Abstract

Supervision is one of Indonesia's efforts to protect the environment, but its regulation still needs improvement. The reason is that the regulation does not cover broad authority for the Technical Authority, a comprehensive and measurable supervision scheme. Regulations regarding this matter significantly affect entrepreneurs' compliance levels to prevent or even increase environmental violations. Therefore, the regulation can be improved by studying it from Denmark. This study aims to provide an overview of environmental monitoring in Denmark to be used as a reference for regulatory changes in Indonesia. More comprehensive and participatory supervision regulations can significantly reduce environmental pollution and/or damage cases. This research is normative research with statutory and comparative approaches. The study suggests that several provisions in Denmark can be adopted, namely the extent of the authority of Danish Supervisory Officials starting from location, raw materials, and equipment used to product distribution and intervention against companies, stricter sanctions, and ensnare environmental violators, the authority to obtain personal information from other institutions, an excellent vertical integration system, and Supervisory Officials according to the number and background.

Abstract

The author's aim in researching waste banks is to provide an understanding of waste management with a new paradigm in waste management, namely waste banks. Based on Law Number 18 of 2008, the use new paradigm of collect-transport-dispose in the Minister of Environment and Forestry Regulation Number 14 of 2021, namely with the issuance of a circular. This research was carried out using the legal research method. This type of empirical legal research is descriptive in nature, explaining what happened in Sukoharjo Regency and analyzed qualitatively. Results from several literature and interviews with the existence of waste bank regulations, local governments carry out and implement them. Sukoharjo Regency has the role of the environmental service in carrying out environmental management, especially waste management. However, there are areas where not all of them have active waste banks, so this research is interesting to examine waste banks in realizing the legal principles of a sustainable environment in Sukoharjo Regency. The research results show that the implementation of waste banks in Sukoharjo Regency must be further optimized to achieve environmental law objectives with the principle of sustainability and waste banks as a circular economy.

Abstract

: This research aims to determine the sustainability of the implementation of government policies in the rehabilitation of uninhabitable houses in Sukoharjo Regency. This type of research is empirical legal research or non-doctrial research to determine the conditions that occur in practice using a qualitative approach. The types and sources of research data consist of primary and secondary data. Data collection techniques were obtained through interviews and literature studies. The data analysis technique used is a qualitative data analysis model. The results of the research show that the continued implementation of government policy in the rehabilitation of uninhabitable houses in Sukoharjo Regency has had a positive impact on the people of Sukoharjo Regency. However, this program has not been able to address the housing backlog problem which is the main problem for the people of Sukoharjo Regency. Limited land is currently the main factor inhibiting backlog handling in the Sukoharjo Regency area.

Abstract

The development of infrastructure for the general interest in Indonesia continues to be encouraged by the Government to improve the general well-being, but it has to deal with public ownership by acquiring land for such development. This study determines the forms of legal protection for landowners affected by land acquisition. The study uses normative legal research, which compares legal issues in two countries, Indonesia and the Netherlands. This research is descriptive, using statute, conceptual, and case approaches. The results of this study show that legal protection for landowners affected by land acquisition in Indonesia, based on some cases in the investigated judgment, needs to protect and provide legal certainty for landowners fully. The case is based on unilaterally granting compensation, and the court has not filed a lawsuit for such compensation. The courts in Indonesia, in settling the land acquisition damages dispute, are more subject to existing rules that do not look at the situation on the ground. The implementation of the acquisition process carried out by the Evaluation Team must comply with the procedures in the land acquisition regulations. Secondly, legal protection for landowners affected by land acquisition in the Netherlands; based on several cases in the ruling under investigation, the Netherlands has provided legal protection in the form of high compensation for the cost of landowner losses. The Supreme Court is working hard for a reasonable outcome by providing high-value compensation. Both states have the same obstacle in implementing land acquisition: a dispute with landowners about compensation.

Abstract

The study aims to analyze the indefeasible title concept on electronic land certificates for preventing land mafia. This research is normative legal research using legal and conceptual approaches. Legal materials include primary and secondary legal materials. According to the study, one of the causes of the land mafia is the land registration system's tendency to publish harmful material, as contained in Government Regulation 24 of 1997 on Land Registration. Therefore, reforming and developing the land law system into a positive publication system is necessary. By the Regulations of the Minister of Agrarian No. 1 of 2021 on Electronic Certificates, Electronic certificates are expected to be a database of landlords to reduce land disputes and strengthen the legitimacy of land certificates as a guarantee of ownership of land rights in Indonesia. Suppose an error in the registration procedure of a positive publication causes the losses of the party that should be more entitled. In that case, the state will guarantee compensation in substance to the party whose right is proven correct using the indefeasible title concept.

Abstract

Space is an area that includes land space, sea space and air space, including space within the earth as a unified territory, where humans and other creatures live, carry out activities and maintain their survival. Increasing population growth has an impact on the economic development of the people of an autonomous region who will undoubtedly utilize space that is considered strategic to support their economic activities. The complexity of development growth in Indonesia requires priority development programs and plans in various aspects or fields, but this development must not conflict with the fifth principle of Pancasila, namely social justice for all Indonesian. There is no consistency in implementing regulations, especially in enforcing laws related to spatial planning, which results in inappropriate development growth which impacts the surrounding environment, and green open space becoming increasingly narrow.

Abstract

Indonesia's growth toward the digital era can no longer be applied to achieve modernization in the land sector, starting with the application of electronic-based land services, particularly the digitization of land certificates. By implementing electronic-based land services, the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency's Regulation No. 1 of 2021 concerning Electronic Certificates seeks to modernize land registration to enhance measures of the community's access to public services and ease of doing business. The issue with this research is the factors that prevent establishing a program for digital certificate holders to preserve their legal and land rights. Technically speaking, electronic certificates are more secure than analog (manual) ones when it comes to security. This added value will benefit holders of electronic land certificates by reducing the likelihood of certificate fraud, preventing illegal land transactions like those carried out by land mafias, and making it easier to transact with land parcels.

Abstract

The research in this article aims to find out whether the mechanism implemented in determining the minimum wage for the City of Surakarta in 2022 is or is not in accordance with Government Regulation Number 36 of 2021 concerning Wages, and to analyze whether or not the decision of the minimum wage for the City of Surakarta in 2022 has fulfilled the principles of expendiency and fairness for workers and employers. This research uses a type of empirical legal research with a descriptive nature, then the data is analyzed qualitatively. The study shows the results that the mechanism for determining the minimum wage for the city of Surakarta in 2022 is normatively not fully in accordance with Government Regulation Number 36 of 2021 concerning Wages. In addition, the decision of the Surakarta Minimum Wage for 2022 has not been able to fulfill the principles of expendiency and fairness for workers and employers, due to significant changes in the mechanism for setting the city's minimum wage for 2022 and the role of workers and employers in the city minimum wage setting process is still strictly limited by applicable regulations.

Abstract

This article aims to analyze whether mediation for the settlement of disputes over termination of employment in Department of Industry and Labor of Sukoharjo has been effective enough or hasn’t been effective also to find out the obstacles that have been encountered by the mediators while handling the mediations in in Department of Industry and Labor of Sukoharjo. This article uses empirical legal research method  by directly examining research from the field and the nature of the research and the approach used is descriptive analytic.The result of this study indicates that the mediation for the settlement of disputes over termination of employment in Department of Industry and Labor of Sukoharjo hasn’t been effective enough, especially on law factor and cultural factor. In addition, the obstacles that have been encountered by mediators while handling the mediations are first, both parties stand on their own opinion and no one wants to settle down that makes it harder to find the solution, second, the employers can not attend the assembly, third, the employers are hard to cooperate with, lastly, the Covid-19 pandemic that is still spreading.

Abstract

This research aims to explain the developer's default in terms of delays in providing the Flat Ownership Certificate (SHMSRS) and the developer's responsibility to consumers regarding delays in receiving the SHMSRS. The method used in this research is normative juridical. with a statutory approach and a conceptual approach. According to the findings of this study, if the developer is late in providing SHMSRS to consumers, the developer has committed a default. The developer is not timely in carrying out its obligations towards consumers because SHMSRS needs to be obtained as proof of ownership of the apartment unit. The developer's responsibility in the event of delays in providing SHMSRS is to be able to process SHMSRS as quickly as possible and immediately hand it over to consumers. However, consumers can also cancel the purchase of an apartment and the payment received must be returned in full by the developer to the prospective buyer. If the developer cannot comply, consumers can take legal action, namely by mediating and resolving disputes outside the court (Mediation and Arbitration), filing a lawsuit with the General Court (Civil), administrative legal action, submitting a report to the police investigator (criminal action).
