Abstract

Work accidents can be said to be a conflict in employment because they cause losses to workers and companies. Although the government has regulated the company's obligations in implementing occupational safety and health through various laws and regulations, in reality the effectiveness of the implementation of these regulations is still a problem, especially in terms of law enforcement in companies that have not fully implemented occupational safety standards according to applicable norms and provisions, one of which is at PT Sinar Semesta which is a metal casting company in Klaten Regency. This study aims to determine the regulations related to Occupational Safety and Health and the implementation of legal protection for Occupational Safety and Health at PT Sinar Semesta. This study uses an empirical legal research method. Based on the results of the study, it can be concluded that Occupational Safety and Health has actually been regulated in several laws and regulations. However, the implementation of legal protection for Occupational Safety and Health at PT Sinar Semesta has not been fully fulfilled because there are no health facilities specifically located in the company environment, the Occupational Safety and Health Management System has not been implemented, and the Occupational Safety and Health Development Committee has not been formed..

Abstract

The digital era has significantly transformed consumer behavior while simultaneously presenting new challenges in the protection of consumer rights. This study aims to analyze the juridical challenges and prospects of state administrative law in enforcing consumer rights within the digital context. Employing normative legal research methods, this study is based on secondary data, including statutory regulations, academic literature, and tertiary legal references. The findings reveal a regulatory gap caused by the rapid pace of technological advancement, weak inter-agency coordination, limited digital literacy among consumers, and the complexity of cross-border transactions. Although the Consumer Protection Law serves as the primary legal foundation, its implementation remains insufficient in the digital realm. Consequently, state administrative law must undergo adaptive transformation by enhancing digital public services, personal data protection, and the accountability of public officials. Comprehensive regulatory reform, capacity building for legal apparatus, development of digital infrastructure, and public education are essential to establishing an effective and responsive consumer protection framework in the digital age. This research contributes both theoretically and practically to the renewal of administrative law and the formulation of adaptive public policy for digital consumer protection.

Abstract

ABSTRACT Research Objective: This research aims to juridically analyze the Decision of the High Military Court III of Surabaya No. 114-K/PMT.III/BDG/AL/VII/2023 on the involvement of two active members of the Indonesian National Army’s Navy in the crime of transporting timber forest produce without valid documents (illegal logging). This analysis focuses on the application of the general norms of the criminal law, the forestry law, and the military law that intersect in this case, as well as how far the “equality before the law” principle is applied to military personnel. Research Method: This research employed the normative juridical method (doctrinal method) with an analytical approach on legal regulations, legal doctrines, as well as court decisions. The analyzed legal materials include Law No. 34 of 2004 on the Indonesian National Army, Law No. 18 of 2013 on the Prevention and Elimination of Forest Destruction, the Criminal Code, the Military Criminal Code, Law No. 31 of 1997 on the Military Court, as well as the Governmental Regulation No. 5 of 2021. Result: Results of this research show that the action of the Indonesian Navy’s personnel in this case was proven to violate positive law violations both in the realm of general crime and the ream of military criminal law. Judges’ decision was deemed accurate as it considered legal evidence, the losses of the state, as well as the legal equality principle without discriminating against the military institution status. The imposition of penalization in the form of imprisonment and fines in this case also reflected consistency in the application of the legal state principle in military justice. Research Application: This research may become a reference to enforce the law against state apparatus, especially military personnel, who committed legal violations outside of their authority. Apart from that, this analysis may be used as a material for evaluation and improvement of the internal monitoring system in the Indonesian National Army’s environment so that it may be more transparent and accountable. Novelty: The “equality before the law” theory profoundly analyzes this military decision using the ratio decidendi theory. This research offers an interdisciplinary analysis between military law, environmental law, the law on permits, and the principle of constitutional justice in one decision, as well as the confirmation that the “equality before the law” principle must still be enforced for all citizens, including the state defense apparatus. Keywords: Military Decision, Justice, Crime, Illegal Logging.   ABSTRAK Tujuan Penelitian: Penelitian ini bertujuan untuk menganalisis secara yuridis Putusan Pengadilan Militer Tinggi III Surabaya No. 114-K/PMT.III/BDG/AL/VII/2023 tentang keterlibatan dua anggota aktif TNI Angkatan Laut dalam tindak pidana pengangkutan hasil hutan kayu tanpa dokumen yang sah (illegal logging). Analisis ini berfokus pada penerapan norma-norma umum hukum pidana, hukum kehutanan, dan hukum militer yang bersinggungan dalam perkara ini, serta sejauh mana asas “kesetaraan di hadapan hukum” diterapkan kepada personel militer. Metode Penelitian: Penelitian ini menggunakan metode yuridis normatif (metode doktrinal) dengan pendekatan analitis terhadap peraturan perundang-undangan, doktrin hukum, serta putusan pengadilan. Bahan hukum yang dianalisis meliputi Undang-Undang Nomor 34 Tahun 2004 tentang Tentara Nasional Indonesia, Undang-Undang Nomor 18 Tahun 2013 tentang Pencegahan dan Pemberantasan Perusakan Hutan, Kitab Undang-Undang Hukum Pidana, Kitab Undang-Undang Hukum Pidana Militer, Undang-Undang Nomor 31 Tahun 1997 tentang Peradilan Militer, serta Peraturan Pemerintah Nomor 5 Tahun 2021. Hasil: Hasil penelitian ini menunjukkan bahwa tindakan personel TNI AL dalam perkara ini terbukti melanggar hukum positif baik dalam ranah pidana umum maupun ranah hukum pidana militer. Putusan hakim dinilai tepat karena mempertimbangkan alat bukti yang sah, kerugian negara, serta asas persamaan hukum tanpa membeda-bedakan status kelembagaan militer. Penjatuhan pidana berupa pidana penjara dan denda dalam perkara ini juga mencerminkan konsistensi penerapan asas negara hukum dalam peradilan militer. Aplikasi Penelitian: Penelitian ini dapat menjadi acuan untuk menegakkan hukum terhadap aparatur negara, khususnya personel militer, yang melakukan pelanggaran hukum di luar kewenangannya. Selain itu, analisis ini dapat digunakan sebagai bahan evaluasi dan penyempurnaan sistem pengawasan internal di lingkungan Tentara Nasional Indonesia agar lebih transparan dan akuntabel. Kebaruan: Teori "kesetaraan di hadapan hukum" menganalisis keputusan militer ini secara mendalam menggunakan teori ratio decidendi. Penelitian ini menawarkan analisis interdisipliner antara hukum militer, hukum lingkungan, undang-undang perizinan, dan asas keadilan konstitusional dalam satu putusan, sekaligus penegasan bahwa asas "kesetaraan di hadapan hukum" tetap harus ditegakkan bagi seluruh warga negara, termasuk aparat pertahanan negara. Abstract

The government is working on a food barn program or commonly referred to as a food estate to anticipate the post-pandemic food crisis. This food estate program is carried out by expanding land including protected forest areas. This raises problems regarding the government's policy in food estate programs that use protected forest areas. The aim of this research is to find out problems in food estate policies related to the use of protected forest areas. This research uses normative research methods, with deduction analysis techniques. The results of this research show that the Food Estate policy has problems related to protected forest areas that can be used for food estate projects which are regulated in Minister of Environment and Forestry Regulation No. 7 of 2021, contrary to Article 26 of Law no. 41 of 1999 which does not include the food estate program in the use of protected forests. This shows that the food estate policy needs to be reviewed, especially regarding the criteria for protected forest areas that do not have a protective function so that there is no conflict between one policy and another.

Abstract

Dalam pelaksanaan perjanjian kredit perbankan menimbulkan suatu hak dan kewajiban yang harus dipenuhi oleh bank sebagai kreditur dan nasabah sebagai debitur. Tujuan penelitian ini adalah untuk menganalisis kewenangan Pemerintah Daerah Kota Surakarta dalam penerbitan Surat Bukti Kepemilikan Bangunan Gedung (SBKBG). Metode penelitian menggunakan metode hukum normatif dengan melakukan penafsiran hukum dan konstruksi hukum melalui norma hukum yang berlaku. Pengumpulan data menggunakan studi hukum kepustakaan dengan data sekunder berupa bahan pustaka seperti buku, literatur dan jurnal hukum yang terkait. Teknik analisis data menggunakan analisis kualitatif. Hasil penelitian menunjukkan bahwa Pemerintah Kota Surakarta mengeluarkan Perda No. 14 Tahun 2023 tentang Pajak Daerah dan Retribusi Daerah di mana dalam Pasal 1 No. 53 menyebutkan bahwa Surat Bukti Kepemilikan Bangunan Gedung (SBKBG) adalah surat tanda bukti hak atas status kepemilikan Bangunan Gedung yang bertujuan untuk menjamin kepastian dan ketertiban hukum dalam Penyelenggaraan Bangunan Gedung, setiap Bangunan Gedung harus memenuhi persyaratan administratif dan persyaratan teknis Bangunan Gedung.

Abstract

Negara Indonesia ialah negara hukum, ketentuan ini dijamin dalam Undang- Undang Dasar Negara Republik Indonesia Tahun 1945 (UUD NRI Tahun 1945), pada Pasal 1 ayat (3). Sebagai negara hukum Indonesia memiliki kewajiban untuk melindungi segenap rakyat Indonesia, termasuk mengatur kemanfaatan semua aspek kehidupan agar mampu memberikan kemakmuran bagi seluruh rakyat Indonesia. Pada penjelasan Pasal 33 ayat (4) disebutkan bahwa: “...Khusus tempat pemakaman, tempat yang dianggap suci dan tanah milik masyarakat adat, sebelum dikeluarkan izin dari instansi Pemerintah yang berwenang perlu mendapat persetujuan dari masyarakat setempat.” Ketentuan ini menganulir larangan penggunaan tanah masyarakat adat untuk usaha Migas dan Pertambangan. Dengan kata lain, kegiatan Migas dan Tambang dapat dilakukan di atas tanah masyarakat adat setelah mendapatkan persetujuan dari masyarakat adat. Persetujuan masyarakat adat tersebut dilakukan dalam bentuk penyelesaian secara musyawarah dan mufakat untuk mendapatkan keputusan mengenai cara jual beli, tukar-menukar, ganti rugi yang layak, pengakuan atau bentuk penggantian lain kepada pemegang hak atas tanah.

Abstract

This study aims to determine the concept of the no work no pay principle in laws and regulations by companies with the Covid- 19 Pandemic concept. Methods This research is a prescriptive normative legal research. The legal sources of this legal research use primary and secondary legal materials. The approach technique used is the method of applying the law and the conceptual approach. Data collection techniques used are literature study, document study and interviews. The technique of analyzing legal materials is descriptive using the deductive reasoning method. Results Based on research on the concept of wages according to the no work no pay principle by the Covid- 19 pandemic company, there are several concepts that can be used as guidelines. First, the basic concept refers to and is guided by the no work no pay principle contained in Article 93 paragraph (1) of Law Number 13 of 2003 concerning Manpower which reads "Wages are not paid if the worker/labourer does not do work" . The no work no pay principle applies if the Worker/Labourer does not work on the basis of the Worker/Labourer's own fault or intention. Because there is no work without wages, it does not apply if the condition of the Worker/Labourer experiences several conditions as regulated in Article 93 paragraph (2) of the Manpower Act. However, what is noted in the wage policy in the Covid-19 pandemic is that the provisions in Article 93 paragraph (2) letter f do not apply, because it cannot be fulfilled "the employer does not employ workers or laborers due to their own mistakes or because of obstacles that can be avoided by the entrepreneur" because the Covid-19 pandemic condition is an event that cannot be avoided and is not the fault of any party.

Abstract

The objective of research was to find out the suitability of the use of protected forests in Karanganyar Regency for tourist attractions with statutory and concerning the legality of retribution withdrawal by local governments which is legal because local governments have regional autonomy.With the legal issue, the author uses normative research methods with perspective research of used cases and regulatory approaches. Nature tourism is one form of protected forests utilization that falls into the group of environmental services utilization according to Article 1 number (6) Regulation of Minister of Forestry Number P.47/MENHUT-II/2013. The helding of tourism in protected forest areas is allowed with the provision not to reduce, change, or eliminate its main functions, change the landscape, and damage environmental elements. However, in the implementation, the parties that involved didn't apply it as it used to be, there were persons who violated the rules that have been made. In addition to violations in the use of protected forests as tourist attractions, other problems occurred was the withdrawal of the retribution, in interviews that the author did with the management of protected forests, it claimed that the withdrawal of retribution in tourist attractions that use protected forests is basically not the right of the local government because the manager of the protected forest doesn't come from the local government but Perum Perhutani instead.

Abstract

The purpose of writing this research is to find out about pancasila justice in the of industrial relations dispute mediation at the Departement of Industry and Manpower of Sukoharjo Regency. The writing of this research uses a normative juridicial legal research method by reviewing library materials or secondary data. The nature of the data research and the approach used are prescriptive and statute approach. Pancasila Justice has characteristic of humanizing humans in a fair and civilized manner according to their human rights and providing social justice for all Indonesian people. From the data dispute cases that have been analyzed, there are still procedures and recommendations that are not in accordance with Law Number 2 of 2004 concerning Settlement of Indutrial Relations Disputes, Law Number 13 of 2003 concerning Manpower and Pancasila Justice. This legal fact causes dispute resolution through mediation to be unfair because it is not in accordance with Pancasila justice where Pancasila jutice has the characteristics of humanizing humans fairly and civilly according to their human rights and providing social justice for all Indonesian people.

Abstract

Penelitian ini bertujuan untuk mengidentifikasi hukum lingkungan yang berlaku, Undang-Undang Nomor 32 Tahun 2009 dalam pengelolaan limbah COVID-19 serta upaya dalam mengatasi hambatan nya di Rumah Sakit Paru Dr. H. A. Rotinsulu. Penelitian ini memakai metode penelitian fakta-fakta empiris bersifat deskriptif dengan mengaplikasikan pendekatan kualitatif. Sumber penelitian ini merupakan data primer yang diperoleh dengan wawancara dan observasi serta data sekunder yakni peraturan perundang-undangan yang memiliki kaitan dengan objek penelitian. Berdasarkan hasil observasi pengelolaan limbah COVID-19 telah memenuhi ketentuan yang berlaku pada Peraturan Menteri Lingkungan Hidup Nomor 56 Tahun 2015, Peraturan Menteri Kesehatan Nomor 7 Tahun 2019 dan Keputusan Menteri Kesehatan Nomor HK.01.07/Menkes/537/2020 Tentang, akan tetapi dalam implementasi nya masih belum optimal dilaksanakan, seperti upaya pemilahan, dumping dan pengelolaan lainnya. Hambatan dalam pengelolaan limbah di rumah sakit masih belum gencarnya upaya pemilahan dari penghasil limbah yakni pasien diperlukan edukasi untuk mendukung pengelolaan limbah infeksius COVID-19 yang benar secara hukum.
