Abstract

This study aims to find out whether the rule of urgency has been applied in the arrangement of land for sale and forms of legal protection for land holders whose land is designated as land for use. This research uses normative legal research. This research uses case, legal, and conceptual approaches. The results of this study, firstly, the basis of urgency has not been applied in the determination of land for sale originating from HGB based on the analysis of the court ruling related to the BPN decision appeal on land settlement for sale in this study. This is due to three factors, namely the substance of the law, the legal structure, and the legal culture. Second, the form of legal protection for HGB Holders whose land is established as land transfer based on the theory of the legal protection of J.B. J. B. ten Berge, there are three forms of protection namely protection through democracy, protection through hierarchical relations of government, and protection through jurisdictional arrangements. Of the three types of protection of such law, according to the analysis of the Author, the protection through the legal arrangement has been optimally applied as legal protection to the HGB Holder.

Abstract

This study aims to examine the potential of restorative justice to resolve environmental criminal violations from the perspective of Pancasila philosophy, exploring relevant concepts so that they can be applied in the process of resolving environmental criminal cases. The type of research used is normative or doctrinal legal research. Normative research is research that usually uses documents as sources of legal materials such as laws and regulations, court decisions, legal theories, and opinions of legal scholars. The restorative justice approach in resolving environmental criminal cases can only be applied to formal offenses in Article 100. The concept of Restorative Justice is in accordance with the 4th Principle, namely deliberation which contains the principles of conferencing, search solutions, reconciliation, repair and circles (mutual support).

Abstract

Land sale and purchase tax is one of the sources of local revenue regulated in the Law on Central and Regional Financial Relations. This provision is expected to be a means to increase regional fiscal independence. The problem arises when the government cannot set a minimum standard for the selling price of land owned by each person, so a mechanism is needed to ensure that the state can still obtain reasonable tax revenue from each land sale and purchase transaction. This study was conducted to see how the government carries out the legal policy to maintain the source of income derived from the land sale and purchase process. The analysis will be carried out using a normative legal research method supported by a conceptual and legislative approach. Various legal regulations related to the imposition of land sale and purchase tax will be studied using the legal realism perspective put forward by Chambliss and Seidman. This theory was chosen to show how social construction in Indonesian society and the influence of various aspects of life can affect the effectiveness of the imposition of land sale and purchase tax. The results of the study indicate that the government must set several standards, such as the percentage according to NJOP and the application of the Land Value Zone, to ensure that the amount of tax received can better reflect the value of legal certainty for the government. This study will provide an overview of the legal policy steps that can be used to standardize the imposition of taxes on similar economic processes.

Abstract

Artikel ini mengkaji peran pemerintah dalam hal ini Dinas Lingkungan Hidup Kabupaten Gunungkidul dalam menangani pengelolaan sampah plastik di wilayah pesisir pantai Drini didasarkan dengan peraturan undang-undang serta peraturan daerah yang berlaku dalam hal ini serta hambatan apa saja yang dihadapi serta solusi untuk mengatasi hambatan tersebut. Metodologi penelitian adalah empiris bersifat diskriptif dengan bersumber pada bahan hukum primer, sekunder dan tersier. Penulisan hukum ini memiliki pendekatan penelitian yang bersifat kualitatif dengan bersumber pada bahan hukum primer dan sekunder. Penulis melakukan teknik pengumpulan data dengan cara wawancara dengan memperoleh data langsung dari respondern atau narasumber yang bersangkutan. Teknik analisis yang digunakan adalah metode partisipatif. Hasil penelitian hukum ini antara lain peran Dinas Lingkungan Hidup Kabupaten Gunungkidul mempunyai tugas membantu Kepala Daerah melaksanakan urusan pemerintahan di bidang lingkungan hidup. Peran nyata dalam program pengelolaan sampah di wilayah pesisir pantai Drini masih belum maksimal. Hambatan yang ada masih memerlukan solusi yang bisa mengurangi serta membantu meningkatkan pengelolan sampah plastik di wilayah pantai.

Abstract

Approaches in legal education that emphasize the justice value of Pancasila are increasingly relevant in rising environmental awareness among students. A learning model not only offers theoretical insights into environmental protection but also encourages the practical application of justice value in the context of law enforcement. This study seeks to develop a law enforcement learning model based on Pancasila justice value to increase environmental awareness at Yogyakarta State University, Indonesia. The study employed a mixed-methods approach, integrating qualitative and quantitative methods within a research and development (R&D) design. The data were collected using questionnaires, observations, and document analysis. The population consisted of students who took civic education courses at Yogyakarta State University in 2023. A sample was selected using proportionate stratified random sampling, dividing the university's faculties into groups based on cultural similarities, including the Faculty of Social, Legal and Political Sciences; Faculty of Economics and Business; Faculty of Education and Psychology; and Faculty of Languages, Arts and Culture. The results revealed three main findings. First, civic education at Yogyakarta State University required further development in terms of materials, methods, media, resources, and evaluation. Second, developing a law enforcement learning model based on the justice value of Pancasila to increase environmental awareness involved initial, core, and closing activities. These activities included identifying environmental problems, introducing environmental law materials, selecting problems for class research, gathering and documenting information, developing class portfolios, presenting portfolios, and reflecting on the learning experience. Third, the model demonstrated effectiveness and significantly increased student's environmental awareness at Yogyakarta State University, effectively increasing their understanding of theory and practice.

Abstract

The management of mining waste is a crucial aspect in maintaining the balance between the exploitation of natural resources and environmental protection. PT Aneka Tambang Tbk (Antam), as a mining company, strives to implement sustainable waste management policies to support the concept of Green Business in Indonesia. This study aims to analyze the role of national and international regulations in mining waste management and the implementation of these policies by Antam based on its 2020-2023 sustainability report. Using a normative juridical approach, this research finds that although regulations governing waste management are in place, challenges remain in their implementation, including harmonization with international standards and the effectiveness of supervision mechanisms. Therefore, strengthening regulations and enhancing transparency in waste reporting and management are necessary to ensure that the mining industry aligns with sustainability principles.

Abstract

Rapid population growth in Indonesia, especially in Karanganyar Regency, has contributed to the conversion of agricultural land to non-agricultural land, which has the potential to threaten food security and environmental sustainability. With the main agricultural land protection regulation in Undang-Undang Nomor 41 Tahun 2009 with further regulations in Karanganyar Regency through regional regulations on Karanganyar Regional Peraturan Daerah Karanganyar Nomor 19 Tahun 2019 Perubahan Atas Peraturan Daerah Nomor 1 Tahun 2013, Peraturan Daerah Karanganyar Nomor 6 Tahun 2020 and the basis for the Kesesuaian Kegiatan Pemanfaatan Ruang (KKPR) policy with the Online Single Submission (OSS) system based on the Peraturan Menteri Agraria dan Tata Ruang (ATR) Nomor 13 Tahun 2021. However, in the implementation of these various arrangements there are various problems and challenges. This study aims to analyse the various challenges and problems in the efforts to realize the conversion of agricultural land to non-agricultural land in Karanganyar. This study uses a juridical empirical research method, using a legislative approach and a conceptual approach. The research findings show that there are inconsistencies in regulations, weak supervision and law enforcement, and lack of public awareness and participation.

Abstract

This research discusses the settlement of Sultan Ground (SG) and Pakualaman Ground (PAG) land controlled by the community based on the principle of people's sovereignty. The special status of the Yogyakarta Special Region (DIY) grants the Sultanate and Pakualaman Duchy the authority to manage SG and PAG land. However, in practice, the inventory process of these lands has led to legal issues, particularly concerning ownership and the rights of communities that have long occupied the land. This study employs normative legal research methods with statutory and conceptual approaches. The sources of data include primary, secondary, and tertiary legal materials. The findings indicate a dualism in agrarian law between the Basic Agrarian Law (UUPA) and the Yogyakarta Special Region Law, which results in legal uncertainty for communities that have long inhabited SG and PAG land. The study concludes that the community's rights over SG and PAG land before the inventory process can be based on the magersari and anggaduh principles, which are recognized in customary law. However, the lack of legal recognition within the national legal system causes communities to lose rights over the land they have utilized for generations. Therefore, a legal solution that accommodates the principle of people's sovereignty is needed to resolve land disputes in Yogyakarta, ensuring legal certainty and justice for the community.

Abstract

Pemanfaatan BMN/D pertama kali diatur melalui Keputusan Menteri Keuangan Nomor 470/KMK.01/1994, sedangkan Peraturan pelaksana dari UUPA sendiri, yakni Peraturan Pemerintah Nomor 40 Tahun, baru diundangkan pada Tahun 1996. Sementara itu, Pemerintah Daerah Provinsi Jawa Barat pada tahhun 1984 telah melakukan Perjanjian BGS dengan PT Interna Permai untuk membangun Gedung dan fasilitasnya di Jalan Banceuy No. 8, Braga, Bandung. Terjadinya kekosongan hukum saat perjanjian tersebut ditandatangi menimbulkan ketidakpastian terhadap pelaksanaan perjanjian itu sendiri dan berujung pada sengeketa TUN terkait perpanjangan Sertipikat HGB pecahan pada Ruko Banceuy yang ditolak oleh Sekretaris Daerah Provinsi Jawa Barat. Tujuan penulisan ini adalah untuk mengetahui perlindungan hukum HGB pada BMN/D yang menjadi objek pemanfaatan perjanjian BGS menurut Putusan 72/G/2014/PTUN-BDG dan pasca diundangkannya Undang-Undang Cipta Kerja. Sekretaris Daerah Provinsi Jawa Barat selaku pemegang Hak Pengelolaan dan pelaksana BGS memiliki kewenangan untuk menolak perpanjangan HGB di atas tanah Hak Pengelolaan. Dengan diundangkan UU Cipta Kerja dan Peraturan pelaksananya, ada penegasan terkait kewajiban Mitra BGS dan pihak lain yang memegang sertipikat HGB di atas tanah Hak Pengelolaan.

Abstract

This study aims to analyze the implementation of local government policies in the management of the Setu Babakan Betawi Cultural Village from the perspective of spatial planning law. The research method employed is empirical legal research with a descriptive nature and a qualitative approach, involving document studies and interviews. The results show that the policy implementation has been carried out through various regulations; however, it still faces challenges such as fragmented authority among agencies, lack of coordination, and limited resources. To optimize the management and preservation of the area, strategic efforts are needed, including strengthening regulations, preparing a Detailed Spatial Plan (RDTR), increasing resources and budget allocation, involving the local community, and utilizing technology. Through these measures, the Setu Babakan Betawi Cultural Village is expected to remain a sustainable center for cultural preservation amidst Jakarta’s urban development.
