Abstract

Background: Public service quality is a crucial component of good governance, and the application of General Principles of Good Government (AUPB) plays a key role in ensuring effective public services. These principles, which include transparency, accountability, fairness, and efficiency, are essential for fostering trust between government institutions and citizens. However, there is a gap in understanding how effectively AUPB are implemented within public services and their impact on service delivery. Objective: This study aims to evaluate the effectiveness of implementing the General Principles of Good Government (AUPB) in public services. The research focuses on how these principles influence the efficiency, transparency, and quality of services provided by governmental institutions. Method: A mixed-methods approach was employed, combining qualitative interviews with public sector employees and quantitative surveys with citizens receiving public services. Data were collected from various government agencies to assess the practical application of AUPB principles and their impact on service quality. Results: The findings suggest that while AUPB are widely recognized, their implementation varies across institutions. Public services that effectively apply these principles show higher satisfaction rates among citizens, with increased accountability and transparency. Conclusion: The study concludes that implementing AUPB significantly improves the quality and transparency of public services, but challenges remain in ensuring consistent application across all governmental sectors.

Abstract

This study aims to identify, explore, and analyze the factors that influence the implementation of an inventory information system application in improving the quality of inventory records at the Class I Immigration Office TPI Cirebon. The implementation of this application is expected to contribute to the realization of good governance through more efficient, accurate, and transparent service and administrative management. This research uses a descriptive qualitative approach with a phenomenological method. Data collection techniques include observation, in-depth interviews, document analysis, and archival research. The informants consist of office leaders, application operators, civil servants, and community service users. Data analysis is carried out through data reduction, data presentation, and conclusion drawing. The results show that the implementation of the inventory information system application has been carried out in both internal and external services. However, it has not yet been optimal due to several challenges, such as limited access via Android devices, the unavailability of integrated service features for inventory recording, and inadequate internet bandwidth. This research provides strategic recommendations for system development to become more adaptive, efficient, and responsive to user needs.

Abstract

Praktik illegal fishing menggunakan bahan peledak merupakan ancaman serius bagi ekosistem laut dan kesejahteraan masyarakat pesisir. Penelitian ini bertujuan untuk menganalisis efektivitas penegakan hukum terhadap destructive fishing di wilayah Cantigi, Kabupaten Indramayu, dengan perspektif keadilan lingkungan. Menggunakan metode yuridis empiris dengan pendekatan kualitatif, penelitian ini mengkaji regulasi perikanan, wawancara dengan aparat penegak hukum, serta dampak sosial-ekologi akibat praktik tersebut. Hasil penelitian menunjukkan bahwa meskipun Ditpolairud Polda Jawa Barat telah menjalankan prosedur hukum sesuai KUHAP, efektivitasnya masih terhambat oleh keterbatasan teknologi pemantauan, minimnya patroli terpadu, serta lemahnya koordinasi lintas instansi. Dari sisi sosial, faktor ekonomi menjadi pendorong utama nelayan untuk tetap menggunakan bahan peledak, meskipun mereka menyadari risiko hukum dan kerusakan ekologi yang ditimbulkannya. Oleh karena itu, pendekatan represif semata tidak cukup untuk menangani permasalahan ini. Diperlukan strategi multidimensional yang mencakup penguatan pengawasan berbasis teknologi, edukasi hukum, serta program pemberdayaan ekonomi bagi nelayan agar mereka beralih ke metode perikanan yang lebih berkelanjutan. Penelitian ini merekomendasikan integrasi antara penegakan hukum yang tegas, penguatan patroli berbasis komunitas, serta rehabilitasi ekosistem laut sebagai langkah strategis untuk menciptakan keadilan lingkungan yang lebih adil dan berkelanjutan.

Abstract

Background. Unregistered marriages remain widespread, creating legal issues for both couples and their children. Aims. The objective of this community service program is to provide assistance in the itsbat nikah process at the Religious Court, enabling couples to obtain legal certainty. The implementation methods included socialization, legal counseling, and direct assistance up to the issuance of the court’s decision. Methods. The socialization activities demonstrated an increased awareness among participants regarding the importance of marriage registration. Counseling activities resulted in a deeper understanding of the consequences of marriage. Assistance activities helped participants prepare documents and face the court proceedings. Conclusion. Of the 32 couples who registered, 24 passed the administrative verification to participate in the hearing, and 23 obtained itsbat nikah decrees, while one case was rejected due to age verification issues. Implementation. By obtaining an itsbat nikah decree, couples could proceed to the Office of Religious Affairs to have a marriage certificate issued.

Abstract

The development of digitalization of almost all aspects of modern life, including healthcare, has been influenced by the use of technology. Health is very important for everyone, no matter age, socioeconomic status, or other factors. The current digital age in the provision of medical services through virtual clinics has grown rapidly. However, the existence of online clinics creates unclear legal regulations for therapeutic transactions, which can have potentially adverse legal repercussions for patients. Patients can file lawsuits against online clinics and healthcare professionals involved if there is an error in diagnosis or treatment. Therapeutic transactions consist of medication, diagnosis and medical treatment. But in online clinics, there is debate about the legality and ethics of these therapeutic transactions. Some of the problems that arise in therapeutic transactions through online clinics include the inability to perform physical examinations, medical data security issues, and the inability to track patient histories. The method used to assess is doctrinal (normative juridical), considering the concept of law as written law, which is made by local government regulations. The results showed that Health Law Number 36 of 2009 concerning Health and Article 1320 of the Civil Code, which regulates the legal terms of an agreement, can be used to assess the validity of therapeutic transactions carried out in online clinics. The research findings also show that fulfillment of the requirements of Health Law Number 36 of 2009 must include the responsibility of patients who receive medical care through online clinics. To optimize their services on online clinic platforms such as the Cirebon City Health Office, health service providers and health practitioners such as doctors, medical personnel, and other health workers use this platform. These organizers must consider Health Law Number 36 of 2009, which covers medical practice standards, telemedicine patient privacy, and a doctor's license or License to Practice. In addition, special policies must be made by the central government and the Cirebon City Health Office to provide clear legal protection for patients who receive medical services through online clinics when conducting medical transactions.

Abstract

Land use conversion in the context of tourism development particularly nature-based tourism constitutes a strategic issue encompassing legal, environmental, and socio-economic dimensions. This study aims to analyze the extent to which Indonesia’s legal and regulatory frameworks have accommodated the governance of land-use conversion within the framework of sustainable tourism development. The research employs a normative juridical approach by examining statutory regulations relating to spatial planning and land-use conversion. This study is particularly relevant given the increasing strategic importance of environmental policies, including those in Kuningan Regency. One such regulation is Law Number 26 of 2007 concerning Spatial Planning. The findings indicate that, normatively, there is a degree of legal synchronization across various regulations that ensures conformity in spatial utilization with the Regional Spatial Plan (RTRW) and the Detailed Spatial Plan (RDTR), while also incorporating sustainability and environmental protection considerations. Nonetheless, practical challenges persist, including overlapping authorities, weak enforcement mechanisms, and limited public participation. Therefore, there is a pressing need to strengthen both legal structures and the legal culture of society to realize legal certainty and effective protection in land-use conversion for equitable and sustainable tourism development.

Abstract

Rapat Umum Pemegang Saham (RUPS) merupakan organ perseroan yang paling tinggi dan memiliki kekuasaan dalam menentukan arah dan tujuan perseroan. RUPS secara elektronik (E-RUPS) diatur dalam Pasal 77 ayat (1) Undang-undang Perseroan Terbatas. RUPS dapat dilakukan secara elektronik (E-RUPS) melalui aplikasi bernama eASY.KSEI, dengan penggunaan e-Proxy dan e-Voting. Adapun masalah dalam penelitian ini adalah (1) Bagaimanakah prosedur mekanisme Rapat Umum Pemegang Saham Elektronik (E-RUPS) pada PT. “X”, (2) Bagaimanakah keabsahan akta risalah yang dibuat oleh notaris dalam Rapat Umum Pemegang Saham Elektronik (E-RUPS). Metode yang digunakan dalam penelitian ini adalah yuridis normatif, spesifikasi penelitian deskriptif analitis, yaitu berasal dari fenomena-fenomena atau kejadian-kejadian berdasarkan kenyataan dan fakta-fakta yang ada di masyarakat dikaitan dengan teori hukum. Sumber data primer peraturan perundang-undangan, pustakaan. Adapun sumber data sekunder menggunakan wawancara dan metode pencarian data melalui media online. Hasil penelitian ini bahwa mekanisme Rapat Umum Pemegang Saham Elektronik (E-RUPS) pada PT. “X” telah sesuai dengan Peraturan Otoritas Jasa Keuangan No. 16/POJK.04/2020 dengan menggunakan aplikasi eASY.KSEI, dengan penggunaan e-Proxy dan e-Voting. Akta risalah rapat yang dibuat oleh notaris melalui media elektronik sudah sah, karena sesuai dengan Pasal 8 ayat (1) huruf b Peraturan Otoritas Jasa Keuangan No. 16/POJK.04/2020 notaris pasar modal wajib hadir secara fisik ditempat dilaksanakannya RUPS PT Terbuka secara fisik dalam pelaksanaan Rapat Umum Pemegang Saham Elektronik (E-RUPS). Dalam konteks mekanisme penerapan Rapat Umum Pemegang Saham secara Elektronik (E-RUPS) telah menggunakan eASY.KSEI dengan e-Proxy yaitu pemberian kuasa secara elektronik pada E-RUPS. Akta risalah dalam Rapat Umum Pemegang Saham secara Elektronik (E-RUPS) sudah sah, karena sesuai dengan ketentuan Peraturan Otoritas Jasa Keuangan No.16/POJK.04/2020 tentang Pelaksanaan Rapat Umum Pemegang Saham Perusahaan Terbuka secara Elektronik.

Abstract

Penelitian ini mengeksplorasi dampak dan hukum penambangan pasir ilegal yang dilakukan oleh kelompok masyarakat di Desa Dono Mulyo, Banjit, Waykanan. Pendekatan yuridis normatif dilakukan dengan mengkaji peraturan perundang-undangan yang terkait dengan pertambangan pasir dan dampak lingkungan. Sementara itu, pendekatan empiris melibatkan pengamatan terhadap kejadian aktual, seperti penangkapan pelaku pertambangan pasir ilegal oleh Polda Lampung. Hasil penelitian menunjukkan bahwa faktor-faktor seperti kurangnya kesadaran hukum masyarakat, kemiskinan, ketidakpastian kepemilikan tanah, dan faktor politik dan sosial berperan dalam mendorong kegiatan pertambangan pasir ilegal. Dalam putusan hukum, hakim mempertimbangkan unsur-unsur dakwaan, termasuk identifikasi terdakwa, kesaksian saksi, dan penerimaan terdakwa. Hakim mengacu pada ketentuan hukum yang mengatur pertambangan dan izin-izin terkait. Selain itu, penelitian juga menyoroti kurangnya sosialisasi penegakan hukum dan perlunya pendekatan holistik dalam penanggulangan pertambangan pasir ilegal. Peningkatan kesadaran masyarakat, penegakan hukum yang kuat, perbaikan kondisi ekonomi, dan upaya menjaga lingkungan merupakan elemen-elemen kunci dalam penanggulangan masalah ini. Penelitian ini memberikan kontribusi pada pemahaman tentang kompleksitas isu pertambangan pasir ilegal, serta faktor-faktor yang perlu dipertimbangkan oleh hakim dalam menjatuhkan putusan pidana. Implikasi dari temuan penelitian ini dapat membantu dalam pengembangan kebijakan yang lebih efektif dan berkelanjutan terkait dengan penanggulangan pertambangan ilegal.

Abstract

The Indonesian Standard Industrial Classification (KBLI) is a collection of business classification codes developed by the Central Statistics Agency (BPS) to categorize business and economic activities in Indonesia. Based on the International Standard Industrial Classification (ISIC), KBLI is integrated into the Online Single Submission (OSS) system, functioning as a tool for issuing business licenses and informing policy design. However, its implementation faces challenges, including the presence of irrelevant and non-functional codes, such as code 92000 for gambling activities, which contradict legal and social norms in Indonesia. This research aims to determine whether the adoption of KBLI over ISIC is excessive, leading to legal implications. A normative juridical approach or doctrinal research method is employed in this study, utilizing secondary data from the legal foundations of ISIC and KBLI, along with other related regulations. The results indicate that the excessive application of ISIC in KBLI has several negative impacts on its effectiveness. Codes irrelevant to the legal and social context in Indonesia render the issuance of business licenses ineffective and contradict the legal requirements stipulated in the Civil Code (KUHPerdata). The findings suggest that efforts are needed to enhance the effectiveness of KBLI in fulfilling its role as a classification system for business fields and economic activities in Indonesia. This can be achieved by considering relevance and local context to avoid unintended legal implications.
