Abstract

Ideally, the Principle of Legality serves as the fundamental basis in criminal law to ensure legal certainty and justice. However, in reality, with the enactment of Law No. 1 of 2023, there has been controversy regarding the evolving application of the law in Indonesia. The issue that arises is how this change impacts the application of criminal law, particularly in the context of protecting collective and individual interests. This study aims to analyze the position and consequences of the Principle of Legality in the development of criminal law in Indonesia. The method used is normative juridical research with a descriptive qualitative approach. The results of the study show that the Principle of Legality in Law No. 1 of 2023 emphasizes the principles of lex scripta, lex stricta, lex certa, and lex praevia, which reinforce legal certainty. The consequence of its application for the future of criminal law is the creation of a principle that is more adaptive and relevant to the diverse needs and culture of Indonesian society.

Abstract

The implementation of PERMEN-LH Number 7 of 2014 as a legal basis for imposing additional penalties for corporations raises problems because the related regulations have weaknesses in implementation, such as: aspects of legal synchronization, overlapping authority, potential legal consequences in the form of lawsuits against unlawful acts and uncertainty in determining the extent of the affected area due to criminal acts that affect the amount of costs incurred by corporations as additional penalties. The purpose of this study is to find out and analyze To find out and analyze the implementation of the Minister of Environment Regulation Number 7 of 2014 in several environmental criminal cases. To find out and analyze the legal consequences in the Minister of Environment Regulation Number 7 of 2014 on the enforcement of environmental criminal law in Indonesia. Additional penalties as in Article 119 UUPPLH do not have detailed implementing rules regarding the mechanism of its application. PERMEN-LH Number 7 of 2014 which is often used by law enforcement officials in environmental cases has weaknesses such as: not in sync with Article 119 of Law Number 32 of 2009 concerning Environmental Protection and Management; there is an overlap of authority between the Ministry of Finance and the Ministry of Environment and Forestry in terms of environmental restoration; and lack of certainty in calculating the extent of the affected area due to criminal acts. The imposition of additional penalties in the form of repairs due to criminal acts that are converted into a sum of money in Decision Number 256 / Pid.sus / PN Rgt; Case Number: 37 / Pid.Sus-LH / 2018 / PN; Case Number 349 / PID.B-LH / 2019 / PN.Plw has not been able to provide protection for the environment because it is considered non-tax state revenue (PNBP), which is entirely deposited into the State Treasury, thus the funds cannot be used as restoration or environmental improvement funds

Abstract

Sistem peradilan pidana dalam memberikan efek jera dapat dilakukan melalui penerapan hukuman premium remedium salah satunya untuk penegakan Tindak Pidana Korupsi di bidang perbankan pada Putusan Pengadilan Negeri Medan Nomor 41/Pid.Sus-TPK/2020/PN Mdn. Permasalahan dalam Penelitian ini adalah pertanggung jawaban hukum pidana terhadap tindak pidana korupsi dalam bidang perbankan, penerapan Primum Remedium dalam penegakan hukum tindak pidana korupsi dan analisa terhadap putusan Majelis Hakim berdasarkan Putusan Nomor 41/Pid.Sus-TPK/2020/PN Mdn.  Metode penelitian yang digunakan dalam penelitian ini adalah jenis penelitian normatif dan sifat penelitian deskriptif. Pengumpulan data dilakukan melalui studi kepustakaan guna memperoleh bahan hukum primer, sekunder dan tersier. Kemudian bahan tersebut dianalisa secara kualitatif dan diakhiri dengan penarikan kesimpulan secara deduktif.  Hasil penelitian ini adalah pertanggung jawaban hukum pidana terhadap tindak pidana korupsi dalam bidang perbankan diatur dalam Undang-Undang Pemeberantasan Tindak Pidana Korupsi yang secara khusus memang dimaksudkan untuk memberantas tindak pidana yang merugikan keuangan negara. Penerapan Primum Remedium dalam UU Pemberatan Tindak Pidana Korupsi dapat dilihat dari adanya ketentuan sanksi pidana lebih dimaksudkan untuk memberikan pidana yang setimpal dengan perbuatan (kejahatan). Putusan Majelis hakim Perkara dalam Perkara Nomor 41/Pid.Sus-TPK/2020/PN Mdn tidak relevan sebagai perwujudan penerapan Primum Remedium. Hal tersebut dapat diketahui bahwa baik majelis hakim pada pengadilan negeri, pengadilan tinggi dan kasasi terkesan tidak menunjukkan pembentukan anti korupsi yang bisa dilihat hanya setengah dari pidana yang dituntut oleh jaksa yang dikabulkan oleh majelis hakim.

Abstract

The Indonesian government itself, in terms of eradicating corruption, has made improvements to the law regarding the eradication of corruption and the establishment of a Corruption Eradication Commission institution to support law enforcement. The government has established Law Number 31 of 1999 concerning the Eradication of Corruption Crimes as amended by Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Corruption Crimes. Therefore, it is important to examine unlawful acts in Corruption Crimes. This research is aimed at analyzing unlawful acts in Corruption Crimes which cause state losses in corruption cases, how to analyze the evidence of corruption crimes in the Medan District Court Decision Number 38/Pid.Sus-TPK/2022/PN Mdn, as well as analysis in Work on Road Improvement Work Projects Which Cause State Losses in Corruption Crime Cases in Medan District Court Decision Number 38/Pid.Sus-TPK/2022/PN Mdn. The research method used is normative juridical research, which is supported by primary and secondary data sources. All legal materials were collected using library research techniques using document study data collection tools. Analyzed qualitatively. In eradicating criminal acts of corruption, especially in the application of unlawful elements, we must be able to prove whether there has been an unlawful act in which there has been a violation of statutory regulations or failure to implement statutory regulations which then has the potential to cause financial losses to the State. In this research the defendant violated the provisions of Government Regulation Number 58 of 2005 concerning Regional Financial Management, Presidential Regulation Number 54 of 2010 concerning Procurement of Government Goods/Services and its amendments, and Minister of Home Affairs Regulation Number 13 of 2006 as amended by Minister of Home Affairs Regulation Number 21 of 2011 concerning the Second Amendment to Minister of Home Affairs Regulation Number 13 of 2016 concerning Guidelines for Regional Financial Management. Abstract

Mining of minerals without a permit is a mining activity that has a big impact, especially on the environment and the State administrative system. This study explores aspects of unlawful acts in cases of unlicensed mining that can be detrimental to the State and have an impact on the environment, focusing on the Bingai River Watershed, Langkat Regency. This research aims to reduce, overcome, and analyze the interpretation of unlawful acts and implement material law against excavated mining actors in the Bingai River Basin. This research uses an empirical juridical approach with descriptive-analytical methods. Data was obtained from case studies at the Langkat District Environmental Service, Sei Bingai District SDA and Environment and other related legal materials, as well as in-depth legal literature regarding mining without permits and law enforcement. The results of this research show that criminal law enforcement against perpetrators of C-quarry mining in the Bingai river basin faces complex challenges, including interpreting unlawful acts, applying clear legal principles, and efforts to prevent unauthorized C-quarry mining activities in the Bingai river basin. . This research contributes to an understanding of the legal dynamics in enforcing criminal law against perpetrators of the criminal act of excavated mining in the Bingai river basin, as well as providing a basis for improving the law enforcement system and efforts to overcome the criminal act of excavated mining in the Bingai river basin.

Abstract

Karena status melalui sosial media Instagram, saksi korban Fitriani Manurung tidak terima dan kemudian melaporkan terdakwa Febi Nur Amalia ke Penyidik ​​Polres Medan Kota karena menyerang kehormatannya melalui media sosial dipersangkakan melanggar Pasal 27 ayat 3 jo Pasal 45 ayat 3 Undang-Undang Nomor 19 Tahun 2019 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Oleh karena itu, Tujuan penelitian ini untuk menjelaskan tentang formulasi tindak pidana pertanggungjawaban pidana dalam Undang-Undang Informasi dan Transaksi elektronik, analisis yuridis oleh hakim terhadap tindak pidana Informasi dan Transaksi Elektronik pada putusan Pengadilan Negeri Medan Nomor 3563/Pid.Sus/2019/PN.Mdn, serta hambatan yuridis dalam penegakan hukum oleh hakim terhadap tindak pidana Informasi dan Transaksi Elektronik. Berdasarkan hasil Penelitian Perkara kedudukan PN Medan sebagai berikut : Terdakwa Febi Nur Amalia atas permintaan saksi korban Fitriani Manurung pada tanggal 12 Desember 2016 meminjamkan uang sebesar Rp. 70.000.000,- (tujuh puluh juta rupiah) melalui transfer ke rekening suami korban. setelah lama tidak dikembalikan, maka pada tahun 2017 terdakwa berusaha menagih hutang kepada saksi korban Fitriani Manurung baik melalui pesan WA maupun datang ke rumahnya namun tidak mendapat respon dari korban saksi Fitriani Manurung dan selalu berusaha menghindar dan tidak mengakui adanya hutang tersebut. Therefore, the purpose of this study is to explain the formulation of criminal acts of criminal responsibility in the Electronic Information and Transaction Law, juridical analysis by judges on criminal acts of Information and Electronic Transactions in the Medan District Court decision Number 3563/Pid.Sus/2019/PN Mdn, as well as juridical obstacles in law enforcement by judges against criminal acts of Information and Electronic Transactions. Based on the results of the research on the position of the Medan District Court as follows: The defendant Febi Nur Amalia at the request of the victim witness Fitriani Manurung on December 12, 2016 lent Rp. 70,000,000,- (seventy million rupiah) by transfer to the victim's husband's account. after a long time not being returned, then in 2017 the defendant tried to collect a debt from the victim witness Fitriani Manurung either through WA messages or came to his house but did not get a response from the victim witness Fitriani Manurung and always tried to avoid and did not admit the existence of the debt. Abstract

Penyalahgunaan narkotika dinilai sudah sangat meresahkan masyarakat dikarenakan banyaknya dampak negatif yang ditimbulkan dari penggunaan narkotika ini. Penegakan hukum terhadap pelaku penyalahgunaan narkotika juga dinilai meresahkan karena tidak mewujudkan kepastian hukum. Salah satunya yaitu penjatuhan pidana dibawah sanksi pidana minimum khusus dalam Putusan Mahkamah Agung Republik Indonesia Nomor: 775 K/ Pid. Sus/ 2020. Pengaturan tindak pidana narkotika dikaitkan dengan sanksi di bawah sanksi minimum tidak mewujudkan kepastian hukum. Pengaturan narkotika sebagaimana yang diatur dalam BAB XV Undang-Undang Nomor 35 Tahun 2009 Tentang Narkotika telah disertai ketentuan pidana minimum yang jelas dan terperinci. Pedoman hakim dalam menjatuhkan pidana dibawah ancaman sanksi pidana minimum khusus kepada pelaku tindak pidana narkotika berpedoman pada Asas kebebasan hakim yang menjunjung tinggi keadilan. Selain itu hakim juga berpedoman pada Surat Edaran Mahkamah Agung Nomor 03 Tahun 2015 Tentang Pemberlakuan Rumusan Hasil Rapat Pleno Kamar Mahkamah Agung Tahun 2015 Sebagai Pedoman Pelaksanaan Tugas Bagi Pengadilan. Penerapan sanksi pidana di bawah ancaman pidana minimum khusus dalam perkara tindak pidana narkotika berdasarkan putusan Mahkamah Agung Republik Indonesia Nomor: 775 K/ PID. SUS/ 2020 dapat dikemukakan bahwa, Majelis Hakim yang memeriksa dan mengadili perkara dalam telah salah menerapkan hukum karena telah menjatuhkan pidana dibawah ancaman sanksi minimum khusus yang telah diatur dalam pasal 112 ayat (1) Undang-Undang Nomor 35 Tahun 2009 Tentang Narkotika. Hal ini menimbulkan ketidakpastian dalam penegakan hukum yang telah diatur Undang-Undang sebagaimana mestinya. Kata kunci: Minimun Khusus, Narkotika, Sanksi Pidana. Abstract The abuse of narcotics is considered very unsettling and has a negative impact on the use of narcotics. The application of the law to narcotics offenders is also considered unsettling because it does not create legal certainty. One of them is the imposition of crimes under special minimum criminal sanctions in the Decision of the Supreme Court of the Republic of Indonesia Number: 775 K / Pid. Sus / 2020. The regulation of narcotics crime linked to sanctions under the minimum sanction does not create legal certainty. Narcotics regulation as regulated in Chapter XV Law Number 35 Year 2009 concerning Narcotics has been accompanied by clear and detailed minimum criminal provisions. Guidelines for judges in imposing crimes under the threat of a special minimum criminal sanction against narcotics offenders are guided by the principle of freedom of judges who uphold justice. In addition, the judges also refer to the Supreme Court Circular Number 03 of 2015 concerning the Enforcement of the Formulation of the Results of the 2015 Supreme Court Chamber Plenary Meeting as Guidelines for the Implementation of Duties for the Court. The application of criminal sanctions under the threat of a special minimum penalty in narcotics crime cases based on the decision of the Supreme Court of the Republic of Indonesia Number: 775 K / PID. SUS / 2020 can be argued that, the Panel of Judges examining and adjudicating a case has wrongly applied the law because it has imposed a crime under the threat of a special minimum sanction as stipulated in article 112 paragraph (1) of Law Number 35 of 2009 concerning Narcotics. Abstract

Peredaran dan penyalahgunaan narkotika merupakan salah satu permasalahan nasional yang dipandang serius oleh pemerintah, karena dapat menyebabkan rusaknya moral bangsa, Pelaku tindak pidana narkotika tidak jarang mendapatkan hukuman berdasarkan putusan pengadilan yang kurang memenuhi rasa keadilan dan kepastian hukum. Pada kasus-kasus narkotika, terdapat beberapa pasal yang sering digunakan untuk menjerat pelaku ialah Pasal 114, Pasal 112, dan Pasal 127 Undang-undang Nomor 35 Tahun 2009 Tentang Narkotika. Ketiga pasal tersebut, terdapat dua pasal yang multitafsir dan ketidak jelasan rumusan yaitu pada Pasal 112 dan Pasal 127 Undang-undang Nomor 35 Tahun 2009 tentang Narkotika. Pasal multitafsir tersebut akan mengakibatkan para pelaku kejahatan narkotika (pengedar) akan berlindung seolah-olah dia korban kejahatan narkotika. Bahwa hal tersebut akan berdampak pada penjatuhan hukuman dengan hukuman yang singkat sehingga menimbulkan ketidakadilan pada proses pelaksanaannya. Oleh karena itu tujuan dari penelitian ini untuk menganalisa, mengidentifikasi formulasi dan perbedaan kualifikasi Pasal 112 dan Pasal 127 Ayat 1 huruf a Undang-undang Nomor 35 Tahun 2009 tentang Narkotika serta mengkaji dasar pertimbangan Hakim dalam menerapkan Pasal 112 dan Pasal 127 Ayat 1 huruf a Undang-undang Nomor 35 Tahun 2009 tentang Narkotika dalam Putusan Nomor 1023/Pid.Sus/2018/PN.Rap Nomor 762/Pid.Sus/2017/PN.Rap, dan Nomor 712/Pid.Sus/2017/PN.Rap. Kata kunci: Formulasi, Kualifikasi, Pengeder dan Penyalahguna Narkoba. Abstract Drug traffic and drug abuse are one of the main national and serious problem because they can mar the people's morality. However, the perpetrators of drug criminal offense are treated unfairly in court for justice and legal certainty. In the cases of narcotics, the articles imposed on the perpetrators are Article 114, , Article 112, and Article 127 of Law No. 35/2009 on Narcotics. Of the three Articles above, two of them (Article 112 and Article 127) have multi-interpretation and unclearness of formula about narcotics which can cause the perpetrators (drug dealers) to get the alibi as if he were the victim. That it will cause the sentence will be reduced so that there will be injustice in its implementation. The objective of the research is to analyze and to identify the formulation and the difference of the qualification of Article 112 and Article 127, paragraph 1 letter a of Law No. 35/2009 on Narcotics and analyzed the judges' consideration in implementing of these two Articles in the Verdicts Number 1023/Pd.Sus/2018/PN.Rap, Number 762/Pid.Sus/2017/PN.Rap, and Number 712/Pid.Sus/ Pid.Sus/2017/PN.Rap. Abstract

Dominus Litis merupakan asas universal yang melekat pada Jaksa. Jaksa selaku penuntut umum memiliki peran sentral dalam sistem peradilan pidana. Kehadiran Perja Nomor 15 Tahun 2020 Tentang Penghentian Penuntutan berdasarkan keadilan restoratif menjadi landasan bagi Jaksa untuk melakukan penegakan hukum pidana berorientasi keadilan restoratif. Penegakan hukum pidana secara umum maupun berorientasi keadilan restoratif yang dilakukan oleh Jaksa selaku Dominus Litis terdapat kelemahan dan kendala yang ditemukan dalam proses penerapannya. Esensi asas Dominus Litis yang melekat pada Jaksa belum optimal. Pada Tahap Pra Penuntutan, Jaksa selaku Dominus Litis hanya sebatas menerima SPDP dan meneliti berkas dari penyidik untuk ditindak lanjuti ke tahap penuntutan atau dikembalikan ke penyidik. Penerapan penghentian penuntutan berdasarkan keadilan restoratif oleh Jaksa selaku Dominus Litis sudah sesuai dan selaras dengan nilai-nilai yang terkandung dalam pancasila khususnya pada sila keempat. Akan tetapi dalam penerapanya ditemukan kendala-kendala antara lain:Substansi Hukum, Struktur Hukum, dan Budaya Hukum.Penguatan kewenangan jaksa selaku Dominus Litis dalam penegakan hukum pidana berorientasi keadilan restoratif dapat dilakukan dengan memformulasikan konsep keadilan restoratif kedalam KUHAP. Namun demikian, dalam proses pembaharuan KUHAP membutuhkan banyak aspek pertimbangan serta memakan waktu yang begitu lama. Hal yang paling mungkin dilakukan dalam waktu dekat yaitu melakukan sinergitas antar lembaga Polri Dan Kejaksaan untuk menerapkan asas Dominus Litis dalam penegakan hukum pidana berorientasi keadilan restoratif. Kata kunci: Dominus Litis, Jaksa, Keadilan Restoratif. Abstract Dominus Litis is a universal principle attached to the Prosecutor. The prosecutor as the public prosecutor has a central role in the criminal justice system. The presence of Perja Number 15 of 2020 concerning Termination of Prosecution based on restorative justice is the basis for the Prosecutor to enforce restorative justice-oriented criminal law. The enforcement of criminal law in general and restorative justice oriented carried out by the Prosecutor as Dominus Litis has weaknesses and obstacles that are found in the process of its application.the essence of the Dominus Litis principle attached to the Prosecutor is not optimal. In the Pre Prosecution Stage, the Prosecutor as Dominus Litis is only limited to receiving SPDP and examining files from investigators to be followed up to the prosecution stage or returned to investigators. The application of the termination of prosecution based on restorative justice by the Prosecutor as Dominus Litis is appropriate and in line with the values contained in Pancasila, especially in the fourth precept. However, in its implementation, there were obstacles, including: Legal Substance, Legal Structure, and Legal Culture. Strengthening the authority of the prosecutor as Dominus Litis in the enforcement of restorative justice-oriented criminal law can be done by formulating the concept of restorative justice into the Criminal Procedure Code. However, the process of reforming the Criminal Procedure Code requires many aspects of consideration and takes such a long time. The most likely thing to do in the near future is to synergize between the institutions of the Police and the Prosecutor's Office to apply the Dominus Litis principle in the enforcement of restorative justice-oriented criminal law. Abstract

Survei Nasional Penyalahgunaan Narkoba 2021 menunjukkan ganja sebagai narkotika yang paling sering disalahgunakan, mencapai 41,4%. Meskipun upaya pemusnahan ladang ganja dilakukan dalam rencana aksi pemberantasan, keberadaan ladang-ladang yang belum terungkap masih mungkin di Provinsi Sumatera Utara. Oleh karena itu, permasalahan ladang ganja memerlukan perhatian serius, khususnya terkait kebijakan hukum pidana oleh BNN Provinsi Sumatera Utara. Penelitian ini menggunakan metode hukum yuridis normatif yang deskriptif analitis dengan pengumpulan data dari bahan hukum primer, sekunder, dan tersier melalui wawancara, serta dianalisis secara kualitatif. Hasil penelitian ditemukan bahwa meskipun kebijakan hukum pidana dalam pemberantasan penyalahgunaan narkotika dilaksanakan oleh eksekutif, perlu dicatat bahwa beberapa delik tindak pidana narkotika yang diatur dalam Undang-Undang Nomor 35 Tahun 2009 tidak diatur lagi dalam Undang-Undang Nomor 1 Tahun 2023 tentang KUHP. BNN Provinsi Sumatera Utara telah melakukan pemusnahan ladang ganja pada tahun 2022 di empat titik Pegunungan Tor Sihite Kabupaten Mandailing Natal.
