Abstract

The increasing number of domestic violence cases so far, especially during COVID-19 in Medan City, makes there no longer a safe zone for children and women, especially housewives. Based on LBH APIK data that Medan City is in the red zone for domestic violence cases. With these economic difficulties, it is very risky for domestic violence, especially in the Covid-19 pandemic period which is recommended by the Government to stay at home or reduce employees in complying with Prokes, so that many companies or other businesses experience a major slump or loss. From the observation of the team also get many housewives who are just silent and do not report cases of domestic violence this is due to fear, shame and lack of knowledge. The methods used in this devotion are: 1. Health education with reproductive health materials of domestic violence victims; 2. PKPA staff training; 3. Assistance of PKPA staff in conducting reproductive health counseling to domestic violence victims; 4. Evaluation of program success: pre test and post test of PKPA staff and domestic violence victims of extension participants; 5. Socialization and training in application use Android-based prototype. The external target of this community service program activity is the formation of a group of women who become educators of Reproductive Health of women victims of domestic violence; Reproductive health module of KDRT victims, publication in issn-based journal, Video activities (youtube) and Harian Waspada Medan, Android Prototype Application, UU PKDRT.

Abstract

The lack of public awareness of the environment is a problem that is still sustainable today, due to lack of knowledge and still low public awareness to love the environment, especially in terms of greening, as evidenced by the increasing number of buildings without re-greening. so that concern for the environment itself is minimal. The movement of 500 trees or flower plants and forest plants, and carried out legal counseling activities on environmental conservation in Binjai City, aims to realize awareness of the people of Binjai City in maintaining environmental sustainability through understanding the paradigm of environmental protection and management as regulated in Law No. 32 of 2009 concerning Environmental Protection and Management. This legal counseling uses a statutory approach by first examining laws related to environmental conservation which aims at sustainable development. The paradigm of environmental conservation with the 3R system is Reuse (Reusing waste that can still be used or can function other), Reduce (Reduce everything that causes or causes waste), Recycle (Reprocessing waste or recycling into a product or item that can be useful), becomes a solution to maintain environmental sustainability.

Abstract

Most of the trash bins at school are conventional models. When you want to dispose of trash you have to open or push the lid on the trash can, sometimes the lid is dirty with garbage piling up because the cleaners rarely check the condition of the trash can, this makes students' interest and awareness low to throw garbage in place. The purpose of this research is to design a tool that can facilitate and attract students' interest in disposing garbage in its place and making it easier for janitors to check and control the contents of the waste. This research make the environment at SMK Yaspih Rajeg cleaner because most students are no longer lazy and hesitant to throw garbage in its place, supported by the performance of cleaners who are more optimal in checking and controlling the contents of the trash. This study uses several methods such as data collection and analytical methods (Structured Analysis and Design) with flowcharts. The result, smart trash can that uses Arduino Mega as a microcontroller combined with several sensors and modules such as ultrasonic sensors, infrared sensors, touch sensors, servo motors, and SIM800l V2 which presents various features in smart trash cans.

Abstract

The Indonesian government itself, in terms of eradicating corruption, has made improvements to the law regarding the eradication of corruption and the establishment of a Corruption Eradication Commission institution to support law enforcement. The government has established Law Number 31 of 1999 concerning the Eradication of Corruption Crimes as amended by Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Corruption Crimes. Therefore, it is important to examine unlawful acts in Corruption Crimes. This research is aimed at analyzing unlawful acts in Corruption Crimes which cause state losses in corruption cases, how to analyze the evidence of corruption crimes in the Medan District Court Decision Number 38/Pid.Sus-TPK/2022/PN Mdn, as well as analysis in Work on Road Improvement Work Projects Which Cause State Losses in Corruption Crime Cases in Medan District Court Decision Number 38/Pid.Sus-TPK/2022/PN Mdn. The research method used is normative juridical research, which is supported by primary and secondary data sources. All legal materials were collected using library research techniques using document study data collection tools. Analyzed qualitatively. In eradicating criminal acts of corruption, especially in the application of unlawful elements, we must be able to prove whether there has been an unlawful act in which there has been a violation of statutory regulations or failure to implement statutory regulations which then has the potential to cause financial losses to the State. In this research the defendant violated the provisions of Government Regulation Number 58 of 2005 concerning Regional Financial Management, Presidential Regulation Number 54 of 2010 concerning Procurement of Government Goods/Services and its amendments, and Minister of Home Affairs Regulation Number 13 of 2006 as amended by Minister of Home Affairs Regulation Number 21 of 2011 concerning the Second Amendment to Minister of Home Affairs Regulation Number 13 of 2016 concerning Guidelines for Regional Financial Management. Abstract

Mining of minerals without a permit is a mining activity that has a big impact, especially on the environment and the State administrative system. This study explores aspects of unlawful acts in cases of unlicensed mining that can be detrimental to the State and have an impact on the environment, focusing on the Bingai River Watershed, Langkat Regency. This research aims to reduce, overcome, and analyze the interpretation of unlawful acts and implement material law against excavated mining actors in the Bingai River Basin. This research uses an empirical juridical approach with descriptive-analytical methods. Data was obtained from case studies at the Langkat District Environmental Service, Sei Bingai District SDA and Environment and other related legal materials, as well as in-depth legal literature regarding mining without permits and law enforcement. The results of this research show that criminal law enforcement against perpetrators of C-quarry mining in the Bingai river basin faces complex challenges, including interpreting unlawful acts, applying clear legal principles, and efforts to prevent unauthorized C-quarry mining activities in the Bingai river basin. . This research contributes to an understanding of the legal dynamics in enforcing criminal law against perpetrators of the criminal act of excavated mining in the Bingai river basin, as well as providing a basis for improving the law enforcement system and efforts to overcome the criminal act of excavated mining in the Bingai river basin.

Abstract

The illegal dumping of B3 waste into the environment can cause serious negative impacts. However, in principle, the dumping of B3 waste is permitted as long as it complies with the established terms and procedures. In reality, there are still many cases of B3 waste dumping without permits, which may lead to criminal liability, both for corporations and individuals. This research focuses on the legal framework regulating B3 waste disposal in Indonesia, the forms of corporate criminal liability in environmental pollution cases caused by B3 waste dumping, and the application of such liability in court decisions. The study applies normative juridical research methods using secondary data, including primary, secondary, and tertiary legal materials. Data were collected through literature review techniques and analyzed qualitatively. The results show that the regulation of B3 waste dumping in Indonesia is governed by Law No. 32 of 2009, Law No. 6 of 2023, Government Regulation No. 22 of 2021, and Minister of Environment and Forestry Regulation No. 6 of 2021. The forms of corporate criminal liability are regulated in the 2023 Criminal Code, which allows for criminal sanctions to be imposed on corporations, their executives, or both. Furthermore, Article 116 of the Environmental Protection and Management Law and Supreme Court Regulation No. 1 of 2023 also regulate corporate criminal liability in environmental cases. The application of corporate criminal liability to PT Synergy Oil Nusantara in Batam District Court Decision No. 491/Pid.Sus/2023/PN Btm was found to contain legal errors. However, the application of criminal liability to PT Datonglightway International Technology in Serang District Court Decision Number 89/Pid.Sus/2024/PN Srg was appropriate.

Abstract

This study aims to analyze legal regulations, forms of criminal liability, and legal considerations of judges regarding business entities that commit environmental pollution exceeding the established quality standards. A good and healthy environment is a fundamental right of every citizen as guaranteed in Article 28H paragraph (1) of the 1945 Constitution of the Republic of Indonesia and further regulated in Law Number 32 of 2009 concerning Environmental Protection and Management. However, in practice, environmental pollution by business entities still frequently occurs, thus giving rise to legal issues related to the effectiveness of enforcing corporate criminal liability. This study uses a normative juridical research method with a descriptive analytical nature, a statutory regulatory approach, and case studies. Research data were obtained through literature studies covering relevant laws and regulations, legal documents, books, dictionaries, mass media, and internet sources, then analyzed qualitatively. The results of the study indicate that: (1) legal regulations related to violations of environmental quality standards normatively reflect the values ​​of justice, legal certainty, and legal benefits, but the effectiveness of their implementation still depends on coordination between law enforcement agencies; (2) the criminal liability of business entities is based on the provisions of Article 116 of Law Number 32 of 2009 which allows for the prosecution of legal entities and/or their managers; and (3) the legal considerations of judges in decisions regarding the criminal liability of business entities are based on the application of positive law while still paying attention to the values ​​of justice, benefit and legal certainty.

Abstract

Abstract: The main challenge in managing the EEZ is law enforcement. Pollution, illegal fishing, and excessive exploitation of resources often occur in this area. Therefore, the state must have sufficient capacity to monitor and enforce the law to protect the marine ecosystem. Effective law enforcement in the EEZ also requires international cooperation, especially when pollution or resource exploitation issues involve more than one country. The unclear regulation of the area of duty between law enforcement agencies that have similar duties, functions, and authorities in the Indonesian Exclusive Economic Zone (EEZ) has led to disharmony and overlapping authorities in the implementation of law enforcement. This study aims to determine the normative juridical research method, namely a method that refers to legal norms carried out by means of literature studies related to the problems studied, this study has a descriptive nature, and the data is analyzed qualitatively. The research results indicate that there is overlapping authority in conducting investigations in the EEZ, particularly in cases of pollution caused by the illegal dumping of hazardous waste by foreign vessels carrying out transshipment, which damages the ecosystem. This creates overlapping authority in investigations, necessitating harmonization and clear regulatory reform to determine the authority to conduct investigations in the EEZ. Keywords: Exclusive Economic Zone, Environmental Pollution, Hazardous Waste Abstrak: Tantangan utama dalam pengelolaan ZEE adalah penegakan hukum. Pencemaran, penangkapan ikan ilegal, dan eksploitasi sumber daya yang berlebihan sering kali terjadi di wilayah ini. Oleh karena itu, negara harus memiliki kapasitas yang cukup untuk mengawasi dan menegakkan hukum guna melindungi ekosistem laut. Penegakan hukum yang efektif di ZEE juga memerlukan kerjasama internasional, terutama ketika masalah pencemaran atau eksploitasi sumber daya melibatkan lebih dari satu negara. Ketidakjelasan pengaturan wilayah tugas antar lembaga penegak hukum yang memiliki kesamaan dalam tugas, fungsi, dan wewenang di wilayah Zona Ekonomi Eksklusif (ZEE) Indonesia telah menimbulkan disharmoni dan tumpang tindih kewenangan dalam pelaksanaan penegakan hukum penelitian ini bertujuan untuk mengetahui Metode penelitian yuridis normatif, yaitu metode yang mengacu pada norma-norma hukum yang dilakukan dengan cara studi kepustakaan yang berkaitan dengan permasalahan yang diteliti, penelitian ini memiliki sifat deskriptif, serta data yang dianalisis secara kualitatif Hasil penelitian menunjukan bahwa terjadi tumpang tindih kewenangan dalam melakukan penyidikan di zee terutama pada kasus pencemaran oleh pembuangan limbah b3 oleh kapal asing yang melakukan transihpment secara illegal yang merusak ekosistem menyebabkan tumpang tindih kewenangan dalam penyidikan sehingga perlunya harmonisasi dan reformasi regulasi yang jelas untuk menentukan kewenangan melakukan penyidikan di zee Kata Kunci : Zona Ekonomi Eksklusif, Pencemaran lingkungan, Limbah B3
