Abstract

The purpose of this research is to analyze the legal certainty and evidentiary strength of electronic certificates against land rights holders as a valid proof of ownership, which is generally in physical form. Based on the UUPA and PP 24/1997, land certificates in the form of documents hold the position of written evidence. However, the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency has issued a policy regarding electronic certificates regulated in the Ministerial Regulation of Agrarian Affairs and Spatial Planning/National Land Agency Number 1 of 2021 concerning Electronic Certificates. The research method used is normative juridical with an approach through legislation. The research results indicate that the conversion of land certificates from physical to electronic form can only be carried out on land that has already been registered through a data maintenance application submitted by the rights holder. The legal certainty depends on whether or not a request for data maintenance has been submitted. In terms of proof, electronic certificates provide protection to the rights holder as an electronic evidence tool, which is demonstrated in two ways: by showing it directly from the electronic system and also by presenting the printed result.

Abstract

The purpose of this research is to analyze the responsibilities that must be borne by a notary if there is a notarial deed or also known as an authentic deed whose contents do not match the original facts or reality. The authority of a Notary in creating authentic deeds is commensurate with their responsibility, as this responsibility continues to attach to the notary even after retirement, as stipulated in Law Number 2 of 2014. There are times when the notary makes a mistake in creating an authentic deed, whether intentional or unintentional, so when this happens later and causes losses to the parties involved, is the notary obliged to be held accountable for it? So, it needs to be discussed to what extent the responsibilities of the Notary are limited. The research method used is normative juridical. Research results show that if a Notary makes a mistake in an authentic deed they created, causing harm to others, as long as the aggrieved party can prove that the mistake was due to the Notary's negligence or intent, the Notary can be held accountable from the perspectives of general law, civil law, administrative law, and criminal law. When a Notary is proven to have intentionally or knowingly created or collaborated and signed a false deed, the notary can be charged with complicity in the forgery of a deed.

Abstract

This article discusses the legal issue of protecting the rights of children who are victims of incest rape after abortion in the law enforcement process. The crimes that occur should be resolved by the criminal justice system. In fact, child victims of incest rape have not received protection at every stage of the examination, from the investigation, prosecution to court decision. The importance of protecting child victims can be seen as a form of protection by the state in the form of administering justice. Apart from the completeness of statutory regulations regarding the protection of child victims, (the Witness and Victim Protection Agency), law enforcement officials, related government agencies and other relevant parties, the function of the judiciary plays an important role. This article aims first, to analyze the regulations regarding forms of protection for victims of incest rape in the criminal justice system. Second, it aims to analyze the enforcement of legal protection for child victims of incest rape in the judicial system. The method used in this article is a normative juridical research type using a statutory approach, conceptual approach and case approach. Analysis of legal materials, namely legal materials and literature that have been collected through systematic methods and then analyzed by inventorying, systematizing and interpreting all legal regulations and concepts according to the problems discussed. Substantially, from a regulatory perspective, a lot has been regulated regarding legal protection for child victims of incest, but in law enforcement it has not been able to provide protection, because the regulations for victim protection are still partially regulated. Studies of court decisions have not been able to accommodate the values of legal efficacy and the value of legal justice in providing legal protection to child victims of incest rape, especially in the criminal justice system. This study is important to carry out so that in the future there will be legal harmonization regarding legal protection for child victims of incest in the future.
