Abstract

Indonesia is the highest country in Southeast Asia using electronic wallets or e-wallets. However, e-wallets as mobile payment services provide risks and problems for their users. The submission of personal data by users and the acceptance of personal data by e-wallet application providers are seen as legally enforceable statements of will. Protection of personal data on e-wallets is very necessary. The purpose of this research is to find out the protection of personal data which is the protection of human rights and the enforcement of the values of justice for consumers. This research is normative juridical research using analytical and conceptual approach, the statute approach and comparative approach. Literature study was conducted on the collection of primary and secondary legal materials, then the analysis was carried out qualitatively. The results of the research show that the regulatory model for the protection of personal data on e-wallets in the future requires arrangements regarding the obligation of consent from personal data subjects in personal data transfer activities both at home and abroad. Technical arrangements regarding the protection of personal data on e-wallets must be outlined in Bank Indonesia Regulations and Financial Services Authority Regulations.

Abstract

This study aims to elaborate on the policies regarding the protection of TCEs related to creative economy businesses in the tourism sector, and the implementation of these policies in Bali. The study uses a socio-legal research method by using statutes, conceptual, economic, and technological approaches. The study indicated that TCEs are transformed across generations in custodian communities that are not sacred can be categorized as open TCEs and can be developed to support tourism creative economy businesses. Meanwhile, the type of TCEs that are sacred can only be used by the community carrying them for sacred purposes, categorized as closed TCEs. The policies at the international, national, and local levels related to open TCEs have regulated access for it to be developed for creative economy businesses including the tourism sector as well as protection of benefit sharing for the community. Meanwhile, the Indonesia Copyright Law and Provisions on Communal Intellectual Property Data have not accommodated benefit sharing. In Bali, policy related to sacred TCE can be observed through the 2019 Joint Decree on the Strengthening and Protection of Balinese Sacred Dances that prohibits Balinese Sacred Dances from being performed outside of sacred purposes. The implementation of an inventory of the protection of TCEs in Bali has been carried out by the Office of the Ministry of Law and Human Rights of Bali Province in collaboration with the Regional Government in Bali including university, although has not been maximized due to the large variety of cultural expressions in the community.

Abstract

Tie-dye is known as a method of dyeing which results in a design on the fabric by which the fabric is collected and tied tightly with fibres, rope, or yarn, then dyed or coloured. The cloth is then processed into clothes, masks, and other accessories which can now be easily found in several online shops. This paper aims to identify, analyze, and elaborate on the legal protection of tie-dye motifs based on Indonesia Law Number 28 the Year 2014 concerning Copyright and the responsibilities of influencers who promote tie-dyed motif products. This is normative legal research with a statutory approach and a conceptual approach. The technique of tracing legal materials uses document study techniques and the analysis of studies uses qualitative analysis. The study shows that the tie-dye motif has been protected under Copyright law both nationally and internationally. Tie-dye motif as a form of continues to be developed with a high economic value has received clear protection under Indonesia Law Number 28 of 2014 concerning Copyright. The clear arrangement of tie-dyes is becoming increasingly important, especially when tie-dyes are used commercially. Regarding the Announcement of a copyrighted work, such as tie-dye products, the element of the uniqueness of form and originality are important points in copyright protection, so it is only natural for an influencer not to allow the sale and/or duplication of goods resulting from infringement of copyright and/or Related Right as regulated in Indonesia Copyright Law.

Abstract

Introduction: This article is to examine the arrangement of the Inventory of Communal Intellectual Property (ICP) in the perspective of the Culture Advancement or IPR and to locate the ideal future concept regarding the Inventory of Communal Intellectual Property (ICP).Purposes of the Research: The purpose of this research is to analyze the Communal Intellectual Property (ICP) inventory concept in the perspective of IPR or Cultural Advancement.Methods of the Research: This research uses normative legal research with the statutory approach and conceptual approach.Results of the Research: In this research was found that the inventory concept in the Cultural Advancement Law is more sustainable rather than Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 13 of 2017, subsequent to the inventory is conducted and it will be continued to the next stage are securing, maintaining, salvaging, and publishing.

Abstract

Introduction: Non-communicable diseases are chronic diseases that are the most common causes of death worldwide, including in Indonesia. The increase in the prevalence of NCDs occurs year after year and becomes a problem for national health and budget. This challenge is why the enactment of Law Number 17 of 2023 on Health was subsequently followed by the implementation of Government Regulation Number 28 of 2024 on the Implementation Regulations of Law Number 17 of 2023 on Health. This research aims to understand the prevention of non-communicable diseases outlined in this regulation. Method: The research design used a descriptive-analytical approach with a normative-juridical approach. Searching for constitutional norms was used to gather legal resources. Since the analysis was about a legal event or state, a descriptive technique was employed to present it. The case method for the research problem was used. Results: Health promotion, early detection, limiting sugar, salt, and fat intake, controlling tobacco products, physical activity, immunization, and health services are all part of the NCD control strategy, according to Article 192 of Government Regulation Number 28 of 2024 concerning the Implementation Regulation of Law No. 17 of 2023 concerning Health. Conclusion: The prevention of NCDs requires holistic and comprehensive actions,, starting with the formation of government regulations. The government is the policy executor authorized by law to implement public policies to achieve the health administration goals in Indonesia.

Abstract

This study aims to compare trademark protection systems adopted in Indonesia and Malaysia on exclusive rights to trademarks, especially in the human rights context, and to analyze regulations in both countries in supporting small business in the tourism sector through trademark registration incentives. The normative legal research method is used in this study by using statutory, conceptual, and comparative approaches with descriptive qualitative analysis. The study reveals that trademarks as intangible property rights and the right to own property can be considered human rights refer to Arts. 27(2) and 17 UDHR. To strengthen trademark protection in human rights and Intellectual Property Rights contexts, Indonesia adopts a first-to-file system where trademark registration is an obligation, because it protects those who file it first, as stipulated in Law No. 20 of 2016. Gianyar as tourism area in Bali-Indonesia has Regent Regulation Number 86 of 2021 that supports small businesses in tourism through trademark registration incentives. Meanwhile, Malaysia adopts a first-to-use trademark protection system stipulated in the Trademark Act 2019.  However, trademark registration is an essential step to ensure business continuity. Both Indonesia and Malaysia governments have at least attempted to play a positive role in supporting the growth of their economies.

Abstract

The disharmony between Laws and the Regulations of Balinese cultural tourism’s regulation and policy is still exist, specifically in terms of tourism management’s purpose and authority. The clarity of the purpose and the scope in the setting of Balinese cultural tourism Laws and Regulations need to be conducted comprehensively and structured, so the substantial dynamic that included and stated in the law will not be partial. According to the analysis of regulation content of laws and regulation for the application of Tri Hita Karana (THK) in Balinese culture tuorism’s operation, there are numerous disharmonisation that happened between Undang-undang Nomor 10 Tahun 2009 about tourism, as the Laws and Regulations that organizes the tourism, and sectoral Laws and Regulations that organizes limited tourism (whether forest, marine, and culture tourism). Although the disharmonisation already harmonized through Undang-undang Cipta Kerja (Laws of Work Creation), the comprehensive and structured clarity of purpose is still achieved yet, so the substantial dynamic that included and stated in the law will not be partial.

Abstract

Pengaturan pemberdayaan sosial di Indonesia memiliki urgensi bagi penyandang disabilitas untuk mendapatkan hak kesejahteraan sosial. Pentingnya pemberdayaan sosial khususnya dalam perspektif pengembangan potensi keterampilan, akses magang dan ekonomi diatur dalam Peraturan Pemerintah Nomor 52 Tahun 2019 tentang Penyelenggaraan Kesejahteraan Sosial bagi Penyandang Disabilitas. Potensi tersebut berkaitan dengan Undang-undang Nomor 8 Tahun 2016 tentang Penyandang Disabilitas dan menjadi penting mengingat pada pengaturan tersebut menekankan bahwa penyandang disabilitas bukan sebagai objek namun sebagai subjek. Tujuan penelitian ini untuk mengetahui pengaturan pemberdayaan sosial bagi penyandang disabilitas serta untuk mengetahui bentuk-bentuk pengembangan yang dilakukan dalam rangka pemberdayaan sosial bagi penyandang disabilitas. Metode penelitian hukum normatif digunakan, yang melibatkan pemeriksaan undang-undang dan peraturan yang relevan, serta tinjauan pustaka. Hasil studi menunjukkan bahwa Indonesia telah mengakomodir ketentuan peraturan perundang-undangan terkait pemberdayaan sosial terutama pada pengembangan potensi keterampilan, akses magang dan ekonomi dalam bentuk penumbuhan iklim, pelatihan, pendampingan, peningkatan akses pemasaran hasil usaha, sekaligus penguatan kelembagaan dan kemitraan. Selain itu, bidang kesenian seperti kerajinan tangan dan tari-tarian banyak dipamerkan sebagai bentuk pemberdayaan sosial.

Abstract

Tujuan studi ini untuk menganalisis kepastian hukum perlindungan bagi pemegang Hak Cipta atas transformasi musik oleh anonim di media sosial. Studi ini menggunakan metode penelitian normative dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil studi menunjukan bahwa kepastian hukum bagi pemegang hak cipta atas karya musik yang ditransformasikan diatur dalam Pasal 40 ayat (1) huruf n Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta (UUHC). Pemegang Hak Cipta memiliki Hak Ekslusif yakni hak moral dan hak ekonomi terhadap karya ciptaanya. Sehingga pihak lain yang menggunakan untuk kepentingan komersial tanpa seizin pemegang Hak Cipta adalah perbuatan pelanggaran yang konsekusensinya dapat digugat perdata berupa ganti rugi maupun dikenakan sanksi pidana berdasarkan pasal 99 Ayat (1) maupun sanksi pidana diatur dalam Pasal 113 Ayat (2) UUHC. Berkaitan dengan pencegahan pelanggaran transformasi musik oleh anonym, penting diatur ketentuan secara eksplisit mengenai pengaturan tentang mekanisme pelacakan secara digital untuk menelusuri identitas dibalik akun anonim, dalam rangka kepastian hukum perlindungan bagi pemegang hak cipta. ABSTRACT The purpose of this study is to analyze the legal certainty of protection for Copyright holders for anonymous music transformation on social media. This study uses a normative research method with a statue approach amd conceptual approach. The results of the study indicate that legal certainty for copyright holders for transformed musical works is regulated in Article 40 paragraph (1) letter n of Law Number 28 of 2014 concerning Copyright (UUHC). Copyright holders have Exclusive Rights, namely moral rights and economic rights to their creative works. So that other parties who use it for commercial purposes without the permission of the Copyright holder are committing an act of violation (Article 9), the consequences of which can be sued for civil damages under Article 99 Paragraph (1) as well as subject to criminal sanctions based on Article 113 Paragraph (2) UUHC. Related to the prevention of violations of the music transformation by the anonymuos it is important to explicitly regulate provisions regarding the regulation of digital tracking mechanisms to trace the identity behind anonymous accounts, in the context of legal certainty protection for copyright holders.

Abstract

The purpose of this study is to analyze the legal protection of Young Artist-style paintings from the perspective of copyright and traditional cultural expressions amidst the development of the digital era. This study uses a normative legal research method with a statutory approach, a conceptual approach, and a comparative approach. The results of the study indicate that legally, Young Artist-style paintings are included in the category of creations in the field of fine arts, as regulated in Law Number 28 of 2014 concerning Copyright. However, because the work is sourced from communal Balinese cultural values, individual protection through copyright is not entirely adequate. Therefore, legal recognition is needed, namely through Traditional Cultural Expressions (EBT), to protect the moral rights and cultural identity of the Sayan Village community. In the digital context, the biggest challenge lies in the possibility of being produced/recreated by artificial intelligence along with the development of the current digital era. Effective protection efforts can be carried out through strengthening national regulations, establishing a digital cultural expression database, and implementing technologies such as Digital Rights Management (DRM) or blockchain certificates to guarantee the attribution and authenticity of works. This research confirms that protecting Young Artist style paintings is not only a legal obligation, but also a form of responsibility
