Abstract

Studi ini mengkaji fungsi penyusunan kontrak dalam menghindari konflik pada perjanjian kemitraan usaha (joint venture) berskala UMKM. Masalah yang kerap timbul dalam praktik kerjasama usaha UMKM adalah ketidakjelasan isi kontrak yang mengakibatkan perbedaan interpretasi di antara pihak-pihak dan berujung pada perselisihan. Situasi ini semakin rumit karena pelaku usaha kecil cenderung tetap bergantung pada kepercayaan atau kesepakatan tidak resmi tanpa adanya kontrak yang jelas. Studi ini menerapkan metode penelitian hukum normatif dengan pendekatan konseptual dan legislasi melalui analisis pustaka. Temuan penelitian menunjukkan bahwa penyusunan kontrak memiliki peranan krusial dalam memberikan kepastian hukum, mengatur hak dan kewajiban pihak-pihak secara adil, serta mencegah kemungkinan konflik melalui formulasi klausul yang jelas seperti pembagian keuntungan, kontribusi para pihak, wanprestasi, force majeure, dan penyelesaian sengketa. Di samping itu, penyusunan kontrak juga berperan sebagai alat pengelolaan risiko hukum yang dapat meminimalkan ketidakpastian dalam pelaksanaan kerjasama usaha. Dengan kata lain, semakin tinggi kualitas kontrak yang disusun, semakin rendah kemungkinan terjadinya sengketa dalam kerjasama UMKM, sehingga kelangsungan usaha bisa lebih terjamin.

Abstract

This study aims to analyze the legal status of joint property that has not been divided after divorce when one of the parties passes away, as well as to examine the judge’s ratio decidendi in Decision No. 520/Pdt.G/2022/PN.DPS concerning the distribution of joint property and inheritance. The research method used is normative juridical research with statutory, conceptual, and case approaches. Legal materials were obtained through library research and analyzed qualitatively using legal interpretation methods. The novelty of this study lies in the analysis of the relationship between the distribution of joint property after divorce and the distribution of inheritance in childless marriages, particularly when the joint property has not been separated before one party dies. Based on the results of the study, it is concluded that joint property must first be separated before the inheritance distribution is carried out. The analysis of Decision No. 520/Pdt.G/2022/PN.DPS shows that the judges recognized the existence of joint property and the rights of the second ex-wife; however, the direct division into two portions was not fully in accordance with the legal construction of the Civil Code because the joint property should first have been separated, after which the deceased’s share should have been proportionally distributed among the heirs in order to ensure legal certainty and justice for the parties.

Abstract

Sexual violence against women remains a persistent socio-legal problem in Indonesia despite the enactment of Law Number 12 of 2022 on Sexual Violence Crimes (UU TPKS). This study aims to analyse the implementation of the UU TPKS in Simalungun Regency and examine the role of Habonaron Do Bona in strengthening victim-centred socio-legal protection within an integrative legal framework. This study employs a socio-legal research design combining normative juridical analysis of UU TPKS, particularly Articles 66–70 on victim rights, restitution, and recovery, with empirical qualitative data obtained through interviews, field observations, and document analysis involving law enforcement officers, customary leaders, legal practitioners, and victim support actors. The findings show weak implementation of UU TPKS at the local level. Restitution mechanisms under Articles 67–70 are rarely applied, resulting in minimal compensation for victims due to procedural barriers and limited law enforcement facilitation. Victim recovery rights under Article 66 are also not effectively implemented because psychosocial and medical services remain fragmented. Informal settlement practices persist, reducing access to formal justice. Patriarchal norms, stigma, and community pressure drive low reporting rates. Empirically, Habonaron Do Bona reflects values of truth and justice but is often interpreted to prioritise social harmony over victim protection. The study’s novelty lies in empirically repositioning local wisdom within an integrative socio-legal model that connects legal pluralism with state victim protection mechanisms. The findings imply the need to strengthen restitution enforcement, integrate recovery services, and develop culturally sensitive prevention strategies. The study is limited to one region and qualitative data, suggesting the need for comparative future research.

Abstract

Krisis sampah plastik menjadi isu global dan nasional yang semakin mendesak, mendorong lahirnya Global Plastics Treaty (GPT) dengan prinsip pencemar membayar, ekonomi sirkular, dan Extended Producer Responsibility (EPR). Di Indonesia, meskipun telah ada regulasi seperti Undang-Undang Nomor 18 Tahun 2008 dan Peraturan Presiden Nomor 97 Tahun 2017, masih terdapat kesenjangan dengan standar global, terutama dalam implementasi dan pengawasan. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan komparatif untuk menganalisis regulasi nasional dan membandingkannya dengan praktik di negara lain. Hasil penelitian menunjukkan bahwa permasalahan utama terletak pada lemahnya implementasi, kurangnya integrasi kebijakan, serta belum optimalnya tanggung jawab produsen. Oleh karena itu, diperlukan penguatan regulasi, harmonisasi dengan standar internasional, serta peningkatan pengawasan dan partisipasi berbagai pihak guna meningkatkan efektivitas pengelolaan limbah plastik di Indonesia.

Abstract

Abstrak Sungai Ciliwung merupakan salah satu sungai terpanjang di Indonesia, sungai tersebut membentang melewati daerah Bogor di Jawa Barat Hingga ke Jakarta Utara DKI Jakarta, dibalik kemegahan dari sungai Ciliwung terdapat permasalahan pencemaran yang mengintai dan amat sangat berbahaya apabila dibiarkan secara terus menerus, permasalahan pencemaran ini terjadi akibat kebiasaan-kebiasaan masyarakat membuang limbah dan sisa hasil residu kegiatan industri ke dalam aliran sungai Ciliwung sehingga pencemaran tersebut tidak dapat terhindarkan, dalam tulisan ini pembahasan meliputi mengenai bagaimana regulasi yang mengatur mengenai pencemaran daerah aliran sungai dan juga mengatur mengenai dampak akibat terjadinya pencemaran di aliran air sungai Ciliwung serta membahas mengenai efektifitas dari ditegakkannya hukum dalam memberantas pencemaran yang terjadi di Sungai Ciliwung, kajian ini dibahas dengan menggunakan teori yuridis normatif dan mengambil sumber-sumber data dari beberapa sumber primer dan sekunder dalam tersusunnya jurnal ilmiah ini. Abstract

Although integrated marriage validation (itsbat nikah) services are available to Indonesian migrant workers (PMI) in Sarawak, Malaysia, some participants still need information regarding court procedures, the function of marriage registration, family documents, and the protection of civil rights. This Community Service activity aims to strengthen PMI’s legal literacy through media-based legal education as a complement to the integrated marriage validation hearings at the Consulate General of the Republic of Indonesia (KJRI) in Kuching, with evaluation indicators including understanding of marriage validation procedures, perceptions of legal certainty, and the benefits of integrated services. The activity was conducted on December 4-8, 2025, by a collaborative Community Service (PKM) team from Panca Bhakti University in Pontianak, Tarumanagara University in Jakarta, and Sahid University in Jakarta, involving 102 Indonesian migrant worker couples. The activity employed an educational-participatory approach through observation, educational reporting, brief interviews, discussions, legal consultations, the distribution of brochures, and evaluation via questionnaires. The results of the activity showed that 77 applications for itsbat nikah (75.5%) were granted, 5 applications (4.9%) were rejected, and 20 applications (19.6%) were dismissed. As part of the PKM activities, a post-activity evaluation of 60 respondents showed that 87% fell into the “understand” and “fully understand” categories regarding the marriage validation procedure, 92% gave a positive assessment that marriage legalization provides legal certainty, and 93% assessed that the integrated service benefits families. The evaluation results indicate that media-based legal education can complement marriage registration services by providing more contextual and communicative information. This mentoring model can be developed as part of legal services for Indonesian migrant workers at Indonesian diplomatic missions abroad.Penguatan Literasi Hak Sipil Pekerja Migran Indonesia melalui Edukasi Hukum Berbasis Media pada Sidang Itsbat Nikah Terpadu di SarawakABSTRAKMeskipun layanan sidang itsbat nikah terpadu telah tersedia bagi Pekerja Migran Indonesia (PMI) di Sarawak, Malaysia, sebagian peserta masih memerlukan informasi mengenai prosedur persidangan, fungsi pencatatan perkawinan, dokumen keluarga, dan perlindungan hak sipil. Kegiatan Pengabdian kepada Masyarakat ini bertujuan memperkuat literasi hukum PMI melalui edukasi hukum berbasis media sebagai pendamping sidang itsbat nikah terpadu di Konsulat Jenderal Republik Indonesia (KJRI) Kuching, dengan indikator evaluasi meliputi pemahaman prosedur itsbat nikah, persepsi terhadap kepastian hukum, dan manfaat pelayanan terpadu. Kegiatan dilaksanakan pada 4-8 Desember 2025 oleh tim PKM kolaborasi dari Universitas Panca Bhakti Pontianak, Universitas Tarumanagara Jakarta, dan Universitas Sahid Jakarta dengan sasaran 102 pasangan PMI. Kegiatan menggunakan pendekatan edukatif-partisipatif melalui observasi, peliputan edukatif, wawancara singkat, diskusi, konsultasi hukum, pembagian brosur, dan evaluasi melalui angket. Hasil kegiatan menunjukkan bahwa 77 permohonan itsbat nikah (75,5%) dikabulkan, 5 permohonan (4,9%) ditolak, dan 20 permohonan (19,6%) dinyatakan gugur. Dalam rangkaian kegiatan PKM tersebut, evaluasi pascakegiatan terhadap 60 responden menunjukkan bahwa 87% berada pada kategori paham dan sangat paham terhadap prosedur itsbat nikah, 92% memberikan penilaian positif bahwa legalisasi perkawinan memberikan kepastian hukum, dan 93% menilai pelayanan terpadu memberikan manfaat bagi keluarga. Hasil evaluasi menunjukkan bahwa edukasi hukum berbasis media dapat melengkapi pelayanan itsbat nikah dengan penyampaian informasi yang lebih kontekstual dan komunikatif. Abstract

Land disputes in Indonesia often arise from conflicting claims over property certificates, exacerbated by informal proofs like Leter C. This study analyzes the Bandung High Court’s ruling (Decision No. 444/PDT/2024/PT BDG) on an unlawful acts lawsuit challenging the issuance of certificates allegedly misappropriating ancestral land. The research aims to assess the court’s adherence to agrarian laws (UUPA, PP 24/1997) and evaluate the plaintiffs’ failure to prove ownership via certificates. The research used a normative juridical approach, combining statute, conceptual, and case analyses of primary legal materials (court rulings, UUPA) and secondary literature. The court rightly dismissed the lawsuit, affirming certificates as sole valid proof of ownership under Article 19 UUPA. Plaintiffs’ reliance on Leter Ccontravened Supreme Court jurisprudence (No. 023K/PDT/1992), highlighting the need for administrative resolution via BPN before litigation. Strengthens legal certainty in land disputes but underscores systemic inefficiencies in BPN’s mediation. Future research should optimize BPN’s dispute mechanisms and harmonize judicial-administrative coordination.

Abstract

Ideally, the regulation of guardianship in Article 9 paragraph (1) letter b of Law Number 2 of 2014 concerning the Position of Notaries is designed to ensure that notaries possess adequate mental and professional capacity before performing their duties or being temporarily suspended. However, in reality, a normative gap exists: the definition of guardianship still relies on classical civil law, independent medical verification guidelines are absent, and administrative procedures are often subjective, risking violations of administrative justice principles. This study aims to analyze the legal construction of guardianship and to formulate a new interpretative model that integrates legal perspectives, administrative practices, and evidence-based decision medical verification. The study employs a qualitative library research methodology. Primary sources include the Notary Law, Civil Code, and legal doctrines, while secondary sources consist of scientific journals, policy reports, and contemporary psychiatric literature. Data analysis was conducted through content analysis and comparative methods, validated using literature triangulation. The findings suggest that guardianship should be assessed based on contextual functional capacity rather than normative status, allowing temporary suspension to be applied fairly, proportionally, and based on evidence, thereby enhancing the legitimacy of the Notary Law and protecting the notary profession.

Abstract

The limitations placed on the authority of interim Regional Heads, as outlined in Indonesian Law Number 23 of 2014 on Regional Governance, present significant challenges to the continuity of strategic decision-making during leadership transitions. The ambiguity surrounding the scope of interim authority often results in stagnation in public policy implementation, adversely impacting regional development and governance. This study examines the philosophical underpinnings and legal foundations of interim authority, while also evaluating the tangible effects of these limitations on the functioning of regional government. Utilizing a normative legal methodology that incorporates both statutory and conceptual approaches, this research is grounded in a thorough review of primary and secondary legal sources. The findings indicate that interim authority should be viewed as a constitutional mandate designed to ensure the seamless operation of government, despite its temporary nature. However, in practice, stringent normative constraints can lead to a significant leadership vacuum and create opportunities for political interference. These findings underscore the necessity for regulatory reform that provides interim Regional Heads with appropriate flexibility in making strategic decisions, all while maintaining the principles of accountability and oversight. Such policy reforms are essential for sustaining an effective and responsive regional government in the face of political dynamics and leadership transitions.

Abstract

Penelitian ini bertujuan untuk menganalisis pengaruh perubahan Undang-undang Cipta Kerja terhadap penyederhanaan perizinan Andalalin di indonesia dimana terdapat pergeseran paradigma dari sistem perizinan yang dahulunya administratif-birokratis menjadi sistem yang berbasis resiko (Online Single Submission-Risk Based Approach). Penelitian ini menggunakan Penelitian pendekatan kualitatif dengan metode wawancara dengan para pihak pengembang (pemrakarsa) yang sedang melakukan pengajuan permohonan Andalalin baik itu dari kegiatan infrastruktur yang akan dibangun/dioperasikan/dikembangkan, baik itu pengajuan permohonan untuk kewenangan pada Kementerian Perhubungan untuk status jalan Nasional, Dinas Perhubungan Kota/ Kabupaten untuk status jalan Kota/Kabupaten, dan Balai Pengelola Transportasi Darat (BPTD) untuk status jalan provinsi. This study aims to analyze the impact of the Job Creation Law on the simplification of Andalalin (Traffic Impact Analysis) licensing in Indonesia, where there has been a paradigm shift from a previously administrative-bureaucratic licensing system to a risk-based system (Online Single Submission - Risk Based Approach (OSS-RBA)). This research uses a qualitative approach with an interview method involving developer parties (project initiators) who are in the process of applying for Andalalin - including applications for infrastructure to be built, operated, or developed - covering submissions under the authority of the Ministry of Transportation for national roads, the City/District Transportation Agency for city/district roads, and the Regional Land Transport Management Authority (BPTD) for provincial roads.
