Abstract

In credit agreements, land certificates are often used as collateral objects to guarantee the repayment of debts between debtors and creditors. As an object of credit guarantee, the owner of the land certificate must be in a living status, because if the owner has passed away, the process of registering the right of dependency cannot be carried out. Legally, the process of transferring land rights through the inheritance mechanism must be completed first so that the status of ownership of land rights is in the hands of the heirs legally. This study uses a normative juridical research method with the main focus on analyzing the process of registering dependent rights through the inheritance mechanism. The results in this study show that the registration of dependent rights must be based on the status of the living landowner. After the landowner dies, the inheritance process must be completed first before the registration of dependent rights can be carried out. Registration of dependent rights involves the preparation of a credit agreement deed, the preparation of a deed of granting dependent rights and its registration at the land office

Abstract

Data protection is one of the most important aspects of the digital economy, with its legal implications extending across digital landscapes. The failure to protect data in data breaches can threaten the interests of owners and expose them to various risks. Legal compliance regarding how owners are notified of data breaches is important to prevent this, necessitating deep legal discourse and analysis. Using a comparative legal research method with a statutory approach, this study dissects norms within Indonesia and South Korea’s legal systems to analyze their differences in legal compliance regarding this issue. The findings of this study highlight the discrepancies in legal frameworks between Indonesia and South Korea. It particularly notes Indonesia's lack of a governing body for data breach notifications and the absence of comprehensive privacy impact assessments or cybersecurity compliance. Ultimately, the study underscores the need for Indonesia to develop a normative model for data protection to address its significant regulatory gaps—contrasting with South Korea's more robust legal mechanisms and the GDPR's systematic oversight.KEYWORDS: Data Breach, Data Breach Notification, Data Protection.

Abstract

The enforcement of digital conduct provisions is currently gaining more relevance. Indonesia and Thailand, as two countries with diverse socio-cultural and religious backgrounds, continue to struggle with ensuring that online conduct was within safe boundaries. However, ongoing efforts to regulate this situation raised numerous questions regarding the balance between freedom of expression and societal sensitivities, particularly in relation to how 'harm' was defined by individuals and the legal system. A normative legal study was conducted to analyze the relevant primary law sources from both countries and examined how ‘harm’ is defined by the Indonesian and Thailand legal system. The results showed that there was a significant disconnect between Indonesia and Thailand's diverse societies and how the legal system tried to balance competing interests. Legal provisions and enforcement also showed a strong focus on socio-cultural preservation that may inadvertently limit digital discourse.

Abstract

Dalam beberapa tahun terakhir, pelanggaran data pribadi oleh korporasi di Indonesia meningkat secara signifikan, menunjukkan perlunya kepastian hukum dalam pertanggungjawaban pidana terhadap pelaku. Penelitian ini bertujuan untuk menganalisis kepastian hukum dalam pertanggungjawaban pidana korporasi atas penyalahgunaan data pribadi di Indonesia. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Hasil penelitian menunjukkan bahwa Indonesia telah memiliki kerangka hukum yang jelas dan tegas dalam pertanggungjawaban pidana korporasi atas penyalahgunaan data pribadi. UU PDP menetapkan mekanisme strict liability, yang memastikan korporasi tetap bertanggung jawab meskipun pelanggaran dilakukan oleh individu dalam perusahaan. Sanksi tegas berupa denda hingga 2% dari pendapatan tahunan, pencabutan izin usaha, serta hukuman pidana bagi pengurus korporasi memperkuat aspek kepastian hukum.

Abstract

Kitab Undang-Undang Hukum Pidana (KUHP) yang berlaku di Indonesia hingga saat ini yang merupakan warisan dari kolonial Belanda yakni Wetboek van Strafrecht voor Nederlansch Indie (Wvs NI), yang dinilai tidak lagi relevan dengan perkembangan masyarakat modern dan nilai-nilai keindonesiaan. Pemberlakuan KUHP lama masih menimbulkan ketidakpastian hukum, adanya dualism hukum hingga ketidaksesuaian prinsip keadilan (retributive) yang diharapkan. Oleh karena itu, pembaharuan hukum pidana melalui KUHP Nasional menjadi langkah penting untuk menghilangkan karakter colonial, mengintegrasikan nilai yang hidup didalam masyarakat serta menjawab seluruh kebutuhan masyarakat di era modern saat ini. Penelitian ini bertujuan untuk menganalisis bagaimana dekolonialisasi dalam KUHP Nasional melalui rekodifikasi dapat memperkuat sistem hukum pidana Indonesia. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian yuridis normative dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Data yang dianalisis adalah data sekunder yang diperoleh secara tidak langsung melalui teknik studi kepustakaan yang kemudian diolah dan dianalisis secara deskriptif-kualitatif. Hasil penelitian menunjukkan bahwa KUHP Nasional merefleksikan dekolonialisasi melalui penghapusan karakteristik colonial, penguatan nilai-nilai Pancasila, mengintegrasikan hukum yang hidup didalam masyarakat hingga mengutamakan prinsip keadilan restorative sehingga memperkuat sistem hukum pidana.

Abstract

The phenomenon of e-commerce in Indonesia has demonstrated rapid growth, with high transaction values projected in 2024. However, the circulation of counterfeit products on digital platforms poses a serious challenge, endangering consumers. Although the legal framework for consumer protection in Indonesia provides a foundation for safeguarding consumer rights, oversight of counterfeit products in e-commerce has been deemed ineffective in ensuring consumer protection. This study employs normative legal research methods with comparative law, legislative, and conceptual approaches. The findings reveal that the Consumer Protection Act (UU Perlindungan Konsumen) has not been fully effective in ensuring the accountability of digital platforms, monitoring products, and resolving disputes. In comparison, EU regulations mandate the responsibility of digital platforms, the use of tracking technologies such as blockchain, regular audits, and strict sanctions for violations. The study recommends strengthening platform accountability in seller verification, adopting technology for product monitoring, and developing an integrated online dispute resolution mechanism through the Consumer Dispute Settlement Body (BPSK). Referring to progressive legal theory, Indonesia's regulatory framework must adaptively evolve to address digital dynamics, create legal certainty, and build public trust in a secure and equitable e-commerce ecosystem. [Fenomena e-commerce di Indonesia telah menunjukkan pertumbuhan pesat dengan nilai transaksi yang tinggi pada tahun 2024. Namun, peredaran produk palsu di platform digital menjadi tantangan serius yang membahayakan konsumen. Meskipun kerangka hukum perlindungan konsumen di Indonesia telah memberikan landasan hukum untuk melindungi hak konsumen, namun pengawasan terhadap produk palsu di e-commerce dinilai belum efektif dalam melindungi kosnumen. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perbandingan hukum, perundang-undangan, dan konseptual. Hasil penelitian menunjukkan bahwa UU Perlindungan Konsumen belum optimal dalam memastikan tanggung jawab platform digital, pengawasan produk, dan penyelesaian sengketa. Sebagai perbandingan, regulasi UE mengatur kewajiban platform digital, penggunaan teknologi pelacakan seperti blockchain, audit berkala, dan sanksi tegas bagi pelanggar. Rekomendasi penelitian mencakup penguatan tanggung jawab platform dalam verifikasi penjual, adopsi teknologi untuk pengawasan produk, dan pengembangan mekanisme penyelesaian sengketa daring yang terintegrasi dengan Badan Penyelesaian Sengketa Konsumen (BPSK). Dengan mengacu pada teori hukum progresif, regulasi di Indonesia perlu berkembang secara adaptif untuk menghadapi dinamika digital, menciptakan kepastian hukum, dan meningkatkan kepercayaan masyarakat terhadap e-commerce yang aman dan berkeadilan].

Abstract

Introduction to the Problem: Indonesia has been continuously developing its legal framework regarding many aspects of digital spaces, including cybersecurity, in the quest of maximizing the potentials of Industry 4.0. However, this rapid development of legal framework must be analyzed thoroughly to make sure that it’s in line with the principles of human rights. Purpose/Study Objectives: Drawing from international standards of human rights, this research focuses on analyzing the cybersecurity legal framework in Indonesia, and how the laws and regulations related to it fare against international standards of human rights. Design/Methodology/Approach: Using the normative legal research method, this research analyzes secondary data in the form of primary Indonesian and international law sources to evaluate the protection of human rights in the midst of this legal development. Findings: Findings of this research show that the legal framework in Indonesia does leave many rooms for potential human rights abuse, with normative loopholes and underestimation of potential issues regarding the denial of human rights, within digital spaces. Abstract

Introduction: This research examines the effectiveness of handling human rights-based public complaints at the Regional Inspectorate of Riau Islands Province.Purposes of the Research: The aim is to evaluate the implementation, obstacles, and efforts to optimize complaint management.Methods of the Research: Method used is an empirical legal research method with a statutory and empirical approach. Data were obtained through interviews, observations, and study of legal documents related to the handling of public complaints.Results Main Findings of the Research: Results showed that although the regulatory framework exists, its implementation has not been optimal. The main obstacles include limited human resources both in number and competence, lack of socialization to the community, and weak legal structure and culture. This has led to slow processing of complaints and a low level of responsiveness to community needs. Recommendations include improving HR competencies through regular training, strengthening socialization to raise public awareness, and optimizing technology to support complaints management. These measures are expected to ensure respect for and fulfillment of human rights in public services, increase public trust in the government, and support clean and accountable governance.

Abstract

Keselamatan kapal perikanan menjadi aspek krusial dalam menjaga keberlanjutan sektor perikanan, khususnya di Kepulauan Riau yang kaya akan sumber daya kelautan. Kapal perikanan kecil, sebagai tulang punggung industri perikanan, menghadapi tantangan serius terkait registrasi dan penertiban. Penelitian ini bertujuan untuk menyelidiki tantangan dan prospek registrasi kapal kecil di Kepulauan Riau serta memberikan gambaran komprehensif mengenai keselamatan kapal perikanan di wilayah tersebut. Penelitian ini bertujuan untuk menganalisis peraturan dan implementasi registrasi kapal perikanan di Kepulauan Riau, mengevaluasi peran Pemerintah Daerah dalam penertiban kapal perikanan, dan merumuskan rekomendasi untuk meningkatkan keselamatan kapal perikanan di wilayah ini. Metode penelitian yang digunakan adalah metode yuridis normatif dengan menggunakan pendekatan konseptual dan pendekatan perundang-undangan. Pendekatan konseptual akan digunakan untuk mengidentifikasi konsep-konsep dasar terkait keselamatan kapal perikanan dan registrasi kapal kecil di wilayah Kepulauan Riau. Analisis menunjukkan bahwa registrasi kapal kecil di Kepulauan Riau menghadapi berbagai tantangan, termasuk kendala administratif, kurangnya pemahaman masyarakat nelayan, dan kurangnya infrastruktur pendukung. Pemerintah Daerah Kepulauan Riau telah mengambil langkah-langkah strategis, namun implementasi masih dihadapkan pada tantangan sumber daya manusia dan teknologi. Rekomendasi diberikan untuk meningkatkan efektivitas registrasi kapal, penertiban, dan keselamatan kapal perikanan secara keseluruhan. Title: Fishing Vessel Safety: Challenges and Prospects for Small Vessel Registration in the Riau Islands Fishing vessel safety is a crucial aspect in maintaining the sustainability of the fisheries sector, especially in the Riau Islands which are rich in marine resources. Small fishing vessels, as the backbone of the fishing industry, face serious challenges regarding registration and regulation. This research aims to investigate the challenges and prospects of small vessel registration in the Riau Islands and provide a comprehensive picture of fishing vessel safety in the region. This research aims to analyze the regulations and implementation of fishing vessel registration in the Riau Islands, evaluate the role of the Regional Government in controlling fishing vessels, and formulate recommendations to improve the safety of fishing vessels in this region. The research method used is a normative juridical method using a conceptual approach and a statute approach. A conceptual approach will be used to identify basic concepts related to fishing vessel safety and small vessel registration in the Riau Islands region. Analysis shows that small vessel registration in the Riau Islands faces various challenges, including administrative obstacles, lack of understanding of fishing communities, and lack of supporting infrastructure. The Regional Government of the Riau Islands has taken strategic steps, but implementation is still faced with human resource and technological challenges. Recommendations are provided to improve the effectiveness of vessel registration, control and overall safety of fishing vessels.

Abstract

Emergency laws are often framed as necessary tools to respond quickly during national crises, but they also present significant risks to democratic structures. This paper explores how emergency powers can be used to centralize executive authority in Indonesia, Thailand, and Vietnam. The purpose of this study is to analyze how legal frameworks enable or fail to restrict executive power during emergencies. Using a doctrinal legal research method, the paper examines constitutional texts, relevant statutes, and key political events to assess how emergency powers function in practice. Findings show that while all three countries demonstrate varying degrees of executive flexibility, Indonesia stands out due to its lack of clear legal limits and minimal oversight, while Thailand is riddled with normative inconsistencies and multiple avenues for its executive branch to weaponize the state of emergency. Vietnam, on the other hand, subordinates all branches of state power to the overarching control of the Communist Party, resulting in possible limited legal accountability and significant potential for unchecked executive action. The study emphasizes the need for stronger legal safeguards to prevent emergency powers from becoming a lasting feature of governance.
