Abstract

Corporations inevitably violate human rights in a variety of ways. As corporations evolved into massive multinational businesses, corporate violence—which is a legacy of colonialism and corporate power—continues to exist today. Corporate players maintain their freedom in pursuing their objectives using convoluted and obscure multinational organizations and supply networks, through the utilization of corporate law principles like the veil of corporate ownership, and also through other practices like tax evasion and lobbying of political bodies. The objective of this article is to explore the legal aspects of the problem of corporate violence, and suggesting reforms to ensure justice for the affected parties. This article uses the doctrinal research method along with the comparative method, focusing on both primary and secondary data. This article makes the case that the issue stems from the structural and systemic flaws in the framework of international law as well as in corporate laws that continually preserve corporate institutions in frustrating the advancement of the cause for human rights.  To effectively enhance the corporate and human rights environment, a framework of hard law, soft law, and non-law reforms and actions is needed.

Abstract

ABSTRACT Purpose of the study: This research aimed to fill gap by detailing the arguments around legal responsibility of juvenile narcotics use that are not intended for recreational purposes, but rather for medical purposes. This seeks to contribute to the growing literature on restorative justice in Indonesia, particularly for the development of the juvenile justice system. Methodology: This study examined the phenomenon of narcotics uses in the self-medication context, particularly among youth, utilizing the normative legal research method and bolstered by a case study (Judicial Decision). It also utilized the statutory approach, which involved an in-depth analysis of applicable legal provisions regarding juvenile crimes and narcotics. Results: While conceptual analysis found that there are many connections between the emerging trend of self-diagnosis and self-medication with narcotics use among children, yet the normative support to deal with this phenomenon through restorative justice remains poor. The impact of the lack of normative support is shown in the judicial decision, in which restorative justice through the application of diversion was applied incautiously, blurring children’s well-being;  disturbed by medical issue at first and later worsened by marijuana addiction. Applications of this study: The study can be an instrumental reference in guiding legal reforms, shaping healthcare policies for juvenile narcotic use, and providing information on educational and awareness programs that distinguish between medical and non-medical use of narcotics by minors. Novelty/Originality of this study: The originality of this study lies in its specific accent on the intersection of juvenile law, narcotics use, and medical treatment, which is a relatively underexplored area in legal research in Indonesia. It is also found in its analysis of a decision of a juvenile court regarding the use and possession of narcotics.

Abstract

Indonesia as a sovereign country guarantees and provides protection for every citizen. This is a reflection of the State of Indonesia as a state of law. It is the same as the supporting profession of legal consultants in the capital market who have the right to have all their rights protected while carrying out their profession. The supporting profession of legal consultants in the capital market has an important role. Provisions of Article 67 of Law no. 8 of 1995 concerning the Capital Market which reads "In carrying out business activities in the Capital Market sector, Capital Market Supporting Professionals are required to provide an independent opinion or assessment. However, according to the author's careful review, in the capital market legal consultant profession, legal immunity has not been found while carrying out their profession. While in the Advocate Law there is immunity for an Advocate who carries out his functions as contained in Article 16 of Law Number 18 of 2003 concerning Advocates. The Capital Market Law does not explicitly describe legal protection for capital market legal consultants. For this reason, in this paper the author finds about preventive legal protection for capital market legal consultants in Indonesia with a Comparative Study of Indonesian and Singapore Laws. Legal Consultants in the Capital Market in Indonesia, one of the fundamental things to avoid legal sanctions is obedience to existing legal norms. While in Singapore it was found that since the beginning according to the country's constitution there has been legal immunity for professions related to Advocates, Lawyers or legal consultants. To answer the problem of this paper, the writer uses normative juridical method with progressive legal theory (Prof. Satjipto Rahardjo) and Legal Protection Theory (Philipus M. Hadjon).

Abstract

The juvenile justice system is intrinsically related to youth development, as it is responsible for the education and rehabilitation of children who have committed or are suspected of committing a crime. Juvenile crimes must go through criminal proceedings before being tried in court. However, discussions on preventing duress during these proceedings in Indonesia remain limited. This research aims to analyze efforts to prevent duress during juvenile criminal proceedings in Indonesia, highlighting potential gaps and comparing them to the United Kingdom's juvenile justice system. Utilizing the normative research method with the support of the comparative approach, this study examines existing Indonesian laws and their implementation while juxtaposing them with the UK’s juvenile justice framework. The analysis reveals significant opportunities for duress to occur within Indonesia’s juvenile justice system, contrasting with the UK’s system, which has a more structured set of legal norms. Based on these findings, this research proposes a model for legal development, focusing on closing procedural gaps that allow duress to occur during juvenile criminal proceedings in Indonesia.

To support this method, this research also utilizes literature analysis and comparative analysis technique to analyze the dichotomy between Geographical Indication and Traditional Knowledge.Findings: Analysis finds that the GI regime comes out as the superior regime of protection from the dichotomy, with lesser normative loopholes. Authenticity plays an important role in the comparative analysis between the two regimes, as it’s normatively backed as an important part of the tourism sector. Further analysis also finds that the GI regime can still be improved, particularly regarding substantive examination, which needs more definitive provisions to guarantee authenticity of traditional cuisines in Indonesia.Paper Type: Research Article
