Abstract

Effectiveness of Industrial Design registration provision based on Act No. 31, 2000 concerning IndustrialDesign in Bali has not been fully enforced. It was caused by some factors such as: lack of understanding ofIndustrial Design in societies and some of them do not know the existence of this regulation which regulate thefirst file system, some societies who has not developed the need to have laws on Industrial Design as well as thepresence of communal cultures of the Indonesian people, which is completely different from the basic concept ofindividual right protection of IPR, which based on legal cultures of west countries have contributed to thedifficulties in fully implementing IPR. The other factors caused by lack of awareness Industrial Design protectionboth the substance and the existence of this provision among law enforcers and the inadequate infrastructurerequired to administer IPR.. The concept protection of Industrial Design protect designer / owner or recipient ofthe right who register their right based on first to file system. Through this system the designer would have anexclusive rights in the form of economic and moral right. The legal consequence of the inefficiency in enforcingarticle 10 jo article 12 of the Act No. 31 of 2000 concerning Industrial Design , which regulate first to file, mightresult in the failure of the designer to secure their right over their designs, whereas the legal protection shall be goto the person who registers and have evident in form of certificate registration.

Abstract

Lagu-lagu yang digunakan secara komersial di restoran atau kafe tanpa izin dari pencipta dikategorikan sebagai melanggar hak cipta sesuai dengan Pasal 1, 4 sampai 9 Undang-Undang Nomor 28 tahun 2014 tentang Hak Cipta (UU Hak Cipta Indonesia). Namun, penggunaan lagu secara komersial tidak dianggap sebagai pelanggaran Hak Cipta asalkan pengguna memenuhi kewajiban mereka berdasarkan perjanjian dengan Lembaga Manajemen Kolektif (LMK) untuk membayar lagu royalti berdasarkan Pasal 87 (4) UU Hak Cipta Indonesia. Namun demikian, keberadaan lembaga ini tidak diketahui secara luas oleh pengusaha masyarakat (restoran dan kafe pemilik) di kawasan wisata Jimbaran-Kedonganan Bali. Tujuan dari sosialisasi ini adalah untuk memberikan pemahaman tentang perlindungan hak cipta lagu, pentingnya kewajiban membayar royalti oleh pengguna melalui LMK dan untuk mencegah dan meminimalkan kasus pelanggaran Hak Cipta. Metode yang digunakan dalam diseminasi ini dengan pemberian kuliah singkat dan diskusi mendalam untuk meningkatkan keasadaran mereka terkait hak cipta lagu dan melakukan distribusi UU Hak Cipta Indonesia. Diseminasi berhasil diselenggarakan di Kedonganan pada 21 21 Juni 2016 dan di Jimbaran pada 4 Agustus 2016, para peserta sangat antusias karena materi yang disampaikan hal yang baru dan berguna untuk kegiatan bisnis sehari-hari mereka.

Abstract

The Good Corporate Governance (GCG) regulated under the Regulation of Bank Indonesia No. 8/14/PBI/2006 concerning with the implementation of GCG for Bnks. Although this regulation has already excisted since 2006,many banks do not fully understand how to implement the GCG practically. There are some principles of GCG that need to be considered, namely: Transparency, Accountability, Responsibility, Independency, and Fairness.Besides the GCG, Bank also should implement the principle of prudent banking. Both of those principles are very important for healthy and better future of the banking practice, therefore it needs to be continually socialized. The socialization concerning with GCG and the prudent banking principles as part of community service were conducted in PT. BPR. Abstract

ABSTRACT The team lecturers from Faculty of Law socialized Business law, Nationality law, Criminal law and Adat law at the Legal Clinic Radio Polda “SUARA JANGER” on July 2007. This community services used interactive method by using telephone, SMS and e-mail. The all session of interactive legal consultation were well done and got positive response from the communities as proven by the receipt of 4 to 5 calls within a one hour interactive duration conducted once a week. Through this services community and legal consultation several legal issues such as industrial design, children’s protection who were born from mix marriage, good governance, money laundering, terrorism, and polygamy were discussed and the further legal solutions were advised by the team advisors refer to the Act No. 31 year 2000, the Act No. 12 year 2006, and the Act No.15 year 2003.

Abstract

Originally the concept of CSR in developed countries is voluntary (voluntary based). Otherwise, in IndonesiaCSR is developed on the basis of legal obligation (mandatory based). Legal norms which expressly stipulatelegal obligation for the company to implement Corporate Social Responsibility (CSR) is the Law 40 /2007 onLimited Liability Companies, Government Decree No. 47/ 2012 and Act No. 25/2007 on Investment. Accordingto the Article 74 of Law No. 40/ 2007 as well as the Article 3 Government Decree No. 47/2012, each companyrunning its business activities in the field and / or related to the natural resources is required to carry out socialand environmental responsibility including companies engagement in the field of tourism in Sanur Bali. VariousCSR activities for the tourism companies in Sanur Bali, besides referring to the legislation are also expected torefer to the concept of Triple Bottom Line (Profit, People, Planet). These are designed to make balance betweenprofit related to People and the Planet for CSR perspective, as well as ISO 26000.

Abstract

ABSRACT Training of Constructing Scientific Report on Social Major (Law) has done on SMA Negeri 3 Denpasar, by the Guiding Team of the Lecturers of Law Faculty of Udayana University through a practice of constructing a report in a class through a workshop. Aproximately, 40% are for meanwhile, 60% are by practice of composing and providing some reference which is related to the constructing of a social-scientific report, and there all are done well so far. This fact was indicated by the responds which were given by the students of SMA Negeri 3 Denpasar, especially for those who join the KIR group.This activity has been done once a week.

Abstract

In Indonesia, the General meeting of Shareholder through teleconference mechanism can be conducted under the provision of Article 77 of Law No. 40 of 2007 concerning Limited Liability Company. This teleconferencing mechanism allows all participants to see and to hear each other as well as  to participate in the teleconference meeting. There is legal vacuum with regard to position of shareholders in the General Meeting by teleconference mechanism, especially in the case of network problems. However, by analogy with the legal construct of the provisions of Article 90 of the Company Law can be stated that the position of shareholders continues to be recognized as a legal subject who has legal right and has valid votes counted even if the minutes of the meeting have not been signed electronically because internet network problem as long as treatise or the minute of General Meeting of shareholders is made by notarial deed and shall be signed by the Notary who made the deed.

Abstract

The WTO – TRIPs Agreement regulates the principle of non- discrimination which must be complied by its member countries. There are two principle of non discriminationnamely the principle of National Treatment ( NT ) and Most Favoured Nations principle (MFN).  This study focus to the adoption of MFN and NT principles into IntellectualProperty Rights  laws of Indonesia whether it harmony with the legal system in Indonesia.   This study uses the normative legal research methods by using  conceptual approachand statute approach . The  legal materials that studies in this research  consists of thePrimary Legal Materials : Act No.  19 of  2002 , Act No. No. . 15 of 2001, Act No. 14 of2001,  as well as the TRIPs Agreement.  Secondary legal materials studied in this research are  legal text books and law journals related to NT and MFN principle in the field of IntellectualProperty Rights.                                  .The results showed that the Principle of Non Discrimination System in the form of theprinciple of National Treatment (NT) expressly governed through  Article 3 TRIPsAgreement and the principle of Most Favoured Nations (MFN) regulated  through  Article 4TRIPS Agreement.  As a member of WTO-TRIPs Agreement, Indonesia should comply andadopt the MFN and NT principles into IPR laws. Currently those principles exist implicitlyand explicitly such as in the Act No. 19 of 2002, the Act No. 14 of 2001, and the Act No. 15of 2001.  Although the MFN and NT principles has already adopted, it is still need moreeffort to implement the principle of non Discrimination, especially in the relationshipbetween Indonesia and other unequal size countries, between developing and developedcountries.

Abstract

As a member of the WTO-TRIMs Agreement basically Indonesia has stipulated the NationalTreatment Principle to the legal provisions relating to investment activities. However, theIndonesian investment Law (Law No. 25 of 2007) still remains that the regulation of NationalTreatment with regard to national interests. In order to the difficulties may exist in domesticlevel such as the social, economic as well as values may be different in some member countries,the WTO-TRIMs provide exceptions for the member with notify mandatory requirement tothe Board of TRIMs. Relating to investment activities other International standards alsorelevant to study is the GCG principles developed by the OECD. Although Indonesia is notOECD member countries, the GCG principles adopted in various Indonesian laws relatedto investment activities doe to it relevant and harmony to the economic, social as well ascommunity values in order to develop capital investment.

Abstract

Keanekaragam hayati laut dikembangkan sebagai salah satu produk dalam kegiatan kepariwisataan serta akses the right to tourism bagi wisatawan. Namun, pemenuhan hak tersebut jangan sampai  mengorbankan  sustainable tourism  bagi generasi mendatang, khususnya akses  lingkungan  sehat mata rantai ekosistem keanekaragaman hayati biota laut. Oleh karenanya, penting  mengkaji tanggungjawab perusahaan dalam usaha perlindungan dan konservasi. Metode penelitian hukum normatif digunakan untuk mengkaji Convention on Biological Diversity, UNWTO, UDHR, the GPs for Business and Human Rights, U.U. No. 5 Tahun 1990, U.U. No. 32 Tahun 2009, maupun U.U. No. 10 Tahun 2009. Perusahaan bersama dengan stakeholders lainnya bertanggungjawab mewujudkan perlindungan dan konservasi terhadap keanekaragaman biota laut.  Model Action Plans on Business and Human Rights relevan  untuk meningkatkan tanggung jawab perusahaan dalam perlindungan dan konservasi keanekaragaman hayati laut.
