Abstract

Environmental pollution which can result further because in addition to environmental damage it also poses a hazard, namely specifically the presence of known hazardous and toxic waste. in Sukaraos Village, Cikijing District, Majalengka Regency, which can result in B3 waste pollution in its business so this needs attention from the central government and local governments. The author will review this research to find out related to legal studies in B3 waste management to realize legal justice and aspects of law enforcement carried out by the Majalengka Regency Environmental Service. the analysis is qualitative analysis. Majalengka Regency Regent Regulation Number 33 of 2019 related to the management of hazardous and toxic waste does not reflect legal justice for MSME business actors Convection this is due to the absence of obligations from the local government for the allocation of B3 waste management for business actors, difficult permits and management fees waste that is charged to business actors and is expensive. The aspects of law enforcement carried out by the Majalengka Regency Environmental Service are still not effective because there are factors in law enforcement itself, including legal factors, law enforcement factors, facilities factors, community factors and legal culture factors that have not been realized by the community. The conclusion of this study is that the existing regulations in Majalengka Regency and other regulations have not created legal justice for the perpetrators themselves because environmental law enforcement and protection of business actors have not been maximized due to several law enforcement factors that do not run optimally.

Abstract

Spatial planning is a juridical instrument for environmental protection and management which is then used as one of the main focuses of the United Nations in the Sustainable Development Goals. However, Indonesia, which is currently focused on development and accelerating the investment, results in frequent actions that neglect the use of space and the environment. This formulation of the research is the problem regarding the implementation of spatial planning policies in the regions in order to realize goal number 11 of the Sustainable Development Goals. The purpose of this study is to examine the implementation of regional spatial planning policies in order to realize goal number 11 of the Sustainable Development Goals. The paradigm used is critical legal studies with qualitative research and using socio legal research approach. The results of the study found that problems regarding the implementation of goal number 11 of the Sustainable Development Goals in Majalengka Regency still meet some obstacles because Indonesia, which is currently focused on the development period and accelerating investment, made Regional Regulation Number 11 of 2011 concerning Spatial Plans for Majalengka Regency 2011-2031 no longer implementable as a policy product that has been implemented by the Regional Government of Majalengka Regency.

Abstract

The concept of consumer protection is to guarantee legal certainty to consumers, namely efforts to empower consumers to obtain or determine their choice of goods and/or services and to defend or defend their rights if business actors harm them. Legal norms to protect the interests of consumers are not sufficient. Therefore, to achieve a balance in protecting the interests of consumers and business actors, a clear legal order is needed so that a healthy economy can be realized. Consumer protection norms in the Consumer Protection Law System, as a fundamental norm, become the criteria for determining alleged violations of consumer rights. The aim of this study is to provide an alternative for resolving cases, a form of embodiment of the implementation of consumer rights protection policies. The approach method used in this research is juridical sociological. However, there are still legal loopholes that often occur. May harm the interests of consumers. The existence of regulations that still have to be synchronized and harmonized between the Consumer Protection Act and the rules governing Arbitration and Alternative Dispute Resolution issues because the Consumer Protection Law formulates rules for resolving consumer disputes by separate arbitration, which is relatively different from the basic concept of the arbitration mechanism which generally accepted so that the settlement of consumer disputes becomes legal uncertainty.

Abstract

Rapat Umum Pemegang Saham (RUPS) merupakan organ perseroan yang paling tinggi dan memiliki kekuasaan dalam menentukan arah dan tujuan perseroan. RUPS secara elektronik (E-RUPS) diatur dalam Pasal 77 ayat (1) Undang-undang Perseroan Terbatas. RUPS dapat dilakukan secara elektronik (E-RUPS) melalui aplikasi bernama eASY.KSEI, dengan penggunaan e-Proxy dan e-Voting. Adapun masalah dalam penelitian ini adalah (1) Bagaimanakah prosedur mekanisme Rapat Umum Pemegang Saham Elektronik (E-RUPS) pada PT. “X”, (2) Bagaimanakah keabsahan akta risalah yang dibuat oleh notaris dalam Rapat Umum Pemegang Saham Elektronik (E-RUPS). Metode yang digunakan dalam penelitian ini adalah yuridis normatif, spesifikasi penelitian deskriptif analitis, yaitu berasal dari fenomena-fenomena atau kejadian-kejadian berdasarkan kenyataan dan fakta-fakta yang ada di masyarakat dikaitan dengan teori hukum. Sumber data primer peraturan perundang-undangan, pustakaan. Adapun sumber data sekunder menggunakan wawancara dan metode pencarian data melalui media online. Hasil penelitian ini bahwa mekanisme Rapat Umum Pemegang Saham Elektronik (E-RUPS) pada PT. “X” telah sesuai dengan Peraturan Otoritas Jasa Keuangan No. 16/POJK.04/2020 dengan menggunakan aplikasi eASY.KSEI, dengan penggunaan e-Proxy dan e-Voting. Akta risalah rapat yang dibuat oleh notaris melalui media elektronik sudah sah, karena sesuai dengan Pasal 8 ayat (1) huruf b Peraturan Otoritas Jasa Keuangan No. 16/POJK.04/2020 notaris pasar modal wajib hadir secara fisik ditempat dilaksanakannya RUPS PT Terbuka secara fisik dalam pelaksanaan Rapat Umum Pemegang Saham Elektronik (E-RUPS). Dalam konteks mekanisme penerapan Rapat Umum Pemegang Saham secara Elektronik (E-RUPS) telah menggunakan eASY.KSEI dengan e-Proxy yaitu pemberian kuasa secara elektronik pada E-RUPS. Akta risalah dalam Rapat Umum Pemegang Saham secara Elektronik (E-RUPS) sudah sah, karena sesuai dengan ketentuan Peraturan Otoritas Jasa Keuangan No.16/POJK.04/2020 tentang Pelaksanaan Rapat Umum Pemegang Saham Perusahaan Terbuka secara Elektronik.

Abstract

Keterbatasan jumlah dokter gigi mengharuskan pelimpahan wewenang agar pelayanan kesehatan berjalan dengan baik. Penekanan studi kepada bagaimanakah budaya hukum dokter gigi dalam pelaksanaan pelimpahan wewenang dan akibat hukumnya, dengan pendekatan penelitian metode socio-legal. Temuan penelitian tidak ada satupun dokter gigi melakukan pelimpahan wewenang kepada perawat gigi secara tertulis sesuai kewenangan dan kompetensi perawat gigi sebagai pelaksana tugas berdasarkan UU No. 38/2014 tentang Keperawatan, dan Peraturan Menteri Kesehatan No. 2052/MEN-KES/PER/X/2011 tentang Izin Praktik dan Pelaksanaan Praktik Kedokteran. Budaya hukum dokter gigi cenderung mengabaikan sehingga tidak ada pemahaman prosedur pelimpahan wewenang yang benar disebabkan pengetahuan hukum dokter gigi sangat terbatas sehingga sulit untuk menuntut kesadaran dan kepatuhan hukum. Konsekuensi yuridis bila pelaksanaan pelimpahan wewenang tersebut tidak dilaksanakan sesuai dengan Permenkes No. 2052/MENKES/PER/X/2011 penerapan sanksi administratif dapat berupa peringatan lisan, tertulis sampai dengan pencabutan Surat Izin Praktik. Legal Culture of Dental Doctors in The Authority of The Author and the Consequences of Law Limitations on the number of dentists require delegation of authority to make health services work well. The emphasis of the study on how the dental legal culture in the implementation of the delegation of authority and its legal consequences, with research approach socio-legal method. The findings of the study of none of the dentists delegated authority to dental nurses in writing in accordance with the authority and competence of dental nurses as executors of duties based on Law No. 38/2014 on Nursing, and Regulation of the Minister of Health No. 2052/MENKES/PER/X/2011 on Practice License and Implementation of Medical Practice. The dental legal culture tends to ignore so that there is no understanding of proper delegation procedures due to the limited knowledge of dental law that it is difficult to demand legal awareness and compliance. The juridical consequences when the implementation of the delegation of authority is not carried out in accordance with the Minister of Health Decree no. 2052/MENKES/PER/X/2011 the application of administrative sanctions may include oral warning, written up to the revocation of Practice License.

Abstract

In e-commerce, customer reviews play an important role in influencing the decisions made by customers. Before making a purchase, many people read positive customer reviews because they can offer useful information to potential buyers and increase their overall level of trust in the product. Positive customer reviews also help a store look more credible However, what happens to business actors is not as expected, so consumers act in bad faith by making bad judgments in marketplace product reviews. The purpose of this study is to analyze the good faith of business actors and how it impacts the law established by the Consumer Protection Law. This study uses a normative legal research study whose findings show that consumers are not liable for criticism that harms business entities, in accordance with the Consumer Protection Law (UUPK). In particular, Article 5a requires consumers to pay special attention to product descriptions listed in stores.

Abstract

This study aims to control water pollution by conducting observations on the hotel industry in Cirebon City regarding the implementation of compliance with the standardization of wastewater quality standard parameters according to Ministerial Regulation No. P 68 of 2016. Research methods were conducted openly through interview techniques regarding monitoring and management of wastewater produced by the Hospitality Industry in Cirebon City. The results of the study identified that from the hotel industry in the city of Cirebon which is the object of research, the quality standard of wastewater produced exceeds the standardization of meeting quality standards so that there is still a risk of water pollution. The handling can be this problem by conducting strict monitoring by the environmental service and providing knowledge or information related to the management of wastewater quality standards properly so that the content of the waste produced does not endanger the flow of rivers and seas in the city of Cirebon. The approach that must be taken in order to understand and be able to maximize the treatment of liquid waste with a wastewater management plant (IPAL) is to consult the Environmental Service in order to get direction to cooperate with third parties (outsourcing). Observations also state that there is still one hotel that does not use IPAL and in the hotel's activities, the waste is purely dirty and pollutes the river flow in Cirebon City.

Abstract

Plastic waste is still a problem that is difficult to solve due to the lack of awareness about the importance of keeping the environment clean and not leaving litter lying around. Usually, waste generation is generated by economic activities and has the potential to cause environmental pollution. In Cirebon City itself, plastic waste is still an unresolved problem. With the increase in population, there will be an increase in the volume of waste generated by human activities. The problem is how the Cirebon city local government policy related to handling plastic waste generated by street food business actors, this is intended to examine the regulations that have been implemented and run in the city of Cirebon, with an empirical juridical research approach and qualitative data included. This study aims to determine the procedure for handling plastic waste and the elements that influence plastic waste management in the city of Cirebon. Also to find out what anticipatory steps need to be taken in the future.

Abstract

Legal certainty is one of the objectives of law according to Gustav Radburch, with the development of the times, and the rise of digitalization, it is necessary to have a legal umbrella as a form of preventive effort so that there are no legal problems such as misuse of personal data in the labor scope. This legal research method uses normative juridical legal methods using qualitative data based on consideration of the purpose of this research itself to determine the importance of legal certainty and protection of personal data in the context of labor in the era of technology, and information that has developed rapidly. The clarity of legal norms guides community behavior, including the protection of personal data. The impact of technological advances is especially evident in changes in community behavior and information seeking through the internet. This change creates new challenges, especially related to the misuse of personal data in the world of work. Legal protection for personal data in the world of work in the era of digitalization of technology and information is very important. It has positive implications for companies, employees, and society as a whole. By implementing good personal data protection, all parties can benefit from the opportunities offered by digital technology while maintaining the privacy and security of personal data.

Abstract

Abstract. Citengah Village is an agricultural and agro-tourism area. One of the village's leading potentials is the tea and coffee plantation sector commodities. On average, each family head has land use rights of 0.5 hectares and the average annual production is 200 tons with a price per kg of Rp. 1,500. The tourism sector has potential that also needs to be developed into a regional tourist area. Because the location of the village only has a distance of approximately 8 km from the city center of Sumedang, and is supported by 15 potential tourist attractions. The method of writing the article used is descriptive qualitative, describing and explaining the state of development of Citengah Village through community participation in order to achieve an independent village, especially through agritourism. The results of the activities include training on village superior products such as honey jelly, honey milk candy, honey fried bread, and processed chips. In addition, stunting counseling and increasing community digital literacy through knowledge of the use of SmartWatch in the SIMURNI, WAKEPO, and JKN Mobile programs. Abstrak. Desa Citengah merupakan daerah agraris dan agrowisata. Salah satu potensi unggulan desa yakni komoditi sektor perkebunan teh dan kopi. Rata-rata setiap kepala keluarga memiliki hak guna usaha lahan 0,5 Ha dan produksi rata-rata setiap tahun sebanyak 200 ton dengan harga per kg Rp. 1.500. Sektor pariwisata memiliki potensi yang juga perlu dikembangkan menjadi kawasan wisata regional. Karena lokasi desa hanya memiliki jarak kurang lebih 8 km dari pusat kota Sumedang, dan didukung 15 obyek wisata potensial. Metode penulisan artikel yang digunakan adalah deskriptif kualitatif, menggambarkan dan memaparkan keadaan pembangunan Desa Citengah melalui partisipasi masyarakat demi tercapainya desa yang mandiri, khususnya melalui agrowisata. Hasil kegiatan antara lain pelatihan produk unggulan desa berupa jelly madu, permen susu madu, roti goreng madu, dan olahan kripik. Selain itu, dilakukan penyuluhan stunting dan peningkatan literasi digital masyarakat melalui pengetahuan penggunaan SmartWatch dalam program SIMURNI, WAKEPO, dan JKN Mobile.
