Abstract

Kesehatan bank termasuk Bank Perkreditan Rakyat tidak bisa dilepaskan dari peran Komisaris dalam tata kelola institusi perbankan. Tulisan ini bertujuan untuk mengelaborasi fungsi kontrol dan tanggung jawab Komisaris dalam pengelolaan Bank Perkreditan Rakyat yang sehat dalam kaitannya dengan prinsip GCG serta Asas Itikad Baik. Metode yang digunakan untuk menganalisis relevansi antara asas itikad baik dengan GCG bagi kesehatan bank adalah metode normatif. Jenis pendekatan perundang-undangan serta  pendekatan konsep, diantaranya konsep CSR dipergunakan dalam studi ini. Hasil studi menunjukkan bahwa Komisaris  sebagai wakil pemegang saham berperan penting dalam rangka GCG dan asas itikad baik yaitu bertanggungjawab melakukan pengawasan secara independen  dan  fungsi kontrol  terhadap Dewan Direksi yang menjalankan pengelolaan dalam rangka mewujudkan dan secara berkesinambungan meningkatkan kesehatan bank.Kata kunci: GCG; Asas Itikad Baik; Komisaris; Kesehatan Bank.

Abstract

AbstractThe Good faith principle as stated in Article 1338 paragraph (3) of the Civil Code, has not been maximally implemented in BPR credit agreements, so it is important to review the transformation of good faith principle of the Civil Code in banking provisions, especially BPR in realizing sound credit. The research uses normative juridical legal methods. The results of the study show that the transformation of the principle of good faith stated in the Civil Code has not been explicitly stated in the provisions of banking law in Indonesia. The existence of principle of good faith explicitly only exists in Article 1338 Paragraph (3) of the Civil Code. Meanwhile, in the provisions of the Banking Law the existence of the principle of good faith is only implied by the principle of economic democracy by using the precautionary principle that is applied carefully and in good faith, as well as the principles of trust and confidence in good ability, ability, intention and morals from customers or the community in returning credit. The transformation of the principle of good faith should be clearly stated in the norm structure into the Banking Law and other related banking legal provisions.AbstrakGood faith principle sebagaimana tercantum pada Pasal 1338 ayat (3) KUHPerdata, belum diimplementasikan secara maksimal dalam perjanjian kredit BPR, sehingga penting mengkaji  transformasi asas itikad baik KUH Perdata dalam ketentuan perbankan khususnya BPR  dalam  mewujudkan perkreditan yang sehat. Metode penelitian menggunakan metode penelitian hukum yuridis normatif. Hasil penelitian menunjukkan bahwa Transformasi asas itikad baik yang tercantum dalam KUHPerdata belum secara eksplisit ternormakan dalam ketentuan hukum perbankan di Indonesia. Keberadaan asas Itikad baik secara eksplisit hanya eksis dalam Pasal 1338 Ayat (3) KUHPerdata. Sementara itu, dalam ketentuan Undang-Undang Perbankan keberadaan asas itikad baik  hanya  tersirat dari asas demokrasi ekonomi  dengan menggunakan prinsip kehati-hatian yang diterapkan secara hati-hati dan itikad baik,  serta prinsip kepercayaan dan keyakinan akan kemampuan, kesanggupan, itikad serta akhlak yang baik dari nasabah atau masyarakat dalam mengembalikan kredit. Transformasi asas itikad baik sebaiknya dituangkan dalam struktur norma secara tegas ke dalam Undang-Undang Perbankan dan ketentuan hukum perbankan terkait lainnya.

Abstract

ABSTRAK Tujuan dari penelitian ini yaitu mengkaji mengenai perlindungan hak cipta atas lagu berkaitan dengan sistem platform ilegal yang memberikan akses pengunduhan lagu secara bebas, serta upaya hukum yang dilakukan terhadap pengunduhan ilegal oleh Pencipta maupun Pemegang Hak Cipta. Penelitian ini menggunakan metode penulisan hukum normatf dengan pendekatan undang-undang. Hasil studi menunjukkan bahwa mengunduh lagu secara bebas melalui sistem platform digital yang tidak memiliki izin, baik dari pihak Pencipta maupun Pemegang Hak Cipta merupakan tindak pelanggaran hak cipta dimana hak ekonomi terhadap karya cipta disini dinikmati oleh pihak-pihak yang tidak bertanggung jawab, yang tidak memiliki andil terhadap karya cipta. Pencipta dapat melakukan langkah pencegahan terhadap tindak pelanggaran hak cipta dengan mengadakan sosialisasi kepada masyarakat terkait perlindungan hak cipta. Terkait upaya hukum terhadap tindak pelanggaran hak cipta dapat dilakukan dengan hukum pidana dengan mengacu pada ketentuan Pasal 120 dan ketentuan pidananya dalam Pasal 113 Ayat (4) Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta. Terhadap upaya hukum secara perdata dapat dilakukan dengan pengajuan gugatan ganti rugi melalui Pengadilan Niaga sesuai dengan Pasal 99 Undang-Undang Hak Cipta. Kata Kunci: Perlindungan Karya Lagu, Sistem Platform, Illegal Downloading, Hak Cipta. ABSTRACT The purpose of this study is to examine the copyright protection of songs related to illegal platform systems that provide access to download songs freely, as well as legal remedies taken against illegal downloads by creators and copyright holders. This study uses a normative legal method with a statue approarch. The results of the study show that downloading songs freely through a digital platform system that does not have permission, both from the Creator and the Copyright Holder is an act of copyright infringement where the economic rights of copyrighted works here are used by irresponsible parties, who do not own the copyright, or even contribute to the copyright. Creators can take steps to prevent copyright infringement by conducting outrich to the public regarding copyright protection. Regarding legal remedies against acts of copyright infringement, criminal law can be carried out by referring to the provisions of Article 120 and the criminal provisions in Article 113 Paragraph Number (4) of Law Number 28 of 2014 concerning Copyright. Against civil legal remedies, it can be carried out by filing a claim for compensation through the Commercial Court in accordance with Article 99 of the Copyright Law. Abstract

Abstract This article aims to analyze the categorization of the food plating art as art in the context of copyright protection and the protection of photography and video works upon the food presentation. This article uses normative research method with conceptual, statutory and comparative approaches. The results show that the food plating art cannot be categorized as a work of art that is protected under copyright because the elements of copyright protection that are interrelated to each other have not been fully fulfilled, such as the fixation requirement which is not successfully fulfilled. The food plating art is impermanent because it is easily destroyed and will not exist after being eaten (perishable in nature) because the art is meant to be eaten. Thus, the element of “should be embodied in real form” are very difficult to fulfill. The food plating art cannot yet be considered copyrighted art. However, derivatives of the food plating art in the form of photographic and cinematographic works on the food plating art can be copyrighted as works of Food Art Photography and Food Art Cinematography. Therefore, the creator has exclusive rights in the form of moral rights and economic rights, while the copyright holder can enjoy exclusive rights in the form of economic rights over the photographic and cinematographic works. Keywords: Food plating art, Copyright, Derivative Work, Technology Abstrak Tulisan ini bertujuan untuk menganalisis pengkategorian seni menghidangkan makanan sebagai seni dalam konteks perlindungan Hak Cipta serta perlindungannya terhadap karya fotografi dan video terhadap keberadaan hidangan makanan. Tulisan ini menggunakan metode penelitian normatif dengan pendekatan konseptual, perundang-undangan dan perbandingan. Hasil penelitian menunjukkan bahwa seni menghidangkan makanan tidak dapat dikategoritisasikan sebagai karya seni yang dilindungi Hak Cipta karena belum terpenuhinya secara utuh unsur-unsur perlindungan hak cipta yang saling berkaitan satu sama lain, seperti syarat fixation yang tidak terpenuhi. Karya seni menghidangkan makanan sifatnya memang tidak permanen karena mudah dihancurkan dan akan tidak eksis setelah dimakan, karena sifat seni penyajiannya memang untuk dimakan. Dengan demikian, unsur diwujudkan dalam bentuk nyata sangat sulit dipenuhi. Seni menghidangkan makanan belum dapat dianggap sebagai seni yang dilindungi hak cipta. Namun demikian, turunan dari seni menghidangkan makanan tersebut dalam wujud karya fotografi dan sinematografi atas seni menghidangkan makanan dapat dilindungi hak cipta sebagai karya Food Art Photography dan Food art cinematography, sehingga penciptanya memiliki hak ekslusif berupa hak moral dan hak ekonomi, sedangkan pemegang hak cipta dapat menikmati hak eksklusif berupa hak ekonomi atas karya fotografi dan sinematografi tersebut. Abstract

Traditional Cultural Expressions have basically been protected through national law, but in their regulation traditional food is not included as part of Traditional Cultural Expressions even though traditional food is one of Indonesia's traditional cultures that also characterizes the Indonesian Nation. For this reason, it is important to study the norms that occur in this study. The purpose of this study is to analyze the traditional food protection arrangements as traditional cultural expressions and the legal consequences that will occur if a traditional food is not listed as part of traditional cultural expressions. The method in this study uses a type of normative juridical legal research with a statute approach that focuses on the study of statutory regulations regarding legal issues in this study. The sources of legal materials in this study consist of primary, secondary, and tertiary legal materials. The results of this study indicate that traditional food regulation has not been regulated as Traditional Cultural Expressions in the law in force in Indonesia precisely in Law No. 28 of 2014 concerning Copyright. The absence of arrangements related to traditional food as Traditional Cultural Expressions results in foreign parties or other countries easily recognizing the tradition, so it is necessary to regulate traditional food as Traditional Cultural Expressions.

Abstract

Regulations regarding the protection of communal intellectual property in Indonesia are currently scattered in various regulations that are not explicitly stated in the form of Laws, and do not regulate benefit-sharing comprehensively. The purpose of this research is to elaborate on a protection strengthening model of Communal Intellectual Property based on the transplantation of policy content related to works of tradition, culture, custom, traditional knowledge, genetic resources and potential geographical indications from various existing legal policies and other sources both locally, nationally and internationally into the legal form of a Law, as well as a benefit-sharing regulation mechanism related to the commercial use of Communal Intellectual Property. The research method used is normative legal research with statutory, comparative, conceptual and analytical approaches. The results of the research showed that the current policy regarding Communal Intellectual Property in Indonesia is still in the hierarchy of Regulations of the Minister of Law and Human Rights and Government Regulations, namely Permenkumham 13/2017 and PP 56 of 2022. Several articles in the provisions of statutory regulations on Intellectual Property in Indonesia have regulated Communal Intellectual Property, but its nature is still very general. For stronger protection and legal certainty it is very urgent to regulate the protection policy in the form of a Law through a transplantation model of the substance of existing legal products related to Communal Intellectual Property, as well as strengthening of policy content including benefit-sharing in relation to the commercial use of Communal Intellectual Property.

Abstract

Emergency situations in midwifery care during pregnancy, labor, and the postnatal period can arise unexpectedly. It is crucial for midwives to be knowledgeable about the legal frameworks governing the protection provided to them in the execution of their professional responsibilities. This scoping review aims to explore the legal protection provided to midwives in emergency situations through a search of relevant literature in bibliography databases and hand-searching, and employed the Participant, Concept, and Context (PCC) principle to formulate the eligibility criteria. Data extraction was conducted using the PRISMA flow diagram. The analysis was conducted using a meta-aggregation approach to map the legal framework for emergency midwifery care from available studies. The review found key themes that emerged from the review included legal protection and scope of practice, midwives' authority in emergency care, importance of competencies and certifications, challenges and power imbalances in midwifery practice, and midwives' dissatisfaction and professional deviation.  This scoping review underscores the importance of legal protection and scope of practice for midwives

Abstract

Household food security is an essential issue for a country and has become a national issue in poor and developing countries worldwide during the COVID-19 pandemic. Various problems could arise if household food-nutrition needs are not met. This study aims to explore factors related to household food security during the COVID-19 pandemic in Indonesia. A systematic literature review that was used twelve articles. Three electronic databases (Google Scholar, ProQuest, and ScienceDirect) were used to find the articles between January 2020 to April 2023. The original articles were selected based on the PRISMA-P flowchart model. The results show the socio-demographic (sex of household’s head, age, education, literacy) and socio-economic (occupation, income, wealth, area of living) factors influencing household food security. Households having a male head of household, good literacy, and an adequate economy have a significant effect on having nutritious food security during COVID-19 pandemic. These findings recommend that the central government of Indonesia provide financial assistance to food-insecure households, improve access to food, and promote healthy food products

Abstract

The problem of outsourcing workers extends to the tourism industry. The unique challenge of 'seasonality' makes it more difficult to protect the outsourcing workers' legal rights in the said sector. The research examines the outsourcing regulation in Indonesia by referring to the Job Creation Law, by questioning whether the existing regulations provide prominent legal protection for outsourcing workers, especially in tourism sectors, and how the future law allows for improved protection. The research method used is normative legal research with statutory and legal conceptual approaches. The results of the study show that the amendment of the Manpower Law incorporated into the Job Creation Law and its implementing legal instruments significantly changed outsourcing regulation. As the Job Creation Law has abolished Article 64 of the Manpower Law, the scheme established by the Constitutional Court to prevent companies from exploiting workers in their decisions has become vague in the Job Creation Law. Following global practices, the country can implement a flexible workers policy while simultaneously protecting their rights which Indonesia must adopt.Keywords: Outsourcing, Rights Protection, Tourism Business.

Abstract

Legal certainty for Communal Intellectual Property protection on the inventory and record-keeping arrangements in terms of ownership proof in Indonesia, has increasingly been regulated in various regulations. However, threats are also growing. Traditional Cultural expression works are easily turned into personal video works. Along with that, such works are also vulnerable as those are easily threatened by Artificial intelligence’s ability to express works made from previous works of art such as paintings. This article aims to analyze Traditional Cultural Expressions protection which are transformed or adapted into personal works or works made by Artificial Intelligence and the measures to overcome these threats. The results show that referring to Government Regulation 56/2022, the commercial use of Traditional Cultural Expressions works both in the form of adaptation and transformation by individual humans and Artificial Intelligence is required to obtain a permit and pay attention to the distribution of benefits which will further be determined by the Minister. However, regulations on this mechanism has not been explicitly regulated. Measures to overcome threats can be made through measures to turn threats into opportunities and strengths. It is also relevant to prioritize countervailing measures, namely by following the pattern of threats as a balancing act.
