Abstract

The main problem facing the majority of respondents is the lack of capital andmarketing difficulties. Although many special credit schemes for small enterprises, themajority of respondents, especially those located in rural areas, never get credit frombanks or other institutions. Implementation of extension activities to capital for micro-enterprises because lack of knowledge about the capital so that the business communitycan not thrive. Capital program for micro businesses helpful to develop a businessSungapan II Dusun community and foster new innovations in business. The stages of theactivities carried out during ongoing counseling is the identification, dissemination capital,capital counseling, debriefing. The result of this program is that people know what theexisting capital base and to understand where and how to obtain them.

Abstract

Farmers in dusun Dungtileng, Somongari village, district of Kaligesing, Purworejoregency, Central Java Provisions, had used organic’s fertilizer. But, they still used thebasic material, so the quality is still low. This program was conducted to provideadditional insights and teach the farmers of this village cultivate organic fertilizerscomposed of animal waste, dry leaves, green leaves, fruits decanter of waste, and soil. Byimproved the quality of organic’s fertilizer, farmers would get many benefits.

Occupational Safety and Health of Operator of Sugar Makers in dusun Dungtileng have been overlookedyet. If it continues to be ignored, it can raise the risk of working.Therefore, it is necessary to counseling Health and Safety in the form of counselingworking environment (5S) and fix Occupational Posture (Musculoskeletal). With hopes,It can improve the quality of Occupational Safety and Health. Besides, it also couldincrease profit.

Abstract

Basically, economic analysis towards criminal law relates to two points namely, rationality and efficiency. Rationality denotes that a person, in committing a crime always takes the cost and benefit into account. While efficiency means that a crime offender tends to use certain way which is less costly in committing the crime. An optimum criminal law enforcement, therefore,   may be achieved  through a certain method which takes the following three aspects into account; the benefit which is gained by the criminal offender, the lost which is caused by such crime, and also, the expenditure caused by  legal enforcement activities

Abstract

There will be some implications  if progressive law idea is applied on the criminal law judiciary  system to enforce the law. The implications are firstly, the police will not use the written law as primary instrument in combating crimes, but they are going to place forward the conscience, secondly, unloading coherent characteristic at public attorney, that is bureaucratic sentralistic, and go into effect the comando system embracing responsibility hierachie, and thirdly, the court ( judge ) should not  handle the case only based on written law but also placed forward on conscience, because the law is created for the citizen and not inversed. The task of the judges  are  not only as technical Acts but they are also as a social creature.

Abstract

This research focuses on the accomodation of cultural values of Maduranes society in solving carok problem in criminal law. Using the socio-legal research, interview, observation as the primery data, and data analysis are based on the inductive and qualitative manner, this research reveals that changing the criminal law conception as the public law into public law with the private dimension particularly in murder cases caused by self esteem defence is a must to give a chance for cultural values of Maduranes society in solving carok problem. So that, penal mediation based on the cultural values of Maduranes society as a methode to solve carok can be accomodated in criminal law by adopting some principles of traditional village or tribal moots model, victim-offender mediation model, and community panels or courts model.Key words : carok, cultural values, and penal mediation

Abstract

This research focuses on corporate criminal liability for gross violation of human rights. Based on normative legal research, this research reveals; first, extending criminal responsibility beyond individual to corporation for gross violation of human rights is required because national states are sometimes unwilling or powerless to properly sanction corporations for fear of negative economic consequences. Corporation also results serious or systematic human rights violations and encourages criminal conduct by maintaining a corporate culture that condones or even rewards violations of the law; second, Canada and Australia have opened a prosecutorial window by suing Unocal and Anvil Mining Limited as the perpetrator of crime against humanity; last, In Indonesia prosecuting corporation for human right violations will resulted into reformulation of criminal conduct of abetting, limitation of corporate responsibility and punishment and treatment.Key words : Corporation, criminal responsibility, gross violation of human rights

Abstract

There are two main things discussed in this research; first, the source of the state financial loss and the calculation method in the court decision of corruption case, and second,the correlation between the calculation method of the state financial loss in the legal perspective of the judges and the decision on the amount of indemnification. This research is a normative legal study. The result of the research shows that first, the source of the state financial loss varies from the asset release, fictitious activities, unsettled payables of tax payers, andout-of-budget expenses, with the calculation method used involving rounded down total loss, main loss, main loss plus interest, and the margin between the amount of the budget subtracted by the realization of the used amount. Second, in deciding the amount of the indemnification, not all of the judges referred to the calculation method of the state financial loss.

Abstract

The main problems in this research: first, how are the theses constructed by the schools in legal philosophy? Second, what are the methodological consequences that emerge dut the different theses of each school in legal philosophy? This research was a normative legal research. The result of the research concluded, first, every law school that exists in legal philosophy has different thesis from one to the other. The thesis of natural law school is the thesis of morality and normativity. Legal realism separates law and moral, and puts more importance on social facts. The thesis of Kelsen's pure theory of law is a synthesis of the thesis of natural law and empirical positivism/legal realism. The thesis of American Sociological Jurisprudence is a synthesis of the legal positivism and the school of history; it separates law and morals as well as the unity between law and fact. Meanwhile, the thesis of utilitarianism is the separation between law and moral as well as the unity between law and fact. Second, the thesis differences in the schools of legal philosophy have consequences on the methodology that is used.

Abstract

This research focused on the idea of proportionality in criminal law and its implementation in the policy of criminal sanctions formulation in legislation. As a normative legal research, this study used a philosophical, conceptual, and statute approach. This study revealed that crime and punishment are an important element of proportionality of criminal law. The higher the crime, the more severe the punishment received by the perpetrators of the crime. In a sanction that integrates both elements, the severity of criminal penalties is based on the proportionality between the seriousness of the crime and the perpetrator's fault with the severity of the potential liability for criminal penalty. The idea of proportionality requires three things: parity, the rank of the seriousness of the crime, and the criminal gap among very serious, heavy, and mild crimes. The policy of criminal sanctions formulation in economic laws has not reflected the idea of proportionality of criminal law. The potential liability for formal crime is more severe than that of material crime. Among similar crimes of bribery, money laundering, and obstruction of justice, the potential liabilities for the penalty are also not proportional. The potential liability for the violations of permits in Banking Law is even more severe than that of corruption. Since the proportionality of criminal law is based on the creation of justice, legislators should rank the seriousness of crimes by using the values in a society as a scale.
