Abstract

Penelitian ini mengkaji konstruksi pertanggungjawaban pidana notaris dalam pembuatan akta otentik yang didasarkan pada dokumen tidak sah, dengan berfokus pada Putusan Mahkamah Agung Nomor 379 K/Pid/2021. Persoalan mendasar yang dikaji adalah ketegangan antara doktrin kebenaran formil yang membatasi tanggung jawab notaris hanya pada aspek formal akta, dengan realitas praktik peradilan yang berpotensi memperluas pertanggungjawaban notaris hingga ranah pidana. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa: (1) tanggung jawab notaris terhadap keabsahan dokumen dalam akta autentik peralihan hak atas tanah dibatasi oleh doktrin kebenaran formil, namun prinsip kehati-hatian menuntut notaris untuk melakukan verifikasi kelayakan formal dokumen; (2) dalam putusan tersebut, hakim mengkonstruksi pertanggungjawaban pidana notaris berdasarkan unsur kesengajaan dan keterlibatan aktif dalam penggunaan dokumen yang tidak sah; (3) penerapan pertanggungjawaban pidana tersebut belum sepenuhnya selaras dengan batasan kewenangan jabatan notaris sebagaimana diatur dalam Undang-Undang Jabatan Notaris. Penelitian ini merekomendasikan perlunya perumusan batas tanggung jawab notaris yang lebih jelas guna menciptakan kepastian hukum yang proporsional.

Abstract

Asset tracking and confiscation of assets from corruption crimes committed by three law enforcement agencies have not shown satisfactory results. This study uses a normative legal research method (doctrinal legal research) with a primary focus on corruption cases. This research method was adopted because the payment of Replacement Money in corruption cases has not been fully implemented optimally. Many corruption cases still impose additional penalties in the form of Replacement Money, and corruptors transfer assets to third parties before the state confiscates them. This study uses 3 (three approaches, namely the conceptual approach, the statutory approach, and the case approach. The results of this study indicate that the payment of Replacement Money in corruption cases aims to recover state losses by ratifying Law Number 7 of 2006 on the Ratification of the United Nations Convention on the Eradication of Corruption, 2003. This is done to implement a reverse-verification process for prospective officials before they take office. The practice of paying compensation in corruption cases, which are economic crimes, should prioritise fines or similar penalties. If the perpetrator of corruption fails to pay the fine or compensation, law enforcement (prosecutors), as the implementing agency, will form a team to track down the embezzled assets and seize them to compensate the state for losses.

Abstract

The current environment has been exploited without consideration or regard for sustainability and ecological balance. Forests have been plundered and burned, natural resources have been depleted without any effort to replenish them, and development in many cities has ignored spatial planning. All of these actions have ultimately resulted in severe environmental degradation. The decline in the carrying capacity and capacity of the environment, pollution and destruction of the environment, climate change, deforestation, and damage to terrestrial and marine ecosystems have become serious threats to the survival of humans and other living creatures. The issue examined in this paper is how to revive public understanding and awareness (participation) of the law in preserving the function of the environment. This paper uses a philosophical and legal hermeneutic approach, which is to look at the fundamental side using the method of text criticism, which refers to how the grand discourse on environmental law is criticized through several main references. Through this approach and method, it is hoped that the Green Ecology Quitionent (GEQ) model concept can be developed based on cosmic religious environmental law. Cosmic religion is a fundamental concept of diverse local wisdom possessed by Indonesian society. This model concept is expected to become a reference or starting point for the development of environmental policy, environmental education, law enforcement, management, and preservation of environmental functions in Indonesia.

Abstract

This article examined the emerging concept of sustainability collaboration within Indonesia's competition law framework, highlighting the need to reconcile environmental sustainability with effective market competition. Indonesian competition law, particularly Law No. 5 of 1999, traditionally prohibited horizontal agreements under a rigid approach, whereas global developments increasingly recognized sustainability agreements that generated long-term consumer welfare. This study employed normative legal research with a comparative approach, using the regulatory frameworks of the European Union and the United Kingdom as benchmarks. The analysis identified a significant regulatory gap in Indonesia, where Article 50 of Law No. 5 of 1999 did not accommodate environmental efficiencies such as carbon reduction and sustainable supply chains. To address this gap, the study proposed revitalizing the public interest exception, adopting a dedicated KPPU Regulation on Sustainability Agreements, and introducing an open door policy to provide greater legal certainty for businesses. It concluded that shifting toward a long-term consumer welfare standard was essential to support both competitive markets and sustainable economic development in Indonesia.

Abstract

Land disputes involving factual possession without formally recognized rights remain a significant challenge to legal certainty in Indonesia, particularly when physical occupation conflicts with a registered land right. Differences in judicial assessment of documentary evidence, factual possession, and applicable legal principles may produce inconsistent outcomes and weaken the predictability of land dispute resolution. This study examines how judicial reasoning shapes the resolution of disputes involving factual possession without formally recognized rights and assesses its contribution to legal certainty. The study employs a normative legal method using statutory, conceptual, and case approaches. It examines the legal status of factual possession, the evidentiary position of registered land rights, and the judicial reasoning reflected in Medan High Court Decision Number 100/PDT/2024/PT MDN. The findings show that differences in judicial reasoning can produce divergent legal outcomes when courts assign different weight to formal land documents, physical possession, and procedural considerations. The study also finds that insufficiently reasoned judicial decisions may weaken the predictability of land dispute resolution and create uncertainty for both registered rights holders and factual occupants. The study concludes that courts require a coherent and transparent reasoning framework to reconcile formal land rights with relevant factual circumstances while maintaining consistency, fairness, and legal certainty.

Abstract

This article analyzes the forms and effectiveness of legal protection for good-faith buyers in the purchase of uncertified land through notarial deeds and evaluates the legal validity of such deeds within Indonesia’s land law framework. The study is grounded in the urgency created by the widespread circulation of uncertified land, which generates legal uncertainty and exposes buyers to a high risk of disputes due to the absence of registered ownership. Using a normative juridical method with statutory and conceptual approaches, supported by analysis of Denpasar High Court Decision No. 75/Pdt/2016/PT.DPS, this research demonstrates that notarial deeds in uncertified land transactions possess only obligatory power and cannot serve as constitutive evidence for the transfer of rights, which falls under the authority of PPAT pursuant to Government Regulation No. 24 of 1997. The findings reveal that preventive and repressive legal protection remains limited as long as the land has not been registered, thereby requiring notaries to apply the prudential principle through document verification and disclosure of legal risks. The novelty of this study lies in its integrated analysis of notarial authority, deed validity, and legal protection mechanisms for good-faith buyers in uncertified land transactions, offering a conceptual foundation for agrarian and notarial law reform in the digital era.   Artikel ini menganalisis bentuk dan efektivitas perlindungan hukum bagi pembeli beriktikad baik dalam transaksi jual beli tanah belum bersertifikat melalui akta notaris serta menilai keabsahan akta tersebut dalam kerangka hukum pertanahan Indonesia. Penelitian ini dilatarbelakangi oleh maraknya tanah yang belum terdaftar sehingga menimbulkan ketidakpastian hukum dan meningkatkan potensi sengketa akibat tidak adanya bukti hak yang kuat. Dengan menggunakan metode yuridis normatif melalui pendekatan perundang-undangan dan konseptual yang diperkuat analisis Putusan Pengadilan Tinggi Denpasar Nomor 75/Pdt/2016/PT.DPS, penelitian ini menunjukkan bahwa akta notaris dalam transaksi tanah belum bersertifikat hanya memiliki kekuatan obligatoir dan tidak dapat dijadikan dasar konstitutif pemindahan hak yang merupakan kewenangan PPAT berdasarkan PP Nomor 24 Tahun 1997. Hasil penelitian mengungkapkan bahwa perlindungan hukum baik preventif maupun represif masih terbatas selama tanah belum didaftarkan, sehingga notaris wajib menerapkan prinsip kehati-hatian melalui verifikasi dokumen dan pemberian penjelasan mengenai risiko hukum. Kebaruan penelitian ini terletak pada integrasi analisis mengenai peran notaris, keabsahan akta, dan perlindungan hukum pembeli beriktikad baik dalam transaksi tanah belum bersertifikat sebagai kontribusi terhadap pembaruan hukum agraria dan kenotariatan di era digital.
