Abstract

Institution Banking is a financial institution that has strategic value in a country's economy. To achieve the specified goals, the company will use procedures that are most appropriate to the activities carried out by the company, especially in providing credit to its customers. In banking practice, we will know that there are sequences of activities or processes that occur starting from the credit applicant seeking information at the bank until the withdrawal of the loan can be realized. To obtain a clearer picture, these activities can be classified into three stages, namely: those interested in credit seeking information, obtaining information, and receiving forms (forms for submitting credit applications) from the bank, those interested in credit filling in and submitting forms to until the credit application is approved by the bank, the credit applicant applies for the realization of a credit withdrawal and the credit granting bank will realize it and to realize the credit a credit agreement is made first, where in banking the credit agreement can be made by notarial deed and private agreement

Abstract

Pencemaran lingkungan akibat limbah industri menjadi persoalan serius yang mengancam kelestarian lingkungan dan kesehatan masyarakat. Latar belakang penelitian ini didasari oleh banyaknya kasus pencemaran lingkungan yang timbul akibat kurang optimalnya pengawasan serta ketegasan pemerintah dalam menerapkan kebijakan lingkungan. Penelitian ini bertujuan untuk menganalisis peran pemerintah dalam menanggulangi pencemaran lingkungan akibat limbah industri serta mengevaluasi efektivitas kebijakan dan penegakan hukum yang berlaku. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan mengkaji peraturan perundang-undangan yang relevan serta studi kepustakaan. Hasil penelitian menunjukkan bahwa pemerintah memiliki peran penting dalam pengawasan, penegakan hukum, pemberian sanksi, dan pembinaan terhadap pelaku industri. Namun, dalam praktiknya, masih ditemukan kelemahan dalam hal penegakan hukum dan kurangnya koordinasi antar lembaga terkait. Selain itu, rendahnya kesadaran hukum pelaku industri turut memperparah tingkat pencemaran. Kesimpulannya, upaya penanggulangan pencemaran lingkungan memerlukan peran aktif pemerintah yang tidak hanya bersifat represif tetapi juga preventif dan edukatif. Pemerintah perlu meningkatkan kapasitas pengawasan, memperketat izin lingkungan, serta mendorong pelaku industri untuk menerapkan prinsip pembangunan berkelanjutan dan tanggung jawab lingkungan secara konsisten.

Abstract

This study critically examines the authority of the Constitutional Court in conducting judicial review of Law No. 2 of 2014 on the Notary Position, analyzed through the perspectives of legal certainty and justice. Unlike previous studies that predominantly describe the Constitutional Court’s authority in general terms, this research specifically addresses the normative implications of Constitutional Court decisions on the regulation of the notary profession and the legal consequences arising therefrom. Employing a normative juridical method with statutory and case approaches, this study analyzes relevant legislation and several Constitutional Court decisions concerning the Notary Law. The findings reveal that while Constitutional Court decisions play a crucial role in safeguarding constitutional rights and providing legal certainty and justice for affected parties, they simultaneously expose a legal vacuum, particularly when granted petitions are not followed by adequate implementing regulations. This condition stems from the inherently passive nature of the Constitutional Court, which is constitutionally limited to reviewing laws without possessing legislative authority to formulate new norms. This study contributes theoretically by strengthening the discourse on the relationship between judicial review, legal certainty, and justice within the Indonesian constitutional system. Practically, it underscores the urgency of legislative responsiveness in addressing legal vacuums following Constitutional Court decisions to ensure the effective implementation of constitutional justice and prevent normative uncertainty in the regulation of notary positions.

Abstract

Background General: Asset disclosure through the LHKPN system serves as a transparency mechanism to prevent corruption among state officials. Background Specific: In practice, several officials report granted assets without authentic deeds, even though Indonesian civil law requires notarial or PPAT deeds for the legal validity of grants. Knowledge Gap: No comprehensive study has specifically examined the legal certainty of reporting grants without authentic deeds in the LHKPN system or its interaction with civil law and anti-corruption regulations. Aims: This study analyzes the legal status of grants made without authentic deeds under Indonesian law and evaluates the legal certainty of their reporting within the LHKPN. Results: Findings indicate that grants lacking authentic deeds do not fulfill the formal requirements of Articles 1666, 1682, and 1868 of the Civil Code, rendering them invalid and lacking evidentiary strength. Their inclusion in the LHKPN creates legal uncertainty regarding ownership legitimacy and the accuracy of verification by the Corruption Eradication Commission. Novelty: The study provides an integrated analysis connecting civil law, administrative anti-corruption mechanisms, and legal certainty theory to the issue of non-authentic grant reporting. Implications: Normative clarification and regulatory harmonization are required to ensure that grants reported in the LHKPN possess lawful foundations, strengthening transparency, accountability, and the integrity of state officials. Abstract

The Indonesian legal system is characterized by pluralism, where customary law exists alongside formal national law. Although customary law is normatively recognized, its integration into the national contract law system remains limited. This study aims, first, to analyze the normative integration of customary law and contract law in Indonesia; second, to compare the practice of customary law integration in Indonesia with Malaysia; and third, to formulate an ideal model for integrating customary law and contract law systems in the context of communal sanctions. The research employs normative legal methods with a threefold analytical approach are statutory, conceptual, and comparative. The findings indicate that, first, the integration of customary law into Indonesia’s contract law system is still primarily normative and not operational, as reflected in the application of the kasepekang sanction, which demonstrates a dualism between communal customary law and individualistic national contract law, resulting in legal uncertainty and potential injustice. Second, comparative analysis with Malaysia shows that although both countries recognize customary law, Indonesia lacks adequate operational mechanisms, whereas Malaysia implements constitutional, legislative, and judicial approaches that are more effective in contractual practice. Third, the ideal integration model in Indonesia requires transforming communal sanctions into mechanisms that are transparent, proportional, and restorative, aligned with human rights principles and contractual justice.

Abstract

In various cases related to environmental problems, usually industry is the most dominant subject as the mastermind that causes a decline in the quality of the environment in a certain area or community environment. This is inseparable from the economic activities of the community that are increasingly depleting natural resources. This can certainly be a trigger for disputes between industry and society. Awareness of the environment does not only create everything beautiful and clean, but here there is an obligation from every human being to respect and appreciate the rights of others and the surrounding life. However, often many people are less responsible in disposing of waste so that it is not uncommon to cause environmental pollution, which will later harm people around the industry. In the past, humans lived without worrying about disturbances or dangers that would cause air pollution, water pollution or environmental pollution by an industrial activity. But now, along with the development of science and technology, people often feel worried about the disruption of their lives. Even before technology developed, humans with their living environment felt more comfortable. But the development of the present era has presented many industries with all kinds of activities. One way to enforce environmental laws in order to have a deterrent effect is through civil law. However, often dispute resolution through civil is not popular with the Indonesian people, this is because the process takes a long time.

Abstract

A notary is a public official authorized to do authentic deeds and has other authorities as referred to in this Law or based on other laws. This study aims to determine how a notary’s authority and responsibility as a deed maker is towards parties who do not recognize the deed. This type of research uses a doctrinal type because it is concerned about justice and good faith and aims to review the Notary Office Law. The literature study that will be worked on is legal documents such as the Law on the Position of Notary Public, Jurisprudence regarding related cases, and the decision of the West Jakarta District Court No.547/Pdt.G/2021/PN.Jkt.Brt. Based on the results of this study, it is the authority of the notary as the maker of the deed against parties who do not recognize the deed, stating that both parties have agreed and agreed to and at this moment, make a Sale and Purchase Agreement and Power of Attorney with the agreed terms and conditions. The responsibility of a Notary in doing a deed is the responsibility of a Notary in doing an authentic deed due to negligence in doing a deed. The negligence, in this case, is if a Notary has done a deed not by the applicable regulations.

Abstract

A severe ecological crisis will occur if a group of humans exploit nature at will without heeding the applicable rules. This condition will endanger human survival. As a result, there will be environmental damage such as air, water and soil pollution. Environmental damage that occurs now is not only local, regional and national but already global. Damage that ultimately causes harm to human life and welfare itself. In addition to causing a decrease in the carrying capacity and capacity of the environment for human life and other creatures. Ecological intelligence and community empowerment play a very important role, especially in maintaining the sustainability and sustainability of the environment, through sensitivity, awareness, understanding, and critical thinking, it is expected to overcome the problems of environmental law issues while forming environmental ethics. This research uses a legal philosophy approach, namely reviewing the nature of ecological intelligence and its relation to community empowerment in the development of Environmental Law in Indonesia, as a support, a conceptual approach is used, namely by bringing up objects of interest in this research and presenting relevant concepts to be discussed. The text criticism method is also used as an analytical knife to conduct an examination, and provide reinforcing arguments. Through ecological intelligence it can understand the issues and problems of environmental law from the perspective of ecological balance and sustainability, understand the principles of ecology. Encourage critical thinking, creative problem solving and apply legal knowledge to new situations. Assess the impact or effect of human actions and applying technology on the environment. Provide care, empathy and respect for others and other living things. Appreciate differences in backgrounds, motivations, intentions in interacting according to a perspective of mutual respect for the value of cooperation; Committed to equality, justice, inclusiveness, and respect for all people, and able to adapt to the legal system both and that is the essence of Critical Legal Empowerment.

Abstract

Land registration is a process step in order to obtain legal land ownership status. In the process, land buying and selling needs to be done before a Land Deed Officials so that land registration can be carried out. The National Land Agency as the land registration center carries out the land registration process systematically. The form of land registration is the issuance of a land certificate, but not necessarily the issuance of a land certificate can explain that the land has a strong legal basis because in practice there are still problems with court land disputes. The purpose of this research is to find out the High Court Decision Number 323/PDT/2015/PT.BDG when viewed from the aspect of National Land Law and legal certainty for parties who hold proof of ownership of land rights (certificate) as well as the accountability of government institutions that issue land certificates that turn out to be problematic. The research method uses a normative legal approach with qualitative descriptive data analysis. The results of the study explain that although the system method used by the National Land Agency for land registration is in accordance with Government Regulation Number 24 of 1997 concerning Land Registration, however, the physical data and documents that are required for land registration are still not in accordance so that the land certificate which should be the basis for land ownership turns out to cause conflict in the field because the area of the land does not match the area of the adjoining land.

Abstract

General Background: Loan agreements secured by land certificates remain highly vulnerable to civil disputes in Indonesia, particularly when executed without authentic deeds and registered mortgage rights. Specific Background: The dispute examined in Wonosari District Court Decision Number 44/Pdt.G/2021/PN Wno involved a loan agreement valued at IDR 1,750,000,000 secured by eight Certificates of Ownership and formalized solely through an underhand deed without notarial involvement or Mortgage Right registration. Knowledge Gap: Previous discussions on Indonesian contract law have insufficiently emphasized the preventive legal function of Notaries in protecting creditors through authentic deeds and executory guarantees in high-value financial transactions. Aims: This study analyzes the validity of underhand loan agreements, the application of the good faith principle, and the legal consequences arising from the absence of the Notary’s preventive function and unregistered mortgage rights. Results: The findings demonstrate that the agreement remained legally valid under Article 1320 of the Civil Code; however, the absence of an authentic deed substantially weakened the creditor’s evidentiary position and eliminated executory rights over the collateral. The court applied the principle of good faith to establish debtor default but reduced the creditor’s claimed interest from IDR 1.28 billion to IDR 58.6 million and rejected the penalty claim. Novelty: This study highlights the cumulative legal losses caused by the absence of preventive notarial protection in mortgage-based lending transactions. Implications: The findings underline the necessity of authentic deeds, registered mortgage rights, and preventive notarial supervision to strengthen legal certainty and creditor protection in Indonesian financial agreements. Highlights: Unregistered collateral eliminated executory rights over eight land ownership certificates. Good faith doctrine supported judicial recognition of debtor default in civil litigation. Interest recovery was drastically reduced because contractual evidence lacked formal authentication.
