Abstract

Criminalization in legislation tends to increase, and most of it deals with administrative violations with the potential to cause over-criminalization. This study aims to analyze the concept of over-criminalization and its various forms in criminal legislation. As normative legal research, this study uses a conceptual and statutory approach. The results show that over-criminalization is generally conceptualized in relation to criminalization. The forms also include re-criminalization of an act having been banned by other laws, formulation  of  offenses  without  sufficient  error  requirements,  criminalization  of  impeccable  deeds, formulation of offenses without fulfilling the principle of lex certa, criminalization of pure administrative violations, and criminal penalties incomparable to the seriousness of the offenses. The forms of over-criminalization in legislation are obvious in different articles in Law on Plantations, Law Environmental Protection, and Management, and Law on Mineral and Coal Mining.

Abstract

This study aims to analyze the theoretical problems in placing criminal law as a last resort only on offenses in Article 100 paragraph (1) of the PPLH Law and the notion is related to the characteristics of environmental offenses. As a normative legal research, this study uses the statutory, the history, and the conceptual approaches. The results of the study concluded that the placement of criminal law as a last resort only in Article 100 paragraph (1) of the PPLH Law is theoretically problematic. The offenses in the Article, as well as the offenses in Article 101, Article 102, Article 103, Article 104, Article 107, and Article 109 (businesses/activities that are mandatory to EIA), meets the criteria for a real danger model (concrete endangerment) which requires direct contact between contaminated material and the environment carried out in an unlawful manner. Criminal law as a last resort should apply to offenses that enter the abstract endangerment model as regulated in Article 109 (businesses/activities related to UPL-UKL), Article 110, and Article 111 because they are purely administrative violations, there is no direct contact between material polluted with the environment, and protect ecological values indirectly through the provision of intervention mechanisms for the government to prevent environmental losses.

Abstract

The Regional Regulation on Cultural Heritage of Denpasar City has been in effect for 5 years, it is very important to assess its effectiveness. There are two problems raised in this study. First, how effective is the Denpasar City Cultural Heritage Regional Regulation? Second, what is the strategy to achieve the effectiveness of the Denpasar City Cultural Heritage Regional Regulation? Data analysis was carried out both from primary data from the results of interview data, and analysis of secondary data in the form of primary and secondary legal materials. Therefore, this research can be called a research that uses mixed methods or is categorized as a socio-legal research. The results of the study conclude, firstly, regarding the effectiveness of the Regional Regulation on Cultural Heritage of Denpasar City, it can be reviewed from three sides, namely the role of regional officials, the rule of law, and legal awareness of the community. Second, the Regional Regulation on Cultural Heritage of Denpasar City is still not effective in regulating and implementing it in supporting the preservation and management of cultural heritage in Denpasar City. To achieve the legal effectiveness of the Denpasar City Cultural Heritage Regional Regulation, several strategies can be pursued, among others, the legal aspect strategy, the institutional aspect strategy, the physical aspect strategy and the financial aspect strategy.

Abstract

This study aims to analyze the application of participating perpetrator in court decisions in corruption cases. The research question is whether the double intention as a condition for participating perpetrator in the decision of a corruption case is fulfilled? As a normative legal research, the study in this research is focused on the ratio of four decisions on corruption cases, especially the concept of criminal participation. The results of the study concluded that the double-intentional evidence as a condition for participating perpetrator so was ignored by the panel of judges. The role of involvement of each defendant in the offense of participating perpetrator in the ongoing decision is not described. The judge is not even able to distinguish between the conditions of a person as a perpetrator and the participating perpetrator. In the decisions studied, the judges also mixed the concepts of ordering, advocating, and participating in committing criminal acts of corruption. The judge's inaccuracy in the use of double intention resulted in the emergence of an unfair sentence. Therefore, this study suggests that the Supreme Court should make guidelines for the application of participating perpetrator in corruption cases.

Abstract

This paper is aimed at analyzing the concepts and parameters to determine an act as a bribery and gratuity in the Anti-Corruption Law and court cases.  This involved the application of the doctrinal legal research to understand these differences. The results of this study showed that bribery requires a meeting of mind between the bribe givers and bribe recipients which is not found in gratuity. The reporting mechanism and the reversal burden of proof do not apply to bribery while Operation Catching Hand does not apply to gratuity due to its inability to satisfy the provisions of the Criminal Procedure Code. Criminal sanctions are also imposed on both the giver and the recipient of a bribe while the act of a giver in gratuity is not considered as a criminal offense. The study also found that the court failed to apply these essential differences.

Abstract

Penelitian ini bertujuan untuk menganalisis ketidaktepatan putusan pengadilan perkara PT. AJS dengan terdakwa Benny Tjoktosaputro sebagai tindak pidana korupsi. Fokus kajian diarahkan kepada fakta hukum yang dinyatakan terbukti dalam pertimbangan hukum hakim terkait unsur delik dalam Pasal 2 ayat (1) Undang-undang Pemberantasan Tindak Pidana Korupsi. Riset ini merupakan penelitian hukum normatif dengan menjadikan putusan pengadilan sebagai bahan hukum primer. Hasil penelitian menunjukkan bahwa perbuatan terdakwa dalam perkara a quo lebih tepat dikategorikan sebagai tindak pidana pasar modal. Perampasan harta benda yang sebagian besar kepunyaan anak usaha PT. Hanson International Tbk dan harta benda terdakwa yang diperoleh sebelum keterlibatannya dalam perkara tersebut juga tidak tepat dan melanggar hak asasi manusia. Penetapan kerugian keuangan negara sebesar Rp. 12.157.000.000.000 juga tidak dapat dipertanggungjawabkan. The purpose of this study is to examine the inaccuracy of the court's verdict in the case of PT. AJS vs. defendant Benny Tjoktosaputro is a corruption case. The study's focus is on the legal facts established by the judge's legal consideration of the offense promulgated in Article 2 paragraph (1) of the Law on the Eradication of Corruption. By making court judgments as of the primary source of law, this research is doctrinal legal research. The findings revealed that the defendant's acts should have been classified as a capital market offense. Confiscation of property, most of which belongs to subsidiaries of PT. Hanson International Limited, as well as the defendant's property, acquired before his involvement in the case, is also unethical and in violation of human rights. The determination of IDR12,157,000,000,000 as state financial losses is also unreliable.

Abstract

Akar tuba (Derris elliptica) digunakan sebagai racun pada penangkapan ikan air tawar. Rotenon sebagai bahan aktif dari akar tuba sangat efektif untuk membunuh ikan tetapi penelitian tentang toksisitasnya masih sangat terbatas. Tujuan penelitian ini untuk mengetahui tingkat toksisitas ekstrak akar tuba menggunakan pelarut etanol, heksan dan akuades dengan menggunakan dua hewan uji yaitu artemia (Artemia sp.) dan ikan mas (Cyprinus carpio). Penelitian ini menggunakan rancangan acak lengkap (RAL) dengan 5 tingkat konsentrasi yang berbeda. Jumlah rendemen hasil ekstraksi pada pelarut etanol, heksan dan akuades berturut-turut 5; 3,6; 2,5%. Hasil penelitian pada artemia menunjukkan bahwa tingkat mortalitas 100% pelarut heksan terjadi pada konsentrasi 63 dan 100 mg/l; etanol 100 mg/l dan akuades 1000 mg/l.  Hasil analisis probit pada artemia menunjukkan nilai LC50 (Lethal Concentration) 24 jam pada heksan, etanol dan akuades berturut-turut 37,03; 46,77; 307,47 mg/l. Hasil penelitian pada ikan mas menunjukkan bahwa tingkat mortalitas 100% pelarut heksan terjadi pada konsentrasi 3,979; 6,30 dan 9,96 mg/l dan pelarut etanol 9,96 mg/l. Hasil analisis probit pada hewan uji ikan mas menunjukkan nilai LC50-96 jam heksan dan etanol berturut-turut 3,83 dan 6,85 mg/l. Penelitian ini diharapkan mampu menjadi data awal untuk penggunaan akar tuba baik untuk meracuni ikan maupun untuk membius ikan.

Abstract

Douglas Husak has been widely known, especially in the United States and Europe, as a leading theorist who combines the disciplines of legal philosophy and criminal law. Most of his writings were directed at the use of the coercive means of the state through criminal law as minimum as possible. The minimalist theory of criminal law that he coined was motivated by the phenomenon of the increasing number of acts criminalized in the United States Federal State Law in which the majority related to offenses of risk prevention causing overcriminalization. To prevent this, criminal law must be placed as a last resort. The state’s decision to criminalize an act must pay attention to internal and external constraints. The first includes the nontrivial harm or evil constraint, the culpability of the actor, and the proportionality of punishment, while the second is related to the substantiality of the state’s authority to punish. The thought is relevant to be adopted in the criminalization policy in Indonesia, especially regarding the principle of the blameworthiness of conduct, the severity of punishment must weigh the dangerousness of the (actor) offenses, and criminalization should not be taken if other means are equally effective or even more effective to achieve the goal. Abstrak Douglas Husak dikenal luas terutama di Amerika Serikat dan Eropa sebagai teoretisi terkemuka yang menggabungkan antara disiplin filsafat hukum dan hukum pidana. Tulisan-tulisan Husak kebanyakan diarahkan pada penggunaan sarana koersif negara melalui hukum pidana seminimal mungkin. Teori hukum pidana minimalis yang dicetuskannya dilatarbelakangi fenomena semakin banyaknya perbuatan-perbuatan yang dikriminalisasi dalam undang-undang Negara Federal Amerika dan mayoritas terkait offenses of risk prevention sehingga menimbulkan kelebihan kriminalisasi. Untuk mencegahnya, hukum pidana harus ditempatkan sebagai sarana terakhir. Keputusan negara untuk mengkriminalisasi suatu perbuatan harus memperhatikan pembatas internal dan pembatas eksternal. Yang pertama meliputi sifat jahat dan dampak kerugian/kerusakan yang begitu serius dari dilakukannya suatu tindak pidana, kesalahan pembuat, dan proporsionalitas pidana; sedangkan yang kedua terkait substansialitas kewenangan negara untuk memidana. Pemikiran Husak relevan untuk diadopsi dalam kebijakan kriminalisasi di Indonesia terutama menyangkut prinsip ketercelaan suatu perbuatan, penetapan beratnya ancaman pidana mengacu pada seriusitas delik dan kesalahan pembuat, dan kriminalisasi tidak boleh ditempuh jika cara-cara lain sama efektif atau bahkan lebih efektif untuk mencapai tujuan.

Abstract

 The study proposes the compensation and restitution regulations which should be oriented to protect the victim of crime. Although most regulations have been adopted the right of the victims to receive the compensation and restitution, but this study finds that there are some weaknesses in such regulations. Hence, compensation regulation should be specifically focused on the fulfillment of the right of the victims of crime. It shall not depend on court decisions, but such compensation should be provided even though the victims ceased before the court proceeding has started, or even if he or she wrongly arrested by police. This compensation is only to cover material losses and traumatic stress recovery cost. It could be paid directly monthly/yearly and could be converted to other form of compensation. Restitution refers to the paradigm of restorative justice. In Indonesia, restitution should be based on final and binding court decision. If the perpetrator does not want to provide it for the victim, he/she has moral obligation to provide it for the victim oven without inkracht court decision, and this could be used by the judges to pardon the perpetrator. Restitution shall be enforced for all criminal offences which resulting direct and indirect losses for the victims. Restitution is not merely about monetary values but moral obligation of the perpetrator to recover the victim’s condition.

Abstract

Basically, the authority of attorney general to control the circulations of printed goods is accordance with the principle of due process of law, equality before the law, and the right of freedom of expression as stipulated in the constitution 1945. Interpreting these principles has close relationship with the basic principle of human right in Indonesia, rechtsidee, values, and world view containing in the five basic pillars of Pancasila that stresses more to the balance of right and obligation. In the context of judicial review of an article 30 (3) c act number 16 2004, the problem is not on   the existence of its legal norm but on the procedure to implement it in which attorney general did not provide proper and accountable mechanism so that these three principles are not purely conducted.
