Abstract

This research intend to determine and resolve the process of dispute settlement of industrial relations between employee and PT Suzuki Finance Indonesia Branch Office Purwokerto on mediation step that was held at Dinas Tenaga Kerja, Koperasi dan UKM Kab. Banyumas. This research using normative and empirical methods which use primary and secondary legal materials. Also using interview data sources with the mediator of Dinnakerkop UKM Kab. Banyumas and documentary study. The conclusion of this research is the dispute settlement of industrial relations on this case already in accordance with PPHI Law, but there are obstacles that cause the solution of industrial relation can not to be done in the mediation step.

Abstract

Penelitian ini mendeskripsikan dan mengkaji permasalahan: pertama, bagaimana kondisi ekologis dan perlindungan lingkungan saat ini dalam tren pembangunan ekonomi. Kedua, apa esensi, arah, dan prinsip blue economy untuk pemulihan dan penguatan potensi alam akibat krisis ekologis. Penelitian ini adalah penelitian hukum yuridis normatif dengan pendekatan perundang-undangan (statue approach) dan pendekatan konseptual (conseptual approach). Hasil penelitian menunjukkan bahwa ola pengelolaan lingkungan yang diadopsi di Indonesia sejauh ini masih terjebak pada tuntutan pertumbuhan ekonomi. Serta konsepsi blue economy didirikan pada penilaian dan penggabungan nilai sebenarnya dari alam (biru) sebagai modal ke semua aspek kegiatan ekonomi (konseptualisasi, perencanaan, pembangunan infrastruktur, perdagangan, wisata, eksploitasi sumber daya terbarukan, produksi energi/konsumsi.

Abstract

Permasalahan penyelundupan satwa endemik di Indonesia merupakan fenomena yang mengkhawatirkan karena berimplikasi serius terhadap kelestarian keanekaragaman hayati dan keseimbangan ekosistem. Tindakan ilegal ini tidak hanya mengancam populasi spesies-spesies langka, tetapi juga menjadi tantangan besar bagi sistem hukum nasional yang bertugas melindungi kekayaan hayati negara. Kajian ini secara khusus menelaah bagaimana mekanisme penegakan hukum dijalankan terhadap praktik penyelundupan satwa endemik, dengan bertumpu pada analisis normatif terhadap Undang-Undang Nomor 5 Tahun 1990 tentang Konservasi Sumber Daya Alam Hayati dan Ekosistemnya. Metode penelitian yang digunakan bersifat yuridis normatif dengan pendekatan peraturan perundang-undangan serta analisis putusan pengadilan yang relevan. Penelitian ini mengungkap bahwa terdapat sejumlah kendala dalam implementasi hukum, antara lain lemahnya pengawasan, rendahnya efek jera dari sanksi yang dijatuhkan, serta keterbatasan koordinasi antar lembaga penegak hukum. Hasil temuan juga menunjukkan bahwa walaupun kerangka hukum telah tersedia, penerapannya belum maksimal dalam menanggulangi penyelundupan satwa secara efektif. Oleh karena itu, diperlukan pembaruan kebijakan serta penguatan sinergi antar-instansi agar tujuan pelestarian sumber daya alam hayati dapat tercapai secara menyeluruh. Kesimpulan utama dari penelitian ini menegaskan bahwa penegakan hukum yang tegas, terpadu, dan konsisten merupakan kunci dalam menghentikan praktik penyelundupan satwa endemik di Indonesia.

Abstract

Repeated forest fires highly impact on tree species composition. Forest planning requires information about the current condition of species composition. This paper investigates the current tree composition of natural regeneration after repeated forest fires, regeneration process after repeated fires, and strategy of secondary growth related to ecological restoration issues. Re-observation of the 1.8 hectares permanent plot in Samboja Research Forest was conducted in 2011. All trees with diameters above 10 cm at breast height (DBH) were re-numbered and mapped. Herbarium specimen was collected for species identification. Number of taxon was determined, Important Value Index was calculated, species trait of light response was identified based on the references and dispersion index species was calculated. Results show after twenty eight years initial forest fire, 191 species naturally regenerated in the burnt area. Macaranga gigantea, a light demanding pioneer species of Euphorbiaceae was the most dominant species, followed by Vernonia arborea belonging to Asteraceae. Both, M. gigantea and V. arborea had clumped distribution. Eight species identified survived from repeated fires, are Anthocephalus chinensis, Dipterocarpus cornutus, Diospyros borneensis, Eusideroxylon zwageri, Shorea ovalis, Syzygium borneensis, Pholidocarpus majadum and Vatica umbonata. All surviving species was distributed uniformly in the plot. Dominant pioneer species which has grown after repeated fires indicates that the current condition of burnt forest is in the early succession. Protecting forest, assisting natural regeneration and monitoring dominant species are suggested as activities for the ecological restoration.

Indonesia telah meratifikasi Paris Agreement sebagai bentuk komitmen dalam mitigasi emisi global. Namun, justru semakin banyak tantangan dalam menekan angka emisi tersebut, salah satunya tidak terlindunginya hutan alam di wilayah konsesi, sehingga menimbulkan risiko terlampauinya target pemerintah dalam FOLU Net Sink 2030. Target FOLU Net Sink 2030 dapat memberikan dampak positif maupun negatif. Terdapat kebijakan dalam FOLU Net Sink 2030 yang menjadi bumerang bagi kelangsungan dan keberlanjutan hutan di Indonesia karena tetap melegalkan deforestasi untuk Proyek Strategis Nasional (PSN). Lemahnya koordinasi antara aparat penegak hukum semakin memperburuk kegiatan deforestasi. Penelitian ini menggunakan metode kualitatif dengan pendekatan normatif dan komparatif. Sehingga didapatkan dua kesimpulan, yakni 1) diperlukan penghapusan terminologi "deforestasi terencana" yang mengizinkan penggundulan 325.000 hektar per tahun termasuk untuk Proyek Strategis Nasional (PSN) karena akan bertentangan dengan komitmen global yang tertuang dalam dokumen NDC, 2) Diperlukan reformasi kebijakan yang fundamental dan komprehensif, dimulai dari reaktualisasi regulasi anti deforestasi yang absolut tanpa pengecualian dengan memperhatikan perencanaan, dan mekanisme pengawasan oleh lembaga negara terkait serta penegak hukum. Indonesia has ratified the Paris Agreement as a form of commitment to global emission mitigation. However, there are increasingly many challenges in reducing these emissions, one of which is the lack of protection for natural forests in concession areas, thereby posing a risk of exceeding the government's target in FOLU Net Sink 2030. The FOLU Net Sink 2030 target can have both positive and negative impacts. There are policies in the FOLU Net Sink 2030 that are counterproductive to the survival and sustainability of forests in Indonesia because they continue to legalize deforestation for National Strategic Projects (PSN). Weak coordination between law enforcement agencies further exacerbates deforestation activities. This study uses a qualitative method with a normative and comparative approach. This leads to two conclusions: 1) it is necessary to remove the term “planned deforestation,” which allows for the clearing of 325,000 hectares per year, including for National Strategic Projects (PSN), as it contradicts global commitments outlined in the NDC document; 2) Fundamental and comprehensive policy reform is needed, starting with the re-actualization of absolute anti-deforestation regulations without exceptions, taking into account planning and monitoring mechanisms by relevant state institutions and law enforcement agencies. Abstract

Indonesia’s insolvency framework is currently suboptimal in accomodating rapid creditor enforcement with preserving viable firms, particularly publicly listed companies where market signaling and minority interests are at stake. This article proposes the adoption of a semi-public restructuring regime that combines private negotiation (pre-packs) with structured judicial oversight similar to scheme procedures, including limited moratorium and cram-down powers. Using a normative juridical method supported by case analysis (including Garuda’s dual-track restructuring) and interviews with supervisory judges, the paper: (1) identifies legal and practical shortcomings of PKPU/Bankruptcy under Law No. 37/2004; (2) compares UK Part 26A, US Chapter 11, and regional moratorium models; and (3) formulates statutory reforms to operationalize semi-public restructuring in Indonesia. The proposal rests on three core pillars: a mandatory insolvency test, a time-bound moratorium to facilitate rescue, and judicially supervised cram-down with strengthened disclosure obligations to safeguard minority creditors.

Abstract

This study aims to examine the legal accountability of the Land Deed Official (PPAT) in unauthorized land rights transfers in the case study of SHM 24451. In their function as a public authority, the PPAT, creates authentic deeds, particularly deeds of land rights transfer, which serve as evidence proving that a legal act of rights transfer has occurred lawfully and provides legal certainty. This research is normative juridical legal research using doctrinal, conceptual, and case approaches. A descriptive method is used to analyze data based on the theory of authentic deeds and the theory of official accountability. The problem arises when, during the deed-making process, there is suspicion of non-compliance with formal and material requirements, thus making the PPAT, as a public official, accountable for the legal acts performed. The results indicate that rights transfers that do not meet formal and material requirements can be subject to administrative, civil, and criminal liabilities. This causes legal violations and harms the community. These findings emphasize the importance of compliance with professional ethics, legal principles during the execution of tasks, authority as a PPAT, as well as maintaining the integrity of the profession, institution, and public trust.

Abstract

Pelayanan kesehatan adalah bidang kompleks yang melibatkan interaksi multidimensional antara tenaga medis, tenaga kesehatan, dan pasien, di mana etika profesi memegang peran krusial. Hubungan profesional ini diatur oleh prinsip-prinsip moral seperti beneficence, autonomy, justice, dan fidelity. Pasien, sebagai subjek utama, memiliki hak dan kewajiban yang jelas, mencerminkan kepercayaan substansial pada profesional kesehatan. Meskipun etika dan kerangka hukum ada, potensi sengketa medis tetap signifikan, seringkali dipicu oleh miskomunikasi, diskriminasi (gender, ekonomi, agama, dll.), kurangnya transparansi, atau ketidakpuasan terhadap kualitas layanan. Menjaga etika profesi bukan hanya kewajiban moral, tetapi juga strategi esensial untuk meminimalkan risiko sengketa dan membangun hubungan harmonis. Penelitian ini menggunakan metode yuridis normatif untuk mengkaji bagaimana etika kesehatan yang baik dalam hubungan profesional antara tenaga medis dan pasien dapat mencegah sengketa medis. Fokusnya adalah meneliti hukum sebagai norma, aturan, dan prinsip untuk menjawab permasalahan hukum terkait.

Abstract

Repeated forest fires remarkably impact species composition. Pioneer species colonize the burnt forest and widely develop up to 30 years after a fire, but late-succession species regenerate gradually or even disappear owing to direct impact of fires or other ecological consequences related to fires. Hence, forest restoration through assisted natural regeneration needs some information about the state of post-fire species composition. To better evaluate tree species composition after repeated fires, the species dominance as an indicator of species composition was used in this research, with additional information on the species association and distribution patterns. A 1.8-hectare plot, divided into 180 subplots with a size of 10 × 10 m, was established in a secondary forest in Samboja Research Forest, East Kalimantan. The sample plot was burnt in 1982/1983 and 1997/1998. All trees above 10 cm DBH were measured and leaf specimens were collected for species identification at the Herbarium Bogoriense, Cibinong, West Java. For comparison, the 1981 data from the Indonesian Institute of Sciences were used. Analysis of the Importance Value Index used the species dominance data. A 2 × 2 matrix based on the presence–absence of species for each subplot was used to analyze the association index among species. Variance and average value ratio of certain species present in each subplot were expressed in a dispersion index. A chi-square was used to test the significance between the association and dispersion index. Thirteen years after a second fire, pioneer species Macaranga gigantea were most dominant, followed by Vernonia arborea, a sub-climax species. This indicated that the forest was in an early succession process. Pholidocarpus majadum was consistently dominant before and after the fire. A total of 38 pairs of species were significantly positively associated and 4801 pairs negatively associated. About 60% of species association, both negatively and positively, were among the "native species" (species that existed before the fire events) and "non-native species" (newcomer species that regenerated after the fire) in the plot sample. A non-native species, Vernonia arborea, associated negatively with the non-native species Tabernaemontana spireumcama, and native species Oncosperma horridum, Palaquium and Endiandra rubescens.
