Abstract

The principle of legality is a fundamental concept in criminal law that ensures legal certainty by stipulating that an act can only be punished if it has been clearly regulated by law prior to its commission and is not applied retroactively. This principle protects individuals from arbitrary actions by law enforcement and serves as the main foundation for criminal law enforcement. However, its application must be balanced with attention to substantive justice through interpretations that are responsive to the social and cultural context of society. Thus, the principle of legality not only guarantees legal certainty but also allows room for balanced and dynamic justice, functioning as a bridge between legal certainty and justice within the criminal justice system.

Abstract

Legal education constitutes a fundamental pillar in the formation of law enforcement in Indonesia, yet current legal practice often reflects a rigid, rule-bound orientation that fails to adequately serve societal needs. This gap between legal norms and social realities is rooted in educational processes that emphasize theoretical knowledge over experiential learning. Although law faculties offer doctrinal courses, judicial practice modules, and internship programs, these have not been sufficient in producing graduates able to apply the law in a socially responsive and justice-oriented manner. Clinical legal education through the development of campus legal aid institutions offers a strategic solution to bridge this gap. This study examines (1) the urgency of clinical legal education within Indonesian legal education, and (2) its implementation through strengthened legal aid facilities on campus. The findings show that clinical legal education is essential for equipping students with practical competencies, deepening their understanding of community legal issues, and fostering progressive legal reasoning. Effective implementation requires expanded student engagement in community-based legal services, a shift in lecturers’ pedagogical approaches toward practice-oriented instruction, and optimization of campus legal aid institutions as laboratories for real-world legal problem-solving. These measures are expected to produce graduates capable of advancing a humanistic and justice-centered model of law enforcement.

Abstract

Introduction: Law enforcement against lawyers as perpetrators of contempt of court in the criminal justice system in Indonesia still faces significant challenges. The contempt of court case between lawyer Razman and Hotman Paris shows that the law enforcement process is still convoluted.Purposes of the Research: To examine the law enforcement against Advocates who commit contempt of court and to compare law enforcement with Thailand. Methods of the Research: This research uses a quantitative juridical-normative method through a statute approach by comparing the legal foundations in the enforcement of contempt of court. Results Main Findings of the Research: The findings indicate that in Indonesia, law enforcement is still convoluted as it goes through the reporting process via the police, then the prosecutor's office, and the court. This is different from Thailand, where Article 33 of the Civil Procedure Code states that a judge can impose a penalty on the suspect without going through the reporting process to the police and so on. Therefore, there is a need for an article that accommodates the law enforcement process for lawyers committing contempt of court during the trial.

Abstract

The lack of Legal Aid Implementers compared to Legal Aid Recipients is expected to hamper access to justice for the poor. Therefore this research aims to provide space for Paralegals especially in the Law Faculty of UNNES to be able to provide free legal assistance outside the court of the poor in Central Java. This research will at least discuss two issues, namely 1) How is the existence of the Law Faculty UNNES Paralegal in a juridical and institutional manner in providing Legal Aid? and 2) What is the role of the Paralegal Faculty of Law at UNNES in providing Legal Aid to the poor in Central Java ?. The method used in this research is sociological juridical with a qualitative approach. The results of this study indicate that currently Paralegals can only carry out non-litigation Legal Aid. This happened because the Supreme Court based on Decision Number 22 P / HUM / 2018 had canceled the Paralegal's role in litigation. The role of Paralegals from UNNES Law Faculty students is as a facilitator or intermediary in accommodating complaints of cases and consultation from Legal Aid recipients to be conveyed to Legal Aid Providers namely lecturers who are members of the Center for Legal Aid Study, while the role of Paralegals from UNNES Law Faculty alumni is as an assistant or who helps Advocates in carrying out non-litigation Legal Assistance such as mediation, consultation, negotiation, advocating cases outside the court and making trial files. The provision of legal aid by the Paralegal is considered to be very helpful for Lecturers and Advocates in fulfilling access to justice for the poor.

Abstract

Law enforcement is one of the many facets of society that have seen substantial changes as a result of the quick growth of digital technology, especially artificial intelligence (AI). The purpose of this study is to assess how electronic evidence is used in Indonesia's criminal justice system, pinpoint the difficulties encountered, and offer suggestions for enhancing the efficiency and equity of electronic evidence in the age of artificial intelligence. In line with the technological elements included in digital and criminal investigation research methodologies, this qualitative study aids in the creation of a theoretical framework for the use of electronic evidence in the setting of artificial intelligence. The results show that Indonesian law is now able to meet the needs of the digital age with its adaptation to technological advancements. Finding material truth in court proceedings is made possible by electronic evidence, which is legally acknowledged as a legitimate tool in criminal justice. To successfully address these issues and optimize the use of AI in the legal system, it is imperative to develop a strong ethical framework, improve law enforcement capacities, and update rules on a regular basis.

Abstract

In the era of Society 5.0, characterized by the pervasive digitalization of societal functions, platform service providers play a pivotal role. These platforms, however, are frequently exploited by users for unlawful activities. This study investigates the prerequisites for invoking the safe harbor principle, which shields service providers from criminal liability. Employing a qualitative research approach, secondary data was gathered through a comprehensive literature review and subsequently analyzed qualitatively. The safe harbor principle serves as a critical legal mechanism utilized by platform service providers to shield themselves from legal repercussions arising from illicit actions committed by their users. To qualify for this exemption, providers typically must promptly remove unlawful content upon notification and refrain from active involvement in the transmission of such information. However, recent developments indicate that providers may forfeit safe harbor protection if they play a significant role in moderating or curating content on their platforms. This research underscores the essential conditions that platform service providers must meet to avail themselves of the safe harbor principle, highlighting the nuanced balance between facilitating digital innovation and upholding legal accountability. By clarifying these conditions amidst evolving regulatory landscapes, this study contributes to ongoing discussions on legal frameworks governing digital platforms, offering insights crucial for policymakers, legal practitioners, and stakeholders navigating the intersection of technology, law, and societal governance.

Abstract

Corporate crime, also known as white-collar crime, has persisted in Indonesia for decades, evolving alongside the country's economic and industrial growth. Various models and theories have emerged to address these issues, reflecting a growing recognition of the need for robust legal frameworks to combat corporate misconduct. Normative legal research methods have been employed in this study, focusing specifically on the criminal law aspects related to the development of corporate criminal liability theories and concepts under Law Number 1 of 2023. Law Number 1 of 2023 introduces the corporation as a maker and also a responsible corporation model of corporate criminal liability, recognizing corporations as legal entities capable of being held accountable for their actions. This statutory framework represents a significant advancement, reinforcing Supreme Court Regulation Number 13 of 2016. The research explores various perspectives on corporate responsibility models and theories, offering ideal solutions for their application and development within Indonesia's legal framework. This evolution signifies Indonesia's commitment to enhancing corporate accountability and ethical standards, aligning its legal principles with international norms while addressing domestic challenges. By integrating these models and theories into its legal system, Indonesia aims to foster a corporate culture that prioritizes compliance and ethical conduct, thereby mitigating the impact of corporate crime on society and promoting sustainable economic development.
