Abstract

This research focuses on the fundamental justification for the policy of inserting Islamic criminal law values into the National Criminal Code, especially regarding the policy of criminalizing the moral offense of adultery and the form of adoption of the said values and principles of Islamic criminal law in the National Criminal Code, particularly on the policy of criminalizing the moral offense of adultery. This is a normative legal research with statutory, philosophical and policy approaches. This research concludes that theoretically (socio-historically based) and juridically (based on the values of the Pancasila philosophy, mainly the first principle and the 1945 Constitution, specifically article 29), the absorption of Islamic criminal law values in the preparation of the Criminal Code is a historical and constitutional right. Values and the principles of Islamic criminal law regarding the moral offense of adultery have not been fully absorbed in the National Criminal Code. Some forms of adoption that have reflected the values and principles of Islamic criminal law are the expansion of the scope of acts criminalized as adultery, the philosophy of prohibiting adultery and the threat of criminal sanctions against adultery. Some Acts that are essentially moral offenses of adultery but are not criminalized as moral offenses of adultery, i.e. rape, prostitution and enjoying pornographic content for oneself.Keyword: Adoption; Values and Principles of Islamic Criminal Law; Moral Offenses of Adultery and the Criminal Code AbstrakPenelitian ini berfokus pada dasar justifikasi kebijakan mengadopsi nilai-nilai hukum pidana Islam dalam KUHP Nasional khususnya mengenai kebijakan kriminalisasi delik kesusilaan zina dan bentuk adopsi terhadap nilai-nilai dan prinsip-prinsip hukum pidana Islam dalam KUHP Nasional khususnya mengenai kebijakan kriminalisasi delik kesusilaan zina. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan, filsafat dan kebijakan. Penelitian ini menyimpulkan bahwa secara teoritis (berbasis sosio-historis) dan secara yuridis (berbasis nilai falsafah Pancasila khususnya sila pertama dan UUD 1945 khususnya Pasal 29, penyerapan nilai-nilai hukum pidana Islam dalam penyusunan KUHP adalah suatu hak sejarah dan hak konstitusional. Nilai dan prinsip hukum pidana Islam tentang delik kesusilaan zina belum sepenuhnya terserap dalam KUHP Nasional. Beberapa bentuk adopsi yang sudah mencerminkan nilai dan prinsip hukum pidana Islam ialah mengenai adanya perluasan cakupan tentang perbuatan yang dikriminalkan sebagai zina, filosofi pelarangan zina dan ancaman sanksi pidana terhada zina. Beberapa perbuatan yang hakikatnya merupakan delik kesusilaan zina tetapi tidak dikriminalisasi sebagai delik kesusilaan zina yaitu perkosaan, pelacuran dan menikmati untuk diri sendiri terhadap konten pornografi.Kata Kunci: Adopsi; Delik Kesusilaan Zina dan KUHP; Nilai dan Prinsip Hukum Pidana Islam.

Abstract

Biodiesel is derived from natural fats such as vegetable or animal oils. This study uses a type of microalgae that can produce products and has the potential as biodiesel fuel, namely Nannochloropsis sp. The purpose of this study was to determine the effect of osmotic shock on the oil yield of Nannochloropsis sp. to determine the optimum osmotic shock, and to determine the composition of fatty acid content in the microalgae Nanochloropsis sp. in both wet and dry conditions. The extraction process in this study used five variations of osmotic shock, namely 0, 30, 60, 90 and 120 atm. The results showed that osmotic shock had an effect on both oil yields of Nannochloropsis sp. both in wet conditions (R=0.890 Sig<0.043) and Nannochloropsis sp. dry conditions (R=0.916 Sig<0.029). So that the higher the osmotic shock applied, the higher the yield of Nannochloropsis sp. wet and oil yield of Nannochloropsis sp. dry. then the osmotic stress of 120atm is good for extracting the oil of Nannochloropsis sp. Each result obtained is Nannochloropsis sp. wet atm 120 atm (3.96 %) and for Nannochloropsis sp. dry 120 atm (2.60 %). Results of GC Chromatogram analysis on oil yield of Nannochloropsis sp. 13 fatty acids were found including saturated fat: octanoate (C8:0), laurate (C12:0), tetradecanoate (C14:0), heptadecanoate (C17:0), arachidate (C20:0), heneicosanoate (C21:0), tricosanoate (C23:0), lignocerate (C24:0) dan lemak tak jenuh palmitoleate (C16:1), oleic (C18:1), linolelaidic (C18:2), nervonate (C24:1), dan docosahexaenoate (C22:6).

Abstract

As an influential legal idea, Satjipto Rahardjo’s progressive law has colored various legal discourses and practices in Indonesia. Court decisions, as legal texts that record and summarize the trial process, also show that litigants, experts, and court judges often use this legal idea. This research will examine how progressive legal phrases are used in court decisions and whether the users have considered their underlying assumptions, pillars, or principles. This research is limited to Constitutional Court decisions in law review cases. The use of progressive legal phrases is generally accompanied by several progressive legal assumptions proposed by Satjipto Rahardjo. However, these are selected and used partially according to the needs and interests of their users, and thus can have bias implications when compared and examined comprehensively based on other assumptions or pillars.

Abstract

The General Election Law has placed villages at the forefront of the election monitoring system by establishing Village Panwaslu. However, it still needs to be fully able to unravel the complexity of the election monitoring system. This study aims to strengthen the election supervision system so that all electoral issues can be resolved at the village level. This research uses normative legal research methods that focus on the reconstruction and institutionalization of the election supervision system at the village level through the synergy of village judicial institutions. The result of the research is that the design of election supervision at the village level, which only places one member, has yet to resolve the many burdens of election supervision fully. Although Article 448 paragraph (3) of the Election Law authorizes the community to monitor actively, it has proven not optimal because there is no clear legal protection for the participatory monitoring system. The weakness of the monitoring system can be strengthened through 1) The establishment of Village Panwaslu members that involve village judicial institutions consisting of Babinkantibmas, Babinsa, and community leaders; 2) Expanding the authority of the Village Panwaslu to resolve disputes over the election process at the village level.

Abstract

Sriminosari coastline is surrounded by mangroves and has high eco-tourism potential. Therefore,the local community initiatives to establish a Pandan Alas fishermen association to manage thefisheries and mangrove commodity. The commodity potential of the village is not only themangroves but also the presence of green mussel seeds which naturally found in the coastalwaters. This project intends to empower the Pandan Alas Fisherman Association in SriminosariVillage, the eastern region of Lampung, Indonesia. The local community is trained to culture thegreen mussels by introducing the rack culture system technology. This program carried outthrough a survey, focus group discussions (FGD), simulations, installation of rack culturetechnology, and evaluation. Green mussel cultivation has been run successfully in Sriminosari andhopefully to be a profitable and sustainable business.

Abstract

The problem that often occurs in the era of globalization education in Indonesia is the lack of religious knowledge, one of the factors is the neglect of Islamic religious values in the learning process and the lack of student morals. The research is qualitative research. While the type of research is descriptive in nature. This research is classified as field research when viewed from the place where the research was carried out. The subjects in this study were school principals, Islamic Religious Education teachers, and students of ma nurul hidayah al-amin indraloka jaya. While the object is coaching in growing students' spiritual intelligence. The data comes from observation interviews and documentation. In this case the researcher acts as a full participant, where the researcher is a planner, implementer, data collector, analyzer and becomes a reporter on research results. The results of the study show that the efforts of the akhlaq aqidah teacher in cultivating the spiritual intelligence of students at MA Nurul Hidayah Al Amin Indraloka Jaya lead to the formation of morals through religious activities, habituation and learning in the classroom. Religious activities at MA Nurul Hidayah Al Amin Indraloka Jaya are considered very effective, because the activities carried out at school are habits that are intended as provisions to deepen faith, broaden knowledge about Islam and form Muslim and Muslim women who are able to filter out negative influences from their environment and become a young generation who good morals in everyday life.

Abstract

This juridical normative and empirical study is conducted with the aim at analyzing the relationship between corruption and human rights violation. Two issues shall be discussed, i.e. what factors inhibits the use of human right approach in corruption cases and what changes can be made to the criminal justice system, especially in relation to the penal judgement. One factor inhibiting the use of a human right approach in handling corruption cases in the perspective of treating corruption as pure criminal act wholly unrelated to violation of human rights.  To rectify this situation and accommodate this human right approach, the author recommends to prioritize and use fine which basic value is social welfare.  Court decision in corruption cases, in addition, should when evaluating elements of crime charges, explicitly describe those rights of the victims which are violated and use this consideration in determining what penal sanction are to be given.

Abstract

The purpose of this study is to design and implement a holistic and sustainable education strategy to improve the quality of learning, student achievement and school competitiveness in facing global challenges. This study used a qualitative approach with a descriptive design to explore the factors that influence the quality of education at SMPN 3 Rogojampi. Data were collected through in-depth interviews, observation and document analysis involving teachers, students, principals, parents and the community. Data were analyzed using thematic analysis techniques, involving reduction, presentation and conclusion drawing. Triangulation of sources, methods and time was used to ensure data validity. This research aims to provide a comprehensive picture and strategic recommendations for improving education quality. The results of this study show that improving teachers' competencies, synergy between schools, parents and communities and the integration of character education in the curriculum are the main factors in improving the quality of education at SMPN 3 Rogojampi. Training and workshops for teachers improve the quality of learning with innovative and interesting methods that encourage student motivation. Active collaboration between the school, parents and the community strengthens support for student development. The integration of character education instills moral values that help students not only succeed academically, but also form resilient characters. All these efforts create a conducive and effective learning environment.

Abstract

The purpose of this research is to investigate the legal framework allowing the finance minister to enforce a court decision that approves a good faith third-party objection request, as well as to explore the legal implications and recourse if the finance minister fails to implement the court decision. This study is prompted by Supreme Court Regulation Number 2 of 2022, which elaborates on Article 19 of Law No. 31 of 1999. The significance of this research lies in providing legal certainty regarding the enforcement of court decisions granting good faith third-party objection requests. The research employs the normative legal research method and offers a new perspective by examining the implementation phase of objection application settlements. The findings indicate the Perma No. 2 of 2022 cannot be enforced without a regulation as a legal basis for the finance minister to govern the procedures for executing court decisions granting objections. Furthermore, the prohibition of state property confiscation leaves good faith third parties without legal protection, as there is no certainty about the legal consequences should the finance minister fail to implement the stipulation or court decision granting the objection of the good faith third party, and there are no available remedies for the Good Faith Third Party. Such Perma can not be effectively enforced without technical regulation on the procedure to execute the court verdict. Hence, it is recommended that the ministry of Finance needs to issue regulations concerning the execution of court verdicts providing legal certainty and protection for good faith third parties.

Abstract

In recent years (2020-2023), bullying and cyberbullying cases have shown an increasing trend based on data from the Indonesian Child Protection Commission (KPAI), the Federation of Indonesian Teachers' Unions (FSGI), and Kabarbursa online media. Throughout 2023, FSGI data recorded around 30 bullying cases, with 80% occurring in schools under the auspices of the Ministry of Education and Culture Ristek, and the rest in schools managed by the Ministry of Religious Affairs.The total number of bullying cases recorded reached 1,478, indicating the need for more attention to a safe school environment for students . The method of designing a web-based anti-bullying and cyberbullying information system uses the system development stages of the Borg & Gall model. The purpose of designing a web-based anti-bullying and cyberbullying information system prototype in utilising technology as an effort to create a safe environment, especially in the school environment and foster a culture of mutual respect and safety as well as proactive action efforts to create positive changes in the environment.
