Abstract

Perkembangan teknologi digital telah memberikan perubahan terhadap pola hubungan hukum dalam bidang jasa, khususnya hubungan kerja sama antara freelancer jasa pemasaran digital dengan pengguna jasa yang sering kali dilakukan melalui komunikasi elektronik dan kesepakatan secara lisan. Kondisi tersebut menimbulkan permasalahan hukum ketika terjadi wanprestasi, terutama terkait pemenuhan kewajiban pembayaran serta kekuatan pembuktian atas perjanjian yang tidak dituangkan secara tertulis. Penelitian ini memiliki tujuan untuk menganalisis kekuatan pembuktian perjanjian lisan dalam hubungan jasa pemasaran digital oleh freelancer serta mengkaji penerapan asas kebebasan berkontrak dalam memberikan perlindungan hukum dan keseimbangan bagi para pihak. Metode yang diterapkan dalam studi ini adalah penelitian hukum normatif yang bersifat yuridis, menggunakan pendekatan dari regulasi dan kasus melalui kajian terhadap ketentuan dalam Kitab Undang-Undang Hukum Perdata, Undang-Undang mengenai Informasi dan Transaksi Elektronik, beserta praktik penyelesaian sengketa di bidang perdata. Temuan dari penelitian ini mengungkapkan bahwa perjanjian yang dibuat secara lisan masih memiliki kekuatan hukum asalkan memenuhi kriteria keabsahan perjanjian yang tercantum dalam Pasal 1320 Kitab Undang-Undang Hukum Perdata. Namun, dalam aspek pembuktian, perjanjian lisan memiliki kelemahan karena bergantung pada bukti pendukung seperti komunikasi elektronik, dokumen digital, dan bukti pelaksanaan pekerjaan. Oleh karena itu, penerapan asas kebebasan berkontrak tidak memungkin hanya dimaknai secara mutlak, tetapi harus disertai prinsip itikad baik, kepastian hukum, dan Perlindungan bagi pihak yang memiliki kekuatan negosiasi yang lebih rendah. Dengan demikian, perlindungan hukum untuk para freelancer bisa direalisasikan melalui penguatan catatan digital dan sistem penyelesaian konflik yang dapat menghasilkan keseimbangan hak serta kewajiban antara semua pihak.

Abstract

The land conflict on Rempang Island, triggered by the national strategic project development of Rempang Eco-City, has sparked a sharp juridical debate between the aspects of state power (Machtsstaat) through investment policy instruments and the principles of the Rule of Law (Rechtsstaat) which emphasizes individual rights protection. This study aims to analyze the root causes of overlapping juridical claims between the Land Management Rights (HPL) held by BP Batam and the traditional physical land possession of the Rempang indigenous community based on the concept of the State's Right to Control (HMN), as well as to examine the legal standing and protection of uncertified land civil rights of the indigenous community viewed from the pillar of substantive justice in a Rule of Law. The research method applied is normative legal research utilizing a statute approach and a conceptual approach. The secondary data, consisting of primary, secondary and tertiary legal materials, were collected through literature review and analyzed qualitatively. The results indicate that the overlapping claims occurred due to the government's unilateral issuance of HPL over customary lands (tanah ulayat) that had been physically possessed peacefully, openly and generationally by the indigenous peoples (the Malay, Orang Laut and Orang Darat tribes) long before BP Batam or modern regulations were established. Within the perspective of substantive justice under the Rule of Law and the Basic Agrarian Law (UUPA), a land certificate is not the absolute source of rights but merely an administrative proof; thus, long-term physical possession in good faith (bezit/rechtsverwerking) by indigenous peoples constitutes a legally valid civil right that is constitutionally protected under Article 18B Paragraph (2) of the 1945 Constitution. Consequently, the civil legal protection for the Rempang indigenous community must be fulfilled through equal deliberation mechanisms (the right to consent or object to the project), fair compensation (covering both material and immaterial losses), or the granting of Communal Ownership Rights/land-sharing schemes to ensure that the indigenous people are treated as subjects of development rather than objects of land eviction for investor interests.

Abstract

This study aims to constitutionally analyze the application of the fault liability principle in doctors’ criminal responsibility based on Supreme Court Decision No. 79 PK/PID/2013. The main issues concern how law functions to limit state power legitimacy through the application of fault liability and how to address weak checks and balances mechanisms in protecting constitutional rights. This research employs a normative legal method with statutory, conceptual, and case approaches. The findings indicate that the application of the fault principle in the decision shows interpretative inconsistency, potentially blurring the distinction between professional error and medical risk. This condition contributes to the criminalization of medical professionals and weakens constitutional protections. Furthermore, weak checks and balances in the judicial system lead to dominant judicial interpretations that are not fully aligned with the rule of law. In conclusion, strengthening the evidentiary standard based on reasonable care and reforming judicial oversight mechanisms are essential to ensure legal certainty and constitutional protection for medical professionals.
