Abstract

Abstract

This research is aimed at analyzing penal policy on criminalization against corporation in the Laws related to environment. By using normative legal research accompanied by statutue and conceptual approaches, this study reveals that offense to corporation is only formulated in both Illegal Logging Act and Environmental Protection and Management Act (EPMA) adopting doctrine of identification and functioneel daaderschap. Meanwhile, only EPMA that formulates the criteria for corporate official to be criminally liability for the offense as long as he acts as a functional position in the corporate structure. It is also suggested to adopt strict liabity for administrative dependent of criminal law. All Acts determine the criminal sanction for the petpetrators in the various severity of punishment. This study also found that the strafmodus for fine in those Acts was not formulated. Hence, they prefer to choose short imprisonment then that of fine. This will give impact to the application of the provision.

Abstract

Corporate criminal liability has become an issue following the increase in corporate crimes. This study discusses the possibility of parent company to deny liability for crimes committed by its subsidiary companies. This normative legal research employed qualitative analysis. The results showed that the parent company denied criminal liability by hiding behind the separate legal entities and limited liability doctrine. Through both doctrines, the parent company treats itself as a separate legal entity apart from the subsidiary company so that the former holds no liability for any crime committed by latter. Through piercing the corporate veil doctrine, the parent company intentionally uses the subsidiary company as a tool to maximize profits and applies total control. Therefore, based on the vicarious liability principle, the subsidiary company functioned as the parent company’s agent. It works for or on behalf of the parent company in which every profit made is owned by the parent company.

Abstract

The criminal justice system is built on the ideology of normality, a perspective that all people are physically and intellectually normal. Consequently, the process of investigation, prosecution and examination in court proceedings is only aimed at and designed for those who are normal. The existence of persons with disabilities has become marginalized and even forgotten. The rights of persons with disabilities are often violated both when they are perpetrators and witnesses/victims of criminal acts. In order for the criminal justice system to be pro for them, the medical approach should be abandoned and replaced with a social approach. Here what is needed is what the law enforcers need to fulfill at each stage of the criminal justice so that persons with disabilities have the right to a fair criminal trial. A profile assessment is necessary to determine the character, barriers and needs of persons with disabilities in the early stages of the criminal justice process.

Abstract

Basically, the authority of attorney general to control the circulations of printed goods is accordance with the principle of due process of law, equality before the law, and the right of freedom of expression as stipulated in the constitution 1945. Interpreting these principles has close relationship with the basic principle of human right in Indonesia, rechtsidee, values, and world view containing in the five basic pillars of Pancasila that stresses more to the balance of right and obligation. In the context of judicial review of an article 30 (3) c act number 16 2004, the problem is not on   the existence of its legal norm but on the procedure to implement it in which attorney general did not provide proper and accountable mechanism so that these three principles are not purely conducted.

Abstract

The main maxim of progressive law is law for human, not human for law. Since stressing to human existence to enforce the law, the progressive law rejects the status quo based on legal positivism, the existence of written legal text containing many weaknesses, and pays more attentions to the role of human behavior. In the context of constitutional court roles as the sole and the highest interpreter of the constitution, the interpretation of progressive law wants the institutional court not strictly rely on the written text, not to use legal positivism as a paradigm in interpreting the law, but focusing on rechtsidee, values, and way of life written on Pancasila to implement the substantive justice, not the existence of legal texts in constitution of  1945.

Abstract

Our previous study found that KLU 11.16, isolated from shrimp waste secreted chitinolytic enzymes. The crude enzyme was interesting since their chitooligosccharide was able to inhibit some pathogenic bacteria. In this study we report a purification and characterization of the chitosanase enzyme produced and the identification of the KLU 11.16. Purification of the enzyme was done two steps by ion exchange chromatography followed by gel filtration. Two out of 4 peaks from Gel Filtration step, i.e. fraction 16 and 33 were capable of hydrolyzing 100% deacetylated chitosan, indicating that both fractions contained chitosanase enzyme. The enzyme from fraction 16 had approximate molecular weight of 98.3 kDa. The enzyme worked optimally at temperature of 300C, and pH 6. Addition of Ca2+, Fe2+, K+, Na+ ions in the form of Cl2 salt and detergent Triton X-100 increased the enzyme activity, while Co2+, Mn2+ and Zn2+ ions in the same concentration decreased the enzyme acitivity. Addition of EDTA and SDS significantly decreased the enzyme activity. Molecular based identification revealed that KLU 11.16 was 99% similar to Aeromonas media.
