Abstract

This research focuses on the effectiveness of utilizing productive zakat at the National Zakat Amil Agency (BAZNAS) in Bone Regency. What the author explores is the form and influence of the use of productive zakat on mustahik. This research is a field research, with the sources of this research being observation, interviews and documentation. The results of this research show that through the productive use of zakat, the funds given to mustahik are used as business capital. There are several forms of utilizing productive zakat, namely traditional productive zakat and creative productive zakat. The influence obtained by mustahik who are channeled with business capital assistance is quite influential in developing mustahik businesses, although productive zakat funds can only help in the business sector, they can influence all aspects of social life, or the welfare of mustahik lives. Regarding effectiveness, the utilization of productive zakat is quite effective in helping develop mustahik businesses to alleviate poverty, however the implementation of monitoring is less than optimal due to a lack of monitoring staff. There is a need to increase socialization of zakat utilization programs, so that the programs at the National Zakat Amil Agency in Bone district are widely known to the public.K eywords: Productive Zakat, BAZNAS, Empowerment, effectiveness.

Abstract

The birth of hadith is directly related to the personality of the Prophet Muhammad SAW, as the source of hadith, where he had indeed guided his people for approximately 23 years, and that period was the period of revelation (the Qur'an), along with that the hadith also came out. The birth of hadith during the time of the Prophet was an interaction of the Prophet as Mubayyin (giver of an explanation) regarding the verses of the Qur'an to his friends or to other people, in order to convey the message, and also because of various life problems that were being faced by the people and were in great need of solutions or solutions from the Prophet SAW, then his friends understood and memorized what they had received from the Prophet SAW. The results of this study show that First, the reasons for the prohibition of writing hadith were not due to the ignorance of Muslims in writing activities at that time, in fact they had known writing since the beginning of Islam, even before Islam. Second, the dominant factor in the prohibition of writing hadith was the fear of mixing the Qur'an and asSunnah. In addition, so that the project of writing the Qur'an is not disturbed by the writing of the hadith. Third, there is no contradiction between the hadiths about the prohibition and the permission of writing hadith, because the hadiths about the prohibition appeared first and when the reasons for the prohibition disappeared, the hadith about the permission of writing appeared. Fourth, the activity of writing hadith in the time of the Prophet Muhammad had existed as evidenced by the existence of hadith records in some of the companions known as 'as-Sahifah', but this activity was only individual and on a small scale, while the activity of writing and collecting hadith on a large scale began during the time of the caliph Umar bin Abdul Aziz.

Abstract

Abstrak Mediasi adalah proses penyelesaian sengketa dengan bantuan mediator netral yang tidak dapat memutuskan, hanya membantu pihak-pihak mencapai kesepakatan. Proses ini mengikuti Peraturan Mahkamah Agung No. 1 Tahun 2016. Penelitian ini mengkaji penerapan mediasi sengketa ekonomi syariah di Pengadilan Agama Kelas IA Makassar dengan pendekatan kualitatif. Hasil penelitian menunjukkan bahwa praktik penerapan mediasi sengketa ekonomi syariah di pengadilan agama kelas IA Makassar telah sesuai dengan peraturan Mahkama Agung RI No 1 Tahun 2016 Akan tetapi, mediasi dalam sengketa ini sering kali terbukti tidak berhasil karena banyaknya kreditor yang wanprestasi dalam memenuhi kewajibannya kepada debitur yang mengingkari dari kesepakatan awal. Situasi ini membuat debitur merasa dirugikan dan tidak dapat mencapai perdamaian, maka dari itu tingkat keberhasilan di pengadilan agama makassar sangatlah lemah dan para hakim harus tegas sesuai dengan peraturan yang berlaku. Berdasarkan ketentuan hukum ekonomi syariah Ketentuan Hukum Ekonomi Syariah Terhadap Penerapan Mediasi Sengketa Ekonomi Syariah sudah sesuai dengan peraturan Mahkamah Agung Republik Indonesia Nomor 1 Tahun 2008  yang telah di ubah dengan peraturan Mahkamah Agung RI  No 1 Tahun 2016 tentang prosedur Mediasi di Pengdilan. Implikasi penelitian ini  para hakim harus lebih tegas dalam menghadapi perkara sengketa ekonomi syariah agar terjadi perdamaian  dalam penyelesaian mediasi sesuai dengan prosedur mediasi Nomor 1 Tahun 2016. Kata Kunci: Hukum Ekonomi Syariah, Mediasi, Sengketa   Abstrac Mediation is a dispute resolution process with the help of a neutral mediator who cannot decide, only helps the parties reach an agreement. This process follows Supreme Court Regulation No. 1 of 2016. This study examines the application of sharia economic dispute mediation in the Makassar Class IA Religious Court with a qualitative approach. The results of the study indicate that the practice of implementing sharia economic dispute mediation in the Makassar Class IA Religious Court is in accordance with the Supreme Court Regulation of the Republic of Indonesia No. 1 of 2016. However, mediation in this dispute often proves unsuccessful because many creditors default in fulfilling their obligations to debtors who deny the initial agreement. This situation makes debtors feel disadvantaged and unable to achieve peace, therefore the success rate in the Makassar Religious Court is very weak and judges must be firm in accordance with applicable regulations. Based on the provisions of Islamic economic law, the provisions of Islamic Economic Law on the Implementation of Islamic Economic Dispute Mediation are in accordance with the regulation of the Supreme Court of the Republic of Indonesia Number 1 of 2008 which has been amended by the regulation of the Supreme Court of the Republic of Indonesia Number 1 of 2016 concerning Mediation procedures in Court. The implication of this study is that judges must be more assertive in dealing with Islamic economic dispute cases so that peace can be achieved in mediation settlement in accordance with the mediation procedure Number 1 of 2016. Abstract

Bullying in education is a despicable act and is prohibited by Islam because it can hurt the victim physically and mentally. The meaning of Bullying is an act of threatening, scaring bodily or spiritually against someone due to one’s superiority attitude, so that they feel entitled or powerful to intimidate others. This study examines Bullying from the perspective of the Prophetic Hadith on the phenomenon of Bullying. This study seeks to find the significance of the phenomenon of Bullying with the hadith and the relevance of exploring the preventive measures offered by the hadith of the Prophet. The method used is descriptive-analytical. The results of this research are: 1) The Hadith narrated by Ibn Majah generally explains how the Prophet’s Hadith views Bullying as leading to degrading behavior. The word ihtiqar has a meaning correlation to the orientation of Bullying behavior, namely degrading, Hadith narrated by Sahih Muslim is also about degrading other people’s behavior, and Hadith Bukhari about one’s life and honor must be protected, respected and guarded; 2) the normative relevance of the phenomenon of Bullying is the prohibition of mutual envy, hatred, oppression, neglect and contempt for other Muslims, the prohibition of degrading others which can be the root of the division of Muslims, and no one has the right to kill, insult, damage and injure others without reasons justified by Islamic law.

Abstract

Abstrak Pokok masalah pe.ne.litian ini adalah bagaimana pandangan hukum Islam te.rhadap distribusi zakat fitrah pada dukun anak di De.sa Gattare.ng Ke.camatan Marioriwawo Kabupate.n Soppe.ng? Pokok masalah te.rse.but diuraikan ke.dalam sub masalah yaitu: 1) Bagaimana praktik pendistribusian zakat fitrah pada dukun anak di Desa Gattareng Kecamatan Marioriwawo Kabupaten Soppeng?  2) Faktor apa  yang me.nye.babkan masyarakat De.sa Gattare.ng me.ndistribusikan zakat fitrah pada dukun anak? 3) Bagaimana tinjauan hukum Islam terhadap pendistribusian zakat fitrah pada dukun anak di Desa Gattareng Kecamatan Marioriwawo Kabupaten Soppeng? Je.nis pe.ne.litian ini te.rgolong kualitatif de.ngan pe.nde.katan pe.ne.litian yang digunakan adalah: pe.nde.katan empiris dan syariah. Adapun sumbe.r data pe.ne.litian ini adalah warga De.sa Gattare.ng dan dukun anak. Se.lanjutnya me.tode. pe.ngumpulan data yang digunakan adalah obse.rvasi, wawancara, dokume.ntasi. Hasil pe.ne.litian ini me.nujukkan bahwa Praktik pendistribusian zakat fitrah anak usia 0-3 tahun diberikan kepada dukun anak dalam bentuk beras atau uang. Adapun uang yang diberikan rata-rata 45.000 setara dengan 3 Kg beras. Hal ini dilatar belakangi tradisi yang turun-temurun, kepercayaan masyarakat terhadap keahlian dukun anak, hubungan social yang erat, dan kurangnya pemahaman tentang hukum Islam. Namun menurut hukum Islam, distribusi zakat fitrah kepada dukun anak tidak diperbolehkan karena tidak sesuai dengan Al-Quran surah At-Taubah ayat 60, yang mentapkan penerima zakat harus dari golongan tertentu, seperti fakir miskin. Dukun anak di Desa Gattareng masih mampu secara ekonomi, sehingga tidak memenuhi syarat. Kata Kunci: Dukun Anak, Hukum Islam, Zakat Fitrah.   Abstract The subject matter of this study is how does Islamic law view the distribution of zakat fitrah to child healers in De.sa Gattare.ng Ke.camatan Marioriwawo Kabupate.n Soppe.ng? The.main.problem.is.elaborated.into.sub-problems,.namely: 1) How is the practice of distributing zakat fitrah to child shamans in Gattareng Village, Marioriwawo Sub-district, Soppeng Regency?  2) What factors cause the people of Gattare.ng Village to distribute zakat fitrah to child shamans? 3) What is the Islamic legal review of the distribution of zakat fitrah to child shamans in Gattareng Village, Marioriwawo Sub-district, Soppeng Regency? This research is qualitative and the research approach used is: empirical and sharia approach. The sources of data for this study are the residents of De.sa Gattare.ng and the traditional healers. The data collection methods used were observation, interview, and documentation. The results of this study show that the practice of distributing zakat fitrah for children aged 0-3 years is given to the child shaman in the form of rice or money. The average amount of money given is 45,000, equivalent to 3kg of rice. This is motivated by a tradition that has been passed down from generation to generation, public trust in the expertise of child shamans, close social relations, and a lack of understanding of Islamic law. However, according to Islamic law, the distribution of zakat fitrah to child shamans is not allowed because it is not in accordance with the Al-Quran surah At-Taubah verse 60, which stipulates that zakat recipients must be from certain groups, such as the poor. Child shamans in Gattareng Village are still economically capable, so they do not meet the requirements. Keywords: Child Shaman, Islamic Law,  Zakat Fitrah.

Abstract

Abstrak Beras bantuan pangan (bapang) adalah bantuan berupa beras dari pemerintah yang akan disalurkan ke masyarakat secara ketentuan mekanisme aturan yang sudah ditetapkan sebelumnya, salah satunya untuk disalurkan kepada pihak keluarga miskin. Program beras bantuan pangan (bapang) harus dilakukan sesuai aturan yang telah ditetapkan, berdasarkan pada Buku Pedoman Umum. Penelitian ini mengkaji tentang bagaimanana peran dan tanggung jawab perangkat desa dalam pendistribusian beras bantuan pangan (bapang) di Desa Palangiseng Kecamatan Lilirilau Kabupaten Soppeng dan untuk mengetahui bagaimana pandangan Hukum Islam terhadap pengelolaan beras bantuan pangan (bapang) di Desa Palangiseng Kecamatan Lilirilau Kabupaten Soppeng, dengan menggunakan metode pendekatan kualitatif. Sumber data yang dikumpulkan menggunakan metode wawancara, dokumentasi dan observasi, sumber data tersebut menunjukkan hasil dari penelitian ini bahwa 1). Pendistribusian program beras bantuan pangan (bapang) di Desa Palangiseng Kecamatan Lilirilau Kabupaten Soppeng belum sepenuhnya sesuai dengan aturan-aturan yang telah tercantum dalam buku pedoman umum (pedum) beras bantuan pangan (bapang), karena masih banyak prosedur yang semestinya dilakukan sesuai dengan aturan pemerintah akan tetapi aparat Desa Palangiseng tidak lakukan. 2). Dalam pendistribusian beras bantuan pangan (bapang) di Desa Palangiseng Kecamatan Lilirilau Kabupaten Soppeng telah memenuhi syarat-syarat akad beserta rukun akad. Akan tetapi dari sisi keadilan pendistribusian beras bantuan pangan (bapang) di Desa palangiseng masih kurang karena masih banyak masyarat yang tergolong berpendapatan rendah akan tetapi tidak menerima haknya seperti halnya bantuan program beras bantuan pangan (bapang). Kata Kunci: Hukum Islam, Pendistribusian, Bapang. Abstract Food aid rice (bapang) is assistance in the form of rice from the government that will be distributed to the community according to the provisions of the previously established rules and mechanisms, one of which is to be distributed to poor families. The food aid rice (bapang) program must be carried out according to the rules that have been set, based on the General Guidelines Book. This study examines the roles and responsibilities of village officials in the distribution of food aid rice (bapang) in Palangiseng Village Lilirilau District Soppeng Regency and to find out how Islamic Law views the management of food aid rice (bapang) in Palangiseng Village Lilirilau District Soppeng Regency using a qualitative approach method. The data sources collected using interview, documentation and observation methods, these data sources show the results of this study that 1). The distribution of the food aid rice (bapang) program in Palangiseng Village Lilirilau District Soppeng Regency has not fully complied with the rules that have been stated in the general guidelines book (pedum) for food aid rice (bapang), because there are still many procedures that should be carried out in accordance with government regulations but the Palangiseng Village apparatus did not do it. 2). In the distribution of food aid rice (bapang) in Palangiseng Village Lilirilau District Soppeng Regency, the terms and conditions of the contract along with the pillars of the contract have been met. However, in terms of justice, the distribution of food aid rice (bapang) in Palangiseng Village is still lacking because there are still many people who are classified as low-income but do not receive their rights, such as the food aid rice (bapang) program. Abstract

Abstrak Penelitian ini dilakukan untuk mengetahui bagaimana Tinjauan Hukum Islam Terhadap Akad Istishna’ Pada Pembuatan Perahu di Pulau Pamantauang Desa Pammas Kecamatan Liukang Kalmas Kabupaten Pangkep. Jenis penelitian ini menggunakan penelitian lapangan dengan deskriptif kualitatif dengan pendekatan penelitian yang digunakan adalah pendekatan yuridis dan pendekatan syariah. Adapun sumber data primer dari penelitian ini adalah pihak pembuat perahu dan pembeli perahu, dan sumber data sekunder bersumber dari al-Qur’an, buku, jurnal, dan sumber lainnya. Adapun metode pengumpulan data yang digunakan adalah observasi, wawancara dan dokumentasi langsung dengan pihak pembeli dan pembuat perahu di Pulau Pamantauang. Penelitian ini menunjukkan bahwa: 1) pelaksanaan jual beli perahu di Pulau Pamantauang Desa Pammas Kecamatan Liukang Kalmas Kabupaten Pangkep dilakukan dengan sistem pesanan yaitu pembeli (mustashni’) meminta dibuatkan langsung kepada penjual (shani’) dengan spesifikasi dan syarat tertentu antara kedua belah pihak. Dalam jual beli perahu yang dilakukan di Pulau Pamantauang tersebut termasuk dalam bentuk jual beli Istishna’. 2) Dalam Praktik jual beli perahu yang dilakukan telah memenuhi rukun dan syarat istishna’ yang dimana pembuat dan pembeli perahu dilakukan dengan saling ridha dan sukarela tanpa adanya paksaan, hal tersebut dilandasi pada prinsip yang lebih mengedapankan pada kepercayaan, kerelaan, dan kebersamaan oleh masyarakat sehingga jual beli yang dilakukan dapat dinyatakan sah dan diperbolehkan dalam hukum Islam. Kata Kunci: Hukum Islam, Akad Istishna’, Pembautan Perahu   Abstract This research was conducted to find out how the Review of Islamic Law on the Istishna' Contract on Boat Making on Pamantauang Island, Pammas Village, Liukang Kalmas District, Pangkep Regency. This type of research uses qualitative descriptive field research with the research approaches used are juridical approaches and sharia approaches. The primary data sources of this study are boat builders and boat buyers, and secondary data sources are sourced from the Qur'an, books, journals, and other sources. The data collection methods used are observation, interviews and direct documentation with buyers and boat builders on Pamantauang Island. This study shows that: 1) the implementation of buying and selling boats on Pamantauang Island, Pammas Village, Liukang Kalmas District, Pangkep Regency is carried out with an order system, namely the buyer (mustashni') asks to be made directly to the seller (shani') with certain specifications and conditions between the two parties. In the boat buying and selling carried out on Pamantauang Island, it is included in the form of buying and selling Istishna'. 2) In the practice of buying and selling boats that are carried out has fulfilled the harmony and conditions of istishna' where the boat maker and buyer are carried out with mutual pleasure and voluntarily without any coercion, it is based on a principle that is more based on trust, willingness, and togetherness by the community so that the buying and selling carried out can be declared valid and allowed in Islamic law. Abstract

Character education has become an important issue in the global education system, especially in the modern era characterized by rapid social, technological, and cultural changes. This study aims to explore the integration of moral values derived from the hadith of Prophet Muhammad in strengthening character education in the contemporary education system. A qualitative research method was used with a literature study approach and content analysis of hadiths related to character education, such as honesty, justice, empathy, responsibility, and humility. The results showed that hadith as the second source of Islamic teachings after the Qur'an, contains universal values that are relevant to forming noble individual characters. These values include honesty, compassion, justice, patience, and care for the environment, all of which can be integrated in the modern education curriculum. This research confirms that hadith-based character education is able to answer the challenges of moral degradation in the era of globalization, while offering practical solutions in building a young generation with integrity, social responsibility, and noble character. The implications of this research include the development of a hadith-based character education model, increasing the capacity of educators in teaching moral values, and collaboration between schools, families, and communities in strengthening character education. The integration of values from the hadith into the contemporary education system is a strategic step in creating a harmonious, just and civilized society.

Abstract

This study examines gender education in the perspective of hadith as an effort to develop equality in formal education. The study aims to analyze the understanding of the concept of gender in hadith and its implications for formal education in Indonesia. Using a qualitative method with a content analysis approach, the study explores hadith-reports on gender, including the creation of women, conjugal responsibilities, women’s leadership, and partnership between men and women. The results show that the traditions provide an understanding that men and women are equal, albeit with different roles and responsibilities. The main obstacles in gender-related formal education are gender bias in learning materials and stereotyping of gender roles in the school environment. Islamic education plays an important role in removing these biases through contextualized and fair interpretation of hadith. In conclusion, the integration of moral values and gender education in the formal education system can create a more just and harmonious society. The implication is that collaboration between educators, policymakers and communities is needed to ensure gender equality in formal education.

Abstract

Abstrak Pokok masalah pada penelitian ini adalah “Bagaimana tinjauan hukum Islam terhadap dalam transaksi pinjam meminjam pada warga di Kelurahan Anrong Appaka Kecamatan Pangkajene Kabupaten Pangkep, kemudian dijabarkan menjadi beberapa rumusan masalah yang pertama. Bagaimana mekanisme praktik tranksaksi pinjam meminjam pada warga di Kelurahan  Anrong Appaka Kecamatan Pangkajene Kabupaten Pangkep? Kemudian yang kedua Bagaimana ketentuan hukum islam terhadap tranksaksi pinjam meminjam pada warga di Kelurahan Anrong Appaka Kecamatan Pangkajene Kabupaten Pangkep Jenis penelitian yang digunakan dalam skripsi ini adalah   penelitian kualiatif deskritif dengan pendekatan normatif-teologis. Penelitian ini bertujuan untuk menggambarkan secara mendalam realitas praktik pinjam meminjam dengan rentenir yang terjadi di masyarakat kelurahan anrong appaka serta menganalisinya berdasarkan hukum Islam. Hasil penelitian menunjukkan bahwa praktik pinjam meminjam yang terjadi mengandung unsur riba dan dilakukan dengan sistem bunga tetap mingguan atau bulanan, serta potongan awal dari pokok pinjaman. Walaupun dilakukan atas dasar kesepakatan, transaksi ini bertentangan dengan prinsip hukum Islam yang melarang pengambilan keuntungan atas dasar pinjaman uang (qardh) yang bersifat konsumtif. Dalam hukum Islam, tambahan (bunga) atas pinjaman termasuk kategori riba yang diharamkan. Penelitian ini memberikan kontribusi dalam pengembangan kajian hukum Islam, menjadi referensi bagi peneliti lain dalam mengkaji persoalan serupa di wilayah yang berbeda. Penelitian ini menyoroti rendahnya pemahaman masyarakat terhadap hukum Islam dalam transaksi keuangan. Hal ini menjadi dasar bagi lembaga keagamaan, penyuluh agama, dan tokoh masyarakat untuk meningkatkan edukasi dan dakwah di bidang muamalah syariah, khususnya mengenai bahaya riba dan pentingnya keadilan dalam transaksi. Temuan penelitian ini dapat dijadikan acuan oleh pemerintah daerah, lembaga keuangan syariah, dan organisasi masyarakat Islam untuk menghadirkan solusi alternatif terhadap praktik rentenir, seperti mendirikan koperasi syariah, BMT, atau program pinjaman bebas riba yang mudah diakses oleh masyarakat. Dengan demikian, kebutuhan ekonomi warga dapat terpenuhi tanpa melanggar prinsip-prinsip Islam. Kata Kunci: Riba, Hukum Islam, Pinjam Meminjam, Ekonomi Syariah.   Abstract The main problem in this study is "How is the review of Islamic law on loan and borrowing transactions to residents in Anrong Appaka Village, Pangkajene District, Pangkep Regency, then described into several first problem formulations. What is the mechanism for the practice of loan and loan transaction transactions to residents in Anrong Appaka Village, Pangkajene District, Pangkep Regency? Then the second is how are the provisions of Islamic law on the transfer of loans and loans to residents in Anrong Appaka Village, Pangkajene District, Pangkep Regency The type of research used in this thesis is a qualitative descriptive research with a normative-theological approach. This research aims to describe in depth the reality of the practice of borrowing and borrowing with loan sharks that occur in the community of Anrong Appaka Village and analyze it based on Islamic law. The results of the study show that the practice of borrowing and borrowing that occurs contains elements of usury and is carried out with a fixed weekly or monthly interest system, as well as an initial deduction from the principal of the loan. Even though it was carried out on the basis of agreement, this transaction is contrary to the principles of Islamic law which prohibits the taking of profits on the basis of money loans (qardh) that are consumptive in nature. In Islamic law, additional (interest) on loans is included in the category of riba which is prohibited. This research contributes to the development of the study of Islamic law, becoming a reference for other researchers in studying similar issues in different regions. This research highlights the low public understanding of Islamic law in financial transactions. This is the basis for religious institutions, religious extension workers, and community leaders to improve education and da'wah in the field of sharia muama, especially regarding the dangers of usury and the importance of justice in transactions. The findings of this research can be used as a reference by local governments, Islamic financial institutions, and Islamic community organizations to present alternative solutions to loan shark practices, such as establishing sharia cooperatives, BMT, or usury-free loan programs that are easily accessible to the public. Thus, the economic needs of citizens can be met without violating Islamic principles. Keywords: Riba, Islamic Law, Borrowing and Borrowing, Sharia Economics.
