Abstract

This study aims to provide an explanation of the marriage system that exists in the Dayak Ngaju tribe, Central Kalimantan, and to explain that the Dayak Ngaju tribe has redundant customary institutions that have been recognized in the Regional Regulation of Central Kalimantan Province Number 16 of 2008 concerning Central Kalimantan Dayak Customary Institutions. Traditional marriages carried out by the community are used as a cultural characteristic of the Ngaju Dayak people, the existence of a Dayak Traditional Institution can strengthen traditional marriage because Dayak Traditional Institutions have rules and conditions that must be fulfilled by both men and women. If the rules or conditions are violated later will be obliged to pay a material fine. The purpose of holding a marriage agreement because it is to maintain the preservation of customs so that no divorce occurs. Because basically in all religions divorce is prohibited in a marriage, and the existence of a marriage agreement can be used as a guideline in a household so that they have the fear of not easily carrying out a divorce, because, in the marriage agreement, the parties must carry out the contents of the marriage agreement one way or another. parties must be able to pay the fine or singer

Abstract

Manding Village in Bantul Regency is known as a leather craft center with significant creative economic potential. However, most Micro, Small, and Medium Enterprises (UMKM) in the area have limited understanding of trademark protection and registration procedures. This condition weakens product identity and increases the risk of ownership disputes. This community service program aims to improve legal awareness and technical capacity among local entrepreneurs regarding trademark registration as a form of intellectual property rights protection. The methods used were legal education and direct technical assistance with leather craftsmen in Manding. Assistance was provided to two business partners, Crostoso Leather and GUDUKU, covering all registration stages from trademark search, account creation, form completion, to submission via merek.dgip.go.id. The results showed a significant improvement in participants’ understanding and ability to independently register their trademarks. Moreover, legal awareness and motivation to register trademarks increased substantially. This activity contributed to strengthening local product identity and promoting economic independence through intellectual property rights protection.

Abstract

Shift kerja banyak diterapkan dalam industri minyak dan gas untuk menjaga kontinuitas operasional selama 24 jam; namun, sistem ini dapat berdampak negatif terhadap kesehatan dan keselamatan pekerja. Penelitian ini bertujuan untuk menganalisis hubungan antara shift kerja, stres kerja, dan kelelahan kerja pada pekerja industri minyak dan gas melalui tinjauan literatur sistematis. Pencarian literatur dilakukan menggunakan database PubMed, ScienceDirect, dan Google Scholar untuk publikasi tahun 2020–2025 dengan kata kunci “shift work,” “stress,” “fatigue,” dan “oil and gas industry.” Pemilihan studi mengikuti pedoman PRISMA, menghasilkan 21 artikel relevan untuk dianalisis secara deskriptif. Temuan menunjukkan bahwa shift kerja—terutama shift malam dan jam kerja panjang—berkaitan erat dengan peningkatan stres dan kelelahan pada pekerja. Faktor seperti beban kerja berlebih, dukungan manajemen yang terbatas, gangguan ritme sirkadian, dan budaya keselamatan yang lemah turut meningkatkan risiko kesalahan manusia dan kecelakaan kerja. Penerapan Fatigue Risk Management System (FRMS), penjadwalan ergonomis, waktu istirahat yang cukup, serta penguatan budaya keselamatan terbukti efektif dalam mengurangi kelelahan dan meningkatkan kinerja. Tinjauan ini menekankan pentingnya integrasi strategi keselamatan dan kesehatan kerja untuk meningkatkan kesejahteraan pekerja, menurunkan risiko kecelakaan, dan meningkatkan produktivitas dalam sektor minyak dan gas. Abstract

Sanksi kerja sosial di Indonesia saat ini telah ditetapkan sebagai salah satu jenis pidana utama dalam Kitab Undang-Undang Hukum Pidana (KUHP) yang terbaru. Hukuman ini berfungsi sebagai pilihan pengganti atau tambahan bagi hukuman penjara, terutama untuk pelaku kejahatan ringan. Studi ini bertujuan untuk mengkaji implementasi kerja sosial dalam sudut pandang KUHP yang terbaru dengan pendekatan keadilan rehabilitatif. Tujuannya adalah memberikan kesempatan kepada pelaku tindak pidana untuk memperbaiki diri melalui kerja sosial, tanpa merasakan dampak buruk dari pemenjaraan, serta dapat mengurangi overcapacity di lembaga pemasyarakatan. Hukuman kerja sosial ini dianggap sebagai suatu upaya pemidanaan yang bersifat humanis dan memperhatikan hak asasi manusia. Pendekatan keadilan pemulihan ini fokus pada usaha penyembuhan dan reintegrasi pelaku ke dalam komunitas. Dengan penelitian ini, diharapkan dapat memberikan ilustrasi tentang penerapan hukuman, peraturan, dan fungsi lembaga terkait sanksi pidana kerja sosial sebagai bagian dari pembaruan hukum terkait sistem pemidanaan di Indonesia.

Abstract

Climate change has intensified debates over responsibility for loss and damage suffered by states and communities most vulnerable to its impacts. Rising sea levels, extreme weather events, ecosystem degradation, and economic disruption have generated irreversible harms that cannot be addressed solely through mitigation and adaptation. This article examines the central question of who should bear responsibility for climate-related loss and damage under international law, with a particular focus on the obligations of states. It analyzes the legal foundations of state responsibility, including principles of common but differentiated responsibilities (CBDR), equity, due diligence, and the prevention of transboundary harm. The study situates loss and damage within the framework of key international instruments such as the United Nations Framework Convention on Climate Change, the Paris Agreement, and decisions of the Conference of the Parties, including the establishment of mechanisms addressing loss and damage. It explores how customary international law and emerging climate jurisprudence contribute to clarifying states’ duties, particularly in relation to historical emissions, capacity to respond, and the protection of vulnerable populations. The article also considers the role of compensation, financial assistance, and international cooperation as potential expressions of legal and moral accountability. While international law does not yet provide a comprehensive or enforceable regime for climate loss and damage, the analysis demonstrates that evolving legal norms increasingly recognize differentiated state obligations. The article argues that developed states, due to their greater historical contributions to climate change and superior resources, bear heightened responsibilities to support affected states through finance, technology transfer, and capacity-building. Ultimately, the paper concludes that addressing climate loss and damage requires strengthening legal accountability while fostering equitable cooperation to ensure climate justice and sustainable development for present and future generations.

Abstract

Violence against children in educational environment, including Islamic boarding schools, is a serious issue with long-term impacts on children's physical, psychological, and social development. Forms of violence include physical, psychological, sexual, and bullying, which, although often unseen, can cause trauma, mental disorders, decreased academic performance, and even deviant behavior in the future. This research aims to analyze efforts to prevent violence against children in Islamic boarding schools based on child protection policies, and to examine fair law enforcement through a study of Supreme Court Decision Number 5642 K/Pid.Sus/2022. The method used is empirical legal, combining the analysis of legislation with field facts. The research findings indicate that preventing violence requires synergy between the government, pesantren caretakers, families, and society through legal socialization, fostering a safe environment, enhancing educators' capacity, and providing reporting mechanisms such as the Bullying Box. A legal analysis of Supreme Court Decision No. 5642 K/Pid.Sus/2022 revealed that the defendant, an educator, was found guilty of repeated sexual violence against 12 underage female students and sentenced to death. This decision affirms the application of the principle of the best interest of the child through the awarding of restitution, the handover of the victim baby's custody to the local government, and the prohibition of victim blaming. Law enforcement in this case combines legal certainty, utility, and justice, not only punishing the perpetrator but also restoring the victim, providing a deterrent effect, and strengthening the commitment to child protection in religious-based educational environments.

Abstract

Penal Code Number. 1 of 2023 revitalizes the adultery article which was previously removed in the old Penal Code. This sparked heated debate about the legal politics behind the criminalization of adultery and its implications for human rights, public morality, and the effectiveness of law enforcement. The criminalization of adultery is based on arguments of morality, family protection, and prevention of other criminal acts. Despite noble intentions, the criminalization of adultery raises concerns about potential invasions of privacy, gender discrimination, and abuse of power. It is important to seek a balance between fair and civilized law enforcement with respect for human rights. Narrow and proportional interpretation, a restorative justice approach, and prevention education are key. This research was carried out by identifying two problems, namely (1) what is the political basis of criminal law for the crime of adultery in the Penal Code Number 1 of 2023, (2) how is the application of the adultery article in the Penal Code Number 1 of 2023. The research method used is juridical research- normative because the subject of the study that will be researched uses library materials as basic material for research by conducting an investigation into the regulations related to the problem being discussed. The results of the research state that the penal policies in the adultery article provide substantive justice based on Pancasila. The implementation of criminalization of adultery is one of the efforts to protect human rights for the family/home through effective and dignified solutions.

Abstract

Pemantauan status gizi merupakan upaya penting dalam mendeteksi dini permasalahan gizi pada anak usia sekolah. Proyek independen ini bertujuan mengembangkan dan menerapkan media edukasi pemantauan status gizi menggunakan diagram Indeks Massa Tubuh (IMT) berbahan tripleks sebagai sarana edukasi dan skrining sederhana di lingkungan sekolah. Kegiatan dilaksanakan melalui pengukuran antropometri berupa berat badan dan tinggi badan siswa, perhitungan nilai IMT, serta pengelompokan status gizi berdasarkan kategori ambang batas IMT. Sasaran kegiatan adalah siswa kelas VII SMPN 2 Pekanbaru. Hasil kegiatan menunjukkan bahwa media diagram IMT berbahan tripleks mudah digunakan dan membantu siswa, guru, serta petugas UKS dalam memahami status gizi secara visual. Media ini juga meningkatkan kesadaran akan pentingnya pemantauan status gizi secara rutin sebagai upaya promotif dan preventif kesehatan

Abstract

Legal politics in the context of criminal law must be analyzed seriously, both in relation to material criminal law and formal criminal law. Law No. 5 of 2018 concerning Terrorism Crimes and Law No. 9 of 2013 concerning Terrorism Financing Crimes underwent changes after the enactment of Law No. 1 of 2023 concerning the Criminal Code (Indonesian Criminal Code). This amendment includes a bridge article relating to criminal acts of terrorism within the Criminal Code, which thus has implications for the elaboration of general and special rules. The purpose of this research is to find out how to use logical (Logische Specialiteit) or systematic (Systematische Specialiteit) specialties in interpreting this matter. The method used is juridical-normative with an analytical and conceptual approach based on various legal literature. This research obtained 2 (two) results, namely an explanation of the rules against terrorism in Indonesian positive law and an explanation of the bridging article in the reform of the Indonesian Criminal Code with logical specificity. So it is concluded that the regulation of special terrorism regulations in the Criminal Code does not mean that it weakens the Special Law, but instead strengthens these special regulations in the future if there is a criminal act of terrorism.
