Abstract

This study aims to analyze the effectiveness of zakat collection by the National Zakat Agency (BAZNAS) of North Sumatra Province, which is carried out based on voluntary principles from the perspective of maqashid sharia. This study uses a qualitative approach with a normative-empirical research type based on secondary data. Data were collected through a documentary study of official BAZNAS reports, local government publications, and scientific articles from nationally accredited journals. Data analysis was conducted descriptively and qualitatively with a thematic and normative approach, then examined within the framework of sharia objectives (maqashid sharia). The results show that although BAZNAS has implemented various strategies such as service digitization, zakat campaigns, and the involvement of religious leaders, the effectiveness of zakat collection is still low compared to the existing potential. The main factors affecting effectiveness include low public zakat literacy, weak trust in zakat institutions, limited institutional capacity, and minimal regulatory support at the regional level. In the perspective of maqashid sharia, the voluntary principle will have beneficial value if managed through a strong, professional system and impact on the empowerment of mustahik. Therefore, it is necessary to strengthen regional regulations, increase public literacy, and create institutional synergy so that zakat can become an effective and sustainable instrument of distributive justice.

Abstract

Legal uncertainty regarding jurisdiction in cases of corruption involving civilian and military actors, as well as its impact on the effectiveness of the Corruption Eradication Commission (KPK RI), has caused the KPK RI to hesitate in investigating cases of corruption, which could potentially hinder the optimal handling of cases and harm the constitutional rights of citizens to receive the benefits of development. This study aims to unravel how the military hierarchy structure, military court jurisdiction, and analyze the Constitutional Court (MK) Decision Number 87/PUU-XXI/2023 are carried out through the perspective of Maslahah Mursalah, an Islamic legal philosophy that focuses on public welfare and benefit. These research uses a qualitative method with a legal-normative approach. The research is conducted by reviewing and analyzing relevant literature related to the research topic being studied. The results of the study indicate that the military environment is classified as a social stratification when viewed from a legal sociology perspective, with one of its characteristics being the existence of differences in rank and position within the military hierarchy. Furthermore, progressive law advocates the need to revise the Military Court Act so that military personnel who commit general criminal offenses can be fully tried in civilian courts, which undoubtedly represents a significant step forward toward a more humane and just legal system. Furthermore, an analysis of the Maslahah Mursalah principle regarding the Constitutional Court's Decision No. 87/PUU-XXI/2023, using the criteria outlined by Asy-Syatibi, shows that the Court, in its decision, considered the principle of legal certainty as explained in its legal reasoning, as well as Islamic law governing the principle of legal certainty, thereby ensuring that this decision does not contradict Islamic law.

Abstract

This study aims to analyze the concept of freedom of speech (Hurriyatul Ra'yi) in Islamic teachings and compare its limitations with the provisions of Indonesian Constitutional Law (UUD NRI 1945), particularly in the context of restrictions on hate speech, blasphemy, and the spread of fake news. This study uses a normative (doctrinal) legal type. We apply a philosophical-theological approach to examine Islamic Law and a juridical-normative approach to analyze the Constitutional framework. The analysis is conducted in a comparative-synchronized manner to find common ground and philosophical harmony between the two legal systems. The main primary legal materials include the Qur'an, Hadith, Fiqh Siyasah books, as well as the 1945 UUD NRI and the ITE Law. Freedom of speech in Islam is seen as a right bound by responsibilities and obligations (amar ma'ruf nahi munkar), whose main purpose is to realize the public good (maslahat) and must be stopped if it causes harm (mafsadah). These limitations are supported by the principles of ethics and prevention (Sadd al-Dzarāi'). Accordingly, the Indonesian Constitution guarantees freedom (Article 28E), but imposes mandatory restrictions through Article 28J Paragraph (2) for the sake of "religious values" and "public order." There is a strong philosophical alignment, where Islamic restrictions aimed at preventing mafsadah align with the Constitutional restrictions that protect religious values ​​and public order. Both legal systems fundamentally reject absolute and destructive freedom of expression. This synchronization forms the legal basis for the implementation of positive law (such as the ITE Law) in demanding digital accountability, which in essence protects collective ethics and morality.

Abstract

This study aims to analyze the legal basis for the management and use of employee official housing at PTPN IX and PTPN IV, to examine the legal status of official residences occupied by employees after retirement, and to identify the underlying factors and the efforts made by the companies to resolve the issue. It also seeks to explore the social, economic, and legal implications of retired plantation employees continuing to occupy official housing. The research employs a qualitative approach with a juridical-empirical method, combining normative legal analysis with field observations through case studies of PTPN IX and PTPN IV. The results show that the legal foundation for providing official housing is derived from national regulations such as the State-Owned Enterprises Law, the Plantation Law, and internal company policies, which classify official residences as state property (BMN) allocated for use only during active employment. The findings reveal that many retired employees continue to occupy these houses due to economic constraints, lack of private housing, and a social perception that the houses are part of their earned rights. On the other hand, the companies face difficulties in enforcing eviction due to social resistance and weak regulatory enforcement mechanisms. The discussion indicates that this issue extends beyond legal dimensions, creating significant social and economic repercussions. From the perspective of agrarian and civil law, occupying official residences after retirement without legal authorization constitutes unlawful possession of state property. Socially, the tension between companies and retirees can escalate into community-level conflicts. The study emphasizes the need for policy reform and a more adaptive legal approach that considers the socio-economic conditions of retirees, in line with the Islamic legal renewal framework that upholds justice and public welfare.

Abstract

Consumptive waqf is a type of waqf used to meet the immediate needs of the community, such as the construction of mosques, schools, and temporary social assistance. Although it does not provide sustainable income, consumptive waqf is important for fulfilling basic needs and improving the quality of life. In Indonesia, cash waqf has great potential that can be directed toward urgent needs without violating Islamic principles. This research departs from the urgency of managing consumptive cash waqf in response to economic dynamics, particularly inflation, with a normative juridical approach. This approach emphasizes the analysis of legislation, Islamic legal doctrines, and the principle of maslahah mursalah as a conceptual basis for developing effective and Sharia-compliant waqf management strategies, as well as assessing the impact of inflation on the effects of consumptive cash waqf as a social financing instrument. Based on the results of normative analysis, cash waqf has a clear positive legal basis, among others in Law Number 41 of 2004 concerning Waqf, reinforced by Government Regulation Number 42 of 2006 on the Implementation of the Waqf Law, as well as regulations from the Indonesia Waqf Board (BWI). These regulations recognize the existence of cash waqf and provide a legal framework for its management, including the potential for its consumptive use. However, the consumptive nature of cash waqf is potentially vulnerable to the influence of inflation, which can reduce its utility and effectiveness in meeting social needs. Therefore, the principle of maslahah mursalah becomes important as a balancing instrument between the normative texts of positive law and the practical needs of society in fluctuating economic conditions. The formulation of the management of consumptive cash waqf in accordance with the principles of maslahah mursalah must emphasize the strengthening of nazhir institutions, a transparent oversight mechanism, as well as the integration of community economic empowerment strategies. Based on legislation and a maslahat approach, consumptive cash waqf not only functions as a means of Islamic philanthropy but also as a legal and economic instrument capable of strengthening the socio-economic resilience of communities in facing inflation.

Abstract

This study, entitled “A Study on the Customary Prohibition of Cousin Marriage in the Alas Indigenous Community: Perspectives from Customary Law and Islamic Law,” aims to analyze the reasons behind the prohibition of cousin marriage in the Alas community, examine its compatibility with Islamic law, and explore its social implications within indigenous society. The research specifically investigates why marriages between paternal cousins (sepekhinding) and maternal cousins (pemekhenen) are prohibited, while marriages with the daughter of the father’s sister (mekhimpal) are encouraged under the customary concept of kawin mekhimpal. The study employs a qualitative field research method, with data collected from traditional elders and community leaders in Southeast Aceh through interviews and observation. Data were analyzed descriptively to interpret the relationship between customary norms and Islamic legal principles. The findings reveal that the prohibition of sepekhinding and pemekhenen marriages is rooted in the principle of preserving family honor, maintaining the integrity of the nuclear family, and preventing internal conflict within close kinship structures. Meanwhile, the encouragement of marriage with mekhimpal cousins symbolizes reciprocal relationships that strengthen social and familial cohesion in the extended family system. The results indicate that, based on the Qur’an, Hadith, and Islamic legal analogy (qiyās), the practice of cousin marriage itself is permissible in Islam. Therefore, the customary prohibition of marriage with certain cousins, such as sepekhinding and pemekhenen, is not aligned with Islamic law, which does not restrict marriage among cousins. The discussion highlights that the Alas customary system reflects a sociocultural adaptation aimed at maintaining harmony within the community, even though it differs from Islamic legal provisions. Hence, the study concludes that the customary practice has sociological and moral value but should be reinterpreted in light of Islamic jurisprudence to ensure alignment between religious law and local tradition.

Abstract

Permasalahan waris seperti tidak pernah habis untuk dibahas, walaupun aturan tentang waris Islam sudah sangat detail diatur dalam Alquran namun tetap saja ada permasalahan yang ditimbulkan dalam kehidupan sosial. Tulisan ini ingin menjelaskan bagaimana perkembangan hukum waris di Indonesia, tulisan ini sendiri mengarahkan pemikiran Hazairin dalam membawa pembaharuan konsep waris Islam di Indonesia. Penelitian ini adalah penelitian kepustakaan atau sering disebut dengan yuridis normatif, karena penelitian ini tidak memakai sumber data primer, melainkan hanya memakai sumber data sekunder yang berupa bahan hukum primer dan bahan hukum sekunder serta jika diperlukan juga memakai bahan hukum tersier. Hasli penelitian menunjukkan bahwa Hazairin berkeyakinan sistem hukum waris yang diinginkan oleh Alquran adalah sistem bilateral, keyakinan ini digali dari penafsiran ayat-ayat waris yang terdapat dalam Alquran sendiri. Pengaruh dari pemikiran Hazairin tersebut sangat berimplikasi dalam tata hukum nasional, hal ini bisa ditandai diterapannya ahli waris pengganti dalam Kompilasi Hukum Islam yang merupakan rujukan utama Pengadilan Agama di Indonesia

Abstract

Islam Nusantara is recognized as an ideology that advocates the application of fiqh law while accommodating cultural and traditional values. In the contemporary evolution of religious comprehension, particularly in Aceh, the local community perceives cultural manifestations in worship as misguided. Therefore, the introduction of Islam Nusantara concept aims to rectify these misconceptions through cultural adjustment with Sharia, commonly referred to as Islamization. Considering these challenges, the role of ulemas should be examined by implementing and practicing fiqh law in the Aceh community. Furthermore, this study adopts qualitative and descriptive normative methods. Data are derived from a comprehensive literature review, interviews, and observations, and subjected to qualitative data analysis methods. The results show that fiqh practices in Aceh are always based on the fatwa of ulemas to provide legality of carrying out these practices. The inclusion of ulemas is indispensable to ensure the conformity of new cultural teachings with the established legal framework.

Abstract

This article aims to observe and examine the implementation of Qiyas in everyday life, considering that Qiyas is quite important because it is one of the foundations for establishing Islamic law. The main issue discussed is what Qiyas is, and the extent of the urgency of implementing Qiyas in everyday life. This paper is included in research that uses library methods, because it involves a series of activities related to collecting data from written sources, reading, recording, and analyzing research materials. The results of this research conclude that Qiyas is an important component in establishing Islamic law, which will serve as a guide for its application in existance life.

Abstract

Tulisan ini bertujuan bahwa pada umumnya modus kejahatan investasi seperti arisan bodong, investasi bodong dan lainnya adalah berawal dari iming-iming oknum dengan bujuk rayu yang menjanjikan keuntungan berlipat ganda. Perbuatan gharar yang di-make up dengan berbagai rupa dan kerap menelan korban tersebut ternyata tidak lantas membuat masyarakat jera, bahkan diminati para individu yang bermimpi hidupnya akan berubah secara instan. Fenomena ini menunjukan tingginya animo masyarakat terhadap bisnis investasi namun sayangnya tidak dibarengi pengetahuan dan itikad baik. Salah satu upaya pemerintah dalam mencerdaskan dan melindungi bangsa adalah dengan cara mendorong terlaksananya usaha bersama berbentuk koperasi sebagaimana ketentuan Undang-Undang No.17 Tahun 2012 tentang Perkoperasian yang di dalamnya terdapat klausul nilai-nilai kebaikan sejalan dengan ajaran agama islam seperti halnya syirkah yakni bentuk usaha bersama. Karenanya jurnal ini mengulas seperti apakah nilai-nilai kebaikan dimaksud berdasarkan sudut pandang islam yang hukumnya mengatur perilaku umat.
