Abstract

Hate speech and terrorism are two forms of crime that are similar in their discriminatory nature. The efforts to address these crimes are of significant importance, as they starkly contrast with the values that Indonesia holds dear and present serious threats to its multicultural society. This study aims to explore the correlation between hate speech and terrorism and to explain how this correlation may assist in the development of a legal framework that better addresses both issues. The research employed a normative legal approach to analyze the existing positive laws regarding hate speech and terrorism, aiming to identify correlations between the two. This normative legal research utilized a combined statutory approach, employing primary law sources as secondary data. The analysis revealed normative issues within the Indonesian legal framework that restrict the criminalization of offenses that fall between the legal definitions of hate speech and terrorism. These issues need to be addressed as an important step in Indonesia’s legal development to realize a safe society for all Indonesians.

Abstract

Media massa dan wartawan merupakan dua sumber daya yang saling berhubungan. Perusahaan media massa tidak profesional berdampak negatif terhadap kehidupan pers. Media massa dan wartawan bagaikan dua mata pisau sehingga bisa dijadikan alat untuk kepentingan tertentu, bahkan melanggar hukum. Media massa dan wartawan yang tidak mengedepankan kode etik jurnalistik mencoreng profesi jurnalis, dan cenderung melanggar hukum sehingga muncul stigma negatif di tengah masyarakat terhadap profesi wartawan. Adapun rumusan masalah dalam penelitian ini adalah bagaimana problematika pendirian perusahaan pers serta urgensi verifikasi media massa dan uji kompetensi wartawan, yang dihubungkan dengan prinsip kemerdekaan pers dan Undang-Undang Pers. Penelitian disajikan menggunakan metode yuridis empiris dengan pendekatan penelitian bersifat kualitatif. Berdasarkan hasil penelitian, terdapat celah hukum pada peraturan terkait pendirian media massa. Bahkan UU Nomor 40 Tahun 1999 tentang Pers sendiri membuka ruang kepada siapa saja untuk mendirikan perusahaan pers, namun tidak mewajibkan untuk meningkatkan kapasitas. UU Pers juga tidak mengatur syarat pendidikan bagi wartawan, melainkan hal tersebut diserahkan kepada perusahaan pers. Regulasi pers terkait verifikasi media massa dan uji kompetensi wartawan hanya berlaku bagi yang mendaftar di Dewan Pers. Kondisi tersebut menyebabkan pertumbuhan media massa, khususnya media siber tidak terkendali, bahkan aktivitas wartawan yang tidak profesional cenderung melanggar prinsip-prinsip kemerdekaan pers.

Abstract

Kekerasan seksual terhadap anak merupakan masalah serius yang berdampak jangka panjang bagi korban. Perlindungan hukum terhadap anak korban pelecehan seksual di Indonesia membutuhkan perhatian karena implementasi regulasi yang ada belum optimal. Penelitian ini bertujuan untuk menganalisis pengaturan perlindungan hukum bagi anak korban pelecehan seksual di Kota Batam dan mengevaluasi apakah perlindungan hukum tersebut memberikan rasa keadilan. Menggunakan metode yuridis normatif dengan pendekatan kasus, perundang-undangan, dan konseptual, penelitian ini menemukan bahwa meskipun regulasi seperti Undang-Undang Perlindungan Anak dan Perda Kota Batam sudah kuat, implementasinya menghadapi kendala, seperti minimnya anggaran, proses penyidikan yang sulit, dan kurangnya dukungan psikososial. Putusan pengadilan yang memberikan hukuman 12 tahun penjara kepada pelaku belum sepenuhnya mencerminkan keadilan bagi korban. Penelitian ini merekomendasikan peningkatan anggaran, peran aktif KPPAD, serta dukungan psikososial untuk memastikan perlindungan yang lebih baik bagi korban.

Abstract

Trafficking in Person (TIP) is a transnational crime affecting both countries of origin and destination, with significant implications for vulnerable individuals, particularly those in the online gambling sector. This research explores the categorization of TIP victims working abroad, focusing on legal frameworks and government cooperation to combat this issue. Using a normative juridical approach and qualitative analysis, the study emphasizes the urgency of cross-border collaboration in TIP prevention. The findings highlight the critical need for strengthened international agreements, regional cooperation, and the enforcement of robust legal sanctions against transnational crime syndicates. This research contributes to a deeper understanding of TIP within specific sectors and proposes actionable recommendations to enhance global anti-trafficking efforts.

Abstract

The development of technology and digital transformation has led to the growth of industries such as the creative business industry. One of its impacts is the emergence of Non-Fungible Tokens (NFTs). NFTs are digital assets in the form of tokens representing ownership of a digital artwork. In Indonesia, NFTs currently lack specific legislative regulations, and there is no explicit and clear regulatory framework regarding the protection of NFTs in terms of their intellectual property aspects. Therefore, this study examines the development of NFTs in Indonesia, along with the legal position and protection of NFTs based on intellectual property law in Indonesia. In this research, the author employs a normative juridical research method with a legislative approach. Based on the research findings, it is evident that the development of NFTs, both globally and nationally, is quite significant. The public is increasingly becoming acquainted with NFTs, which have substantial prospects and are associated with many high-commercial-value works. Regarding NFTs as creative works, the regulation that accommodates the protection of intellectual property for NFTs in Indonesia is Law No. 28/2014. It is known that NFTs can take the form of images, paintings, videos, and music, which are considered parts of creations protected by copyright.

Abstract

Agriculture, as a significant contributor to carbon emissions and climate change, needs to not only change its ways to a more sustainable practice but also revisit what has long been considered conventional agriculture practices to support sustainable development. This requires a comprehensive legal framework to ensure that the transition to sustainable agriculture is supported by structured and streamlined legal compliance that can balance stakeholders’ interests. Employing the comparative legal research method, this study aims to analyze the potentials and challenges of applying sustainability in agriculture, using the comparison between Indonesia and Thailand. The findings of this study suggest that Indonesia’s legal framework for sustainable agriculture, focusing on its single Sustainable Agriculture Law, is more comprehensive than Thailand’s multiple regulations, effectively supporting sustainability across various agricultural processes. This framework aligns well with SDGs 2, 12, 13, and 15, which are crucial for agricultural sustainability. Conversely, Thailand faces challenges due to normative gaps and requires a more unified legal framework to address these SDGs adequately.

Abstract

One the negative usages of digital technology is the sharing of inappropriate photo to someone online. However, as social media users are often the target of doxing, young persons who commit this offense can also be considered victims, leaving them vulnerable to bullying, especially in their own environment, such as school. Using normative legal research method and statutory approach, this research analyzes the potentials of school transfer as a post-criminal proceedings method for juveniles who commit sexual offense in the form of inappropriate photo-sharing, to first get them to an environment safe enough for them to be educated on their mistakes in another school, which is important for their growth. This study identifies normative gaps within the Juvenile Justice, Pornography, and Education Laws that hinder the reintegration of juveniles involved in online sexual offenses, proposing school transfer as a mitigative strategy against bullying and harassment. It emphasizes the need for further research to address implementation challenges, underscoring the importance of a holistic restorative justice approach.

Abstract

Introduction: Public service is essential in serving and engaging with the community. It is fundamental for building strong, resilient communities and ensuring a functioning democracy. However, the exposure of personal data in public service is worrying, as data breaches have affected the public's privacy.Purposes of the Research: This study examines the extent to which personal data is protected in the provision of public services in Indonesia and Malaysia. It also investigates how the Indonesian government can learn from Malaysia to improve its data protection in public services.Methods of the Research: This study employed a normative juridical approach. Secondary data was used in this study: the 1945 Constitution, Law Number 25 of 2009 concerning Public Services, Presidential Instruction Number 3 of 2003 concerning National Policy, Strategy for E-Government Development, and the Malaysian Personal Data Protection Act 2010.Results Main Findings of the Research: This study shows many data protection breaches in Indonesia. Additionally, no existing law protects personal data in Indonesia. It is recommended that Indonesia establish a law to protect the personal data of its citizens. Malaysia’s Personal Data Protection Act 2010 can be modelled to establish the law.

Abstract

Introduction: Population growth has positive and negative impacts on a region. Batam city is a city with a fairly large population and Batam City must be able to fulfill its citizens' rights.Purposes of the Research: This study aims to analyze the fulfillment of the right to work and identify ways to control the rate of population growth to meet the need for jobs. Methods of the Research: The method used in this research is normative juridical. The study used is library research. The basis used in this study is the juridical basis which consists of the 1945 Constitution, Law Number 39 of 1999 concerning Human Rights and the theoretical basis used is the legal system theory of Lawrence Meir Friedman. Results of the Research: Based on the results of the study, it was found that the population growth in the Batam city is increasing and the Batam city has an obligation to fulfill the right to work for its residents. Therefore, Batam City must make a population grand design which also contains strategic plans for managing human resources and strategies for preparing jobs for its residents

Abstract

The management of Regional Assets (BMD) in Indonesia continues to face structural and procedural challenges, including inadequate inventory systems, insufficient human resource (HR) competencies, and weak inter-agency coordination. This study critically examines the effectiveness of the fixed asset write-off policy at the Regional Development Planning Agency (Bappeda) of Riau Islands Province in line with Permendagri No. 7 of 2024. Using an empirical legal research method through a sociological approach, the study captures field-based data to assess the practical implications of policy implementation. The findings reveal persistent inefficiencies in asset write-off procedures due to unclear Standard Operating Procedures (SOPs), lack of digital support systems, and low transparency. Additionally, institutional barriers such as limited administrative capacity and leadership gaps hinder policy execution. This study is the first empirical investigation of asset elimination practices in Bappeda Riau Islands, a region with distinctive archipelagic characteristics, thus offering significant academic and policy relevance. The study proposes actionable strategies, including the formation of a dedicated inventory team, HR capacity-building programs, and the enhancement of SOPs to streamline the write-off process. These solutions are expected to improve overall BMD governance, promote accountability, and support increased Regional Original Income (PAD). The research contributes a replicable model for regional governments, especially in geographically complex areas, to optimize asset management through evidence-based policy refinement.
