Abstract

The type of this research is socio legal research which employed hermeneutic approach. The study showed that the legal protection of Computer Program which is regulated under Copyrights Act No. 19 Year 2002 is still weak in Indonesia. Based on BSA and USSTR report 2009, Indonesia was considered still in level of Priority Watch List. Some factors caused high level infringement of Computer Program (88%) in Indonesia due to: first, the legal substance of Computer Program protection (Article 15 (e) (g) the Act No. 19, Year 2002 concerning Copyright as the result of TRIPs harmonization, considered still distinct from the perspective legal culture of Indonesia. There are almost no space for social function (Copyright limitation) for Computer Program; Second, the factor of economic; Third, apparently the law enforcer more protect people who have power than the weak of end users; fourth, the innovation of technology. By comparing the legal protection with the developed countries (the European and US) and developing country (Malaysia),which are all as the member of WTO, only European regulate the Copyright limitation for Computer Program especially for education purposes such as to improve the technical emx» of Computer Program. Therefore the model of Article 5 (3) the Council Directive 911250/EEC of 14 May 1991 on the legal Protection of Computer Program, may suit with the need to construct Better future protection for Computer Program in Indonesia, regarding balance rights both for end users and the copyright owners.

Abstract

Kondisi perekonomian di Bali yang bergantung pada kegiatan pariwisata menjadi terpuruk sebagai dampak dari Covid-19. Hal ini menjadi pelajaran kepada setiap lapisan termasuk Desa Adat di Bali untuk bersama-sama menangani Covid-19. Penelitian ini bertujuan untuk menganalisis dan mengkaji implementasi otonomi Desa Adat serta mengelaborasi model sinergi yang tepat dalam rangka percepatan penanganan Covid-19. Hasil penelitian menunjukkan bahwa otonomi Desa Adat dalam penanganan Covid-19 ditempatkan pada peran strategis Desa Adat dalam pembentukan aturan hukum adat yaitu Pararem yang bertujuan untuk mengatur kehidupan masyarakat hukum adat Bali sesuai dengan hukum nasional yang berlaku di Indonesia. Hal ini menunjukkan model sinergi berlakunya hukum adat dan hukum nasional sesuai dengan konsep pluralisme hukum dan regulatory compliance.

Abstract

As part of traditional cultural expressions (TCEs) , traditional weaving including “Traditional Balinese weaving” may be appropriately protected based on article 38 (1) Law No. 28 of 2014 concerning Indonesian Copyright Law. However, the new Indonesian copyright law  seem unclearly protect traditional weaving expression as it is. As WIPO, in international level, protects traditional knowledge, the previous  Indonesian copyright law  (Law No. 19 of 2002) relatively clearly provides a legal basis to protect traditional weaving, especially  when a foreigner uses traditional expression works for comercial purposes, the law empasizes that users should get a license from the state. Meanwhile, the new law is silent for a similar discourse. Therefore, the appropriate protection for traditional weaving through copyright regime is still called into question. The  sui generis law, both in international and national levels, is espected to provide a legal basis protecting TCEs.  Unfortunatly, it is still in the form of a bill until now in Indonesia. By understanding this phenomenon, some grounds to protect  TCEs including traditional Balinese weaving can be considered such as human rights approach for traditional cultural community as well as the intangible cultural harritage approaches from UNESCO schema. In addition, sui-generis  model provisions as well as inventorying and documenting can be considered as an appropriate way to prove and to preserve, safeguard, maintain, and protect  traditional weaving  including traditional Balinese weaving, although there are still challenges because a traditional motive of Balinese weaving is easily produced as an industrial fabric material through modern technology

Abstract

This study aims to examine whether the substance of Balinese traditional law instrument (the awig-awig) contradicts to human rights. This study employed normative legal research. The result shows that the awig-awig stands as convention but, on the other side, it is constructed by the Desa Pakraman under the Balinese Local Government Regulation Number 3 of 2003. Therefore, based on the hierarchy of the norm, it is not a fully autonomous community. Moreover, it is separated from the Unitary State of the Republic of Indonesia and internationally. The traditional law instrument should inline to the national law and international law, especially those related to human rights values. Although it aims to keep the balance of cosmic or universe, international and national instruments related to human rights should be used as a reference to construct customary rules, particularly for the one that is related to kesepekang (a rejection) and manak salah (a sanction for boy and girl born twin). It potentially causes social friction due to its disruption to the human rights values and adequate standard of living.Instrumen Hukum Tradisional Bali: Realisme antara Keseimbangan Kosmik dan Hak Asasi Manusia AbstrakTujuan dari studi ini adalah untuk mengkaji apakah substansi instrumen hukum tradisional Bali yang juga disebut Awig-Awig bertentangan dengan hukum hak asasi manusia. Studi ini menggunakan penelitian hukum normatif. Hasil penelitian menunjukkan bahwa Awig-awig sebagai instrumen hukum tradisional di satu sisi bentuknya sebagai hukum tidak tertulis, tetapi di sisi lain dikonstruksi oleh Desa Pakraman berdasarkan Peraturan Pemerintah Daerah Bali Nomor 3 tahun 2003, oleh karena itu dari hirarki norma, Desa Pakraman  bukan komunitas yang sepenuhnya otonom dalam membuat ketentuan, apalagi terpisah dari Negara Kesatuan Republik Indonesia dan internasional. Instrumen hukum tradisional harus sejalan dengan Hukum nasional dan hukum internasional, terutama yang terkait dengan nilai-nilai hak asasi manusia. Meskipun sifatnya bertujuan untuk menjaga keseimbangan kosmik atau alam semesta, nampaknya instrumen-instrumen internasional dan nasional yang terkait dengan hak asasi manusia perlu digunakan sebagai referensi oleh Desa Pakraman dalam membangun aturan-aturan adat, terutama yang berkaitan dengan kesepekang (penolakan dari Desa Pakraman) dan manak salah (terkait dengan sanksi bagi anak kembar laki-laki dan perempuan yang dilahirkan sebagai kembar sekaligus) yang berpotensi menyebabkan gesekan sosial karena gangguannya terhadap nilai-nilai hak asasi manusia dan standar kehidupan yang layak.DOI: https://doi.org/10.22304/pjih.v5n3.a3

Abstract

Tie-dye is known as a method of dyeing which results in a design on the fabric by which the fabric is collected and tied tightly with fibres, rope, or yarn, then dyed or coloured. The cloth is then processed into clothes, masks, and other accessories which can now be easily found in several online shops. This paper aims to identify, analyze, and elaborate on the legal protection of tie-dye motifs based on Indonesia Law Number 28 the Year 2014 concerning Copyright and the responsibilities of influencers who promote tie-dyed motif products. This is normative legal research with a statutory approach and a conceptual approach. The technique of tracing legal materials uses document study techniques and the analysis of studies uses qualitative analysis. The study shows that the tie-dye motif has been protected under Copyright law both nationally and internationally. Tie-dye motif as a form of continues to be developed with a high economic value has received clear protection under Indonesia Law Number 28 of 2014 concerning Copyright. The clear arrangement of tie-dyes is becoming increasingly important, especially when tie-dyes are used commercially. Regarding the Announcement of a copyrighted work, such as tie-dye products, the element of the uniqueness of form and originality are important points in copyright protection, so it is only natural for an influencer not to allow the sale and/or duplication of goods resulting from infringement of copyright and/or Related Right as regulated in Indonesia Copyright Law.

Abstract

As a global principal, corporations have the obligation to comply with national and international hard law of human rights, respect soft laws and global standards. The United Nations Guiding Principles on Business and Human Rights (GPs) of 2011 were unanimously endorsed by the Human Rights Council and are respected as a global standard that stipulates that corporations should respect human rights when conducting their business activities. The purpose of this paper is to examine the scope and focus of National Action Plans (NAPs) by comparing the Netherlands NAP on Human Rights (2013) is compared to the UK’s updated NAP of 2016 with the aim of providing ideas and good examples of a NAP for Indonesia. This study used normative legal method. It is considered to be a valuable lesson both for developed and developing countries that for practical matters it is highly important to create and implement a NAP for the implementation of the GPs. Fortunately, Indonesia in June 2017 has launched a National Action Plan on Business and Human Rights (NAP). The burden responsibility to carry out the NAP on Business and Human Rights to corporation to be implemented strongly rests on the government authorities both central government and all levels authorities, including the local level, have the duty to implement human rights obligation, including to convince corporations that upholding the GPs will ultimately be to their benefit.

Abstract

Negara diakui sebagai salah satu subjek hukum dalam Hukum Perdagangan Internasional. Negara memiliki kedaulatan untuk mengatur barang atau jasa yang keluar dan memasuki wilayahnya. Kewenangan mengatur tersebut termasuk dalam kedudukannya pada posisi Negara sebagai pedagang. Dalam perkembangannya kedudukan Negara juga menjadi pihak pembeli. Tulisan ini bertujuan untuk mengekplorasi kedudukan negara sebagai pembeli dalam konteks  hukum perdagangan internasional dan penyelesaian sengketa yang dapat diambil oleh Negara berdasarkan Hukum Perdagangan Internasional. Tulisan ini merupakan penelitian hukum normatif melalui pendekatan peraturan perundang-undangan, pendekatan analitis dan konseptual. Hasil studi menunjukkan bahwa suatu Negara dapat menjadi pembeli melalui BUMN yang diwajibkan untuk memberitahukan perusahaan tersebut kepada Council for Trade in Good sebagai implementasi dari prinsip non-diskriminasi dan juga untuk menjamin transparansi kegiatan perdagangan. Dalam pengertian Negara sebagai pembeli, dapat dipahami bahwa hubungan perdagangan yang terjadi antara Negara sebagai pembeli dan pedagang adalah hubungan kontraktual. Oleh karena itu, prinsip kebebasan berkontrak, termasuk prinsip pemilihan cara penyelesaian sengketa dapat diterapkan, baik mengenai pilihan hukum maupun pilihan forum.

Abstract

Preventing early childhood marriage (ECM) can protect children’s rights from the perspective of human rights. There are several rules regarding the age limit for marriage. In Indonesia, the minimum age for marriage is nineteen years. However, in fact, early child marriage is still relatively high, with the seventh highest ranking in the world. This study aims to elaborate on the rights of children, which ECM potentially violates, and to identify who is responsible for minimizing and/or combating this phenomenon. This normative legal research with a human rights approach occurs in the childhood protection context. The results show that ECM has implications for violations against the right to life, the right to education, the right to develop, and the right to health. Thus, more stringently applying international and national law and combining with local wisdom (Balinese Customary Law) in protecting children's rights in the context of preventing ECM can prevent ECM effectively and minimize violations of other children's rights. Moreover, it is believed that the responsibility to reduce and combat ECM not only belongs to the government but also to all stakeholders within the community, such as families, academics, the media, non-profit organizations, entrepreneurs, and customary.

Abstract

Tourism activities in era globalization bring positive and negative impacts especially for the host countries destination. To minimize the negative impacts it is very important to always promote the sustainable development of tourism including from a human rights perspective. This paper will discuss concerning who have responsibility to promote a human rights related with sustainable development of tourism. To explore the topic in this article, Author will study both international human rights instruments and environmental convention as well as the soft law regarding the tourism sector such as the UN WTO Global Code Of Ethics. The Law No. 10 Year 2009 concerning Indonesia Tourism Law is also part of legal material studied in this paper. There are national, international legal instruments of the human rights as well as UNWTO Global Codes of Ethics which can be utilized to promote sustainable tourism through human rights perspective. It is considered that all stakeholders have responsibility to promote sustainable development of tourism.

Abstract

The existence of traditionally managed Balinese city hotels is increasingly threatened by the presence of chain hotels, which are internationally managed with an excellent standard of hotel hospitality. In a commercial context, franchised hotels benefit the franchisor, franchisee, and consumers in terms of the quality of hotel standardization and reputation. Still, such hotels remain incomparable to the Balinese city hotels managed traditionally by family owners. In the legal context, the emergence of various types of modern franchised city hotels in Bali is influenced by suitable laws and policies, such as the World Trade Organization (WTO) Agreement with one of its ground bases called the “Non-Discrimination Principle” at the international level and at the regional level, the Association of Southeast Asian Nations Economic Community, which also emphasizes that one of the important central pillars of the multilateral trading system is a region fully integrated into the global economy. The emergence of modern chain city hotels has prevented the local city hotels from competing in terms of both the infrastructure and quality management services. To overcome these crucial issues, the model provisions of the local government regulation and self- regulation framework of hotel associations must be constructed to strengthen the local city hotels as chain hotels by implementing traditional values, e. g. , the Tri Hita Karana, the corporate social responsibility as a strategic development, and human rights approaches, that comply with the WTO Agreement and the laws and policies at the regional level.
