Abstract

The pharmaceutical industry as a business entity must fulfill the right to health, especially for children. However, the Acute Kidney Injury (AKI) case in Indonesian children, with 324 cases in less than a year, indicates a violation of children's right to health and life. Court findings reveal systematic and widespread gross human rights violations, making the pharmaceutical industry involved accountable. This study aims to examine the fulfillment of elements of gross human rights violations by the pharmaceutical industry in producing contaminated drugs containing hazardous and toxic substances, as well as the burden of corporate criminal liability. This research employs a normative legal research method with a statutory approach, analyzing several legal regulations. The findings indicate that corporate actions fulfill the elements of crimes against humanity under the Human Rights Court Law, making them criminally liable. However, individual criminal responsibility remains a challenge in corporate accountability. Therefore, legal reforms are needed to strengthen pharmaceutical oversight and establish more effective corporate sanctions, such as fines as the primary penalty, business license suspension or revocation, and additional sanctions like confiscation of profits from criminal acts, corporate dissolution, and banning executives from establishing new companies in the same field. Industri farmasi sebagai pelaku usaha memiliki kewajiban untuk memenuhi hak atas kesehatan, terutama bagi anak-anak. Namun, kasus Gangguan Ginjal Akut (AKI) pada anak di Indonesia dengan 324 kasus dalam waktu kurang dari setahun menunjukkan adanya pelanggaran hak kesehatan dan hak hidup anak. Fakta persidangan mengungkap adanya pelanggaran Hak Asasi Manusia (HAM) berat yang bersifat sistematis dan meluas, sehingga industri farmasi yang terlibat harus bertanggung jawab. Tujuan penelitian ini adalah untuk mengkaji pemenuhan unsur-unsur pelanggaran HAM berat oleh industri farmasi dalam memproduksi obat-obatan yang terkontaminasi bahan berbahaya dan beracun serta bagaimana beban pertanggungjawaban pidana terhadap korporasi yang terlibat. Penelitian ini menerapkan metode penelitian hukum normatif dengan jenis pendekatan penelitian perundangan-undangan yang mengkaji beberapa peraturan hukum. Hasil penelitian menunjukkan bahwa tindakan korporasi memenuhi unsur kejahatan terhadap kemanusiaan dalam UU Pengadilan HAM sehingga dapat dimintai pertanggungjawaban pidana. Namun, masih terdapat hambatan dalam menegakkan hukum terhadap korporasi. Namun, prinsip pertanggungjawaban pidana individu menjadi hambatan dalam menegakkan hukum terhadap korporasi. Oleh karena itu, diperlukannya  pembaharuan hukum untuk memperkuat pengawasan farmasi serta menetapkan pidana korporasi yang lebih efektif, seperti pidana denda sebagai pidana utama, pembekuan atau pencabutan izin usaha, serta sanksi tambahan seperti perampasan keuntungan yang diperoleh dari tindak pidana, pembubaran korporasi, dan larangan bagi pengurus korporasi untuk mendirikan perusahaan baru di bidang yang sama.

Abstract

Dalam konteks Terorisme di Indonesia, pandangan terhadap terorisme memiliki nuansa yang berbeda dari mayoritas pandangan global. Radikalisme dan terorisme adalah dua hal yang berbeda karena radikalisme adalah suatu paham atau aliran sementara terorisme adalah suatu tindakan namun dua hal ini berkaitan satu sama lain karena ada satu persamaan diantara keduanya dengan tindakan menggunakan kekerasan. Penelitian ini berjenis empiris sama dengan studi lapangan (field research). Teknik pengumpulan data dilakukan melalui studi kepustakaan yaitu dengan melakukan kajian dokumen, peraturan perundang-undangan, terkait, jurnal, hasil penelitian artikel serta mempelajari bahan-bahan tertulis dari data BNPT RI dan artikel terdahulu menggunakan jenis data sekunder sedangkan pengumpulan data diperoleh dari, wawancara dan pengamatan langsung di lapangan menggunakan jenis data primer. Sumber data sekunder dan primer diperoleh dari beberapa pihak termasuk data yang dimiliki oleh BNPT RI. Hasil penelitian ini mengungkapkan bahwa peranan, tanggung jawab, dan kewenangan BNPT RI dalam mengatasi aksi radikal terorisme, selaras dengan UU No. 5 Tahun 2018, mencakup: a. Membentuk regulasi, strategi, dan program nasional di sektor pencegahan terorisme; b. Mengoordinasikan badan pemerintahan berkenaan dengan tata laksana dan eksekusi regulasi pencegahan terorisme; c. Mengimplementasikan regulasi tersebut melalui satuan tugas yang mencakup elemen-elemen instansi pemerintahan terkait, sejalan dengan peran, fungsi, dan wewenang masing-masing. BNPT RI sebagai leading sector. Dengan program-program dari BNPT RI, maka akan mempersempit ruang gerak kelompok radikal terorisme. Adapun implementasi peran BNPT RI dalam penanggulangan radikal terorisme, yaitu 1) Program Sinergisitas dalam Mencegah Terorisme, 2) Mewujudkan Sinergi untuk Indonesia Harmoni, dan 3) Strategi Membangun Perdamaian Global dalam Penanggulangan Terorisme.

Abstract

Parking is an activity regulated by the government as a source of local revenue to support infrastructure development. The management of parking revenue in Batam City refers to Law Number 28 of 2009 on Local Taxes and Levies and Local Regulation of Batam City Number 1 of 2024. The problem of this research is the effectiveness of the government's role in managing parking revenue in Batam City, especially in the aspects of facilities, community participation, and culture of legal compliance. This research aims to analyze the role of government in managing parking revenue in Batam City. The method used is empirical juridical research involving in-depth interviews with the Local Revenue Agency, Transportation Agency, as well as parking attendants in Batam City with statutory approach, conceptual approach and sociological approach. The results show that the government has a strategic role in ensuring that parking revenue is optimally distributed, both for the welfare of parking attendants and the development of city infrastructure. In addition to effective regulations, the main challenges in optimizing the parking system in Batam City lie in improving facilities, public participation, and strengthening the culture of compliance with parking regulations. Therefore, synergy between government policies, especially related to technology and public education, is needed to create a parking system that is more transparent, efficient, and contributes maximally to local revenue.

Abstract

This research explores the policies of the Batam City Regional Government in the context of protecting and fulfilling rights of children and women against acts of discrimination. Focus on the effectiveness  policy and its implementation barriers, this study uses a qualitative approach to investigate the concrete impact  protected rights. Batam City, as an economic and industrial center, faces complex dynamics in facing the challenges of protecting the rights of children and women.  Research highlights  relevance and urgency of handling issues in regional policies.  Global and national context demonstrates the need for effective and well-implemented policies.  detailing the problem, study raises two key questions: first, this study wants to thoroughly discuss the extent of the effectiveness of policies in protecting children's and women's rights from discrimination, and second, what are the main obstacles that hinder policy implementation This type research uses empirical legal research with an approach to legislation and empirical. The findings study provide in-depth insights into implementation of the policy and impact on desired rights. This analysis highlights the complexity of social and cultural dynamics in Batam City that affect policy effectiveness. The results of this study are expected  provide  better understanding the problem of protecting the rights of children and women, provide concrete recommendations for policy improvement, and stimulate the development of further research in this field.  summarizing the findings and providing recommendations, this study has the potential to make  significant contribution to the understanding and implementation policies to protect the rights of children and women regional level.

Abstract

Penelitian ini mengkaji permasalahan hukum terkait efektivitas penerapan Peraturan Menteri Keuangan (PMK) No. 96 Tahun 2023 jo. PMK No. 111 Tahun 2023 terhadap perkembangan UMKM di Kota Batam yang berstatus sebagai Kawasan Perdagangan Bebas dan Pelabuhan Bebas. Permasalahan utama yang diteliti adalah adanya ketidaksesuaian antara tujuan kebijakan yaitu melindungi industri dalam negeri dan mendorong produk lokal dengan dampak implementasinya yang justru dirasakan memberatkan oleh sebagian pelaku UMKM, khususnya yang mengandalkan barang impor dan bahan baku impor. Penelitian ini bertujuan untuk mengevaluasi sejauh mana regulasi tersebut mendukung keberlangsungan dan daya saing UMKM. Menggunakan metode penelitian hukum empiris, data diperoleh melalui wawancara, observasi, dan dokumentasi, serta dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa meskipun kebijakan ini memberikan keuntungan bagi UMKM berbasis produk lokal, seperti pembebasan bea masuk dan dukungan ekspor, pelaku usaha yang bergantung pada barang impor dan bahan baku impor mengalami penurunan omset dan peningkatan beban administrasi. Efektivitas kebijakan ini masih bersifat parsial dan perlu ditingkatkan melalui penyederhanaan regulasi, peningkatan literasi hukum, serta insentif yang inklusif. Dengan pendekatan yang lebih adaptif dan kolaboratif, kebijakan ini diharapkan dapat menciptakan ekosistem usaha yang adil, kompetitif, dan berkelanjutan di wilayah Batam.

Abstract

The rapid development of digital technology has significantly transformed various economic sectors, particularly through the emergence of digitized contracts, including electronic contracts and smart contracts. These innovations are especially impactful in the investment sector, providing enhanced speed, security, and efficiency. As the Indonesian economy becomes increasingly integrated with digital technology, the role of electronic and smart contracts becomes crucial, necessitating adaptations in the country’s legal framework. Indonesia's legal system has responded with regulatory reforms, such as amendments to the Electronic Information and Transactions Law, aiming to address the needs of the digital economy. However, the pace of legal adaptation has raised concerns, particularly regarding the timely recognition and support for smart contracts, which are poised to revolutionize investment practices by automating transactions and reducing the reliance on intermediaries. Despite efforts to regulate electronic systems, Indonesia’s legal politics have struggled to keep up with the demands of these technological advancements, leading to gaps in the legal support for digitized contracts. This paper analyzes the intersection of Indonesia’s legal politics and the evolving landscape of investment, focusing on how the legal framework can better accommodate the integration of electronic and smart contracts. The study emphasizes the need for a comprehensive legal structure that fosters the growth of digital investment, providing legal certainty and protecting stakeholders. Abstract

The relocation policy for residents of the Old Villages of Rempang and Galang in the context of developing Rempang Eco City raises serious issues in legal, social, and human rights aspects. This study aims to analyze the implementation of the relocation policy based on the approaches of Ius Constitutum and Ius Operatum, as well as to provide policy recommendations through the framework of Ius Constituendum. The method applied is empirical juridical with a qualitative approach, involving interviews with affected communities and NGOs, as well as a review of relevant legal regulations. The findings show that the relocation policy has not fulfilled the principles of public participation, the right to housing, and social justice, while also neglecting the principle of Free, Prior, and Informed Consent (FPIC), which is a standard in the protection of indigenous peoples. The relocation process is considered to lack transparency, compensation is disproportionate, and it fails to ensure the social and cultural sustainability of local communities. This study emphasizes the need for a human rights–based and justice-oriented relocation policy, referring to John Rawls’ Theory of Social Justice, by ensuring the protection of customary land rights, meaningful participation, and recognition of indigenous cultural identity. The reformulation of the relocation policy should be grounded in legal principles that are humanistic, participatory, and uphold substantive justice.

Abstract

One of the government programs, namely the Uninhabitable House Program (RTLH), aims to improve the standard of living of underprivileged communities, such as the Suku Laut community in Lingga Regency, Riau Islands Province. The purpose of this study is to determine the extent to which the RTLH program has been implemented and how it impacts the welfare of the Suku Laut community. By using semi-structured interview techniques, document analysis, and observation, an empirical legal research methodology is used. The research employs an empirical legal research method, utilizing semi-structured interviews, observations, and document studies as techniques. The findings indicate that the RTLH program has contributed to improvements in housing conditions, health, and access to basic facilities. However, challenges were identified in program implementation, such as uneven aid distribution and logistical issues that affect overall program effectiveness. Therefore, it is recommended that improvements be made in planning, transparency, and periodic evaluation to ensure that the program's benefits are comprehensively and sustainably experienced by the community.

Abstract

The aim of this research was to analyze legal problems that are hindering the process of intellectual property rights (IPR) transfer within the Indonesian legal system. This objective was achieved by employing the normative legal research method with a statutory approach while, utilizing secondary data. Accordingly, the secondary data used consisted of primary legal sources, including Law No. 30 of 2000 on Trade Secrets, Law No. 20 of 2016 on Trademarks and Geographical Indications, Law No. 28 of 2014 on Copyrights, Law No. 13 of 2016 on Patents, as well as relevant judicial decisions made within the Indonesian legal system, which enhanced the analysis. This research showed the problems that exist within the Indonesian legal system regarding the transfer of IPR and identified the contributing factors. Furthermore, from the analysis conducted, it was found that the Indonesian IPR legal framework is too complex and lacks harmony, specifically when it comes to the mechanisms involved in IPR transfer and the bureaucratic efficiency associated with these processes. This research serves the purpose of providing comprehensive literature for the development of better intellectual property laws, which are continuously being refined by the Indonesian government to protect and foster creativity in the economy of the country, thereby making it a more attractive prospect for capital. Unlike previous studies, this research placed significant emphasis on legal problems specifically hindering the process of IPR transfer and examined their impacts on actual IPR cases within the Indonesian legal system.
