Abstract

This article aims to delve into how regulations and financial literacy policies can affect the growth of the Financial Technology (fintech) industry and contribute to increasing access to capital for Micro, Small, and Medium Enterprises (MSMEs). The focus of this research is to investigate the impact of regulations and financial literacy on access to capital for MSMEs through the use of financial technology. The research focuses on exploring the implementation of regulations and financial literacy policies in Thailand and Malaysia, as well as offering potential insights to deepen understanding of how regulations and financial literacy affect access to capital for MSMEs through the use of fintech in the context of Indonesia.The research method employs a doctrinal legal approach to analyze existing regulations and a literature review to understand the impact of financial literacy and financial technology. The research findings indicate that appropriate and responsive regulations, effective financial literacy programs, and good collaboration between the fintech industry and traditional financial institutions can enhance MSMEs' access to capital. The novelty of this research lies not only in its focus on Thailand and Malaysia but also in providing insights into the potential that can be developed within the context of Indonesia.  However, in the context of Indonesia, challenges such as technological infrastructure and resistance to change still pose serious obstacles.

Abstract

Usaha mikro kecil dan menengah (UMKM) memiliki peran yang sangat besar dalam perekonomian Indonesia, baik dari sisi penyerapan tenaga kerja maupun kontribusinya terhadap produk domestik bruto (PDB). Tantangan besar yang sering dihadapi pelaku UMKM dalam mengembangkan usahanya, terutama terkait dengan pemasaran dan manajemen keuangan. Apabila hal ini tidak diatasi maka UMKM yang sedang bertumbuh akan kalah bersaing. Seperti yang terjadi pada UMKM di Kelurahan Ganjar Asri memiliki kendala diantaranya kurangnya pemahaman strategi branding dan pacaking serta manajemen keuangannya yang masih buruk yang ditandai dengan belum tersusunnya laporan keuangan. Adapun metode pelaksaan dalam pelatihan ini yaitu terdiri dari 4 tahap yang meliputi tahap perencanaan, tahap persiapan, tahap pelaksanaan dan tahap evaluasi. Hasil dari kegiatan pengabdian ini yaitu pelaku UMKM dapat memehami penting branding dan packaging yang dapat meningkatkan daya saing di pasar. Serta pentingnya penyusunan laporan keuangan guna mengetahui kondisi keuangan usaha.

Abstract

Introduction: The Hajj pilgrimage presents unique health challenges due to the large gatherings, particularly affecting elderly participants with preexisting conditions. Health istithaah, referring to physical and mental readiness for Hajj participation, is crucial for ensuring the safety of pilgrims. This study aimed to identify the factors associated with health istithaah status among Indonesian Hajj pilgrims. Methods: This descriptive correlational study examined 1,305 pilgrims scheduled for the 2023 Hajj pilgrimage. The data collected included health istithaah status, age, gender, and medical diagnoses based on ICD-10. The analysis employed Chi-Square tests and multivariate logistic regression (p < 0.05). Results: Of the participants, 772 (59.2%) had unassisted health istithaah, while 533 (40.8%) required assistance. Diabetes mellitus showed the highest association with requiring assistance (PR = 4.938, 95% CI = 3.354–7.270, p = 0.001), followed by symptoms and signs not classified elsewhere (PR = 4.071, 95% CI: 3.091–5.362, p = 0.001) and essential hypertension (PR = 3.467, 95% CI = 2.565–4.685). Age and multiple diagnoses were significantly associated with health istithaah status (p = 0.001), while gender showed no significant association (p = 0.246). Conclusion: Age, multiple diagnoses, and chronic conditions, particularly diabetes, were key factors associated with requiring health istithaah assistance among Indonesian Hajj pilgrims. These findings emphasize the need for targeted health assessments and support for high-risk pilgrims.

Abstract

Indonesian National Police Regulation Number 8 of 2021 concerning the Handling of Criminal Acts Based on Restorative Justice has regulated police authority. This regulation was established as it is indeed necessary for the police to serve as a guideline in handling criminal acts through a restorative justice mechanism. The establishment of this regulation further emphasizes that the discretion provision in Article 18 of Law Number 2 of 2002 is highly urgent and needed in law enforcement practices. Repressive law enforcement efforts are increasingly considered less effective. The research problem formulated includes: First, what is the meaning of restorative justice as a complaint offense under Article 70 of Law Number 1 of 2023? Second, how is the implementation of restorative justice determination as a complaint offense at the level of authority within the Indonesian National Police? This study employs a normative juridical research method. The findings indicate that the application of restorative justice by law enforcement officials remains inconsistent, with varying interpretations at different stages, including investigation, prosecution, and trial processes. A review of the implementation of restorative justice for children in the Mojokerto District Court Decision Number: 11/Pid.Sus-Anak/2023/PN Mjk serves as an example of such inconsistencies. This issue arises due to the absence of explicit restorative justice provisions within the Indonesian Criminal Code (KUHP). The enactment of Law Number 1 of 2023 further reinforces Indonesian National Police Regulation Number 8 of 2021. The implementation of restorative justice determination for complaint offenses at the level of police authority following the enforcement of Article 70 of Law Number 1 of 2023 also stipulates the conditions under which restorative justice may be granted. The application of Article 70 of Law Number 1 of 2023, when aligned with Article 18 of Law Number 2 of 2002, grants police discretion to apply restorative justice in a manner that can be integrated with public interest considerations, particularly those oriented toward fines.

Abstract

Financial statements are the company's primary means of communication with stakeholders. External audits ensure the fairness of financial statements in accordance with accounting standards. However, delays in submitting financial statements (audit delay) are still a phenomenon in Indonesia, especially in the financial sector. This study aims to determine the effect of audit fees, audit opinions, and KAP size on audit delays in financial sector companies listed on the Indonesia Stock Exchange in 2019 - 2023. The data used in this study are secondary data obtained from financial statements and annual reports of financial sector companies listed on the Indonesia Stock Exchange in 2019 - 2023. The sampling technique in this study is the purposive sampling method according to predetermined criteria with a population of 104 companies during 2019 - 2023, and obtaining a final sample of 193. The analysis method used is multiple linear regression to test the relationship between independent variables, namely audit fees, audit opinions, and KAP size, to the dependent variable, namely audit delay, using the Statistical program for Social Science (SPSS) version 24. The results of the study indicate that audit fees have a significant negative effect on audit delay. High audit fees allow auditors to provide sufficient resources to complete the audit process on time. Audit opinions also have a negative effect on audit delay. Companies that receive an unqualified opinion tend to complete audit reports faster than companies that receive other opinions. KAP size has a negative effect on audit delay, where Big Four KAPs complete audits faster than non-Big Four KAPs.

Abstract

Financial service innovations are increasingly diverse and growing rapidly in line with the increase in information technology. Peer to peer lending (P2P Lending) is a breakthrough of financial institutions to serve various parties that need funding. This article intends to analyze the legal aspects and implementation of P2P Lending services in Indonesia. The research method uses a normative juridical approach, through the study of authoritative legal materials and supporting literature materials.  The study found that the Financial Services Authority Regulation Number 77/POJK.01/2016 concerning Information Technology-Based Money Lending and Borrowing Services, Financial Services Authority Regulation Number 13/POJK.02 /2018 concerning Digital Financial Innovation in the Financial Services Sector, Government Regulation Number 82/ 2012 concerning the Implementation of Electronic Transactions and Systems, Financial Services Authority Regulation Number: 1/ POJK.07/2013 concerning Financial Services Sector Consumer Protection are the national legal instrument that regulates this business activity. In addition, the code of ethics made by business associations also complements the regulations for organizing P2P Lending.  The lack of coordination between government agencies has led to ineffective supervision, resulting in illegal P2P Lending companies. The results of this study are expected to provide input for policy makers to improve regulations that can provide legal protection for the parties.

Abstract

This article examines the internet and social media which are increasingly used by the public, especially among teenagers. Through digital technology, people are constantly connected to each other. Along with the rise of various risky behaviors and crimes that use information technology, both as a means and a target. Based on doctrinal studies, the results show that regulations related to information technology and the Internet have not yet reached digital platform providers in creating a secure digital space. Sanctions and penalties for law violations and crimes are only intended for social media users. Efforts to create a safe and civilized digital space are carried out through policy breakthroughs, both at the ministry level and law enforcement agencies. The vulnerability of adolescents to threats in the digital space needs to be overcome with the support of the family as the smallest unit of society, through strengthening digital literacy. Digital skills are expected to improve youth’s ability to use the internet and social media for productive and useful activities. Digital literacy policies for teenagers are not only the responsibility of the state, but also the community, educators, and families.

Abstract

Wilayah Nias merupakan salah satu daerah yang rawan gempa di Sumatera Utara. Gerakan tektonik serta sesar di sepanjang wilayah Sumatera dikontrol dengan adanya batas antara lempeng Indo-Australia dan lempeng Eurasia bagian tenggara yang menjadi penyebab utama terjadinya gempa tersebut. Jika gempa terjadi, maka gelombang gempa akan merambat ke permukaan bumi dan akan memberikan dampak pergerakan tanah yang memiliki nilai percepatan tertentu. Pada penelitian ini bertujuan untuk menghitung intensitas gempa bumi di wilayah Kepulauan Nias, serta membuat zonasi berdasarkan nilai tersebut menggunakan software ArcGis 10.8. Data gempa yang diolah adalah data gempa sejak tahun 2016-2022 yang diambil dari website iris.edu dengan magnitudo ≥ 3 serta kedalaman hiposenter 10-900 Km yang terjadi di Kepulauan Nias dan sekitarnya. Analisi kerentanan gempa bumi dilakukan dengan menggunakan metode Esteva dengan mengacu pada peta percepatan puncak di Batuan Dasar (SB) yang menjadi acuan pada nilai percepatan tanah maksimum yang tepat. Dari hasil penelitian, nilai percepatan tanah maksimum wilayah Kepulauan Nias berkisar antara 0.243-5.482 gal . Lokasi dengan nilai percepatan tanah maksimum tertinggi berada di Kecamatan Mandrehe dan Kecamatan Lahewa. Nilai percepatan tanah maksimum yang didapat dari metode Esteva berbeda dengan nilai percepatan tanah maksimum yang ada pada peta acuan PuSGeN 2017.

Abstract

Conventional monitoring systems have several weaknesses, including limitations in acquiring real-time physical parameters, which impact performance. Additionally, human errors often hinder data quality, further compounded by the inability to respond swiftly to rapid changes in physical parameters due to diverse operating conditions. To address these challenges, an innovative method has been developed for solar panel current and voltage monitoring  using Internet of Things (IoT) technology. This system relies on the NodeMCU ESP8266 microcontroller and the INA219 sensor to monitor the current and voltage of the solar power system. Data obtained by the sensor is collected in real-time, stored in a cloud-based database, and visualized through a web platform. This allows users to monitor the system remotely and access solar panel performance information. Measurements indicate that discrepancies between manual and web-based data are within 2%. The average manual readings of PV voltage and current are 16.96 volts and 119.66 mA, while the web-based readings are 16.98 volts and 118.38 mA. The differences in voltage and current are 0.12% and 1.07%, respectively. The average battery voltage is recorded at 10.5 volts, while the DC motor load shows a voltage difference of 0.63% and a current difference of 1.15%. The battery power test also indicates a difference of 0.65%. This system is effective because it provides real-time access from any location, facilitates quick responses to anomalies, and supports maintenance planning by storing historical data.

Abstract

Bullying committed by children has become a serious concern within the juvenile justice system in Indonesia. Law No. 11 of 2012 concerning the Juvenile Justice System (SPPA) regulates legal protection for children in conflict with the law, including children who are perpetrators of bullying. This study aims to analyze the form of legal protection provided to children who commit bullying offenses and the application of diversion as the main effort in resolving juvenile cases outside of the judiciary. The research method used is normative juridical with a legislative approach and case study. The results of the study indicate that the SPPA Law prioritizes the principle of restorative justice, emphasizing guidance and rehabilitation for the child offender over criminal sanctions. Diversion becomes the main step in handling cases of children in conflict with the law, except in certain cases that meet the criteria for judicial processes. Therefore, the implementation of legal protection for children who commit bullying must be carried out optimally, considering the principle of the best interests of the child.
