research aims to answer the problem of how zakat is distributed according to the zakat law No. 23 of 2011 in Binjai City. How is zakat funds distributed according to law number 23 of 2011 and the perspective of Imam Shafi'i? How is the implementation of the distribution of zakat funds at BAZNAS Binjai City?. What is the perspective of law number 23 of 2011 and Imam Shafi'i's perspective on the system of distributing zakat funds at BAZNAS Binjai City? This research is a qualitative research using a legal science approach. The types of data used in this study are primary data, secondary data and the results of interviews with several administrators of the National Amil Zakat Agency of Binjai City. The results of the study show that the National Amil Zakat Agency in Binjai City in distributing zakat funds has not been running towards poverty alleviation in Binjai City. The lack of synergy to the distribution map that has not yet been seen makes the Binjai City National Amil Zakat Agency considered to need an effective breakthrough.

Abstract

This study aims to examine the level of accuracy of the direction of the Qibla in several mosques in Serdang Bedagai Regency which is determined using a compass, by comparing it to the direction of the Qibla calculated astronomically using geographic coordinate data and the help of GPS-based digital applications (such as Google Earth). The scholars agree that people who can see the Kaaba directly must face the Kaaba building ('ainul Kaaba). However, for people who are outside the Grand Mosque, especially far from Mecca, it is sufficient to face the Kaaba (Jihah Kaaba). Determining the accurate direction of the Qibla is important in carrying out Islamic prayers. In various regions, including Serdang Bedagai Regency, the method commonly used by people to determine the direction of the Qibla is using a compass. However, the accuracy of the compass is often influenced by environmental factors such as local magnetic fields and inaccuracy in use. This study uses an empirical Islamic legal research method (non-doctrinal research), a legal research method that functions to see how the law works in society. The object of the study is the direction of the Qibla from mosques in Serdang Bedagai Regency, totaling 665 mosques which are the research population. The sample in this study was 17 mosques from several sub-districts using the Purposive Sample technique which is a non-random sampling technique, with the vastness of Serdang Bedagai Regency and the large number of mosques requiring researchers to conduct non-probability sampling. In addition, researchers also conducted interviews. The results of the study showed that there was a deviation in the direction of the Qibla in most mosques with an average difference of 2° to 25° from the actual direction. This shows that the use of a compass manually without calibration and consideration of local factors can cause inaccuracy in determining the direction of the Qibla. This study recommends the use of more precise methods such as GPS devices, digital applications, or observations of the position of the sun during Rashdul Qiblah, especially for the construction of new mosques.
