Abstract

This paper aims to provide a view regarding NFT transactions in the future to provide legal certainty, especially for IPR by using normative research methods along with supporting theories to find that in fact NFT transactions in Indonesia are far from legal because they do not meet the rules of NFT transactions where PTSE regulations, especially NFT transactions, do not provide legal guarantees to their owners, one of which is the chain of suppliers, namely Opensea, which is not yet optimal, so there is a need for regulations or crypto exchanges, especially NFTs, which not only provide certainty but the crypto market in Indonesia does not experience scams because in terms of analysis NFTs can be categorized as inherity distinctives or as signs that inherently have distinguishing power, immediately if they get protection through use, because some parties often cheat by taking screenshots, but for parties who make legitimate transactions, they have a differentiating way of gaining access to increasing the digitalization of works has reduced the potential value of copyright scarcity, which has become a significant problem in copyright disputes.

Abstract

The implementation of the European Union Deforestation Regulation (EUDR) has had a significant impact on Indonesia’s palm oil exports to the European Union market. This policy mandates compliance with sustainability and traceability standards, as well as guarantees that traded products no longer originate from deforestation practices. This poses legal and economic challenges for businesses. This study examines how the Indonesian Sustainable Palm Oil (ISPO) certification legal framework promotes sustainable palm oil business practices in Indonesia, as well as the differences in standards between ISPO and the EUDR that could Email potentially lead to legal consequences regarding legal certainty for Indonesian palm oil businesses in the global market. This study employs a normative legal approach with a comparative analysis of national and international regulations. The findings indicate that the ISPO legal framework under Presidential Regulation No. 16 of 2025 which includes seven sustainability principles remains stagnant at 31% coverage due to high costs and a lack of incentives. There are substantial gaps between ISPO and the EUDR in four key areas: definitions of forest and deforestation, geolocation data requirements, deforestation time limits, and the protection of indigenous peoples’ rights through the Free, Prior, and Informed Consent (FPIC) mechanism. This gap creates legal uncertainty for businesses and threatens approximately US$3.2 billion in annual exports to the European Union market. This study recommends the need to harmonize legal definitions in line with international standards, particularly those of the FAO and the EUDR, the integration of a geolocation-based traceability system, the strengthening of protection for the FPIC principle within ISPO regulations, the provision of support and incentives for smallholders to meet sustainability standards, and the strengthening of Indonesia’s economic diplomacy to expand international acceptance and recognition of ISPO certification as an instrument for sustainable palm oil governance.   Keywords: Indonesian Sustainable Palm Oil (ISPO), European Union Deforestation Regulation (EUDR), Sustainable Business, Legal Certainty, Global Market Access

Abstract

Industri perfilman merupakan bagian penting dari ekonomi kreatif, baik di tingkat internasional maupun nasional.  Hak moral dan ekonomi yang terkandung dalam hak cipta melindungi film serta nilai artistiknya. Banyak orang menjadi korban pembajakan film di TikTok seiring dengan meningkatnya peredaran film bajakan. Artikel ilmiah ini menggunakan penelitian Yuridis Normatif untuk menyelesaikan permasalahan hukum. Penelitian ini menemukan bahwa aplikasi TikTok memungkinkan pengguna untuk melaporkan video yang melanggar hak cipta. Sayangnya, banyak pengguna TikTok membiarkan klip film tersebut tersebar luas, sehingga menyulitkan pengawasan terhadap unggahan film curian. Namun, TikTok merupakan perangkat lunak hiburan yang mendorong pengguna untuk menonton film tanpa izin. Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta mengatur kepastian hukum pemegang hak cipta atas pelanggaran film TikTok berdasarkan Pasal 113 ayat (3), Pasal 113 ayat (4), Pasal 95, Pasal 96, Pasal 97, Pasal 98, dan Pasal 99. Pasal 80 Undang-Undang Perfilman tidak berlaku untuk pelanggaran klip film TikTok. Meskipun terdapat undang-undang hak cipta sinematografi, namun  kesadaran publik akan pelanggaran hak cipta masih rendah karena pemerintah tidak memberikan pendidikan yang cukup tentang masalah ini.

Abstract

Kasus Bake n Grind yang viral terkait klaim produk “gluten free” yang tidak benar menimbulkan perhatian publik mengenai pentingnya kepatuhan produsen terhadap prinsip hukum dan transparansi informasi. Penelitian ini membahas kasus tersebut melalui perspektif asas kepastian hukum, yang menekankan bahwa hukum harus jelas, tegas, dan konsisten sehingga hak dan kewajiban produsen dan konsumen terlindungi. Analisis mencakup tanggung jawab Bake n Grind dalam bentuk perdata, administratif, moral/etis, dan potensi pidana, serta upaya penyelesaian yang telah dilakukan melalui klarifikasi, komunikasi dengan konsumen, dan pengawasan BPOM. Hasilnya menunjukkan bahwa kepatuhan terhadap asas kepastian hukum sangat penting untuk melindungi konsumen, menjaga reputasi produsen, dan menegakkan standar hukum dalam industri pangan. Kasus ini menjadi pelajaran bagi produsen untuk selalu menyediakan informasi yang akurat dan jujur mengenai produk yang ditawarkan.

Abstract

This research seeks to examine a Patent regulation in the form of a Non-Fungible Token (NFT-Patent) in Indonesia. The implementation of NFT-Patent is intended to overcome the problems of patent management in Indonesia, such as the long and expensive bureaucratic process of patent, the absence of an integrated patent commercialization ecosystem, and the existence of a legal vacuum regarding the valuation mechanism of a patent. This research aims to answer a formulation of the problem related to how the model of NFT-Patent regulation through the online marketplace in Indonesia. The analysis of the problem formulation will start by comparing Non-Fungible Token (NFT) regulations in Indonesia with other countries, followed by conceptualizing the transfer of ownership rights from NFT-Patent carried out through an online marketplace, then end by formulating the regulation of the NFT-Patent online marketplace in the statutory regulations in Indonesia. By combining doctrinal research methods and reform-oriented research, this study found that based on Indonesia's positive law, NFT is categorized as a crypto commodity which is an object of tax and BKP. On the contrary, the United States sees NFT as conventional IPR in digital form for tax purposes. NFT-Patent is categorized as an intangible movable object whose transaction is considered valid as long as it meets the provisions of Article 1320 of the Civil Code and Article 46 paragraph (2) of the Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems. In its implementation, a transition process is carried out with several stages. The transition stages are regulated in the Regulation of the Minister of Law and Human Rights with the Directorate General of Intellectual Property as the manager. If most of the transition process has been running, the government needs to update the 2016 Patent Law by implementing the Separation Principle by separating the purpose of using inventions into 3, namely consumption, production, and innovation. Ultimately, this research recommends the government to regulate NFT specifically, synergize with blockchain-based Patent ecosystem development companies and encourage collaboration between universities and industrial companies in developing Patents.

Abstract

Algoritma pembelajaran mesin dalam menciptakan karya menjadi permasalahan dalam menilai orisinalitas terhadap karya lagu dan/atau musik yang dihasilkan artificial intelligence dalam lingkup hak cipta. Penelitian ini bertujuan untuk mengetahui tentang pengaturan terkait orisinalitas lagu dan/atau musik yang ada dalam ketentuan nasional maupun internasioal terhadap pemanfaatan artificial intelligence dalam lingkup hak cipta. Penelitian menggunakan metode yuridis normatif dengan pendekatan perundang-undangan terkait pengaturan hak cipta, Pendekatan konseptual, dan pendekatan perbandingan. Hasil penelitian menunjukkan bahwa tidak ditemukan batasan orisinalitas yang pasti dalam ketentuan hukum internasional terkait hak cipta, sedangkan Indonesia memuat batasan orisinalitas terhadap lagu dan/atau musik yang termuat dalam undang-undang No.28 Tahun 2014 tentang hak cipta. Adapun ketentuan yang ada belum memadai dalam memberikan perlindungan lagu dan/atau musik yang dihasilkan artificial intelligence layaknya beberapa negara yang telah membentuk konsepsi perlindungan dalam menilai permasalahan terkait orisinalitas. Pembentukan peraturan dan pertegasan batas orisinalitas menjadi hal yang perlu untuk dimuat dalam peraturan di Indonesia guna mendukung perkembangan teknologi artificial intelligence.

Abstract

The development of information technology has driven the transformation of the General Meeting of Shareholders (GMS) mechanism from face-to-face to electronic (e-GMS). This is intended to eliminate the constraints of distance and location between shareholders. This phenomenon places notaries in a crucial position as cyber notaries to ensure the authenticity and legal certainty of the minutes of meetings held online. The authority of notaries, expressly stated in the UUJN, still emphasizes conventional processes, while notaries are also required to adapt to developments in information technology. In addition, notaries are also required to apply the prudent notary principle, which requires notaries to act with integrity, honesty, and thoroughness in verifying the identity, competence, and accuracy of the parties' statements to prevent legal defects in authentic deeds. This study aims to analyze the implementation of the cyber notary concept in the implementation of e-GMS, identify the technical and legal obstacles faced by notaries, and evaluate legal protection for notaries in exercising their authority.

Abstract

This study aims to examine the regulatory framework of the Quick Response Code Indonesian Standard (QRIS) as a legal instrument that strengthens Indonesia’s digital payment system and promotes its integration within the ASEAN region. The research employs a normative legal method using qualitative-descriptive analysis, based on a review of legal regulations, academic sources, and empirical data related to QRIS implementation at both national and regional levels. The findings reveal that the regulations issued by Bank Indonesia and the Ministry of Finance have provided a robust legal basis for ensuring efficiency and security in Indonesia’s digital payment ecosystem. Furthermore, the cross-border payment collaboration between Indonesia and Thailand serves as evidence of QRIS’s potential to enhance cross-border economic transactions and reinforce Indonesia’s role in regional digital diplomacy. The discussion emphasizes that strengthening the legal framework, data protection, and cybersecurity is essential to maintaining QRIS’s sustainability amid global digital transformation. Overall, QRIS acts not only as a digital payment instrument but also as a manifestation of national economic sovereignty, fostering efficiency, inclusivity, and competitiveness in the global digital economy.

Abstract

Penelitian ini mengkaji perlindungan hukum dan mekanisme pewarisan hak cipta atas aset digital, seperti avatar, aset game, dan token non-fungible (NFT), yang secara hukum diakui sebagai karya yang dilindungi hak cipta berdasarkan hukum Indonesia. Penelitian ini berfokus pada bagaimana hak cipta, khususnya hak ekonominya, dapat dialihkan atau diwariskan kepada ahli waris berdasarkan ketentuan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Meskipun undang-undang tersebut secara eksplisit mengizinkan pengalihan hak cipta melalui warisan, hibah, wasiat, perjanjian tertulis, atau cara hukum lainnya, penerapannya pada aset digital tidak berwujud dan berbasis blockchain masih menghadapi tantangan regulasi dan teknis. Penelitian hukum ini menggunakan metode yuridis normatif dengan pendekatan statuta dan pendekatan konseptual. Pendekatan statuta digunakan untuk menganalisis hukum dan peraturan yang ada seperti Undang-Undang Hak Cipta, KUHP, dan Hukum Warisan Islam, sedangkan pendekatan konseptual mengeksplorasi pemahaman hukum tentang pewarisan aset digital dan status hak kekayaan intelektual di lingkungan virtual. Studi ini menyimpulkan bahwa meskipun hak cipta atas aset digital dapat secara legal diwariskan kepada ahli waris, ketiadaan peraturan khusus tentang perencanaan warisan digital dan kompleksitas teknis dalam mengakses kepemilikan digital (misalnya, kunci pribadi, dompet digital) menghadirkan hambatan yang signifikan. Oleh karena itu, terdapat kebutuhan mendesak untuk reformasi hukum dan inovasi administratif guna memastikan perlindungan yang adil dan efektif terhadap aset hak cipta digital dalam praktik pewarisan di era metaverse
